ACRD negotiated and entered into the Agreement i!1 furtherance of its "Victory and Eagle inter~otion ProJoot' and in lieu of paying condemnation compensation (Agreement, Page 2). A material induosment forme to en#er into the Agreement was that ACRD agreed to allow faun specific access points to the Property from Victory and Eagle Roads, iilustrat~ed in Exhibit A of the Agreement_ ACtiD did not pay for nor acquire these 8ccess points; rather, the aCCeSS,!!e were reserved with the Property.
