Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford
at 7:30 p.m.:

The Motion was made by Tolsma and seconded by Myers to approve the Minutes of the
previous Meeting held April 4, 1989 as written:

Mayor Kingsford read a Proclamation designating April 23-29, 1989 as CONSUMERS WEEK:
Mayor Kingsford: We will take up at this time an item that was not on the Agenda,Resolution
#124, A Resolution of the City of Meridian to approve of the issuance by the Economic
Development Corporation of the City of Meridian of variable rate demand Revenue Bonds.
Mr. Fawcett would you like to cane forward and advise the Council with regard to that
Bond Resolution?
Fawcett: Mr. Mayor & M~nbers of the Council, earlier this evening the Economic Development
Corporation met and I understand they adopted a Bond Resolution that we had requested they
adopt, this relates to the Computrol Project which is relocating to the City of Meridian
Computrol as you know has requested issuance by the Economic Development Corporation of
$3,500,000.00 of Industrial Development Revenue Bonds for the purpose of providing funds
to construct a building and purchase equipment to equip that. building, under the State
Law in order for those Bonds to be issued by the Econcenic Development Corporation it is
a requirement that the municipality that organized the Economic Development Corporation
authorize the issuance of the Bonds. We have gone through a process beginning July of
last year of having the Economic Development Corporation indicate a interest in issuing
those Bonds and then this evening at their meeting they agreed to authorize the issuance
of those Bonds, we anticipate that the financial transaction will close approximately
May 4, 1989, we are now asking that the City Council approve the initial Inducement
Resolution that was adopted by the Economic Development Corporation in July of last year,
as._ well as the Bond Resolution that was adopted earlier this evening at the Econcenic
Development Corporation meeting.
Mayor Kingsford: We have one question, as I look at Resolution #x.24, I see we have a
different Council M~nber on there, I did not look at the this evening at the Board, that
Board has also changed, the President of the Council is automatically the Secretary of
the Corporation and that would be Mr. Tolsma instead of Mr. Brewer:
Fawcett: We will certainly make that correction prior to the time we complete the
transaction:
City Attorney: The Bond Resolution passed by the Econ~.u.c Development Corporation doesn't
indicate an officer on it, it is just to be signed by the secretary there is no name
below it, there is no reference in the document itself as to who is on the Board, so that
will be adequate. In the record of the proceedings there will probably be an announcement
of who was present so we can correct it at that time, this can be corrected by putting
Mr. Morrow in place of Mr. Brewer or we can prepare a new page whichever is the Counsel's
preference.

Fawcett: It probably would be easiest to correct it and run a new sheet, we have this in
the word processor.
City Attorney: If it is the Council's position to go ahead and approve the Resolution, I
think that the Council can approve it knowing that there is going to be a change in the
Resolution and authorizing the Mayor and the City Clerk to execute the changed Resolution.
The Resolution can be passed at this meeting however:
Mayor Kingsford: Any questions of the Council? There was no response.
The .Motion was made by Myers and seconded by Tolsnia. to of Resolution #124 and authorize the
Mayor & City Clerk to sign the modified Resolution #124 making adaptation for former
Counci]man Brewer and inserting Counci]man Morrow:

Item #1: Public Hearing: Prelim;nary and Final Plat on Overland West Park:
Mayor Kingsford: At this time I will open the Public Hearing, is there anyone in the
audience who wishes to offer testimony on this request? There was no response, the Public
Hearing was closed. Are there any comments or questions of the Council?
Tolsma.: The Variances we granted him before they still go?
Mayor Kingsford: What you are .~aking to, is with regard t0 the rem~irements asked-for
by ACEID, ACHD will have to sign off on this plat if they do not approve of then then that
is something he will have to deal with ACRD.
Tolsma.: Did we have that sidewalks ,curbs & gutters would not be required?
Mayor Kingsford: We have agreed to a Variance on those and that is part of the Plat as
you are considering approval.
Morrow: ~ we do not need to take any more formal action in terms of the ACH1] rind--
ations?
Mayor Kingsford: No, it would be my understanding that we have made our recommendations
and are approving variance today,. if he can not get the Highway District to sign off on
this it is something he would have to modify.
City Clerk: Is that going to be satisfactory to you Mr. Roylance?
Roylance: Has the City written a letter to Ron Van Aucker or to ACHD or anybody that
explains you are in support of waiving those require-~nents?
Mayor Kingsford: To my knowledge we haven't, but we will,. send that to your office and
then you could forward to ACHD.

