You have until February 8, 2010 to obtain the city engineer's signature on the final plat. Please note that UDC l.l.-6B-7 allows the director to require, as part of a time extension approval, compliance with the provisions of the UDC; there are two additional conditions of approval for this project that are being required as part of the subject time extension approval. Please see the attached staff report for details on the additional conditions of approval for the subject development. In accordance with UDC 11-SA~3F and UDC 11-SA-6, you have the option to appeal this decision to the City Council. All City Council Reviews rappeals) shall be filed in writing rjcrith the Planning Department within fifteen (15) days after the date of this letter. The appeal will be forvvarded to the City Council to conduct a public hearing: The application should specify the grounds upon which the appeal is filed. (Fzle # TE-O8-012) Staff has reviewed this submittal and offers the following comments: APPLICATICON SUMMARY The applicant, Chad Colbert, has requested approval of a time extension to record the fittal plat for Prato Villas Subdivision. The subject preliminary plat consists of 30 single-family residential building lots and -4 common lots on 9.97 acres in an R-4 zoning district. The Applicant has been unable to meet the time requiremettts specified in Unified Development Code (UDC) ll-6B-7. Applicant attributes the delay to the slow market conditions which prevented the expansion of sewer and water services to their site (see Applicant's letter/application dated 7/2/2008). The annexation (AZ-06-022) and prelitriinary plat (PP-06-022) for Prato Villas Subdivision were approved by the Meridian City Council on August 8, 2006. The development agreement (instrument # 108087854) was signed July 22, 2008. Applicant has not submitted a final plat for Prato Villas Subdivision. Per the conditions of approval, Prato Villas Subdivision preliminary plat would otherwise expire on August 8, 2008. The City of Meridian's Unified Development Code (UDC 11-6.5-7) allows the Director to authorize one administrative tithe extension to record the final plat, not to exceed 18-months, when the applicant files a written request for an extension prior to the expiration of the plat. The Applicant has met the necessary deadline by filing a written request for an 1 S-month time extension before the preliminary plat expired. Additional time extensions up to 18-months may be granted if determined and approved by the City Council. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11-6B-7C). Staff believes that there are additional conditions that should be added to those approved by the City Council far this subdivision. Specifically, staff is recommending first, that Prato Villas comply with the new open space requirement found in UDC 11-3G-3A1 and increase the open space to ten percent. Secondly,. that Prato Villas initiate a development agreement modification to include sample elevations for future homes in this subdivision (See Site Specific Conditions below). Staff recommends approval of Prato Villas Subdivision with the comments and conditions stated in,this report. LOCATION Prato Villas Subdivision is located at 4052 & 4202 W. Daphne St., on the east side of Black Cat Road and north of McMillan Road in the SW '/a of Section 27, 4N., R. 1 W. The applicant is to meet all terms of the approved annexation (AZ-06-022), development agreement (instrument # 108087854) and preliminary plat (PP-06-022). 2. The applicant shall modify the preliminary plat to comply with the new open space requirements found in UDC l 1-3G-3A1 which states "the total land area of all common open space slxall equal or exceed ten percent (10%) of the gross land area of the development." Current preliminary plat shows about 6% open space, to meet current code; Prato Villas must increase its open space by 4%. 3. The applicant shall, before approval of the final plat, submit a development agreement modification application to modify the development agreement (instrument # 108087854) to include sample elevations for the residential subdivision. This DA amendment shall be recorded prior to the City Council approval of the final plat. 4. The applicant shall have an additional 18 months, until Iebruary 8, 2010, to obtain the city engineer's signature on the final plat, satisfy the applicable requirements set forth in the conditions of approval, and begin the process of acquiring building permits and commencing construction of permanent footings or structures.
