Dear Ms. Canning:
This letter is provided in support ofthe following applications:
Paramount Church Subdivision Final Plat
Paramount Church Subdivision creates a parcel in the L-O Zoning District, located at the
southwest corner of the W. Producer Drive and Meridian Road intersection, for construction
of a second church in Paramount. The site was originally preliminary-platted as Lot 2, Block
40, in 2003, on property designated "Village Center Office/Retail " by the project's concept
plan with the Limited Office zoning designation.
The final plat conforms to the approved preliminary plat (PP-3-004) and becomes the first
proposal for development of the Village Center area which was approved for a wide range of
uses anticipated, but not specified, by the project plan (CUP03-008).
Inasmuch as the use was not specified in the CU approval, the attached Paramount L-O
Conceptual Site Plan is provided to assist the City in its evaluation of not only the proposed
church, but also to demonstrate how the remainder of the L-O property may develop in the
future. The companion application, to amend the project's Development Agreement, will
add clarity to the development of the L-O parcel in the future by specifying uses that would
be allowed, subject to detailed site planning, design review (as applicable), and subdivision
platting.
Access to the site will be provided from the north by the already-completed Producer Drive,
from the east by a new full access to Meridian Road, and, eventually, from the west when
North Peppard Ave. is extended as part of a future phase of Paramount Subdivision to serve
lots west of the proposed church.
We are confident that the Paramount Church Subdivision, supported by the companion
application, conforms to the approved preliminary plat and to the approved conditional use

permit; that it conforms to the requirements of the Meridian UDC; and that it is in
conformance with the City's engineering, architectural and surveying standards.
Paramount Subdivision Development Agreement Amendment
Even though a church is a `principal permitted "use in the L-O Zone, it was a use not
specifically identified in the parcel's Village Center designation in CUP03-008. Therefore,
a companion application, with the attached Paramount L-O Conceptual Site Plan is being
submitted to amend Section 4 of the Paramount Development Agreement (dated July 15,
2003, and recorded as Instrument No. 103137116).
A proposed new Subsection 4.3 establishes the basis for approving not only the proposed
church, but also other specified uses currently designated in the City's UDC as `permitted "
or "conditional ". The amendment will enable approval of those specified uses, subject to
detailed site plan, design review (where applicable), and subdivision submittals.
In Conclusion, we trust that the development agreement amendment application will be
processed concurrently with the related Paramount Church Subdivision. If you have questions

FIRST AMENDMENT TO
DEVELOPMENT AGREEMENT
THIS FIRST AMENDMENT TO DEVELOPMENT AGREEMENT is dated the
day of , 2008 ("Amendment"), by and between the CITY OF
MERIDIAN, a municipal corporation of the State of Idaho ("City") and PARAMOUNT
LLC, an Idaho limited liability company, and PARAMOUNT DEVELOPMENT, INC.,
an Idaho corporation (collectively "Owner/Developer"), whose address is c/o Brighton
Corporation, at the address stated above.
RECITALS
A. The City and certain property owners entered into that certain
Development Agreement dated July 15, 2003, recorded as Instrument No. 103137116 on
August 14, 2003, in the records of Ada County, Idaho ("Agreement") regarding certain
real property located in Ada County, Idaho, as such real property is more particularly
described in the Agreement ("Property"). Owner/Developer is the successor in interest to
the "Owners" named in the Agreement as owners of the Property.
B. The City and Owner/Developer desire to amend the Agreement to clarify
the permitted uses of that portion of the Property identified in the original Paramount
Subdivision preliminary plat as Lots 2 and 3, Block 40, and zoned L-O, Limited Office
District, based on the terms and conditions contained herein.
AGREEMENT
NOW THEREFORE, for valuable consideration, including the recitals above
which are hereby incorporated below, the parties agree as follows:
1. Permitted Uses. Section 4 of the Agreement is hereby amended to include a new
Subsection 4.3 which shall read as follows:
"4.3 USES PERMITTED IN L-O ZONED PARCELS BY THIS AGREEMENT: The
uses allowed pursuant to this Agreement are those uses allowed as principal permitted in
the L-O District, specifically: Church or place of religious worship, day care center
educational institution, financial institution health care or social services, parks, public

and private, personal or professional service, public or quasi-public use• and those L-O
District conditional uses, and other specified uses, which shall be "permitted" as a result
of this Agreement, including, but not limited to: Arts entertainment or recreation facility
(indoors)., civic, social or fraternal organization multi-family development nursing or
residential care facility. restaurant (sit-down with no drive-up window, and single-family
attached or detached dwellings. All uses noted herein shall be "permitted" subject on1X
to detailed site planning, design review, as applicable and subdivision submittals in
accordance with the Paramount L-O Conceptual Site Plan dated June 16 2008, on file
with the City Planning Department and attached hereto as Exhibit A. Other uses not
specified herein, but identified as conditional uses in the L-O zoning district shall be
considered in accordance with the requirements of the City's Unified Development Code
codified at Meridian City Code Title 11, as such uses may be amended or re-defined
from time to time."
2. Miscellaneous. Any capitalized term not defined in this Amendment shall have the
same meaning as in the Agreement. Except as modified in this Amendment, the
Agreement remains in full force and effect. In the event of any conflict between the
Amendment and this Agreement, this Amendment shall control.

Paramount Development Inc., to discuss the proposed amendment of Section 4 of the
Paramount Development Agreement to specify uses for the 15-acre L-O zoned property
at the southwest corner of Producer Drive and Meridian Road (vicinity map on back).
The proposed new Subsection 4.3 will read as follows:

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