Bowman.: I am here tonite to advise the Mayor & Council on the projects that are in
the mill for next year, explain how we arrive at what the City of Meridian Contribution

formula is and in general just find out how you think we are doing and maybe gain scene
guidence along the way.I have handed out to each of you a statement of purpose for the
Ada Planning Association (on .file with these minutes) and also a preliminary look at the
1990 budget. (on file with these minutes). Bowman explained the formula to the Mayor
& Council. For the past several years the Board has allowed, in order to keep several
of the Cities active in the Organization a membership fee of $1,000.00 per year, this
includes Meridian, as of this current fiscal year they have asked me to scene back to
members and seek the best I can the normal percentage under the fonmila that would be
your payment, that is what the $4,871.00 is shown on the handout, that would be your
normal payment, I am not here to seek thai~number tonite. I wanted to explain haw that
gets arrived at. I will be speaking to the Mayor about a specific ntunber that is aimable
to both the City and to the APA. We have several tasks that we are engaging in and have
been asked to continue effort next year, one of those is to address the need for a
County wide solution to the stone drainage runoff, the second project which you are
aware of is the standarization of the preliit~inary platting guidelines throughout the
County. This would simplify things for developers thoughout the County..then we have all
our standard transportation things, those are the kind of services we provide.
There wa.s discussion on possibility of double dipping a.s far as the County share against
the City share.
Mayor Kingsford: Tnthen you use the property tax certification as half of the fonrnala. I
guess I have scene problems with that as I look the services the Cities. have to provide
out of the tax certification. For that reason and for the reason we have provided a
certain amount of expert technical staff, I have sce~ trouble at looking at this $4871.00.
and getting excited about it.
Morrotiv: At what time are we going to have discussion concerning this entice concept and
everything that has been discussed here tonite?
Mayor Kingsford: Certainly if we cannot reach an acxord pretty close to what I am
satisfied with, we will come to the Council and discuss what you want to do with regards
to the fees, with regards to scene of the other thing that have been talked about, these
will be at different intervals and I assume we would be apprised of them as they are
being discussed and be asked for some input.
Morrow: It just seems to me that we need to discuss in conjuction with the value of the
dollar here also whether or not we agree with the concept that basically this is
essentially and I understand what you are driving towards with a unified platting
procedure but the thing of it is ,the problem with those kinds of concepts is that
does not recognize things that are specific to our City in the direction we are pursu-
ing, we may not want to be and probably are not going to be anything like Boise or
anything like Garden City nor do we have problems that are equal or equivelant to the
problems that they have so it may not be in our best interest to even participate in
ternis of a County wide platting procedure so it seems to me we need to discuss the
direction those things are going to go and whether or not we even participate in them.
I would hate to see where Meridian gets backed into a corner because we do not discuss
something and are forced to accept things that might be deemed. to be benifical by APA,
Boise City and Ada County and not benifica.l to us at all.
Bowman: Perhaps I could respond with two cxg~anents, one you. have .very good representation
on that ccentnittee and the other part of it is we do not have any enforcement power at
a11, we can not put anyone in a situation where they are backed into a corner because
we do not have any of that power, this is strickly a voluntary organization,. voluntary
operation and what you were given a couple of weeks ago is an attempt to say these are
things that we have decided as a ccmenittee are worth sending back to the individual
cities and the county for consideration and once the APA Board adopts them, I will bring

