ATTACHMENT A GENERAL CONDITIONS APPLICABLE TO ADMINISTRATION OF GRANTS UNDER PART C AND PART E, TITLE 1 P.L. 90.351 AS AMENDED BY 91-644 1, Responsible Party. The Grantee named in the Grant Award is responsible for assuring proper administration of the project or program for which this grant was awarded. It shall assure that the General, Fiscal, and any Special Conditions as set forth in any attachments to the Grant Award are adhered to. 2. Funds awarded will be used only for the project described in Part A, Item 8, of the Application. 3. Reports. Each grantee shall submit such reports as the Idaho Law Enforcement Planning Commission may reasonably require. 4. Discrimination Prohibited. No person shall, on the grounds of race, creed, color or national origin, be excluded from participation in, be refused the benefits of, or be otherwise subjected to discrimination under grants awarded pursuant to P. L. 90-351 as amended by P. L. 91-644 or any project, program, activity, or subgrant supported by such grants. Grantees must comply with the provisions and requirements of Title VI of the Civil Rights Act of 1964 and regulations issued by the Department of Justice thereunder as a con- dition of award of Federal funds and continued grant support. Grantees further must comply with the Justice Department's equal employment opportunity regulation in Federally assisted pro- grams, to the end that discrimination in employ- ment practices of State planning agencies, law enforcement agencies and other agencies or of- fices administering, conducting, or participating in any program or activity receiving Federal finan- cial assistance, on the grounds of race, color, creed, or national origin, be eliminated. This grant condition shall not be interpreted to require the imposition in State plans or planning agency sub - grant programs of any percentage ratio, quota system, or other program to achieve racial balance or eliminate racial imbalance in a law enforcement agency. Where grantee programs produce original books, manuals, films, or other copyrightable material, the grantee may copyright such; but the Idaho Law Enforcement Planning Commission reserves a royalty -free, non-exclusive and irrevocable license to reproduce, publish, translate or otherwise use and authorize others to publish and use such materials. 6. Patents. If any discovery or invention arises or is developed in the course of, or as a result of, work performed in a Grantee project, the Grantee shall refer the discovery or invention to the Law Enforcement Assistance Administration through the Idaho Law Enforcement Planning Commission, which will determine whether or not patent protection will be sought, how any rights therein including patent rights will- be disposed of and administered, and the necessity of other action required to protect the public interest in work supported with federal funds, all in accordance with the Presidential Memorandum of October 10, 1963, on Government Patent Policy. 7. Allowable Cost. The allowability of charges made to funds granted under Part C and Part E of Title I of the Act, as amended, shall be determined in accordance with the general principles of allow- ability and standards for selected cost items set forth in the Bureau of the Budget Circular No. A-87 entitled "Principles for Determining Cost Appli- cable to Grants and Contracts with State and Local Government" (May 9, 1968) and inter- preted and amplified in Section III of the Law Enforcement Assistance Administration Financial Guide, as amended. 8. Financial Reports. Local grantees shall submit, as required by the Law Enforcement Planning Commission, periodic reports on grant progress (form LEPC-122) and expenditure reports (form LEPC - 120) and other reports as LEPC may reasonably require. 9. Control of Funds and Title to Property. The title and control of Part E funds and title to property may not be transferred to private agencies, profit- making or otherwise, even though these may be utilized in the implementation of Part E efforts in- cluding the purchase of services and Part E funds and property will not be diverted to other than correctional uses. 10. Conditions Applicable to Large Construction Pro- gram Grants. Grants of Part E funds for con- struction or facilities which require letting a con- tract amounting to $100,000 or more to a private company or individual must require a bid guarantee equivalent to 5 percent of the bid price, a per- formance bond on the part of the contractor for 100 percent of the contract price and a payment .bond on the part of the contractor for 100 percent of the contract price. 11..Conditions Applicable to all Construction Pro- gram Grants. Grants of Part E funds for construc- tion purposes shall be accompanied by a state- ment of objectives of the proposed facilites, arch- itectural programs, schematics, outline specifi- cations and cost estimates; and, shall include a certification of the manner and means through which needed constructural services (site pre- paration, utility through which building construc- tion, purchases of equipment and fixtures, etc.) will be obtained in accordance with the applicable provisions of appropriate State and/or local law, rules or regulations. 12. Conditions Applicable to all Construction and Renovation Program Grants. Grants of Part E funds for facilities construction or renovation, regardless of size, shall require that architectural and other needed professional services shall be ob- tained upon the basis and consideration of pro- fessional competence to deliver the required ser- vices. Contractual fee obligations for such services shall be in accordance with the prevailing suggested fee schedules of recognized professional organiza- tions. The applicant agrees that it will assist and co- operate actively with the administering agency and the Secretary of Labor in obtaining the com- pliance of contractors and subcontractors with the equal opportunity clause and the rules, regulations, and relevant orders of the Secretary of Labor, that it will furnish the administering agency and the Secretary of Labor such information as they may require for the supervision of such compliance, and that it will otherwise assist the administering agency in the discharge of the agency's primary responsibility for securing compliance. The applicant further agrees that it will refrain from entering into any contract or contract mod- ification subject to Executive Order 11246 of September 24, 1965, with a contractor debarred from, or who has not demonstrated eligibility for, Government contracts and federally assisted con- struction contracts pursuant to the Executive Order and will carry out such sanctions and penal- ties for violation of the equal opportunity clause as may be imposed upon contractors and sub- contractors by the administering agency or the Secretary of Labor pursuant to Part 11, Subpart D of the Executive order, In addition, the appli- cant agrees that if it fails or refuses to comply with these undertakings, the administering agency may take any or all' of the following actions: cance!, terminate, or supend in whole or in part this grant (contract, loan, insurance, guarantee); refrain from extending any further assistance to the applicant under the program with respect to which the failure or refund occured until satis- factory assurance of future compliance has been received from such applicant; and refer the case to the Department of Justice for appropriate legal proceedings. 