The terms of the approved development agreement (Inst. No. 103137116) will be met by City Council approval of agenda iteml5, the proposed development agreement amendment (MDA 08-001). 2) Agree 3) The 25-foot wide landscape buffer will be depicted on the face of the plat. 4) The landscape plans by The Land Group will be revised per the comments listed in item 4 of the staff report. 5 - 9) Agree General Reauirements The developer agrees with the general requirements contained in the staff report, with one exception. Inasmuch as all off-site improvements have been completed and sanitary sewer, water, and pressure irrigation have been stubbed to the parcel, we request that General Requirement 3 be modified to read "General Requirement 3 - A letter of credit or cash surety in the amount of 110% shall be required for all uncompleted ~ M ; '~~-'°~--~~-° ; ~ -~~'~°, -~ ~-' ~ ~~~~, sanitary sewer, water, etc., prior to signature on the final plat. All on-site improvements, including perimeter fencing, landscaping, amenities and on-site pressure irrigation shall be addressed through the Certi tcate of Zoning_Complianceprocws.
