Dear Mayor deWeerd and Council Members,
We will accept stag's proposed modification to our requested Paramount Development
Agreement with reservation and a statement of concern for the record:
• The requirement for this DA Amendment, to enable construction of achurch-already a
Principal Permitted Use in the L-O zone, has added unanticipated cost and processing time
to a planned unit development approved by conditional use permit {CUP-03-008).
StafFs proposed wording change simply confirms that the L-O Zoning District's Principaad
Permitted Uses such as a church-maybe "allowed" when, in fact, Permitted uses should
be a given.
The southerly portion of the L-O zoned parcel was approved by Conditional Use Pernut for
townhomes at a density of 12 units per acre. The proposed DA Amendment contained
language to affirm that "single-family attached" dwellings [townhomesJ would continue to
be a Principal Permitted Use. Staffproposes to strike that language, indicating that a zone
change will be required before the CUP-approved townhome use can be allowed. We
question that such was the intent of the Council's approval in 2003. It certainly was not the
Applicant's intent or expectation.

If the Council accepts staff s proposed modification of our request and concurs with stags
position that a zone change is required to develop the previously-approved townhomes-we ask
that the Council note for the record that development of townhomes, in accordance with the
CUP-03-008, will be subject only to subdivision platting.

Our response to the City's Site Specific Comments for this project is as follows:

1) The requirements of the Paramount annexation (AZ-03-006), preliminary plat (PP-03-004),
and conditional use permit (CUP-03-008) have been met. The terms of the approved
development agreement (Inst. No. 103137116) will be met by City Council approval of
agenda iteml5, the proposed development agreement amendment (NIDA 08-001).

3) The 25-foal wide landscape buffer will be depicted on the face of the plat.
4) The landscape plans by The Land Getup will be revised per the comments listed in item 4 of
the staffreport.

General Requirements
The developer agrees with the general requirements contained in the staffreport with one change
as follows:
"General Requdre-nent 3 - A letter of credit or cash surety in the amount of 110% shall be
required for all uncompleted fencing, landscaping, amenities, pressurized irrigation, sanitary
sewer, water, etc., prior to signature on the final plat or a non-build a8reement shall be
recorded to defer those actions until a buildingnermit is requested. "