10. Building Access for Physically Handicapped. Any building construction funded from Part E alloca- tions and for which there is an intended use that will require that such building or facility be access- ible to the public or may result in the employ- ment or residence therein of physically handi- capped persons must be so constructed as to assure that physically handicapped persons will have ready access to, and use of, such buildings. 11. Criminal Penalties. Whoever embezzles, willfully misapplies, steals or obtains by fraud any funds, assets, or property which are the subject of a grant or contract or other form of assistance pur- suant to this title, whether received directly or indirectly from the Administration, shall be fined no more than $10,000 or imprisoned not more than five years, or both. Whoever knowingly and willfully falsifies, conceals or covers up by trick, scheme, or device, any material fact in any ap- plication for assistance submitted pursuant to this title or in any records required to be main- tained pursuant to this title shall be subject to prosecution under the provisions of Section 1001 of Title 18, United States Code. Any law en- forcement program or project underwritten, in whole or in part, by any grant, or contract or other form of assistance pursuant to this title, whether received directly or indirectly from the Administration shall be subject to the provisions of Section 371 of Title 18, United States Code. 12. Relocation Provisions. The grantee shall assure that any program under which Law Enforcement Assistance Administration financial assistance must be used to pay all or part of the cost of any pro- gram or project which will result in displacement of any person shall provide that: (a) Fair and reasonable relocation payments and assistance shall, be provided to or for displaced persons as are required in such regulations as are issued by the Attorney General. (b) Relocation or assistance programs shall be pro- vided to or for displaced persons as are re- quired in such regulations issued by the At- torney General. (c) Within a reasonable period of time prior to displacement, decent safe and satisfactory re- placement must be available to the displaced person in accordance with such regulations as issued by the Attorney General. The authority for this provision is found in the "Uniform Relocation Assistance and Real Property Acquisition Policy Act of 1970", P.L. 91-646; 84 Stat 1894. ATTACHMENT B CONDITIONS APPLICABLE TO THE FISCAL ADMINISTRATION OF GRANTS UNDER PART C AND PART E OF TITLE I, P.L. 90-35.1 AS AMENDED BY TITLE I P. L. 91-644 1. Responsibility of Grantee. The Grantee must establish fiscal control and fund accounting procedures which assure proper disbursement of, and accounting for, grant funds and required non-federal expenditures. 2. Fiscal Regulations: The fiscal administration of grants shall be subject to such further rules, re- gulations, and policies concerning accounting and records, payment of funds, cost allowability, sub- mission of financial reports, etc., as may be prescribed by the Administration consistent with the purposes and authorizations of P.L. 90-351 including those set forth in the LEAA financial Guide, as amended. Recording and Documentation of Receipts and 3. Expenditures. Accounting procedures must provide for of n accurate and timely recording of receipt of funds by source of expenditures made from such funds and of unexpended balances. Controls must be established which are adequate to insure that expenditures charged to grant activities are for allowable purposes and that documentation is readily available to verify that such charges are accurate. 4. Applicability of State and Local Practices. Except where inconsistent with federal requirements, state procedures and practices will apply to funds disbursed by state agencies and local procedures and practices will apply to funds dispersed by local agencies. Federal procurement regulations require that formal bids must be obtained prior to making any purchases totaling in excess of $2,500. For purchases totaling $250 to $2,499, three informal price quotations or bids should be obtained. Bureau of Budget Circular No. A-87, Principles for Determining Costs Applicable to Grants and Contracts with State and Local Government, must be complied with by Grantees with respect to the treatment of specific items and their cost allowability. 5. Inspection and Audit. Accounts and records of State agencies and of local units of government and all other recipients of assistance under this L.EPC 102-B (Rev. 11171) grant, whether by direct grant or contract or by subgrant or subcontract from primary grantees or contractors, which disburse or utilize grant funds, must be accessible to authorized federal and State officials for the purpose of audit and ex- amination. Notice of accessability as set forth in Section 521 of Title I of P. L. 90-351 and 91-644 must be incorporated in each grant, subgrant, con- tract, subcontract or other document under which funds are to be disbursed where permitted by State constitutional provisions, an annual audit of the planning and action subgrant program must be accomplished by an appropriate State audit agency, State Planning Agency, audit staff or a reputable public accounting firm. To the extent that State and local audit systems are determined by the LEAA to be adequate to insure fiscal accountability, they will be relied upon in lieu of federal audit of grantee and subgrantee accounts. The Administration shall adhere, in all regards, to the principles enunciated in BOB Circular No. A-73, "Audit of Federal Grants -in -Aid to State and local governments." 6. Maintenance of Records. All required records shall be maintained until an audit is completed and all questions arising therefrom are resolved, or three years after completion of the project, whichever is sooner. 7. Non -supplanting. Federal funds made available for grants may not be so used as to supplant state or local funds that would be available in the absence of such federal funds for law enforcement activities but rather will be so used as to increase such state or local funds. 8. Compensation of Personnel. Not more than one-third of the federal funds contained in this grant will be expended for the compensation of personnel. The amount of any such grant expended for the compensation of personnel shall not exceed the amount of state or local funds made available to increase such compensation. The limitations contained in this section shall not apply to the compensation of personnel for time engaged in conducting or undergoing training programs. 