I am enclosing a copy of the preliminary layout showing the location of four tests holes on the site. The subdivision is a five acre development and contains six lots on approximately thirty acres. The soil log of the test holes are as follows: TEST HOLE #1 0' to 3' Top Soil 3' to 8' Clean Sand & Gravel Ground Water was found at 4.5' Depth TEST HOLE #2 0' to 2' Top Soil 2' to 3' Dirty Sand & Gravel 3' to 8' Clean Sand & Gravel Ground Water was found at 5' Depth TEST HOLE #3 0' to 4' Top Soil 4' to 8' Clean Sand & Gravel TEST HOLE #4 0' to 4' Top Soil 4' to 8' Clean Sand & Gravel Ground Water was found at 3.7' Depth In addition to the above information, I am enclosing the minutes from the November 20, 1972 meeting of the Meridian Planning and Zoning Committee considering the denial of the Timothy Subdivision. Please note that one of the main considerations in offering the denial is that the sewage systems would contaminate nine mile drain if development were alowed. I am in hopes that if you do not agree with this assumption, that you would direct your - response to these minutes. It was of particular interest that the ground water in all test holes were four to six feet higher than the water located in nine mile drain. This would indicate that nine mile drain has a sealed channel and is not allowing drainage for this ground water. A proposed solution would be to construct perforated pipes along nine mile creek and discharge into the open channel, thus lowering the ground water. If you need any further information concerning the approval of individual septic tanks in this area, please let me know. I would appreciate hearing your consideration of this matter prior to December 4, 1972 as this is the date that we are appealing the Planning and Zoning Commission's denial. Timothy Subdivision is lo- cated within the jurisdictional mile of Meridian and their approval was also required. In session November 20, 1972, the Meridian Planning and Zoning Commission recom-I mended denial of the Timothy Subdivision (Exhibit #1); however, in session Decem- ber 11, 1972, the Commission recommended the Council approve the development into five acre lots or tracts (Exhibit # 2). The question at this point would be;: Since the Meridian City Code does not contain a comparable section to the County's Section 5.15941, then would the County Subdivision Ordinance prevail? Staff be- lieves it would, because the Meridian Code does not govern land densities outside the city limits. TEARE SUBDIVISION REZONE 76-33-ZC In the processing of this rezone application (4/1/76) staff asked for input from the Meridian Planning and Zoning Commission. The Zoning Commission did not make a recommendation, however, they did acknowledge the one acre lot overlay (Exhibit #4). TEARE SUB. - HISTORY Page 2 Staff had recommended that the Zoning Commission deny the rezone - the Commission in turn recommended the Board also deny the rezone. In session June 7, 1976, the Board granted an R-5 zone for this property. TEARS SUBDIVISION -_SHORT PLAT In the processing of this short plat, staff asked for input from the Meridian Planning and Zoning Commission (12/3/76), however, none was received. The Count Zoning Commission.approved the short plat of Teare Subdivision on January 20 1977 subject to compliance with nine conditions. The condition that the Meridian �Coun- cil approve the plat was inadvertently left out of the action letter sent to Mr. Teare, but he was informed immediately of this additional requirement. On December 21, 1976 staff received a copy of the Meridian Planning and Zoning minutes for their meeting of December 13, 1976. The Commission's action con- cerned itself with the rezone approval and resubdividing the original five acre tracts. The chairman stated the overlay should be obeyed and carried out (Exhibit #5). In session February 14, the Meridian Planning and Zoning Commission tabled any action until legal counsel could be obtained and informed the applicahe (the ap- nt that the Planning and Zoning Commission was a recommending body and that plicant) could present his proposal to the Meridian City Council on March 7, 1977 (Exhibit #6).