them back to you on a somewhat fornal basis saying these are the things we would like to
have you consider. I am available to answer questions a.s a resource person on those and
that is as far as I go. My cce~unitttment is to work with the agencies. I can committ to you
that we will not scene back to you or to anyone else asking for you to adopt what the
group as said you ought to, that is not the purpose of it.
Morrow: From a practical standpoint I just thing in teens of this standard platting
procedure what could easily happen there assuming that Meridian should choose to do
something differently in the platting process that currently exists, ACRD and the
County have to sign off on those plats, right there is the han4ner to force standarizat-
ion. 'T'hey simply refuse to sign off on the plats because we have not accepted some sort
of standarization, how do you resolve those issues?
Bowcnari:I have not even thought of that as a possibility, it has not been raised to my
knowledge at all.
Morrow: That is a practical way of forcing standardization.
Botianan: They could do that right now even without this committee in place:
Mayor Kingsford: I think the thing you have right now Counci]man Morrow with this
carmi.ttee in place is at least we have a sounding board that all those agencies are
at, when the legislature granted the Highway District Ordinance powers we got put into
exactly what you are talking about, they could disapprove any plat that we may approve,
if they had a Ordinance to back that up.
Bowman: We are in an interesting situation in this County, that just got more interesting
with that piece of legislation, some of the ramifications of it I do not think we have
felt yet.
Mayor Kingsford: Any other questions or comments of Mr. Bowman, if not I will say we
appreciate your time and hope the Council will avail th~nselves of Mr. Borrmians invitation
to call him at any time.
Boman.: I did miss introducing Erv Olen who is with me tonite he is the Transportation
Director, and Deputy Director of APA as well.
Item #3: Ordinance #504: Adopt the 1988 Uniform Fixe Code w/exertions:
Mayor Kingsford: An Ordinance amending Section 2-1001 of the revised and ccmpiLi.ed
Ordinances of the City of Meridian to adopt the 1988 edition of the Unifo~n Fire Code,
with an appendix, and exceptions, and providing an effective date, is there anyone in
the audience who wishes Ordinance #504 read in its entirety? There was no response.
The Motion was made by Giesler and seconded by Tolsma that the rules and provisions of
50-902 and all rules and provisions requiring that Ordinances be read on three differ-
ent days be dispensed with and that Ordinance # 504 as read be passed and approved:

Item # 5: Ordinance #506: Annexation & Zoning of Hosac Property:
Mayor Kingsford: An Ordinance annexing & Zoning certain real property which is
described as the Northwest Quarter (NW ~) of the Southwest Quarter (SW ~) excepting
the north twenty eight (28) acres, thereof- , of Section five (5), Township 3 North,
Range 1 East, Boise Meridian, in Ada County, State of Idaho, and providing an
effective date, is there anyone in the audience who wishes Ordinance #506 read in
its entirety? There was no response: This is the Hosac property that was discussed
at the last meeting that had been on a conditional annexation that we requested. they
go ahead with annexation:

Departrnnnt Reports
City Attorney: As many of you know Bill Nary of our office is departing to take a
position with the City Attorney Office in the City of Boise, we have engaged a new
employee, Bill Swartz, I would like to introduce Bill to the Council and he will be
with our firzn and handling the bulk of the prosecution as of May 1, 1989.
The City Clerk was directed to write a letter of thanks to Bill Nary by the Mayor
and Council:
Tolsma: How is the new Parking Ordinance cceriing?
City Attorney: I talked to Mr. Nary before he got so involved and he said he was
going to work on it with Sergeant Robertson so it is still in the working so as soon
as he return and before he leaves we will get that moving.
Mayor Kingsford: I have a couple of things, a few years ago a citizen of the cca~muni.ty
made a very generous donation to the Meridian Burn-out Fund and designated that half
of the interest frcan that fund each year be given to the City-Rnra1 Burrirout Fund and
that the rest of it stay there to accure interest, at this time I would like to pass
this check for $40.28 to the Fire Conrn:i.ssioner and ask him to give that to the Fire
Chief for the Burn-out Fund.The other item is if the Council has any thoughts of
increasing the Mayor or Counci7mans c~ensation, this has to be done during election
year and 120 days before the election. You need to be thinking about this at this time.
My ccs~ment is not a relation but if that is your desire it needs to be considered.