9. Control of Funds and Title to Property. DESCRIPTION OF PROJECT LEPC 101.3 Problem: Increasing numbers of school --located incidents now amounting to about 20 calls/month relating to general juvenile delinquency and, more specifically, those which are alcohol related - possession and consumption by minors. Consumption of alcohol by high school students results in disorderly conduct, disruption of classes and deliberate harassment of staff and faculty. Additionally, thefts both in the buildings and in the parking lot have increased to the point where some degree of school -specialized enforedment is necessary. However, the present size of the MPD does not allow assignment of a man to this specific duty as all personnel are working to capa- city on normal departmental duties - patrol, investigations, etc. It is desired to employ an officer to devote full school year time in working with school staff and students to deter and reduce unlawful incidents which are presently disrupting classes and, reducing the effectiveness of educational processes. Non school months will be used to confer with administrators and develop programs and procedures which will result in a more effective future program. This department is aware of the increasing gap between police and juveniles - and, in fact, the -gap between juveniles and the more adult members of society. We feel that this feeling of separation and rebellion if partly responsible for many unlawful and improper acts by young people. Accordingly, the School -Police Relations Officer will devote much of his time attempting to foster better understanding on both sides of this gap ---giving of his time and experience to juveniles, other officers and adults in rap sessions, PTA and civic meetings and other occasions. Through this type of activity we hope that better relationships can be fostered between all groups in the community with a resulting mutual benefit. Project Activities: The officer will be working in conjunction with high school officials and will be located for duty purposes at the high school. He will ultimately have an office to which students may come for advice or counsel regarding law enforcement related problems of a general or personal nature. Additionally, the officer will be involved in classes on a presentation/teach- ing basis on subjects relating to law enforcement matters. Inci- dents on the school grounds will also be handled by the officer -- thefts, drinking, disruptive activity, vandalism, etc. Chief Hines will direct the employment and duty orientation of this officer. Also, he will frequently confer with both school authorities and the officer in regards to progress and modification of the program. An evaluation of the program including student and faculty attitudes, administrative recommendations and feelings, statis- tical comparison of types and frequency of incidents, etc. will be submitted to the Idaho Law Enforcement Planning Commission by July 19 1973. The program is administered at the state level by th<-,} Idaho Department of Parks and Recreation and at the Federal level by the Bure,-M Of Outdoor Recreation. Nearly $7,000,000 has been allocated by the Parks Board to over 120 project sponsors in the State of Idaho since 1965. The change in the application procedures was occasione6 by the establishMent of a Technical Assistance Project Advisory Commission (TAPAC) by the Park Board. Fhe Commission will review project proposals for technical adequacy vtith the intent of assisting th:a applicant in improving his project and to upgrade the quality of project presented to the Park Board for approval. A sheet outlining the application processing procedures at both the applicant and staff levels is attached. ATTACHMENT A GENERAL CONDITIONS APPLICABLE TO ADMINISTRATION OF GRANTS UNDER PART C AND PART E, TITLE 1 P.L. 90.351 AS AMENDED BY 91-644 1, Responsible Party. The Grantee named in the Grant Award is responsible for assuring proper administration of the project or program for which this grant was awarded. It shall assure that the General, Fiscal, and any Special Conditions as set forth in any attachments to the Grant Award are adhered to. 2. Funds awarded will be used only for the project described in Part A, Item 8, of the Application. 3. Reports. Each grantee shall submit such reports as the Idaho Law Enforcement Planning Commission may reasonably require. 4. Discrimination Prohibited. No person shall, on the grounds of race, creed, color or national origin, be excluded from participation in, be refused the benefits of, or be otherwise subjected to discrimination under grants awarded pursuant to P.L. 90-351 as amended by P.L. 91-644 or any project, program, activity, or subgrant supported by such grants. Grantees must comply with the provisions and requirements of Title VI of the Civil Rights Act of 1964 and regulations issued by the Department of Justice thereunder as a con- dition of award of Federal funds and continued grant support. Grantees further must comply with the Justice Department's equal employment opportunity regulation in Federally assisted pro- grams, to the end that discrimination in employ- ment practices of State planning agencies, law enforcement agencies and other agencies or of- fices administering, conducting, or participating in any program or activity receiving Federal finan- cial assistance, on the grounds of race, color, creed, or national origin, be eliminated. This grant condition shall not be interpreted to require the imposition in State plans or planning agency sub - grant programs of any percentage ratio, quota system, or other program to achieve racial balance or eliminate racial imbalance in a law enforcement agency. Where grantee programs produce original books, manuals, films, or other copyrightable material, the grantee may copyright such; but the Idaho Law Enforcement Planning Commission reserves a royalty -free, non-exclusive and irrevocable license to reproduce, publish, translate or otherwise use and authorize others to publish and use such materials. 6. Patents. If any discovery or invention arises or is developed in the course of, or as a result of, work performed in a Grantee project, the Grantee shall refer the discovery or invention to the Law Enforcement Assistance Administration through the Idaho Law Enforcement Planning Commission, which will determine whether or not patent protection will be sought, how any rights therein including patent rights will be disposed of and administered, and the necessity of other action required to protect the public interest in work supported with federal funds, all in accordance with the Presidential Memorandum of October 10, 1963, on Government Patent Policy. 7. Allowable Cost. The allowability of charges made to funds granted under Part C and Part E of Title I of the Act, as amended, shall be determined in accordance with the general principles of allow- ability and standards for selected cost items set forth in the Bureau of the Budget Circular No. A-87 entitled "Principles for Determining Cost Appli- cable to Grants and Contracts with State and Local Government" (May 9, 1968) and inter- preted and amplified in Section III of the Law Enforcement Assistance Administration Financial Guide, as amended. 