The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
The facility will have to have to meet the State Fire Marshal's standards for
family day care facility. The Meridian Fire Department will conduct an
inspe tion using this standard
2. Address posted in 6" numbers on the front of the building.
3. Provide afire-flow consistent with Appendix III-A of the 1997 Uniform
Fire Code.
4. Provide anapproved tum-around at the rear of the property.

•Request for a Conditional Use Permit for the Demolition of One (1) of Two (2)
Existing Buildings and Replacing them with One (1) New Building for the Operation
of a New Horizon Childcare Center at 1830 N. Meridian Road, in an L-O Zone, by
New Horizon Child Care (File No. CUP-d3-019).
We have reviewed this submittal mid offer the following comments, as conditions of the applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
AppI,ICATION SUMMARY
The applicant, New Horizon Child Care, has requested approval of a conditional use permit (CUP)
for a new childcare facility, adjacent to their existing facility on Meridian Road, just north of
Albertsons. In order to facilitate the construction of the new building, the applicant will be removing
an existing single family house located on the northwest end of the lot and building the new facility in
its place.
The applicant is requesting a 10% reduction in the required parking space for the daycare use in order
to accommodate several existing trees pursuant to section 12-13-13-8 of the MCC.
Section 12-6-1 of the MCC mandates that if more than one (non-accessory) building is on a single lot
it is considered a planned development and is subject tc the requirements of the City's Planned
Development Ordinance.
i.[~l'ATiON & SURROUNDING USES
The subject property is located on the east side of Meridian Road, approximately 1/6 of a mile north
of Fairview Avenue. The following uses surround the subject property:
North -Vacant land, zoned RUT (Ada County)
South - Albertsons, zoned C-C

OWNER OF RECORD
The owner of record is Trudy Comba, and she has given her consent for the applicant to submit the
requested conditional use permit.
STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms of the following and may approve a conditional use permit if
they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
Staff finds that the subject property is large enough to accommodate the required open
spaces, parking, landscaping and other features required by the ordinance.
As noted in the summary the applicant has requested a 10% reduction in parking as allowed
by t he L andscape O rdinance and staff does not object to this request. Furthermore the
applicant is requesting a reduction in the amount of trees required for the mitigation of
several large trees being removed from the site. Staff does not object to this request.
This project is a planned development and is therefore subject to the City's requirements that
the development provide two (2) amenities for use by those who will utilize the
development. The applicant has provided open space in excess of 10% of the gross area of
the lot and a play area for the children to satisfy this requirement. Staff fmds that these
amenities are appropriate to the size and uses of the proposed development, per MCC 12-6-
2e.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The current Comprehensive Plan Land Use Map designates the property as "Commercial"
and it is C-C. Staff finds that the requested use is in compliance with the approved Future
Land Use Map and that if approved as a CUP the project will be in compliance with the
MCC.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character

of the same area;
Staff finds that the proposed development will not adversely change the existing or intended
character of the general vicinity.
D. That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
Staff does not anticipate that the proposed use will adversely affect adjacent properties.
The Commission and Council should rely upon public testimony to determine if the
development will adversely affect the other property in the vicinity.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F: That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that the proposed daycare use will not be detrimental to the economic welfare of
the community, nor would it create the need for any new facilities or services to be paid for
by the public.
G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or
odors;
Staff finds t hat n o e xcessive t raffic, s moke, fumes, glare or odors will result from the
proposed use.
H. That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create simg ficant interference with any traffic on
the surrounding public streets.

I. That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
CONDITIONS OF APPROVAL
Sanitary sewer and water service shall be from existing service lines on the property.
Existing assessments shall be reviewed to determine whether additional assessments will be
due with the new construction.
2. All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties orright-of--way. All parking lot lighting shall be in accordance with Ordinance 11-
13-4C.
3. All new signage shall be in accordance with the standards set forth in Section 11-14 of the
City Zoning and Development Ordinance. All signage is subject to design review and shall
require separate permits.
4. All construction and site improvements shall conform to the requirements ofthe Americans
with Disabilities Act.
A ten percent (10%) reduction in required parking spaces, equaling a 4 space reduction is
approved as requested.
6. Pay the additional fees of $355.75 required for approval as a Planned Development. (Fees
were originally calculated as $340.00 for a CUP and not $695.75 as required for a Planned
Development of this size.)
The submitted landscaping/site plan will be approved pursuant to the following corrections:
• All trees shall be a minimum of two inches (2") in caliper.
• The concrete sidewalk and the fencing that encroaches into the required twenty-five foot
(25') wide landscape buffer on the west side of the proposed building shall be replaced with
landscaping as required by the Landscape Ordinance (MCC 12-13).
Ten copies of a revised site plan shall be submitted to the City Clerk's office at least ten days
prior to the City Council hearing for this project.

8. All parking shall be striped and improved in accordance with the Meridian City Code.
9. A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas.
Storm water treatment and disposal must be designed in accordance with Department of
Environmental Quality 1997 publication Catalog of Stonn Water Best Management Practices
for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal
into a surface water is prohibited unless the jurisdiction which has authority over the
receiving stream provides written authorization prior to development plan approval. The
applicant is responsible for filing all necessary applications with the Idaho Deparhnent of
Water Resources regarding Shallow Injection Wells.
10. Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy for the proposed development. A temporary Certificate of
Occupancy may be obtained byproviding surety to the City in the form of a letter of credit or
cash in the amount of 110% of the cost of the required improvements (including paving,
striping, landscaping, and irrigation). A bid must accompany any request for temporary
occupancy.
Staff recommends approval of this application with the aforementioned conditions.

After review of the Conditional Use Permit of the above-mentioned application Settlers
Irrigation District requests the following:
1. That all in•igation/drainage facilities along with their easements be protected.
The Settlers Canal courses along the east and north boundary of the property.
2. A license agreement will need to be signed and recorded prior to construction of
the tiling of the Settlers Canal.
3. Any changes to the existing irrigation system such as relocation, tiling, and
landscaping must be approved by Settlers Irrigation District.
4. All storm drainage must be retained on site.

District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.

In response to your request for comment, the Ada County Highway District (ACRD) staff has reviewed the
submitted application and site plan for the item referenced above. It has been determined that the Right-of-
Wayand Development Services Department does not have any site-specific requirements for you at this time.
• Roadway improvements currently exist adjacent to the site
If the site plan or use should change in the future, ACRD will review the site plan and may require
improvements to the transportation system at that time.
Prior to the construction or installation of any roadway improvements (curb, gutter, sidewalk, pavement
widening, driveways, culverts, etc), a permit or license agreement must be obtained from ACRD. In addition to
any costs associated with a permit or license agreement, a roadway impact fee will be assessed by ACRD and
will be due prior to the issuance of a building permit.
In accordance with ACHD's standard requirements, the applicant shall:
• Meet District drainage requirements,
• Replace or repair any damaged curb, gutter and sidewalk (as determined by
Construction Services),
• Bear all costs for the relocation of utilities associated with improving street frontages,
• Contact the District's Utility Coordinator or Construction Services Department in
regard to all utility street cuts to determine if the pavement is less than five years old.
These provisions are in accordance with the Ada County Highway District Policy Manual, ISPWC Standards,
Construction Services policies and procedures as well as all applicable ACRD Ordinances. If you should have
any questions in regard to the standard requirements please feel free to contact out Construction Services
Department at 387-6280 or our Drainage Department at 387-6250 (with file number) for details.
