Beeler, Charlie Scott, Sherman Campbell, Wendy Campbell, Kevin Robertson, Jim Johnson, Diana Jackson, Ann Peterson, Gary Smith Paul Stutzman, Bill Nary, Gene Kindred The Motion was made by Myers and seconded by Tolsma to approve the Minutes of the previous Meeting held January 17, 1989 as written: Motion Carried: All Yea: Mayor Kingsford read a Proclamation declaring February 12 though February 18,1989 `~'~. as Business Professionals of America. Week: _ Item #1: Request for Lot Split by Freda Weast: Lot #13 Bowen's Addition: Mayor Kingsford: Council Members do you have any questions? Regarding this the Engineer has made a good draft of the proposed split. City Clerk: After the split this still meets the frontage requirements under the Ordinance: The Motion was made by Morrow and seconded by Myers to approve the Lot split as requested by Freda Weast: Motion Carried: All Yea: Item #2: T & R Construction: Request to place moveable office in Crestwood #3: Mayor Kingsford: There is no representative present, the Council has a copy of the written request. Myers: Do we know how long this unit will be there? City Clerk: In the past we have allowed this on a six month period. Giesler: Do we know what kind of construction the building will be? Mayor Kingsford: A prefab type construction, office type was what was outlined to us:. The Motion was made by Myers and seconded by Giesler to allow T & R Construction to place a moveable office in Crestwood #3 for a period of six months: lotion Carried: All Yea: Ite[t #3: Diana Jackson: Hcsneowner's Association of Crestwood, #3 regarding Street Lights: Mayor Kingsford: I do not see Diana here, we will postpone this to later on the Agenda: MERIDIAN CITY COUNCIL • • FEBRUARY 7, 1989 PAGE # 2 Item #4: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been informed in writing, If you choose to, you have the right to a pre-termination hearing before the Mayor & Council, to appear in person to be judged on facts and defend the claim made by the City that your water sewer and trash bill is delinquent. You may retain Counsel: Is there anyone in the audience who wishes a pre-teYmisiation hearing? There was no response, due to their failure to pay their water bill or present any valid reason why the bill has not been paid, their water shall be shut off on February 15, 1989. In order to have their water turned back on there will be an additional fee of $10.00. They are hereby infoatbed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal their water will be shut off . The Motion was made by Tolsma and seconded by Myers to approve the turnroff list: Motion Carried: All Yea: Mayor Kingsford: the amount of the delinquencies this month is $5,880.40: Item # 5: Approve the Bills: The Motion was made by Tolsma and seconded by Giesler to approve payment of the Bills: Motion Carried: all Yea: Item #6: Award Bid on Material for Water & Sewer Lines in Central Valley Corporate Park: Mayor Kingsford: We opened those Bids on Friday at 2:00 p.m., there were three bids, one was non-reponsive, one took exception to the bid, we have the one, it is the advise of the City Attorney that we do not award that at this point, we do have a month to award that bid. The Motion was made by Myers and seconded by 'Iblsma to table this item until the next Meeting which will be held on February 21, 1989: Motion Carried: All Yea: Item #7: Resolution #122: Establishing a Fire Truck Fund: Mayor Kingsford: A Resolution by the City of Meridian establishing a special Fire Truck Purchase Fund and authorizing the reserving of funds frcen the General Fund from fiscal year 1988-89 and said reservation being effective when funds beccene available and authorizing the transfer of funds reserved from the General Fund to the Special Fire Truck Fund for the purchase of a new fire truck, the present City Truck is going past the twenty year date, so it would be a good idea to start this fund so funds would be available to replace that unit, this amount was a budgeted item. Myers: What would happen to the old truck, do we sell it to saneone else or? Mayor Kingsford: I am sure we can, of course the Rating Bureau does not give any- where the points for equiFanent that is over twenty years old. Morrow: What we may do is use it for a backup unit. MERIDIAN CITY COUNCIL • • FEBRUARY 7, 1989 PAGE # 3 The Motion was made by Giesler and seconded by Myers to approve Resolution #122: Motion Carried: All Yea: Department Reports: City Engineer: I want to pass out to the Councilman a sumenatiy on the ACHD impact fee proposal that they are putting together there will be a Public Informational Hearing toward the end of February. (summary on file with these minutes) °'~ Sergeant Robertson: I would like to request the Council's assistance on a problem I have been working on with the parking in the downta~m area, recently we have received several ccenplaints frcan both business people and citizens who use the downtown area about the violations on the two hour parking limit we have in that area.The main area we have received cc~nplaints on are the area on Idaho between East First and East Second and then on East Second about ~ block both North & South. off of Idaho, We have done scene observation in that area, interesting enough the majority: of the people who are consistently violating the two hour Barking are people who work in the area., so even though we have had ccanplaints from some of the businesses,evident- ly scene of them or some of the employees are consistently almost on a daily basis violating that two hour parking. In trying to cane up with a solution on this, there is a lot of parking space being wasted on Idaho because the painted lines that mark the parking spaces are hard to see,. I think if we were to have the lines repainted it would help the situation. The problem with that is the last time I visited with ACRD they said it was the City's