Storey Mayor, City of Meridian 728 t4eridian Street Meridian, Idaho 83642 RE: C-16 0183-01 City of Meridian Sewer Service Area Dear Mayor Storey: In response to a request from Councilman Dick Williams, we would like to state our position on the issue of whether development outside the Meridian sewage treatment plant's designated service area should be permitted to connect to the proposed system under the conditions of the City's EPA grant. During the planning stage of the project, the City of Meridian developed a sewer "service area" after being directed to study a larger overall "planning area" by the Idaho Department of health and Welfare. A description of both the planning and service areas is contained in the Facility Plan for the City of Meridian, 1976, prepared for the City by J -LT -B Engineers. The sewer service area was arrived at after considering existing needs, planned and potential development, environmental considerations, and compatibility with local planning. By adopting the Facility Plan, the City has essentially committed itself to serve only those areas within the designated service area. We would consider it in conflict with our grant agreement with the City if it were to serve other areas. This action could jeopardize present EPA grants to Meridian. In order to change the project's service area, a Facility Plan amendment would have to be'submitted to the Idaho Department of health and Welfare and to us. The amendment would have to be reviewed for environmental impact, compatibility with local planning, as well as all of our other Facility Planning requirements before we could approve it. 2 A Facility Plan amendment involving a significant change in service area could result in a re-evaluation of the entire project and necessitate preparing an Environmental Impact Statement. A minor shift in the service area, which would not result in a change in the treatment facility's capacity or design life, might be approved with a minimum amount of review. I am Kelly Everitt, member of the public and managing editor of the Malley News; I wish to notify the city council that the current city council procedure for the call of special meetings may be in violation of Idaho's open meeting law. There is apparently no policy or attempt being made by the council to provide consistent public notice of special meetings. It is our contention that despite the fact all special meetings are theoretically open to the public, as a practical Fn -atter they must �CIlf4'ZY be considered closed meetings and thus illegal, s+a" the public has no knowledge the meeting is taking place. The Idaho open meeting law (67-2343) is criminally vague in its definition of.what constitutes "notice as is appropriate to the circumstances." Nevertheless, the law clearly states that priorup blic notice shall be given. Our concerns that no notice at all was being provided were voiced to this council at its December, 1976 regular meeting. We requested the council adopt a policy at that time, but no action has been taken. Since then we have made several contacts with the Attorney General's office to determine what notice is sufficient to meet the language of the law. No formal opinion has been issued as I am not a public official However, in informal conversations with members of the Attorney General's staff we have been told that posting in a public place or publication of a notice at least 24 hours in advance of any special meeting would be the minimum requirements to satisfy the law. Verbal contact with members of the media or other interested individuals who may have a vested interest in actions the council 1 • • 2 intends to take will not satisfy the criteria. Limited mailing of notices also will not satisfy the criteria. Announcement of special meetings at regular meetings of the city council may constitute sufficient notice, provided minutes of the meeting detailing the announcement are posted in a conspicuous public place (the city hall bulletin board would probably be sufficient) at least 24 hours prior to the spe cial meeting. The old open meetings law provided for no penalties for failure to comply. However, the new law, which went into effect July 1. 1977, provides severe penalties. Besides voiding any action taken by the council at any special meeting where prior public notice is not provided, the council members themselves are open to removal from office by ruling of a cistrict court and fines up to $500 each. Since the consequences of the new law are so severe we believe it would be in the best interests of the council to adopt a formal policy outlining the methodology that will be used to provide public notice. Such a policy would at least provide you with a basis for defense in the case you are challenged in court as having held an illegal special meeting and would demonstrate to the courts that you have made good faith efforts to comply with the state law. It would be unfortunate if the Meridian council were to become the first test of the law -and lose.` We have three suggestions in this respect: 1) Post, at least 24 hours prior to any special meeting, a notice of the meeting and reason for its call ( in effect an agenda) on the city hall bulletin board or front door, as well as the front door of the public library. The size of the notice should be suffic- ient that it can be identified and read without an individual being forced to look specifically for it. 2) The council should pass a resolution calling for regular meetings to be held twice a month.(say on the 1st and 3rd or 2nd and 4th Mondays), or perhaps even every Monday. The current once - a -month meeting schedule is impractical for the conduct of city business at the city's present stage of growth. This should cut down on the number of special meetings that are required to be held. By reducing that number the council thus reduces the likelyhood it would violate state law and be subject to the attendant penalties. 3) Request a formal opinion from the Attorney General's office for an interpretation of 67-2343• The council may also wish to consider a fourth policy resolution designed to assist press-council-public relations. We recognize members of the public seldom attend council meetings. Often, their only awareness of what decisions were made and why is through the press. Noting that the Attorney General's office has informally opinioned that notification of the media does not constitute public notice, we nevertheless ask that the council direct the city clerk to provide the same notice to representatives of the media which have evidenced a desire to report on council actions on a regular basis, as the council members themselves would receive. We ask that any council policy adopted concerning the methodology for complying with the public notice requirements of the open meeting law be addressed to the spirit of the law, rather than merely con- forming to the letter of the law. At present, the council's attempt at providing public notice ap- pear to address only the letter of the law, and it is stretching the law to the breaking point, if in fact it has not already done so. I quote from the Idaho Open Meetings Law (67-2343), "The people of the state of Idaho in creating the instruments of government that serve them, do not yield their sovereignty to the agencies so created. Therefore the legislature finds and declares that it is the policy of this state that the formation of public policy is public business and shall not be conducted in secret."