8. Financial Reports. Local grantees shall submit, as required by the Law Enforcement Planning Commission, periodic reports on grant progress (form LEPC-122) and expenditure reports (form LEPC - 120) and other reports as LEPC may reasonably require. 9. Control of Funds and Title to Property. The title and control of Part E funds and title to property may not be transferred to private agencies, profit- making or otherwise, even though these may be utilized in the implementation of Part E efforts in- cluding the purchase of services and Part E funds and property will not be diverted to other than correctional uses. 10. Conditions Applicable to Large Construction Pro- gram Grants. Grants of Part E funds for con- struction or facilities which require letting a con- tract amounting to $100,000 or more to a private company or individual must require a bid guarantee equivalent to 5 percent of the bid price, a per- formance bond on the part of the contractor for 100 percent of the contract price and a payment bond on the part of the contractor for 100 percent of the contract price. 11. Conditions Applicable to all Construction Pro- aram Grants. Grants of Part E funds for construc- tion purposes shall be accompanied by a state- ment of objectives of the proposed facilites, arch- itectural programs, schematics, outline specifi- cations and cost estimates; and, shall include a certification of the manner and means through which needed constructural services (site pre- paration, utility through which building construc- tion, purchases of equipment and fixtures, etc.) will be obtained in accordance with the applicable provisions of appropriate State and/or local law, rules or regulations. 12. Conditions Applicable to all Construction and Renovation Program Grants. Grants of Part E funds for facilities construction or renovation, regardless of size, shall require that architectural and other needed professional services shall be ob- tained upon the basis and consideration of pro- fessional competence to deliver the required ser- vices. Contractual fee obligations for such services shall be in accordance with the prevailing suggested fee schedules of recognized professional organiza- tions. The applicant agrees that it will assist and co- operate actively with the administering agency and the Secretary of Labor in obtaining the com- pliance of contractors and subcontractors with the equal opportunity clause and the rules, regulations, and relevant orders of the Secretary of Labor, that it will furnish the administering agency and the Secretary of Labor such information as they may require for the supervision of such compliance, and that it will otherwise assist the administering agency in the discharge of the agency's primary responsibility for securing compliance. The applicant further agrees that it will refrain from entering into any contract or contract mod- ification subject to Executive Order 11246 of September 24, 1965, with a contractor debarred from, or who has not demonstrated eligibility for, Government contracts and federally assisted con- struction contracts pursuant to the Executive Order and will carry out such sanctions and penal- ties for violation of the equal opportunity clause as may be imposed upon contractors and sub- contractors by the administering agency or the Secretary of Labor pursuant to Part II, Subpart D of the Executive order, In addition, the appli- cant agrees that if it fails or refuses to comply with these undertakings, the administering agency may take any or all' of the following actions: canoe!, terminate, or supend in whole or in part this grant (contract, loan, insurance, guarantee); retrain from extending any further assistance to the applicant under the program with respect to which the failure or refund occured until satis- factory assurance of future compliance has been received from such applicant; and refer the case to the Department of Justice for appropriate legal proceedings. 10. Building Access for Physically Handicapped. Any building construction funded from Part E alloca- tions and for which there is an intended use that will require that such building or facility be access- ible to the public or may result in the employ- ment or residence therein of physically handi- capped persons must be so constructed as to assure that physically handicapped persons will have ready access to, and use of, such buildings. 11. Criminal Penalties. Whoever embezzles, willfully misapplies, steals or obtains by fraud any funds, assets, or property which are the subject of a grant or contract or other form of assistance pur- suant to this title, whether received directly or indirectly from the Administration, shall be fined no more than $10,000 or imprisoned not more than five years, or both. Whoever knowingly and willfully falsifies, conceals or covers up by trick, scheme, or device, any material fact in any ap- plication for assistance submitted pursuant to this title or in any records required to be main- tained pursuant to this title shall be subject to prosecution under the provisions of Section 1001 of Title 18, United States Code. Any law en- forcement program or project underwritten, in whole or in part, by any grant, or contract or other form of assistance pursuant to this title, whether received directly or indirectly from the Administration shall be subject to the provisions of Section 371 of Title 18, United States Code. 12. Relocation Provisions. The grantee shall assure that any program under which Law Enforcement Assistance Administration financial assistance must be used to pay all or part of the cost of any pro- gram or project which will result in displacement of any person shall provide than (a) Fair and reasonable relocation payments and assistance shall, be provided to or for displaced persons as are required in such regulations as are issued by the Attorney General. (b) Relocation or assistance programs shall be pro- vided to or for displaced persons as are re- quired in such regulations issued by the At- torney General. (c) Within a reasonable period of time prior to displacement, decent safe and satisfactory re- placement must be available to the displaced person in accordance with such regulations as issued by the Attorney General. The authority for this provision is found in the "Uniform Relocation Assistance and Real Property Acquisition Policy Act of 1970", P.L. 91-646; 84 Stat 1$94. ATTACHMENT B CONDITIONS APPLICABLE TO THE FISCAL ADMINISTRATION OF GRANTS UNDER PART C AND PART E OF TITLE I, P.L. 90-35.1 AS AMENDED BY TITLE I P. L. 91-644 1. Responsibility of Grantee. The Grantee must establish fiscal control and fund accounting procedures which assure proper disbursement of, and accounting for, grant funds and required non-federal expenditures. 