responsibility to bear the cost of that. They will repaint crosswalks, center lines on the road and that type of thing but not parking spaces, another solution that was brought up was to maybe form a Committee made City Officials and some of the business people along with the citizens to see if additional parking could be arranged that.was not two hour parking. Another option is that the Police Dep~arlment could do a very active enforcenent in that area and issue citations, if this is what the Council decided to do, I would like to reco- mmend that the Council review the Ordinance's concerning parking, we have a problem the way they are now enforcing the payment of parking tickets. Mayor Kingsford: I think it would be a good idea to have the City Attorney look into changing the Ordinance. Myers: One thing I think needs to be done is to get the word out or at least have some discussions with the people that are doing the violations all the time, I think this would be the easiest way to handle this and maybe the Cl~nber of Commerce could help with this. Robertson: There is a couple of businesses I have specifically had ccemplaints on and I have talked to them and I get ecanpliance for maybe two days then we are back to square one. Mayor Kingsford: I would suggest that maybe a Conunittee be put together and I would ask Councilman Myers to head that group from the City. Mayor Kingsford: I see Diana .Jackson is now-present so we will go back to Item #3 on the Agenda: This is in regards to Street Lighting in Crestwood #3: Jackson: By the letter I wrote to the members of the City Council, I think is was pretty explanatory what we were wanting basically what I am asking is if there is some way the City can help us pay for attractive street lights that would add to the sub- division rather than putting up the wooden poles like Idaho Power would supply. MERIDIAN CITY COUNCIL • • FEBRUARY 7, ],989 PAGE # 4 I guess our subdivision was platted .prior to the City requiring the developer to furnish the street lights. The City would have to have them installed and in that case we would only get the wooden poles that the City would supply or pay for our awn. We are asking if maybe the City could pay one third of the cost of the install- ation of different lights, we only are requesting three lights which would be the minimium number going by the size of the subdivision. I furnished you with a map showing approximately where they would be installed. Going with the street light poles that Tolsma Welding makes and we will be working with Meridian Electric and they are giving us a very good bid on that basically we are asking if the City could go the cost of one pole and T & R Construction will pickup just a little bit over half of that, the render and the hcaneaunlers will pay the rest. Mayor Kingsford: I might just explain to the Council, you may or not be aware that the policy of the City has been in the past and that is with subdivisions until approximately two years ago, the City just undertook the obligation of paying for those poles and what it amounted to, we paid an additional fee to Idaho Power per month for each pole that they put in. About two years ago we changed the Ordinance requiring that the developers install street lights, this subdivision as Diana indicated was platted prior to that time so it was not the obligation of the developer to install those lights. The difference per pole in one that we would rent if Idaho Power put it in for example, it amounts to approximately $3.00 per month per pole above the amount we pay if the poles are customer owned. The amount they are asking for is about what we would spend additional over a ten year period. I think it is reasonable, it is not a precedence setting thing because I think this is the last subdivision that was platted before the Ordinance change. Myers: What you are saying is if we buy those poles we do not rent them from Idaho Power? Mayor Kingsford: That is correct, we will still have to pay for the power which is approximately $3.00 per month less than the other way. There was some discussion on where the placement of the poles would be. The Motion was made by Morrow-and seconded by Myers that the City purchase one street light pole in the aunt of $782.00 installed in the Crestwood #3 Subdivision. Motion Carried: All Yea: Department Reports Cont'd: Myers: Speaking of street lights, the residents of Meridian Park have been in contact with me and they would like to see it there could be a light put on Linder at the entrance to the subdivision. The City Clerk will check into this and see if one can be placed there: Mayor Kingsford: We have a request from the Ada County Court Juvenile Services that they want to move a building in at the Ada County Weed Control Property and are solicitng.help from the City on anything we might be able to do to help with this project in regards to permits, in terms of hookup consideration and utilities consideration, it might be a good idea. to look over this request and be prepared to make con¢nents on this at the next meeting,. this request was written on January 26th. Lets be prepared to maybe give thin whatever consideration you feel we can at the next meeting. Myers: I might say that anything we could do to help them would be fine, they have ..