RESOLUTION NO. 124
BY THE COUNCIL: KINGSFORD, MORROW, TOLSMA, GIESLER, AND MYERS
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MERIDIAN, IDAHO, APPROVING THE ISSUANCE BY THE
ECONOMIC DEVELOPMENT CORPORATION OF THE CITY OF
MERIDIAN, IDAHO, OF ITS VARIABLE RATE DEMAND
REVENUE BONDS, (COMPUTROL, INC. PROJECT) SERIES
1989, IN THE AGGREGATE PRINCIPAL AMOUNT OF
$3,500,000 AND APPROVING THE RESOLUTION OF SAID
PUBLIC CORPORATION AUTHORIZING SAID BONDS,
INCLUDING THE TRUST INDENTURE, LOAN AGREEMENT AND
RELATED DOCUMENTS: AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Meridian, Idaho (the "City"), by its
ordinance No. 421, has approved and authorized the creation of
the Economic Development Corporation of the City of Meridian,
Idaho (the "Public Corporation") as a public corporation of the
State of Idaho pursuant to the provisions of Title 50, Chapter
27, Idaho Code, as amended, (the "Act") to act on behalf of the
City to issue nonrecourse revenue bonds for the purpose of
financing the costs of qualified industrial development
facilities within the meaning of the Act; and
WHEREAS, the Public Corporation, by Resolution No. 7
adopted July 26, 1988, (the "Official Action Resolution") did
approve the Application of Computrol, Inc. (the "Company") for
industrial development financing under the Act to provide funds
for the acquisition, construction and equipping of a
microprocessor systems manufacturing facility located in the
City (the "Project") and a copy -of said Application and
Resolution has been filed with the City; and
WHEREAS, the Public Corporation, by Resolution No. 9 (the
"Bond Resolution") adopted on April 18, 1989, a copy of which
has been furnished to the City, has authorized the issuance and
sale of its $3,500,000 Variable Rate Demand Revenue Bonds,
(Computrol, Inc. Project) Series 1989 to be initially as fully
registered variable rate demand bonds (the "Bonds") and by the
Bond Resolution has authorized and approved a Trust Indenture
with First Security Bank of Idaho, N.A. as Trustee, a Loan
Agreement with the Company, and a Bond Purchase Agreement with
the Company and Piper, Jaffray & Hopwood Incorporated (the
"Purchaser"); and
WHEREAS, after at least fourteen (14) days published

notice, the Public Corporation on February 7, 1989, held a
public hearing to allow comment on the Project as required by
Section 147(f) of the Internal Revenue Code (the ~~Code~~); and
WHEREAS, the Act and the Code require that the governing
body of the creating municipality approve the Project and
approve the resolution of the Public Corporation authorizing
the issuance of Bonds; and
WHEREAS, the City Council has reviewed the Application, the
Official Action Resolution and the Bond Resolution and intends,
by the adoption of this resolution. to approve the same
including without limitation the agreement of the Public
Corporation to issue the Bonds upon the terms set forth therein
and the various agreements approved therein in accordance with
the Act;
NOW, THEREFORE, THE CITY COUNCIL OF THE-CITY OF MERIDIAN,
IDAHO, HEREBY RESOLVES AS FOLLOWS:
Section 1. The Project Application, the Official Action
Resolution, the issuance of the Bonds, the Bond Resolution, the
Trust Indenture and the agreements and documents necessary to
issue the Bonds therein expressed and approved, in the amount
and for the purpose therein described and referred to in the
preamble of this Resolution, are hereby approved in accordance
with the Act and the Code. A copy of the Official Action
Resolution, the Application and the Bond Resolution shall be
maintained on file with the Meridian City Clerk.
Section 2. The Project, to be. located at a 10-acre site
located approximately 800 feet east of Meridian-Kuna Road and
approximately 1,200 feet north of I-84, in the Treasure Valley
Corporate Park located at the northeast quadrant of the
I-84/U.S. Highway 69 interchange, Meridian, Idaho, and to be
financed with the proceeds of the Variable Rate Demand Revenue
Bonds, (Computrol, Inc. Project) Series 1989 in the maximum
aggregate principal amount of up to $3,500,000, is hereby
approved. The owner, manager and operator of the facility
shall be Computrol, Inc., an Idaho corporation.
Section 3. This Resolution shall take effect immediately
from and after its adoption and approval as required by law.
ADOPTED by the Council of the City of Meridian, Idaho, this
18th day of April, 1989.

RE: APA Mission Statement
For the past several weeks, APA staff have been working on next year's
preliminary work program and budget. To replicate Zast year's process would have
meant taking only a short-term look into the future for APA and its member
agencies. That seemed insufficient. Hence, we initiated a staff planning
workshop whose focus was to define a Zong-term mission statement for APA.
A mission statement must be one which can guide an agency for many years to come
and which is consistent with its charter. We think we accomplished these goals
and would like to share our product with you:
The purposes of the Ada Planning Association are to:
» Provide a forum to address community issues;
» Serve as a catalyst for building consensus on this community's
vision of the future; and
» Develop and support activities to achieve that vision.
This statement accommodates the official Metropolitan Planning Organization
functions which APA must do each year. It also embraces the intergovernmental
ombudsman tasks which engage an ever greater portion of our effort. It provides
wide Iatitude for timely response to the changing needs of our member agencies.
And it is fully compatible with the September 22, 1977, charter of Ada Planning
Association.
The staff of APA offer this statement for your consideration. We eagerly
solicit your comments about it and your acceptance of it. And we unanimously
offer our commitment to it and to this organization. Thank you.

