The subject property is located in an L-O Zone and owned by St. Lukes Regional Medical Center (File No. CUP-03-0IS). We ilarve reviewed this submittal arttl offer the following comments, as conditions of the applicant. These conditions slladl be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY The applicant, St. Luke's Regional Medical Center, has requested approval of a conditional use permit for a heliport with an accompanying pilot office/quarters and fueling station in the southeast comer of the hospital's property located on the east side of S. Eagle Road and the north side of I-84. St. Luke's has recently leased a helicopter for the transportation of patients to and from its hospitals and other medical facilities. The helicopter is currently stationed at the downtown (Boise) St Luke's Hospital on a landing pad that is not equipped with a refueling station and other associated improvements. Every time another helicopter is dispatched to the downtown St Luke's Hospital, the helicopter must be moved to accommodate the arrival of the additional helicopter. This, in addition to flying elsewhere for refueling, has become very expensive for St. Luke's, and they are looking to this site as the permanent home for their helicopter. The proposed helipad/office site will be manned 24-hours a day. The approach and take off zones are not over any residential subdivision, as required by the Federal Aviation and Administration (FAA). The applicarn has discussed the use of the helicopter with the residents of Montvue Subdivision and the developers of Meadow Lake Village and has made commitments to not approach or take off over either subdivision. The applicant is proposing a manufactured building placed on a permanent foundation as the pilots office/quarters. The manufactured building will include a brick wainscoting to match the existing St Planning & Zoning Commission/Mayor & City Council May 1, 2003 (Hearing Date) Page 2 SURROUNDING USES The following uses surround the subject property: North -Vacant land owned By St Luke's, zoned L-O. South - I-84, zoned I-L. East -Meadow Lakes Village's (Touchmark) maintenance facility zoned L-O. West - St. Luke's property, zoned L-O OWNER OF RECORD The owner of record is St. Luke's Regional Medical Center, and they have given their consent for the applicant to submit their conditional use permit request. STANDARDS FOR CONDITIONAL USES The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following and may approve a conditional use permit if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3): A. That the site is large enough to accommodate the proposed use and all yards, open spaces, parking, landscaping and other features as may be required by this ordinance; Staff finds that the subject property is large enough to accommodate the required open spaces, parking, landscaping and other features required by the ordinance. The landscaping plan will need to be modified to include the required number of trees adjacent to I-84. The submitted landscape plan depicts only three (3) trees where at least ten (10) trees are required (pursuant to MCC12-13-10-6). Several required landscaping trees have been omitted from the submitted landscape plan in the approach and takeoff corridors for safety reasons and staff does not object to their elimination. B. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements of this Ordinance; The current Comprehensive Plan Land Use Map designates the property as "Public/Quasi Public" and is currently zoned "L-O". The St Luke's project was approved under the former Comprehensive Plan when it was dedicated as a "Medical Facility". Staff finds that the proposed retail development, subject to conditions of approval, is harmonious with the MCC and the Comprehensive Plan. That the design, construction, operation, and maintenance will be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity and that such use will not adversely change the essential character of the same area; Staff finds that the proposed development will not adversely change the existing or intended character of the general v icinity. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely affect other property in the vicinity; Other than noise associated with the take off and approach of the helicopter, staff does not anticipate that the proposed use will adversely affect adjacent properties. The Commission and Council should rely upon public testimony to determine if the development will adversely affect the other property in the vicinity. E. That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; Staff finds that the proposed development will be adequately served by the essential public facilities and services listed above. F. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; Staff fmds that the proposed medical helicopter use will not be detrimental to the economic welfare of the community, nor would it create the need for any new facilities or services to be paid for by the public. G. That the proposed use will not involve activities or processes, materials, equipment, and conditions of operation that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Staff finds t hat n o e xcessive t raffic,smoke, fumes, glare or odors will result from the proposed use. That the proposed use will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; Staff fmds that the proposed use will not create si~tuficant interference with any traffic on the surrounding public streets. I. That the proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of this conditional use. CONDITIONS OF APPROVAL Sanitary sewer and water service shall be from existing service lines on the property. 2. The underground fueling facility shall be in compliance with all adopted fire and safety codes. 3. The re-fueling facility shall be for the use of St. Luke's owned or leased helicopters and shall not be used for commercial sales. 4. Revise the Landscape Plan to include at least seven additional trees in the I-841andscape buffer. The revised plan shall be submitted to the City Clerk's office at least ten days prior to the next public hearing for this project for review by staff. 5. The applicant shall comply with all State and Federal aviation guidelines and requirements. 6. The future hangar structure may be built at this location without further conditional use permit approval if located on site as depicted on the submitted site plan. A staff level Certificate of Zoning Compliance (CZC) will be required prior to submitting for a building permit. All exterior lighting, whether attached to the building or located within the parking lot, shall be down-shielded or otherwise altered so that the light does not spill over onto adjacent properties orright-of--way. All parking lot lighting shall be in accordance with Ordinance 11- 13-4C. 8. All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act. 10. All parking shall be striped and improved in accordance with the ADA and Meridian City Code. 11. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City ofMeridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 12. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. RECOMMENDATION Staff recommends approval of this application with the aforementioned conditions. Based on the submitted information, it has been determined that roadway improvements exist adjacent to the site and ACHD has no site improvement requirements attributable to this application. ACHD policy requires that before any improvements of any kind are constructed or installed within the public right-of- way, apermit or license agreement permitting the improvements must be obtained. All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District. Meet District drainage requirements per section 8000 of the ACRD Development Policy Manual. Contact District staff at 387-6170 for details.
