The Regular Meeting of the Meridian City Council was called to order by President of
the Council Ron Tolsma at 7:30 P.M.:
Members Present: Bob Giesler, Bert Myers, Max Yerrington:

The Motion was made by Myers and seconded by Giesler to approve of the Minutes from the
previous Meeting held February 20, 1990 as written:

ITEM #l: RALPH CHRISTENSON, MERIDIAN LIONS CLUB UPDATE MAYOR & COUNCIL ON RODEO:
Ralph Christenson: Gave a brief overview of plans for a Rodeo in September. Would
like the Council to promote as much as possible. There will be no beer served at this
rodeo. There is only one item that I did not place on the letter which you have and that
is we are going to by an all around saddle and a bucking saddle and it will be given
away by points earned.
Tolsma: You have here that a gate can be purchased for $250.00, is that advertising on there?
Christenson: We'll have four gates that the animals come out of, then one catch gate.
Each chute gate we'll sell for $250.00. Explained further about the signs and purchasing
of the gates. We don't need any money now, but if you are interested we just need a letter
of committment.
ITEM#2: PUBLIC HEARING: FINAL PLAT ON MERIDIAN MANOR #6:
Tolsma: At this time I will open the Public Hearing, is there a representative present
for this request.
Bill Briggs, Briggs Engineering, I am here representing Ed Sews & Bert Smith,. the
developers. Briggs was sworn by the City Attorney:
Briggs: We have obtained approval of the City Engineer on the Construction Plans &
we have back from him his review of the subdivision plat, and I do have a corrected
subdivision plat with me and we have taken care of all the suggestions that he made
in his comments and we have no problem with any of these.
Giesler: Has he had the opportunity to go over those since the changes?
Briggs: No not yet. I can leave a corrected copy here tonight with the Engineer and
then bring over additional copies tomorrow.
Engineer Smith: I certainly don't have any problem with Mr. Briggs taking care of the
comments on the plat. As he mentioned the water & sewer plans have been approved and
they are under construction now.

Giesler: Nampa-Meridian also had some comments were those taken care of?
Briggs: Yes those have been or will betaken care of.
Tolsma: Is there anyone else who wishes to testify? Being no response, the Public
Hearing was closed.
The Motion was made by Giesler and seconded by Myers to approve the Final Plat
on Meridian Manor #6:
Yerrington: I think that should be amended to Gary Smith's letter.
The Motion made by Giesler and seconded by Myers was withdrawn.
The Motion was made by Giesler and seconded by Myers to approve the Final Plat
on Meridian Manor #6 with making the necessary changes from the comments of the City
Engineer.

ITEM #3: PUBLIC HEARING: VARIANCE REQUEST BY INTERWEST FINANCIAL: STREET LIGHTS IN
CHATEAU MEADOWS EAST:
Tolsma: i will Open the Public Hearing, is there anyone who wishes to tesify?
This is for putting in post lights instead of street lights, they come on at dark and
go off in sunlight. The only comment that the Engineer had was to have some way to
enforce burned out bulbs.
Myers: Have you talked to anybody about that Gary?
Engineer Smith: No I haven't yet. I picked up on a comment from Chief Bowers, when
he drove through at Meridian Greens it seemed that there was a lack of light being on
for one reason or another, it is something to talk about, some way to improve these
lights. When all the lights are on and working it's a good thing but when light
start burning out and people don't replace them it gets to be a problem.]
Giesler: I think that Mr. Smith has a very good point. When all the lights work it
is nice, but when all the lights are not on it's a problem.
Tolsma: Being there is no one present who wishes to testify on this, I will close
the Public Hearing.
Moe Alidjani: There are also some areas that won't be built on and those areas are
real dark.
Giesler: How important is it that Interwest knows tonight on this?
The Motion was made by Myers and seconded by Yerrington to have the Attorney prepare the
Findings of Fact and Conclusions of Law.

and Conclusions of Law for Tami Shoemaker at 1031 East First Street:

ITEM #5: PRE-TERMINATION HEARING: WATER/SEWER/TRASH DELINQUENCIES:
Tolsma: This is to inform you in writing, if you choose to, you have the right to a pre-
determination hearing at 7:30 P.M. 3/6/90 Before the Mayor and City Council, to appear
in person to be judged on facts and defend the claim made by the City that your water,
sewer, and trash bill is delinquent. This service will be discontinued 3/14/90 unless
paid in full. Is there anyone present who wishes to contest their water/sewer/trash bill?
Wilma Blair: Explained that she can't pay her hill, would like to know if the Council
would give her until April 1st to pay.
Clerk Niemann: You'll pay it all on the 1st? Permission was granted until the 1st of
April.
Tolsma: is there anyone else present who wishes to contest their water/sewer/trash
delinquency? Due to their failure to pau their water bill or to present any valid
reason why the bill has not been paid, their water shall be turned off on March 14, 1990.
in order to have their water turned back on, there will be an additional fee of $10.00.
They are hereby informed that they may appeal or have the decision of the City reviewed
by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they
appeal, the water will be shut off.
The Motion was made by Yerrington and seconded by Myers to approve the turn off list with
the exception of Wilma Blair.

Tolsma: The total amount of the past due accumulation this month is $8,293.87.

ITEM #7: DEPARTMENT REPORTS:
Engineer Smith: The Mayor asked that I bring the Council up to date on a project that
we are looking at, it is the extension of the sewer along Ten Mile Creek from where it
exists right now at the southwest 12th St. out at Crestwood Estates Subdivision. There
has been some interest for development on the south side of the interstate at Kuna Meridian
Overland Road.

The Flying J and Winston Moore are both interested parties and are in need of sewer.
Winston Moore has another direction he can go to get his sewer, but Flying J people
will have to pump their sewage to get rid of it. Both parties are willing to put
in the amount of money into this extension project that they would put into the
ground doing whatever else they would do to get rid of their sewage, so they would
contribute those funds. I estimate that there is about $300,000.00 worth of construction
costs. The Winston Moore property will need sewer by October 1st. The next thing
that we need to do is to enter into an agreement with an engineering firm to have the
plans prepared. In order to make the October 1st date we need to do something right
away.
Tolsma: What percentage would Arnold Machinery and Flying J have on the total cost?
Engineer Smith: I think it would be about 20~.

Police Chief Gordon: We have had a couple changes in the Department that I would
like to let you know about. We had a promotion to Sergeant, that is Bill Musser.
Also, the Detective now is Gary Cushman, Doug Weast is on Patrol now at his request.
We also have appointed a School Resource Officer for the High School which is Dwight
Hosford. That is all I have.
Jim Johnson: We have a workshop scheduled for tomorrow night to work on our Ordinances
and some changes.
Crookston: There is another continuation on the City of Meridian vs. Tamera Perkins case,
we will reconvene the 19th at 9:30 AM.:
Yerrington: My comment is about the Sanitary Service, on Feb. 19th which was Presidents
Day, Moe had 42 call backs for pickups, it seems as though not everybody takes Holidays
at the same time. A suggestion is that he discontinues services and complieswith City Hall
when they are closed as far as garbage pickups.
Giesler: In the past at the High School the Resource Officer has been contracted with
Ada County and alot of the incidents that happen out there end up going through our
Department so the Police Chief, the Mayor and myself visited a little bit and we would
like to get that back again and so we did go to the necessary people on the School Board
and they agreed for us to contract with them again for our own people to be the Resource
Officer out there again. We have had an agreement drawn up between the City and the
School District and I would like the Council's approval for the Mayor and Jack to sign
the agreement.

can sign this agreement with the School.

Clerk Niemann: We need to approve Resolution #132, this has to be approve before we qet
our Grant on the Downtown.
Tolsma: Declaration of Redevlopment Area meeting the Slum and Blight criteria of the
State of Idaho and of the Housing and Community Development Act of 1974, as amended.
The Motion was made by Giesler and seconded by Myers to approve Resolution #132.

Clerk Niemann: I just need to remind the Council Members that on March 14th at 9:15 A.M.
if possible you need to go with the Mayor up to the Department of Commerce.
Sam Fishel: 2 wanted to know why I wasn't on the Agenda. Clerk Niemann explained.

tQERIDIAN SCHOOL RESOURCE OFFICER AGREEMENT
THIS AGREEMENT, entered into by the City of Meridian,
a political subdivision of the State of Idaho, hereinafter
referred to as "the City of Meridian", and Joint School District
Number 2, Meridian, Idaho, hereinafter referred to as "the
District".
@7HEREAS, the District desires increased law
enforcement from the City of Meridian, through the Meridian
Police Department; and
WHEREAS, The City of Meridian and the Meridian Police
Department desire to provide increased law enforcement services
to the District, through the Meridian Police Department; and
WHEREAS, the parties recognize their mutual interest
can be furthered through the use of the School Resource Officer
Program of the Meridian Police Department;
NOW, THEREFORE, for and in consideration of the mutual
covenants and promises contained herein, the parties agree as
follocas:

District and the City of Meridian and shall not be interpreted
to benefit third parties. The relationship of the parties
hereto is that of contractor and independent contractor, and it
is expressly understood and agreed that each party and their
officers, agents, and employees do not ir< any way nor for any

purpose become a partner, agent, joint venturer, servant, or
employee of the other.
2. The City of Meridian, through the Meridian Police
Department, shall provide police protection for the District and
shall provide School Resource Officer services at designated
campuses, as specifically referenced in Paragraph 3 below,
including, but not limited to: investigating and preventing
crimes against persons or property; identifying and arresting
violators of state and local laws; filing investigative reports
and other required reports or documents; patrolling; and, to a
limited extent, maintaining building security, controlling
traffic, and enforcing traffic laws.
3. The Meridian Police Department shall place one (1)
School Resource Officer at Meridian High School and one (1)
School Resource Officer at Meridian Middle School, Meridian
Elementary School and Linder Elementary School, whose services
will be shared among these three schools.

determine how the officers performing the duties under this
Agreement will be deployed, and the manner in which the services
contemplated by this Agreement shall be provided. It is not
contemplated that the interiors of the building will be
patrolled by officers except as is necessary to investigate
crimes and apprehend criminal suspects.
5. The Meridian Police Chief and his officers shall have
the right to exercise due discretion in the performance of this

Agreement, including, but not limited to the type, nature,
extent, and result of any response or activity undertaken by the
Meridian Police Chief and his officers.
6. a. With the exception of paragraph 6(b) below, the
conduct of the Meridian Police Chief and his officers will be
governed by the Meridian Police Policy Manual (hereinafter
"Manual"). In the event that the District's procedures conflict
with the procedures set forth in the Manual, the provisions of
the Manual shall prevail. The Meridian Police Manual shall be
an integral part of this Agreement as if set forth fully herein.
b. Parental Notifications. Notwithstanding any
other provisions to the contrary, the following procedures shall
be used in all instances with regard to notification of a
student's parents about the interaction of police officers with
students:
i. When a police officer suspects a student of having
committed a crime, the officer shall notify the school principal
or designee of the fact that an interviec~~ with the student was
conducted no later than the end of the school day on which the
interview is conducted.

student, an officer determines that the student may have
committed a crime, the officer shall, after concluding the
interview and no later than the end of the school day, notify
the school principal or designee that an interview with the
student was conducted.

iii. In the event that a student is arrested by an
officer or if the officer finds it otherwise necessary to remove
the student from school, the officer shall immediately notify
the principal of the school or designee.
iv. Upon receiving notice of any of the above
circumstances from an officer, the principal or designee may,
if he/she deems it appropriate, make reasonable efforts to
contact the student's parent or guardian. If contact is made,
the principal may tell the parent or guardian of the student
that a police officer questioned the student or removed the
student from campus, as the case may be, and may further state
that additional information may be obtained by contacting the
Meridian Police Department or if another enforcement agency is
involved (and the principal is aware of this fact) he/she may
then give the parent or guardian this information.
v. If a student's parent or guardian contacts the
principal about interviews conducted by a police officer, the
principal may disclose any information received by the principal
from the police officer and may refer further questions to the
Meridian Police Department or the correct law enforcement agency
(if another law enforcement agency is involved and the principal
is aware of the fact).
Liability arising from any of the above actions shall be

governed by paragraphs 16 and 17 of this Agreement.
7. The City of Meridian shall use two (2) suitably
trained police officers in meeting its obligation herein, each

of whom will be physically present at one of the school campuses
referenced in Paragraph 3, in accordance with a schedule that
is mutually agreeable to the District and the Meridian Police
Department.
8. Meridian Police officers providing services and police
protection under the terms of this Agreement may occasionally
wear the uniform of the Meridian Police Department, but will
customarily be dressed in appropriate business attire.
9. The parties recognize that the District may from time

to time adopt policies, procedures, rules, .and regulations
affecting the conduct of persons present on the campuses
referenced in Paragraph 3. To the extent that violation of
those policies, procedures, rules, and regulations constitutes
a violation of law, including breach of the peace, or a threat
to public health or safety, those policies, procedures, rules,
and regulations will be enforced by the Meridian Police Chief
and his officers. To the extent that violation of those
policies, procedures, rules, and regulations does not constitute
a violation of the law, the Meridian Police Department is not
required to take law enforcement action and may leave the
enforcement thereof to the District. School Resource Officers
shall inform the principal, or his designee, of violations of
school policies, procedures, rules, or regulations of which
he/she has personal knowledge.
10. This Agreement is for a period, commencing on or about
August 27, 1990, and ending June 8, 1991. It is agreed under

the terms of this Agreement that the officers shall commence the
duties called for one week prior to the start of school in the
fall of 1990 and will complete the obligations one day after the
last day of school in June of 1991. At the present time the
dates set forth in this section are the anticipated starting and
ending dates.. However, each party to this agreement recognizes,
that as of this date, the start and end of the 1990-1991 school
year is tentative and may be changed, and if there are changes,
this Agreement will automatically be amended to reflect these
changes.
11. As consideration for the services provided by the City
of Meridian pursuant to the terms of this Agreement, the
District shall pay the total sum of $31,140.00 to the City of
Meridian in two installments. One-half shall be paid on January
30, 1991 and the balance on or before May 31, 1991.
12. The parties recognize that a school within the
District may desire to have the Meridian Police Department
provide additional security services for sanctioned school
events. .This agreement does not govern the provision of such
additional security services. Additional security services for
school events may be addressed in an addendum to this Agreement
or in a separate agreement at a later date.
13. The District agrees to provide officers with adequate
office space and suitable desks and chairs for the purposes of
this Agreement.

personnel acting pursuant to this Agreement are not the
employees or agents of the District or schools within the
District, but rather, they remain the employees of the City of
Meridian.
15. Law enforcement personnel acting pursuant to this
Agreement may be absent from their assigned campuses on holidays
observed by the District.
16. In the event the City of Meridian or any of its
officers, agents, employees, insurers, or indemnitors have any
claim, demand, suit, or judgment asserted against them which
arises from acts or omissions of the District, its officers,
agents, or employees, the District shall, at its expense, defend
and indemnify the City of Meridian, its officers, agents,
employees, insurers, and indemnitor, and hold them harmless in
the premises.
17. In the event District or any of its officers, agents,
employees, insurers, or indemnitors have any claim, demand,
suit, or judgment asserted against it which arises from acts or
omissions of the City of Meridian, its officers, agents, or
employees, the City of Meridian shall, at its expense, defend
and indemnify District, its officers, agents, employees,
insurers, and indemnitor, and hold them harmless in the
premises.
18. It is acknowledged by the parties that District
personnel acting pursuant to this Agreement are not the
employees or agents of the City of Meridian, but rather, they

remain the employees of the District.
19. This Agreement may be cancelled by either party for
non-conformance or poor performance on thirty (30) days written
notice. If the performance defect is corrected during the
thirty (30) day period by the party notified thereof, this
Agreement shall continue in full force and effect. In the event
of cancellation of this Agreement, and a failure by the notified
party to timely correct the defect in its performance, the
District shall pay to the City of Meridian the consideration set
out in Paragraph 11, prorated to reflect the number of school
days on which. services were actually performed by the City of
Meridian.
20. Dan Mabe, Assistant Superintendent, represents that
he is the Clerk of the District's Board of Trustees; that he has
the authority to execute this Agreement on behalf of the
District; and that he will promptly bring this Agreement before
said Board of Trustees for its ratification at a regularly
scheduled meeting.
21. This Agreement shall be interpreted in accordance with
the laws of Idaho.
22. This Agreement constitutes the entire agreement of the
parties and all other agreements, oral or written, are merged
herein.
23. This Agreement may be modified only by a mutually
executed writing.
24. The principal of each school shall, in writing,

provide the Meridian Police Chief with a designee to contact in
the event the School Resource Officer cannot contact the
principal when so required pursuant to this Agreement.

Declaration
criteria of the
Development Act
of Redevelopment Area meeting the __ ___
State of Idaho and of the Housing and Community
of 1974, ae amended.
The City of Meridian contains a definable geographic area
known commonly as the East First Street Corridor which extends from
Franklin Road on the South to Fairview Avenue on the North and
contains fronting properties on each side of Eset First Street.
The Eaet First Street Corridor contains a substantial amount
of deteriorated and dilapidated sidewalks, curbs, gutters and
asphalt roadway sections. About 55 percent of the corridor does
not have sidewalks and existing sidewalks are broken and cobbled.
Vehicle parking facilities are limited and substandard. The Eaet
First Street Corridor does not meet local, state, or federal
roadway safety standards and there are no useable handicapped
facilities in the corridor.
The East First Street Corridor is limiting the sound growth
of Meridian. The lack of safe pedestrian, handicapped, and traffic
facilities is both an economic and social liability to the
community. The condition of the East First Street Corridor is a
menace to public health and safety.
Consistent with the community's goals and objectives, as
expressed by the public at numerous public hearings, the City of
Meridian is applying far Idaho Community Development Block Grant
funds to remove the slum and blight conditions in the East First
Street Corridor.

On September 29 and 30, 1990, the Meridian Lions, Deward
Gill, and Ken Hamilton Presentations will present the first of
many rodeos to be held at the Meridian Speedway in Meridian, ID.
This will be an amateur show with an added purse, no slack time,
and lots of fun!!
We will be placing dirt on the track after the last race of
the season, leaving it on until spring, and again using the
grounds for the first rodeo action of the year in Idaho.
We will call the fall rodeo "The Meridian Lions Centennial
Rodeo" with "The Meridian Lions Spring-Fall Rodeos" to follow.
The purpose of this letter is to inform you of the upcoming
rodeo plus offer you several ways to become involved with us.
1. We offer you the opportunity to purchase a gate
at $250.00 for the fall rodeo or $400.00 for both.
2. We have one catch gate available for $500.00.
3. Fence advertising is available for $100.00.
4. We have added purse at $250.00.
5. You will also have the opportunity to place an ad
in the rodeo program.
The Meridian Lions offer these options to you as an on-going
event, twice a year, with your first right of refusal. Quite
frankly, you are getting in on the ground floor on a rodeo that
we anticipate will be one of the biggest events of the year.