WHEREAS, The week beginning April 23, Nineteen Hundred and Eighty-Nine is
the eighth annual National Consumers Week; and
WHEREAS, the 1989 theme "Consumers Open Markets" acknowledges the powerful
role consumers play in our nation's economy; and
WHEREAS, a major function of our competitive free market system is to
satisfy consumer demand; and
WHF~REAS, consumers should have certain rights in these markets including the
right to information, choice, safety, education, and to be heard; and
WHEREAS, ideal fairness for the consumer is achieved when educators, business,
government, and consumers work together to insure equity, increased
competition, and safety in our free market economy; and
WHF~REAS, National Consumers Week promotes consumer programs by both the
public and private sector' encourages dialogue between consumers,
business, and governments; and broadens the scope of consumer awareness.
NOW, THEREFORE, I, Grant P. Kingsford, Mayor of the City of Meridian, do hereby

AN ORDINANCE AMENDING TITLE 2, CHAPTER 2, REVISED AND COMPILED
ORDINANCES OF THE CITY OF MERIDIAN ADOPTING THE 1988 UNIFORM
PLUMBING CODE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Mayor and City Council of the City of
Meridian, State of Idaho, have concluded that it is in the best
interest of said City to adopt the 1988 Uniform Plumbing Code of
the Revised and Compiled Ordinances of the City of Meridian.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That the Section 2-201 of the Revised and
Compiled Ordinances of the City of Meridian is hereby amended to
read as follows:
2-201: ADOPTION OF PLUMBING CODE: There is
hereby adopted by the City of Meridian for
the purpose of establishing minimum
standards of design, materials and
workmanship for all plumbing hereafter
installed, altered or repaired, and to
establish methods of procedure within the
City limits, that certain Plumbing Code
known as the "Uniform Plumbing Code, 1988
Edition", and the whole thereof of which not
less than three (3) copies have been and now
are filed in the office of the Clerk of the
City, and the same are hereby adopted and
incorporated as fully as if set out at
length herein, and from the date of which
this Chapter shall take effect, the
provisions thereof shall control the
installation, alteration or repairing of
plumbing within the corporate

limits of the City; provided however, the
below stated addition to the Uniform
Plumbing Code is also hereby adopted which
addition, if in conflict with the Unifona
Plumbing Code (UPC), shall overrule said
UPC; the addition is stated as follows:
(A) Buildings Move From One
Location To Another: When a
building is moved from one
location to another the service
entrance shall be inspected and
made to conform to the
requirements of the current
edition of the Uniform Plumbing
Code.
Section 2: °EFFECTIVE DATE: WHEREAS, there is an emergency
therefor, which emergency is declared to exist, this Ordinance
shall be in full force and effect from and after its passage,
approval and publication according to law.

AN ORDINANCE AMENDING SECTION 2-1001 OF THE REVISED AND COMPLIED ',
ORDINANCES OF THE CITY OF MERIDIAN TO ADOPT THE 1988 EDITION OF
THE UNIFORM FIRE CODE, WITH AN APPENDIX, AND EXCEPTIONS; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Mayor and City Council of the City of
Meridian, State of Idaho, have concluded that it is in the best '~,
interests of said City to amend Section 2-1001 of the Revised
and Compiled Ordinances of the City of Meridian to re-enact said
Section with changes effective as set forth hereinafter;
NOW, THEREFORE, BE TT ORDAINED BY THE MAYOR AND CITY ',
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Section 2-1001 of the Revised and Compiled
Ordinances is hereby amended to read as follows:
2-1001: ADOPTION OF FIRE CODES:
(A) Uniform Fire C-ode. The Uniform Fire
Code is adopted for the purpose of
regulating an governing conditions hazardous
to life and property from fire. The Uniform
Fire Code, 1988 Edition, including appendix
VI-D, is hereby adopted with the following
exceptions.. to the code:
1. Section 80.303 (a) 6D (i) page
332 the exception shall read as
follows:
