Beumeler, Jim Johnson, Walt Casey, Ron Van Aucker, Moe Alidjani, Paul ~tutzman, Roy Porter, Gary Smith, Ann Peterson, Wayne Crookston: The Motion was made by 'Iblsma and seconded by Giesler to approve the Minutes of the previous Meeting held February 7, 1989 as written: Motion Carried: All Yea: Item #1: Bid on Sewer & Water Pipe for Central Valley Corporate Park: Mayor Kingsford: We had the Bid Opening a couple of weeks ago, there were three Bids two were non-responsive bids, there was one bid that was tabled at the last meeting. Counselor do you want to make any continents on this? City Attorney: We still have not reached a final agreement between Nahas-Simco Group and Cctinputrol, we have thirty days after the bid to award the bid. City Clerk: We would have to have a Special Meeting if it is not awarded tonite: Mayor Kingsford: We could award thebidand not give them notice to proceed until the agreement is finished. Morrow: Can we authorize the Mayor to award the Bid pending the approval of the contract agreement? Mayor Kingsford: I think you could. The Motion was made by Morrow and seconded by Myers to authorize the Mayor to make the award pending the conclusion of the contract between Naha.s-Simco, Computrol and the City of Meridian: Motion Carried: Roll Call Vote: Morrow, Yea: Giesler, Xea: Myers, Yea: Tolsma, Yea: Iten #2: Request from Ada County Juvenile Court Services: Mayor Kingsford: This was brought up at the last meeting, City Engineer did you look into the location of that building and what would be necessary for sewer and water? City Engineer: Yes, I did, the water line is in Bawer Street it goes down to a fire hydrant so water service would not be a problem, in 1987 Ada County Weed put in a new sewer service out to Meridian Road and we have a record drawing on that, so sewer service could be tapped into that. Mayor Kingsford: Did the Council read the copy of the letter, they are asking for what- ever the City might be able to do for them. Morrow: Are they asking us to do the excavation and the hookups? Mayor Kingsford: They are asking for whatever we might do, including that r~DIAN cITY covNCIL FEBRUARY 21,, 1989 PAGE # 2 Myers: I think they have the building pretty well taken care of as far as moving it: There was discussion on the costs involveda Mayor Kingsford: I might reccaanend half of the hookup fees and maybe have our personell help them install: Tolsma.: Do we have the materials on hand? City Engineer: We would have everything but the sewer pipe: The Motion was made by Myers and seconded by Tolsma that the City of Meridian split the hookup fees and have our personell help with the installation of_the.:lii3es: There was discussion on this, what does help them mean, if time penni.ts we could help, One Councilman voiced disfavor of this proposal it was to vague. Motion Failed: 2 Nays, 2 Yeas, Mayor voted Nay: Morrow: I would move we provide the hookups fees without charge and we provide the materials we have in house for the water connection and leave the installation up to them: There was discussion on this: Morrow: I withdraw the Motion: The Motion was made by Morrow and seconded by Giesler to pay up to twelve hundred dollars of the cost of incurred by Ada County Juvenile Services in connecting to the City water & sewer: There was discussion on this by the Mayor & Council Members: Motion Failed: All Nay: The Motion was made by Morrow and seconded by Myers to waive the sewer and water hookup fees for the Ada County Juvenile Court Services building: Motion Carried: All Yea: Item #3: Chamber of Commerce on Downtown Master Plan: Mr. Jim Shearer is here representing the Chamber: Shearer: Actually I should be representing myself and not the C1-~amber of Ccsr¢in~xce, we have put together a proposal JUB & I to do a Downtown Master Plan and Financing Program, I think you have a copy of the proposal ,this has been approved by the Chamber of Commerce Board and by the Idaho First National Bank who donated funds in the amount of $5,000 and also by the Chamber CcaYarii_ttee, we are here now to ask the City Council to approve the proposal. Mayor Kingsford: I have been involved in this for the past ten to twelve years in some kind of program to rejuvenate a part of the downtown area, two weeks ago the Chamber Committee met and approved this amount of money for the project, the reason primarily that they are before you tonite is part of the proposal is that the City of Meridian contribute $2,500.00 to that program, of the $10,000 allocated, Idaho MERIDIAN CITY COUNCIL • • FEBRUARY 21, 1989 PAGE # 3 First National Bank has contributed $5,000, Chamber of Ccaranerce has allotted $2,500 and the City of Meridian has been asked to contribute $2,500, some three months ago I wrote a letter to the Department of Ccerrtnerce anticipating being able to use the proceeds we have received back from the revolving loan fund that was given to Power Dynamics, In the return correspondence they did not feel that would be appropriate use for that it should be used in the Computrol project, I have no problem with that, my recommendation to you is that you approve the Plan, I think it is a good one, and that we allocate $2,500.00 of the revolving loan fund into the Computrol Project and that we take $2,500.00 that was designated for the Computrol Project and put into this project. The Motion was made by Morrow and seconded by Myers to approve