(208) 325-8755 Pursuant to JUB's letter of November 22, 1977 to the Mayor, we have prepared the following discussion in response to their list of comments: 1. The name of Leisman Street has been changed to "West State Street". 2. A survey tie has been made to the C 1/4 corner and is shown on the Plat. 3. The distance of 660 feet shown on the plat is all the property Mr. Leisman has ownership of. Ne is presently considering acquisition of the remaining property in question however since it must be decided by a party other than his seller, it will probably take some time to accomplish. We agree that the distance shown does not agree with that shown on the plat of Phillip Addition, and we further agree with the closing distance that would fit the Phillip Addition Plat. Our basis of bearing was the bearings JUB established on the Phillip Addition Plat. 4, lie have never been requested to show the features of an adjacent subdivision before. The legality of such a request is somewhat in question because the.state subdivision law requires the engineer of record certify that the land shot -in was indeed surveyed by him. In this case, we could not certify as to the property lines within Phillip Addition and it should not be our responsibility to reestablish the property pins in order to do so. It is our understanding the city council did in fact grant a variance for the non -continuation of blest 15th Avenue. If this is not the case, we respectfully request such a variance. . • • Page 2 December 5, 1977 5. In addition to all easements being detailed on the plat, the note was added as requested. 6. No action required. 7. It was our understanding that the city council did grant a variance for the lot arrangement during the approval process. of the subdivision design. Again, if this is not the case, we respectfully request such a variance. 8. The lot numbering system has been revised to reflect block numbers as requested. 9. Street intersection monuments have been set as requested. 10. The street distances along West State Street formerly (Leisman Street) are shown. 11. The Nampa -Meridian Irrigation District has agreed orally that a 20 foot easement for the Nine Mile Drain will be adequate. They have also indicated a letter to that effect is forth- coming. 12. We are presently working with the appropriate agencies in connection with the changes to Nine Mile Drain. Enclosed is correspondence substantiating our claim. 13. The development plans are being submitted to the appropriate agencies. In so far as the various utilities cannot be constructed until approved, we respectfully request the approval of the plat prior to the approval of final utility plans. 14. The bearing of West Pine Street is shown on the plat. In so far as the Ada County Highway District recently acquired 30 foot right-of-way, it is assumed that agency finds 30 feet adequate. An additional 10 feet will probably encroach upon the structures already erected on the property. C. The proposal was submitted to them by your firm in connection the Leisman Addition Subdivision. In order for us to proceed with granting permission to relocate and the the drain we will need a centerline description of drain as it is to be relocated. We will also require a reservation of a right- of-way sufficient in width for future operation, maintenance and repair of the drain. While the United States presently holds right- of-way for the waterway under the Act of August 30, 1890, (26 stat. 391) it would be much better for all concerned if the right-of-way is defined and recorded in the county records. Cox City Clerk Dear Dick: This will acknowledge receipt ofa copy of your letter to the City of Meridian dated October 24th, concerning the above referenced matter. Besides the practical aspects which have been dis- cussed prior to this time, that being should the City of Meridian decide to pay the withheld money over to creditors, we don't know who all those creditors are. The bond with Safeco Insurance Company would be of no value to us if we in any way assume the responsibility or attempt to pay creditors. Further, at this time the most compelling reason for withholding the money is that the engineers have not given your client final approval on the project and they are therefore, under the terms of the contract, not entitled to the money. I It appears to me that the satisfactory way to resolve this matter.is to file an interpleader action which the City will be more than happy to do when final approval has been received from the engineers. A number of months ago we requested that the balance of the contract be paid to Idaho Construction Company so that we could pay our subcontractors. This was refused by the City of Meridian. We then requested thatthe City of Meridian pay whatever sums are due and owing to us directly to the creditors and give whatever the balance is to my client, Idaho Construction Company. This request was similarly denied.,. I feel that your failure to either pay us or pay the creditors directly the money which is due and owing to us under this contract is absolutely ridiculous. We have put up a bond through Safeco Insurance Company to cover any unpaid subcontractors. We have successfully completed the project, but still we cannot get our money, either directly or indirectly by paying on our behalf. Please be advised that 7f these sums are not paid within five (5) days of the date of this letter, we intend to institute whatever cross-claim or independent suit is necessary to collect these monies.