• .' Mayor Kingsford: We have gotten scene good help out of then a.s well, on two or three occasions they have provided manpower for the City for various tasks. It works out very well that our citizens do not have to go to Boise for that. Our reason for pursuing this relocation project is that we are still making every effort to make our temporary presence in Meridian a permanent one. We believe the two juvenile probation officers there have had the positive effect we anticipated and want to be able to have them continue to be housed in Meridian. As you now, Mayor, the Commissioners agreed to our placing services in Meridian if we could do so with donated space. They have not obligated the County to pay for office space. They do, however, pay salaries and utilities. You have been most helpful to us as have Bert Myers, Ray Porter, and several community organizations. Would the city be able to help assure the stability this relocation project can give us by providing the excavation and hookups for the sewage and water for the building to be relocated? Likewise, is there a way any applicable city fees related to this project can be waived. We were inforffied the city of Meridian would pay the cost of having Idaho Pocver install 30~ wooden poles to light our street. ~e the _homeo~.ruers would like something alittle more attractive to add to the value of our homes. we realize the cost will be ffiore but we are requesting that the city of Meridian pay partially for our street lights and T & B Constriction will pay for half of the remainder. If you will approve this request it will mako it much easier for us to keep up the high standards of our city. In investigating the cost of 20~ steel light poles,- we contacted Craig 8ambo of Meridian Electric. He gave us a very fair bid of 5782.00 per pole: X582.00 for materials and y$200.00 for installation. At least three (3) poles will be needed to light our street, which would give us a total cost of X2,346.00. Any h®lp you can give us on this matter cue would greatly appreciat®. To show our appreciation we e~ould like to donate these street lights to the city of t~9eridian. Idaho Street, Meridian, Idaho, and the City Council having heard and taken oral and written testimony, the City Council of the City of Meridian makes the following: FINDINGS OF FACT 1. That notice of public hearing on the requested variance was published for two consecutive weeks prior to the scheduled hearing for January 3, 1989, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the January 3, 1989 hearing; that copies of all notices were available to newspaper, radio and television stations. 2. That the notice of public hearing for a variance is required to be sent to property owners within 300 feet of the external boundaries of the land being considered and to owners of property within the land being considered as required by 11-2-416 E. of the Revised and Compiled Ordinances of the City of Meridian; that this requirement has been met. That the applicant has requested a variance from the Meridian Ordinance which limits the block lengths in a subdivision to no more than 1,000.00 feet in that the Applicant proposes a block length of no more than 2,800.00 feet. 4. That the property under consideration is to platted as Central Valley Corporate Park and is located in the northeast quadrant of the intersection of I-84 and Meridian Road; that the Applicant is the owner; that the entire parcel. consists of approximately 10? acres; that the subdivision is to be developed as a commercial and industrial park; that recreational easements have been provided; that adequate access appears to have been provided in the platting of the land; that no other land will be landlocked by the proposed plat or the grant of the variance for a longer block; 5. That off street-parking will be required by the owners of the individual lots; that the lots will not be less than one acre in size; 6. That the area surrounding the land in question has not been developed with any particular block lengths; that the property to the east is vacant farm land; the property to the south is Interstate highway and across that is land developed commercially and industrially; that the property to the north is undeveloped land and the Meridan Speedway and City park; that the land to the west is developed, commercially and industrially and at the present time has block length longer than 1,000.00 feet. 7. No public testimony was offered regarding the variance. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property.. 2. That the City has authority to grant variances pursuant to Section 11-2-419 and 11-9-612 of the Zoning Ordinance and of the Subdivision Ordinance, respectively. 3. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Zoning Ordinance and upon the record submitted to it and the things upon which it may take judicial notice. 4. That the Council may take judicial notice of its own proceedings, those of the Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. 5. WHEREAS, the Mayor and City Council of the City of Meridian, State of Idaho, have concluded that it is in the best interests of said City to repeal Section 11-2-409 of the Meridian Ordinances. and to re-enact said section with changes effective as set forth hereinafter; NOW, THEREFORE, BE IT ORDAINED HY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: SECTION 1. That Section 11-2-409, is hereby repealed. SECTION 2. That Section 11-2-409 is hereby re-enacted and which shall read as set set forth in Exhibit "A° attached hereto and incorporated herein by this reference. :SECTION 3. WHEREAS, the Mayor and City Council of the City of Meridian, State of Idaho, have concluded that it is in the best interests of said City to repeal Section 2-1102 of the Meridian Ordinances and to re-enact said section with changes effective as set forth hereinafter; NOW, THEREFORE, HE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: SECTION 1. That Section 2-1102, is hereby repealed. SECTION 2. That Section 2-1102 is hereby re-enacted and which shall read as follows: "2-1102: AMENDMENTS TO THE PLAN: The amendments to the Comprehensive Plan of the City, which were processed pursuant: to the Meridian Comprehensive Plan and Title 67, Chapter 65, Idaho Code, are hereby adopted by the City and said Comprehensive Plan is hereby deemed amended as provided in said amendments; the amendments have respective dates of April 2, 1984, February 19, 1985, September 3, 1985, and the date of this Ordinance.
