AN ORDINANCE OF THE CITY OF MERH)IAN AMENDING AND CHANGING THE ZONING OF CERTAIN REAL PROPERTY IN THE CITY OF MERIDIAN WHICH IS GENERALLY DESCRIBED AS A PORTION OF THE SOUTHEAST CORNER OF SECTION 1, TOWNSHIP 3 NORTH, RANGE 1 WEST, AND ALSO KNOWN AS 236 WEST CHERRY LANE, BOISE MERIDIAN, ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council and the Mayor of the City of Meridian, Idaho, have concluded that it is in the best interest of said City to amend and change the zoning from R-4 Residential to LO Limited Office, for the following described pazcel in Section 1 below: NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Meridian, Ada County, Idaho: Section 1: That the aforementioned real property which is described as follows: PARCEL A A tract of land situated in the Southeast Quarter of the Southeast Quarter of Section 1, Township 3 North, Range 1 West, Boise Meridian, Ada County, Idaho, more particularly described as follow: THURGOOD REZONE ORDINANCE BEGINNING at the Northwest corner of the Southeast Quarter of the Southeast Quarter of Section 1, a Yz" diameter iron bar; thence South 89 degrees 52' East 328.84 feet to a''/z" diameter X 24" long iron bar; thence South O degrees 34' East 1,074.55 feet, the TRUE POINT OF BEGINNING; thence South O degrees 34' East 225 feet to a point, a 1" diameter iron pipe on the North right-of--way line of Cherry Lane; thence South 89 degrees 58' East along said right-of--way line, 72.50 feet to a point; thence North 0 degrees 33' East 225 feet to a point; thence North 89 degrees 58' West 76.90 feet to the TRUE POINT OF BEGINNING. PARCEL B A non-exclusive easement for the purposes of egress and ingress over that certain strip of land described as follows: BEGINNING at the Northwest corner of the Southeast Quarter of the Southeast Quarter of Section 1, Township 3 North, Range 1 West, Ada County, Idaho. South 89 degrees 52' East 328.84 feet to a'h" diameter X 24" long iron bar; thence South 0 degrees 34' East 1,074.55 feet; thence South 89 degrees 58' East 76.90 feet to a point which is the TRUE POINT OF BEGINNING; thence continuing on the same course 50 feet to a point; thence South 0 degrees 33' West 225 feet to a point; thence North 89 degrees 58' West 50 feet to a point; thence North 0 degrees 33' East 225 feet to the POINT OF BEGINNING. be, and the same is rezoned from R-4 Residential to LO Limited Office, and Section 11- 2-425, Official Zoning Maps is hereby amended to reflect the same. This rezoning is subject to the conditions referenced in the Findings of Fact and Conclusions of Law as adopted by the Meridian City Council on the request for rezone. Section 2: That if the Applicant shall fail to meet the above conditions the property shall be subject to rezone back to R-4. TH[JRGOOD REZONE ORDINANCE Section 3. EFFECTIVE DATE. There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after its passage and approval as required by law.
