Dear Mayor and City Council: Progress Report for the Merdian Sewer Project Design The design work as required for Step 2 work Funded by the Construc- tion Grants Program under the Rnvironmental Protection Agency and the Idaho Department of Health and Welfare is approximately 85% complete. The design work for interceptors funded by tho. I?conomic Development Administration (F.DA) is approximately 80% complete. T,ach element of the sewer project will he described in more detail in the following paragraphs. As you are aware 1977 Sewer Rehabilitation Project Specifications and Contract Documents 1-lave been submitted to and approved h7 the appropriate regulatory agencies. The bid opening for said project will he April 11, 1977. The Step 3 application for construction funding has been submitted and should be approved in the near future. The Phase Ti Into-rceptor puns and spec if.cati_ons, funded by the Construction Grants Program (I;YA), has been submitted to the regulatory agencies. Final approval of those documents should be within the next week. The Wastewater Treatment raclfCy design is approximately 80% complete to date. An estimated 80% of the specifications have been drafted. Most of the drawings have been completed and reviewed, and are in final drafting. The final design for submission to the regulatory agencies should he ready by the first week in May, 7.977. The Phase I Interceptor plans and specifications, funded by the FDA, have been submitted and approved by the appropriate regulatory agencies. The purpose of constructing these sewers at this time. is to be able. Co complete the sewer work before Cherry Lane and Pinc.Street road improvementsbegin next year. The bidopening for said project is April 11, 1977. The remaining interceptors design is approximately 75% complete. A1]_ field work, preliminary design, and most sewer lines have been drafted. Gentlemen: As of July 1, 1977, you City will have outstanding $2,325,000 Water and Sewer Revenue Bonds dated October 1, 1975 (principal payable serially, numerical order - annuaily, in varying amounts, October 1, 1977 through October 1, 2005). -The interest cost remaining on this issue from July 1, 1977, through the final maturity in 2005 amounts to $3,409,322.29, which is equivalent to a 7.598% net effective rate. The bond attorneys shall review the refunding proposal and prepare all required legal proceedings relative to the refunding; and after a review of all proceedings, executed legal proceedings, and support documents, shall issue their unqualified approving legal opinion as to both the legality and tax-exempt status of this issue; (C) work with a firm of certified public accountants to verify the sufficiency of the escrow. These verifications shall be confirmed by a report prior to delivery of the refunding issue; (D) update financial information relating to the City and its water and sewer systems, and prepare an application for bond rating to be forwarded to Moody's Investors Service; (E) furnish the printed bonds ready for signature; (F) establish at a commercial bank which is a member of the Federal Deposit Insurance Corporation and which has full trust powers, an irrevocable escrow account completely funded as stated above and matched to the full payment of principal and interest on the bonds to be refunded; (G) assist the City in the purchase of the escrow securities; and (N) assist the City in all technical closing procedures necessary for prompt delivery of the bonds. 2. You agree to grant us exclusive right to work with you to develop a mutually agreeable refunding program. It is anticipated that such refunding will be in the principal amount of $2,040,000 to $2,325,000. Bond provisions to include dated date, paying agent, and prior redemption features shall be established prior to the issuance of bonds. It is understood that such refunding shall only be completed once mutually agreeable rates, terms, and conditions have been reached between the City of Meridian (the Issuer) and Bosworth, Sullivan & Company, Inc. Dear b1ayor Storey: l`!e are aware of the time and effort the City of Pter°idian and its consultant, J-U-(3 Engineers, have spent in order to get minority involvement in the City's r~raster-rater treatment project. IJe understand that J-U-[3 Engineers has sub- contracted its design and construction engineering r-cork for the project's outfall sewer line to the minority consulting firm of Cooper and Associates for an additional $23,865 over and above the previously agreed fixed price. We were first informed of the City's plan for minority involvement in an informal conversation with J-IJ-B early in January. At that time and in subsequent conversations, we made it very clear to J-U-G, that although we fu11y support positive efforts to aet minority involvement, Ire could not and still can not participate in any additional costs associated t~rith that involvement r~rhen an acceptable fee has already been estahlished by contr°act. The only tray r~re can participate in extra costs is t~rhere the scope of work descrihed in the existing contract is increased or changed.
