The subject ftem is on the May 27'" City Counal agenda as a P&Z Department staff
report. ACHD is soliciting the city's comment on a request they received from
Fannrest, LLC for release of approximately $33,000 that ACHD is holding in their
RightsaF-Way Trust Fund acxount for two pedestrian bridges across the
Ridenbaugh Canal ($16,500 per bridge) (See attached letter, dated January 29,
2003, from Shelly Reynolds, ACHD)
Both the City of Meridian and ACHD required two pedestrian bridges be constructed
across the Ridenbaugh Canal as part of Thousand Springs Subd'nnsion preliminary
plat. (See attached sections from Meridian and ACHD staff reports.) One of the
bridges was to connect to the north, through Phase No. 1 (into EI Dorado Sub), and
the other bridge was to connect to the west, through Phase No. 5 (into Sherbrooke
Hollows Sub No. 2). However, the Nampa Meridian Irrigation District {NMID) has
since told the Thousand Springs developer (Marty Goldsmith) they are "reluctant to
entertain the idea" of the pedestrian bridges. (See attached letter, dated May 04,
2002, from John Anderson, NMID.) Mr. Anderson also told ACRD that since the
pedestrian bridge is only 1,000 feet from an existing vehicular bridge, they consider
a pedestrian crossing unnecessary. While it was not a City of Meridian condition of
approval, ACHD did require the developer of Sherbrooke Hollows (Greg Johnson) to
deposit money ($15,000) for the other half of the southerly bridge.
During the City of Meridian public hearing for Thousand Springs preliminary plat,
Becky Bowcutt testiFied that NMID would not agree to the pedestrian bridges until
the City of Meridian discussed liability of the crossings (see attached minutes). To
staffs knowledge, the cityy has not initiated conversation on these specfic bridges.
We have entered into a Master Pathway Agreement with NMID, but this occurred
long after Thousand Spring's preliminary plat was approved.
According to ACHD staff, one pedestrian bridge would cost upwards of $80,000.
Since neither the City nor ACHD required W.H. Moore Co. to construct the other halF
of the north pedestrian bridge, ACRD is obligated to return the $16,500 it is holding
for that bridge. So, that leaves a balance of $31,500 for the south bridge -less than
half the required amount. In addition, no public access or easement was ever
granted through either Thousand Springs or Sherbrooke Hollows for the use or
construction of the facility.
Staff offers the following options for the City Council's consideration:
A. Instruct staff to meet with the Thousand Springs and Sherbrooke Hollow
homeowner associations before making a decision in order to solicit their
input on the necessity and desirability of the pedestrian bridges. ff the
homeowners are opposed to the crossing, this may better inform the
Council's decisioNrecommendation to ACRD.
B. Inform ACHD that the City does not agree with the release of the trust fund
deposits and, subsequently, instruct staff to meet with NMID on options for
constructing the bridge.
C. Infonn ACHD that the City agrees with the release of the deposits. In this
instance, it may be necessary for Condition #10 of the Thousand Springs
preliminary plat findings tb be amended, unless Mr. Nichols believes the
condition can remain since its enforcement relies on ACHD's decision.
(Since the City did not require Sherbrooke Hollows to consWct half the
bridge, no amendment is necessary to those findings.)

Dear Mr. Hawkins-Clark,
Three subdivisions in Meridian, Thousand Springs Subdivision No.l and No. 5 and Sherbrooke Hollows
Subdivision No.2 have deposited money into the Public Rights-of--Way Trust Fund account for pedestrian
bridges to cross the Ridenbaugh Canal. Thousand Springs developer Farwest, LLC. has submitted a formal
request that their road trust fund deposits be returned after speaking with Water Superintendent for Nampa &
Meridian Irrigation District (NNIID) John Anderson. The NMID states in the attached letter that the NMID
will not allow a pedestrian bridge to be constructed in the canal right-of--way due to it's interference with
operation and maintenance, along with unsafe recreational use by children. Before releasing these road trust
deposits back to the developer the AHCD Commissioners have requested staff to get comments from
Meridian City on this matter.
Any comments your staff or City Council members may have on this matter in response to the Commissioners
request would be greatly appreciated.

constructing a pedestrian bridge between Lot 33 and 34, Block 1 of Thousand Springs
Subdivision over the Ridenbaugh Canal to the north.

constructing a pedestrian bridge on Lot 46, Block 17 of Thousand Springs Subdivision over
the Ridenbaugh Canal to the southwest.

12. Green Canyon Drive shall be classified as a residential collector from Eagle Road to,

15. Construct a street connection to an existing stub in Los Alamitos Subdivision No. 3.
Construct a vehicular bridge across the Ridenbaugh Canal to connect with the stub from Los
Alamitos Subdivision No. 3.
16. Construct a stub street with a temporary turnaround at the southern terminus of Molly's Way.
Construct a paved temporary turnaround at the south end of the stub with a temporary
easement grovided to the District. Coordinate the design and location of the turnaround with
District staff.
17. Construct turnarounds at the terminus of Indian Creek Place, Boiling Springs, the north and
south terminus of Hood Ranch Place. District policy requires the applicant to construct the
cul-de-sacs with a minimum radius of 45-feet to back-of-curb.
18. Construct a traffic island in the knuckle to define the roadway at the knuckle on the east side
of Pistol Creek Way located approximately 350-feet south of Phifer Drive. The traffic island
shall be constructed a minimum of 4-feet wide with a minimum area of 100-square feet and
the street section around the traffic islands should be a minimum of 21-feet back-to-back.
The design shall be reviewed and approved by the ACHD Planning and Development staff.
19. Construct Weir Creek Avenue in alignment with the knuckle on the north side of Green
Canyon Drive and narrow the knuckle to a maximum width of 41-feet (as measured from
back of curb to back of curb). Coordinate the design of the knuckle with District staff.
20. Construct a 24 to 30-foot wide shared driveway on Eagle Road for Lots 1 and 2, Block 1 of
Thousand Springs on the shared property line of said lots. Pave the driveway its full required

This lever is in response to ywtr lever dated April 30, 2002 regarding Ure proposed Thousutd Springs
pedestrian bridges. The Nantpa & Meridian ]rrigation District will allow bridges throngltout the system
providing they meet certain criteria In this case, when the District was approached on the proposed
bridges at Thousattd Springs they were located wiUrin 100 to 200 feet of a road crossing, therefore the need
for a bridge does not appear to be necessary especially when Ute bridges would open into the cvtal
roadways.
Bridges Utat open onto the canal riglnwf--ways can create problems with Ure Districts operation and
maintenance and also prevent tts from performing maintenance successfiUly under the bridged areas. The
complaints typically start because of childrett playing on the bridges and jumping from Urem. Therefore vve
are reluMant to approve Utese bridges unless there is no other way For people to cross the canal system.
I don't know if the District was fonnaUy approached wiUt blueprints but we have had discnssiorts and
already I><~d several neighbors within the area complain regarding the proposed bridge crossings. Tltey do
not want to see the bridges put in place attd Uterefore the District is reluctant to entertain this idea.