2. Fiscal Regulations: The fiscal administration of grants shall be subject to such further rules, re- gulations, and policies concerning accounting and records, payment of funds, cost allowability, sub- mission of financial reports, etc., as may be prescribed by the Administration consistent with the purposes and authorizations of P.L. 90-351 including those set forth in the LEAA financial Guide, as amended. Recording and Documentation of Receipts and 3. Expenditures. Accounting procedures must provide for an accurate and timely recording of receipt of funds by source of expenditures made from such funds and of unexpended balances. Controls must be established which are adequate to insure that expenditures charged to grant activities are for allowable purposes and that documentation is readily available to verify that such charges are accurate. 4. Applicability of State and Local Practices. Except where inconsistent with Federal requirements, state procedures and practices will apply to funds disbursed by state agencies and local procedures and practices will apply to funds dispersed by local agencies. Federal procurement regulations require that formal bids must be obtained prior to making any purchases totaling in excess of $2,500. For purchases totaling $250 to $2,499, three informal price quotations or bids should be obtained. Bureau of Budget Circular No. A-87, Principles for Determining Costs Applicable to Grants and Contracts with State and Local Government, must be complied with by Grantees with respect to the treatment of specific items and their cost allowability. 5. Inspection and Audit. Accounts and records of State agencies and of local units of government and all other recipients of assistance under this LEPC 102-8 (Rev. 11/71) grant, whether by direct grant or contract or by subgrant or subcontract from primary grantees or contractors, which disburse or utilize grant funds, must be accessible to authorized federal and State officials for the purpose of audit and ex- amination. Notice of accessability as set forth in Section 521 of Title I of P. L. 90-351 and 91-644 must be incorporated in each grant, subgrant, con- tract, subcontract or other document under which funds are to be disbursed where permitted by State constitutional provisions, an annual audit of the planning and action subgrant program must be accomplished by an appropriate State audit agency, State Planning Agency, audit staff or a reputable public accounting firm. To the extent that State and local audit systems are determined by the LEAA . to be adequate to insure fiscal accountability, they will be relied upon in lieu of federal audit of grantee and subgrantee accounts. The Administration shall adhere, in all regards, to the principles enunciated in BOB Circular No. A-73, "Audit of Federal Grants -in -Aid to State and local governments." 6. Maintenance of Records. All required records shall be maintained until an audit is completed and all questions arising therefrom are resolved, or three years after completion of the project, whichever is sooner. 7. Non -supplanting. Federal funds made available for grants may not be so used as to supplant state or local funds that would be available in the absence of such federal funds for law enforcement activities but rather will be so used as to increase such state or local funds. 8. Compensation of Personnel. Not more than one-third of the federal funds contained in this grant will be expended for the compensation of personnel. The amount of any such grant expended for the compensation of personnel shall not exceed the amount of state or local funds made available to increase such compensation. The limitations contained in this section shall not apply to the compensation of personnel for time engaged in conducting or undergoing training programs. 9. Control of Funds and Title to Property. Although he found no evidence of racial discrimination, he made several specific recommendations which we as administrators of the Land and Water Conservation Fund Program in Idaho must transmit to local project sponsors. Your efforts to implement the following suggestions. in order to bring the Land and eater Conservation Fund Program in Idaho into compliance with both the spirit and intent of the Civil Plights Act of 1964 will be very much appreciated. 1. Recipients and sub -recipients of federal funds should maintain statistics on minority employment. Please maintain records on minority workers involved in acquisition, development and maintenance of federally funded recreation areas. 2. Cities with park boards should take affirmative action to appoint minority representation or, their respective boards. 3. Please assign staff to carry out t;ie above recommendations and, where feasible, set specific dates for their attainment. In addition to the above, we should once again inform you that Kent Ellis of our staff is Civil Rights Compliance Officer for our Department and in this capacity is responsible for the following: 1. To assure that all staff and field personnel receive information and training and comely with Title VI of the Civil eights fact of 1964. 2. To assure that all federally assisted recreation areas within the purview of his organization and subject to Bureau of Outdoor Recreation periodic compliance review are available to all on a non- discriminatory basis. The State B*O.R. people gave me a sample of an appraisal agreement which must accompany the L.W.C.F. application. This may be a stumbling block unless you can make other arrangements with the B.O.R. people. B. Appendix . . . . . . . . . . . . . . . . . . 24 IDAHO GRANTS-IN-AID MANUAL FOR LOCAL GOVERNMENTAL UNITS INTRODUCTION The Land and Water Conservation Fund Act (Public Law 88-578) of 1964 has made possible the participation of states and their political subdivisions in a 50 per cent reimbursement program for the acquisition and development of recreation areas. One of the pruposes of this Act directed to the local governments is to create " . . . a recreation environment which will make the states' metropolitan areas more livable." The State Park Board is the administrative agency responsible for the evaluation of all applications for funds --both state and local pro- jects. To determine the needs of the state, and thereby derive a basis for project approval, a Comprehensive Outdoor Recreation Plan has been assembled at the University of Idaho, through the offices of Dr. Howard R. Alden, Special Assistant to the Governor on Outdoor Recreation. Projects will be weighed against needs as shown in the Statewide Comprehensive Plan to arrive at an equitable approach to meeting the needs for all classes of outdoor recreation at all levels of govern- ment. The Plan, using the mechanisms of supply and demand ratios, illustrates the outdoor recreation needs of the six state Park Districts in the state. (See map) The purpose of this brochure is to acquaint the political subdivi- sions with the Land and Water Conservation Fund Act and to delineate procedures for participation in this program. -1- Idaho State Park Districts -2- I. WHO IS ELIGIBLE? The following are the political subdivisions of the State of Idaho that are eligible