of the proposal for the Downtown Master Plan & Financing Program as sul~nitted by Wayne Forrey of JUB & James Shearer and the expenditure of $2,500.00 for the City contribution for the Plan and that $2,500.00 of the Revolving Loan Funds be used for the Computrol Project. Motion Carried: All Yea: Item #4: Ron Van Rucker: Overland Industrial Park: Ron Van Rucker: I have a letter here for the Mayor & Council, if you would like to take a few minutes and read it (Letter on File with these Minutes), I am sure you are all familiar with the site, this property is directly to the East of the Coca. Cola facility, in the statements I made in the letter we have been doing ongoing negotiations with Freidman Bag Company which is out of California, presently located in Boise and looking for a new site for their manufacturing facility based upon loosing their lease in Boise. They have been looking at this site for about six months but not got serious until about three weeks ago. We have sulsn-i.tted a prel~m;nary & final plat on the subdivision of this property, it is our intent to go ahead and install sewer & water lines at this time, I had not anticipated that Freidman was going to move as fast as they have. Oise of the considerations we are asking for is assistance fran the Council in regards to the timing of the building permit and that is based on, if and when they elect and based on my information now this could be as early as March 8, 1989 they would want to start construction, we are asking if a building permit could be obtained at this time even though the platting is not cx~mplete. Secondly we would like to ask the Mayor & Council if they would come up with score kind of late comQx's fee so we could receive some reimbursement of our «~st on the water & sewer lines that it is necessary we install.'I'he other thing we would ask of the Mayor & Council is beings this project is in Ada County is some help in getting Ada County Highway Districts requirement for curbs, gutters & sidewalks waived if they are required by then. Presently the elevations and engineering is probably non-existant and if they were put in they would not be correct in the future when other properties developed. We would also not want to put the monies in the trust fund. I think we have a very good chance to get this facility if the above items can be worked out. Tolsma: You say this goes straight east of the Coco Cola facility? Van Rucker: Yes, Councilman Tolsma was shown on the preliminary plat the property in question: This plant will make all burlap bage and they have a one year option on the other property as they might move part of the operation on plastic bags to this facility. Tolsma: Access to this will be off Overland Road? Van Rucker: Access will be off of Teare Drive to the property: Tolsma: The platting process continues on whether or not this project goes? Van Rucker: Absolutely: MER.IDL~l~T cITY COUNCIL FEBRUARY 21, 1989 PAGE # 4 Mayor Kingsford: When Coca Cola came in we had a legal lot split but scene time back it came to our attention that before more land could be sold this needed to be platted, that process in running in a little arrears basically what they are asking for is that we will grant a building permit even though the platting is not cc~nplete, asking for us to help eliminate scene of the recd,; rents of ACEID that simply do not apply in an Industrial Zone and also to work with them on a late ccereer's fee for those areas that the line extensions could be used by other people. There was discussion on whether Teare Drive could handle this kind of use. Mayor Kingsford: I think what they are talking about is the blanket improvements that ACHD always asks for curbs, gutter & sidewalks: Giesler: I do not have any problem with that: Morrow: I do not have any problem with that either: The Motion was made by Tolsma and seconded by Myers to work with Ron Van Aucker in granting a building permit before the platting of the property is ccenpleteyl. ,work with getting the appropriate requirenents of ACfID waived and entering into a Late Ccener's Agreement on Water & Sewer: Mayor Kingsford: I might point out I asked the City Clerk to do scams checking on the LID procedure after our meeting, we find that sixty percent of the property owners if they vote to request a LID can force a LID in an area, but a government agency can without one vote can demand you have an LID. I think particular in this type of area this is a more logical way to approach those things. Motion Carried: All Yea: Department Reports: City Engineer: Warren Watson lives at the corner of Linder Road and Ustick and he is presently connected to the city sewer, he was connected in 1979. He recently received approval frcen the County to move a temporary living quarters on to his property for his son. In the process he connected this additional unit onto the existing sewer tap, so we now have two living units discharging into the sewer. The question is the connection fee since this is outside the City Limits. Mr. Watson carte in after I contacted him and he informed me he had met with the State Inspector, that Inspector told him it was not necessary to deal with the City of Meridian because he was out- side the City Limits. He is requesting a variance from the outside the City Limits double connection fee because it is a temporary residence. Mayor Kingsford: Any questions of the Council? Morrow: It seers to me that maybe we waive the double fees and charge the temporary unit a single fee, it just seers to me that we ought to charge a single fee, that if we don't and I can appreciate the problems with health and other things but this is the area where you set dangerous precedence. Mayor Kingsford: One other thing we have it is not on City water so we do not have a handle on the amount of water discharged into the sewer. We are charging then the average whir'h is 65Q~ gallons. Myers: So we should probably charge the hookup fee plus an additional user fee. Mayor Kingsford: 2'o be consistant with anyone in the City Limits I think you should MERIDIAN CITY COUNCIL • • FEBRUARY 21, 1989 PAGE # 5 and our Ordinance speaks to having pimple who are not in our taxing district paying extra. It being temporary I can see seems logic in not charging the double fee. The Motion was made by Myers and seconded by Morrow to charge Mr. Watson a single hook- up fee and one additional user fee because of the temporary status: Motion Carried: All Yea: City Attorney: We have had one individual as far as the Day Care Operators that we have not had any cooperation with, do you wish to proceed. with enforcement? It was the consensus of the Mayor & Council to proceed with enforcement on this: Mayor Kingsford: We have looked at and negotiated a little bit and have been offered a free well site near the corner of Ten Mile and Cherry Lane, the ccenbination between the Seventh Day Adventist Church and Rich Allison, they need to have an answer, we need to pin then down while they still have the same Board. If it is the desire of the Council we would like to move along, get the survey~nd have the property deeded to the City: In my judgement at least and the City Engineer's thinking on it, I think it makes good sense to have a well out in that area. The Motion was made by Myers and seconded by Tolsma to proceed with the negotiations to obtain a well site near the corner of Ten Mile and Cherry Lane: Motion Carried: All Yea: Mayor Kingsford: I met with Harvey Hoff this afternoon and we toured his plant and evaluate what kind of things done with regards to noise, they have done a number of things dom. there, they have built a building, they have put insulation on pipes and so on. They are going to do scene more thing, but I think it is going to resolve down to,they are going to have to bring somebody in that deals with those problems. I think they are ~ginn;ng tp more and mAre recogonize that. I~zrvey is very sincere in getting the problem remedied, he gave me his hcene phone and said to call when the noise was the loudest even if it was three o'clock in the morning; they want to try and pinpoint the noise so they can get it fixed. Mayor Kingsford: We have been asked by the Chamber of Commerce to apply for a Grant from the State with regards to the Visitors Bureau there in terms of getting the Street widened or a parking area, in order to apply for that the State requires we have a Resolution, Council approve a Resolution allcxaing the City to apply for that Grant. The Chamber has prepared the application, all we have to do is sign the application and send it in if that is the Council's desire. I have a Resolution #123 prepared if you are interested in applying for that. BOX 1072 CALDWELL, IDAHO 83606 February 21, lg8g Mayor Grant Kingsford and City Council City of Meridian 33 East Idaho Meridian, ID 83642 Gentlemen: ~Z~~,1~ ~~r~ ~ ~ This letter is written in regards to our potential opportunity to secure Fried- man Bag Company as a new industry for Meridian. They would locate on a parcel of ground east of Inland Coca Cola, back 300 feet from I-84. Friedman has been located in Boise, Idaho, for the past five years. They are a leader in their industry and have experienced growth each year. This would bring about 40 new employees to the Meridian area. I am presently negotiating with Mr. Harvey Friedman, owner of Friedman Bag Co. and we have come close to an agreement on the land. In order to induce Fried- man to locate on our site, I have offered to sell the ground for $32,500. per acre and have agreed to plat and provide all utilities to the site. Two areas that I need help from the Council: 1. I need help in being assured that we can have a building permit with- out having the final platting process completed. I have caused this prob- lem by not following the procedure for platting as I should have and for this I apologize. When I realized the need to move quickly for Friedman, I began the procedure, but it may not be completed in time. 2. I will provide for all utilities to the site as required, but need your help to get A.C.H.D. requirements, i.e. curbs, gutters, sidewalks and street improvements on both Overland and Terra Drive waived on this project. As we all know, the engineering and elevations are presently non-existant. Additionally, we need to know that they (A.C.H.D.) will not require a de- posit into the road trust fund. The logical way is the L.I.D. approach after it is developed. Additionally, I would request permission to have Van Auker and Meridian enter into a "late comer's" agreement on the water and sewer lines that would be paid for by Van Auker. In summary, I would ask that you consider these items and~:.give me direction so I may be able to finalize our negotiations with Friedman. Thank you for your consideration in his ma er.