to submit applications for project approval. a. Counties (including Soil and Water Conservation Districts) b. Cities c. Municipalities d. School Districts e. State Agencies f. Recreation Districts g. Other public agencies recognized by State Law II. WHAT TYPES OF PROJECTS ARE ELIGIBLE? a. Planning: Local units of government are not eligible for reim- bursement of funds for comprehensive or regional planning. In- dividual recreation site plans are fundable, provided that they are undertaken by qualified professionals and the cost is a part of an approved development project. b. Acquisition: Reimbursable funds are available for acquisition of lands and waters or interest in lands and waters. The ac- quisition must be utilized for recteation purposes. Lands ac- quired under this program should serve a wide variety of recrea- tional activities. Preliminary development plans must accom- pany applications for acquisition. c. Development: Funds are available for the development of recrea- tional facilities. Facilities may be developed on the following areas: 1. Land previously owned by the political subdivision. 2. Land acquired under this program. 3. Federal lands under twenty-five year lease or non-federal lands under lease for a period of time commensurate with the development investment. Maintenance and operation costs are not fundable under the Land & Water Conservation Fund Act. -3- III. HOW TO QUALIFY FOR FEDERAL FUNDS. a. Needs must be consistent with those delineated in the Statewide Plan. b. Written assurance from the local governmental unit that the said governmental unit has the ability and intention to finance its share of the cost of the particular project, and to operate and maintain by acceptable standards, at the local government's ex- pense, the particular properties or facilities acquired or de- veloped for public outdoor recreation use. a/ (A particularly sound assurance, but not the only acceptable one, is the one-half mill tax levy for recreation purposes.) c. Adjacent land uses should be considered and, if necessary, the local governmental powerg (zoning) should be enacted to insure that adjacent land uses do not and will not detract from recre- ational values. d. PROJECT APPROVAL IS BASED ON THE FOLLOWING GENERAL CRITERIA: a. Application must be in proper order with adequate assurance to meet financial obligations and maintenance costs. b. Need for the project must be identified in the Statewide Plan. c. Financial assistance from the Land and Water Fund is aimed at adding to, rather than substituting or replacing, local. outdoor recreation funds. a/ The political subdivisions will be required to execute a legal agree- ment with the State of Idaho covering these terms. Breach of this agreement may result in a demand for a return of the federal funds involved in the project and the termination of future financial assis- tance available under this program. -4- V. GENERAL CRITERIA FOR PROJECT PRIORITIES: a. High priority shall be given to meeting the needs of urban pop- ulations. b. High priorities would not ordinarily be assigned to projects that would or could, in the absence of the program, be financed with funds appropriated for other purposes, or with private funds. C. Proposals to benefit the general public are preferable to those intended for a segment of the public. However, consideration should be given to the needs of the handicapped, aged and under- privileged groups to assure that they are adequately provided for. d. Development of basic facilities is generally preferable to that of more elaborate construction. e. Developments for spectator type facilities are non -fundable un- less they are a minor portion of a development project. f. Only those proposals which involve efforts, areas or facilities which are primarily related to outdoor recreation may be consid- ered. g. Special consideration will be given applicants who have demon- strated their ability to complete a successful project and oper- ate and maintain a recreation area at acceptable levels. h. Where there are several -projects of highest priority and limited funds are available, the final decision will rest with the Park Board. NOTE: Park Board approval does not insure project approval, as all proposals are subject to the approval of the Bureau of Outdoor Recreation, federal administrators of the Lan and Water Conservation Fund Act. In addition to these priorities, the state may, in the future, esta- blish policy requiring: 1. County representatives within the park district to form outdoor recrea-tion advisory committees to coordinate city, county, etc., planning efforts. 2. Park District liaison officers to cooperate with this Department to coordinate projects at the local level and establish priori- ties of projects within the district. -5- VI. PROJECT APPLICATION PROCEDURE a. Notify the Idaho Department of Parks of your interest to apply for matching funds. b. Present a general explanation of your proposed project to the Idaho Park Board at a regularly scheduled meeting of the Board. c. Obtain application forms and submit the following to the Idaho Department of Parks for presentation at a subsequent meeting of the Board. 1. Seven copies of Forms B.O.R. 8-163 and 164 or 165, (B.O.R. requires 6 copies of forms from state.) with attachments listed under Part III on the back of the forms. 2. Resolution on acquisition or development for outdoor recre- ation officially adopted by Governing Board, Commission, etc. (See sample in appendix.) d. A copy of the application must be submitted to state and regional clearing houses for review and comment. (Obtain address of clear- ing houses from the Park Department.) e. If the Park Board approves your project, it will th6n be sub- mitted to the Bureau of Outdoor Recreation for final approval. NOTE: Experience has revealed that problems in obtaining certifi- cation of adequate title to the project site have been the most common cause of delay in processing development projects for approval. Certification of adequate title must be ob- tained from the office of the State Attorney General prior to submission of the project to the Bureau of Outdoor Recre- ation. Attached is a city map which shows the geographic location of the project. b. A site plan drevn to scale is attached which shows the exterior boundaries of the area to be developed. The proposed location of all facilities for which fund assistance is requested is annotated on the plan. C. A preliminary design and floor plan of the picnic shelter and restroom building are attached. -lbw When it is advantageous to do so, a subdivision may submit projects which combine Acquisition and Development. Such projects should be logical combinations ---for example, the acquisition and development should be on the same site or on closely related sites. DURING THE COURSE OF EXECUTION OF THE PROJECT, AND BEFORE CONSTRUCTION, THE APPLICANT MUST SUBMIT TO THE IDAHO DEPARTMENT OF PARKS FOR APPROVAL.: Plans a. Site plans, specifications and cost estimates. b. Construction plans, specifications and cost estimates. Contracts a. Copies of pertinent contracts. DO NOT INCUR ANY COSTS FOR DEVELOPMENT OR ACQUISITION$ EXCEPT PLANNING COSTS, UNTIL PROJECT IS APPROVED. RESOLUTION: A resolution similar to the sample shown in the appendix, officially adopted by the governing board, commission, etc., must accompany each application. After the project has been found to be qualified for financial assistance by the Federal Bureau of Outdoor Recreation, the political subdivision must execute a binding agreement with the State of Idaho. -17- r. ALLOWABLE COSTS AND FINANCIAL, RECORDS NOTE: Be sure to read "Important Policy Limitations" in Appendix B. I. Basis for Assistance 1. Project costs will be reimbursed project by project. Each pro- ject represents a separate transaction for purposes of deter- mining the amount of the Fund's share of costs. 2. To be subject to reimbursement, casts must have been incurred within the approved project period; except as noted in B.O.R. Manual 670.1.3B. Do not incur costs for acquisition or devel- opment prior to rece,ibin& written notification of Federal ap- roval of yyour +project. 3. Generally, the practices, rules and policies of the applicant, as consistently applied, and if in accord with generally ac- cepted accounting practices, will be sufficient. No invoice or incurred expense will be allowed unless properly identified. 4. The amount of each purchased item of cost that may be reimbursed from the Fund shall not exceed the participant's actual cash outlay for that item, or the fair market value of the item, whichever is the lesser. 5. The total reimbursement made available for an approved project shall not exceed the amount shown in the approved agreement. 6. Any project -related expenditure not specifically excepted (Item 7 - Non -allowable Expenses) may be subject to reimbursement. Such expenditures may include, but are not limited to: a. Personal Services. Personal services of those employees directly engaged in the execution of a project may be reim- bursed. Assistance will be provided according to the pro- portion of time spent on a project. Time spent on a project must be supported by signed time and attendance records. The cost of such compensation is allowable to the extent (1) reasonable for the services rendered, (2) follows an appoint- ment made in accord with applicable state, local and federal requirements, and (3) is determined and supported by gener- ally, accepted payroll practices and time and attendance or equivalent records. Personal services shall be valued according to the Partici- pant's prevailing wage or salary scales for the type of work being done and the proportion of time spent on the project. Salaries and wages for persons working on projects shall not be higher than for similar persons on similar jobs. Assistance may also be provided to share the cost of travel and expenses of individuals contributing their services to the political subdivision. Such contributed services may not be valued and used by the political subdivision for reim- bursement purposes. 7. Non -allowable Ex enditures. These expenditures shall not be included in the base for determining financial assistance: a. Ceremonial or entertainment.expenses. b. Expenses for publicity. c. Bonus payments of any kind. d. Charges for contingency reserves or other similar reserves. e. Charges in excess of the lowest bid, when competitive bid- ding is required by the Bureau of the Participant, unless the Bureau agrees in advance to the higher cost. f. Charges for deficits or overdrafts. g. Taxes for which the organization involved would not have been liable to pay. h. Interest expenses. i. Charges incurred contrary to the policies and practices of the organizations involved. j. Damage judgments arising out of acquisition, construction or equipping of a facility, whether determined by judicial determination, arbitration, negotiation or otherwise. k. Court costs of any kind. 1. Incidental costs relating to acquisition of real Rroperty, and of interest in real propertXj such as the cost of surveys, ap2raisals, title search and le al fees. m. Operation and maintenance costs of outdoor recreation areas and facilities. n. The value of personal services contributed without cost to the Partici ant. o. The value of personal_ properties. However, when the Bureau approves, charges may be made to a project for the use of personal properties on a project, and the resultant charge may be matched. p. The value of, or expenditures for, lands acquired from the united States at less than fair value. q. Services, materials or equipment obtained tinder any other federal program cannot be used for reimbursement. -z1- r. Cost of discounts not taken. s. Equipment to be used for the maintenance of outdoor recre- ation areas and facilities including but not limited, to, automotive equipment, tractors, mowers, other machinery and tools. t. Employee facilities including residences, appliances, office equipment, furniture and utensils. U. Salaries and expenses of the Office of the Governor or of the Chief Executive of a political subdivision, or of the State Legislature, and similar local government bodies. V. Fines and penalties. II. Accounting, Records and Reports 1. Pre -award Surveys. The state may conduct pre -award surveys be- fore qualifying a project proposal to determine the adequacy of financial and administrative management practices and procedures as they may relate to the execution of the proposed project. Periodic surveys may also be undertaken during the project per- iod to assure the continued effectiveness of the financial and administrative management and to provide assistance where nec- essary or requested. The scope of such surveys shall include - the review of the internal systems of financial and administra- tive controls, planning techniques and procedures. 2. Accountin for Funds Received. The accounting procedures should be based on generally accepted accounting standards and principles and generally meet the following minimum requirements, unless the state agrees to exceptions: a. Establishment of separate ledger accounts and supporting documents for each project. Each project account should be identified by the number assigned to the project by the Bureau. b. Identification of all receipts in sufficient detail to show the source of such receipts. C. Itemisation of all supporting records of project expendi- tures in sufficient detail to show the exact nature of each expenditure. 4 d. Cross referencing of each expenditure with the supporting purchase order, contract, toucher, bill, etc. These support- ing documents should contain the signature of the official authorized to approve such expenditures. e. Maintenance of adequate records, approved by the appropriate official, to show that all salaries and wages charged against projects were authorized. -z2- f. Maintenance of payroll vouchers for salaries and wages. If payroll voucher forms are not used, a statement should be prepared at the end of each pay period showing the names of employees and gross amount of salary earned by each. This statement should be verified by the official responsible for the project, and approved by appropriate authority. g. Identification of the invoices or vouchers charged as to project number, account number, date and expense classifi- cation. h. When payment is by check, the cancelled check should be prop- erly identified and filed. When cash disbursements are made, they must be supported by receipts. i. Establishment of adequate internal systems of financial torr trot following generally accepted accounting and auditing principles. These include adequate serial numbering of vouchers where prudent distribution of duties among employees in such a way to decrease opportunities for fraudulent ac- tivities, procedural safeguards, property inventory controls and other reasonable checks and balances. A. Project Submission All project proposals must be submitted to the Idaho Park Board by a personal, preliminary presentation (no forms required) at least one regularly scheduled Park Board meeting prior to a re- quest for official obligation of Land and Water Conservation funds. This presentation is to be general in nature and the prospective participant should be prepared to answer questions on the following items: 1. What is the legal status of the present land ownership? What type of title presently exists? Who owns this title and how do you plan to acquire possession of this land? Z. What is the total estimated cost of your project, including land acquisition and development costs? We realize that cost estimates may be difficult and subject to change, but a reasonable estimate is needed for overall planning con- sideration. 3. What is the tentative time schedule you have for completion of your project? Do you plan to stage the project over sev- eral years? If so, how? 4. What source of funds do you plan to use to meet your share of the project costs? (Remember, the Land and Water Conser- vation Fund will only reimburse you for 50% of the project costs on the basis of paid bills.) 5. Are there any nonrecreational uses of the property? (con- sider power and telephone lines and other existing easements.) 6. Will the project be undertaken by contract, force account, or both? 7. Are there any provisions for donated funds, labor, or sup- plies? If so, in what way? 8. operation and maintenance of the completed facility will be your responsibility. How do you propose to fund these costs? 9. Any special items that would bear directly on the project that the Park Board should be aware of should be presented. 10. What kind of local public support do you expect for this project? ..97- B. Acquisition Project Requirements An approved appraisal is required to establish the fair market value of the project property. Reimbursement is limited to 50 per cent of the fair market value of the land. Any difference between the ap- praised value of the land and negotiated sale price must be paid entirely by the participant. Titla insurance and a five-year his- tory of conveyance (unless included in the appraisal) must be sub- mitted for each acquisition. Before retaining an appraiser, contact the Idaho Department of Parks for appraisal requirements and a sam- ple contract. C. Development Pro"ect Requirements it is felt the Participant should be particularly aware of the fol- lowing requirements: 1. All plans and specifications are to be sent to the Idaho Depart- ment of Parks for review as they become available. Plans are to be reviewed by the Department of Parks prior to construction. 2. The following policy has been established by the Idaho Park Board with regard to increases in the amount of federal funding: a. In cases where project costs exceed the approved total pro- ject cost for reasons such as increased cost of materials and/or labor or where the lowest bid for work exceeds the pre -award project estimate, the Park Board will consider increased project assistance on an individual basis. In seeking a support increase, the political subdivision will be required to make available all information justifying the increase. The Park Board will act upon each request individually to determine if the cost increase was beyond the control of the political subdivision and thus should be eligible for increased federal assistance. b. Political subdivisions applying for an increased project ceiling and the resulting increase in federal reimbursement must be able to prove that they have the necessary funds for meeting the increase in their share of the project cast. C. In cases where project costs are increased due to, -a change in project scope (type or amount of acquisition or devel- opment to be undertaken) without prior Park Board ap2roval, the costs thereof will be borne b the Participant without the benefit of any federal funding. To be eligible for cost sharing on project increases result- ing from a change in project scope, it will be necessary for the Participant to first secure approval from the Park Board for the change in scope. -28- In the event it appears that project costs will overrun the amount of money allocated for the project, the Participant must check with the Idaho Department of Parks before obligating funds in excess of the project ceiling. The Idaho Department of Parks will usually be able to ascertain if the increase is due to a change in scope or simply matters beyond the control of the Par- ticipant. The Park Board must approve all requests for additional funds and all increases will be granted or refused on the basis of the above policy and availability of funds. 3. All work to be undertaken by the Participant's force account crews must be outlined and cost estimates broken down into hours, equipment and salary. Contact the Idaho Department of Parks for necessary instructions. D. Environmental Quality_ Every effort must be made to preserve, enhance and protect natural beauty and prevent environmental disturbance. This includes the elimination and prevention of air and water pollution and protection and enhancement of natural beauty at all project sites. The Parti- cipant should be especially aware of the following policy regarding overhead powerlines: 1. Utility Lines. Overhead utility lines constitute a major detrac- tion from the natural quality of many outdoor recreation areas. The participant will be expected to (1) take all reasonable steps to bury, screen or relocate existing overhead lines at develop- ment or acquisition projects, and (2) to put all new electric wires under 15KV and telephone wires* underground. E. Project Period The Idaho Park Board has established a policy which limits acquisi- tion projects to a one year period and development projects to a period which encompasses two work seasons. *Mass Recreation use areas (swimming, picnicking, crowded spectators, etc.) shall not be located under electric wires on Fund assisted areas or facilities. Installation of electric wires 15KV and above over any area which has received Fund assistance constitutes con- version to other than outdoor recreation use and, is not permitted unless approved in advance by the Director.* 2'4'15
