SiJMMARY AND ANALYSIS OF APPLICANT'S REQLTEST The applicant, Maverik, Inc., has applied for a final plat modification to amend the landsca~e plan approved with the final plat for Woodland Springs Subdivision No. 1. The previously approved landscape plan contains a substantial amount of mitigation for existing trees that were removed from the site for development of this property (213 caliper inches for the entire Woodland Springs Subdivision). All of the mitigation trees for phase 1 were previously approved within the street buffers along Locust Grove and McMillan Roads. With this application, the applicant is proposing to relocate a large portion of those trees from the landscape street buffers to within the Maverik site (Lot 1). The applicant's narrative states that when the final plat landscape plan was submitted to the City, the lot on the corner had not been purchased and its use was unknown. The street buffer landscaping approved for that lot creates a wall of trees that would restrict visibility to that property. For this reason, a modification is requested to relocate some of the trees internally on the site but still provide the amount required per the mitigation plan. Staff has discussed the revisions proposed to the landscape plan with Elroy Huff, City Arborist, and he is supportive of the applicant's request to relocate a large portion of the trees within the site as shown on the revised landscape plan. The Unified Development Code (iJDC) (11-3B-7C.3) requires a minimum density of one tree per 35 linear feet along Locust Grove and McMillan Roads. The trees proposed within the street buffer along McMillan Road comply with this requirement. However, the trees proposed within the street buffer along Locust Grove Road do not comply with the aforementioned minimum density requirement. To comply with UDC requirernents, the applicant shall install one additional tree within the street buffer along Locust Grove Road as a cond'ition of approval of the subject MFP request. Staff is supportive of the applicant's request to modify the approved landscape plan with the aforementioned change. Staff believes the proposed landscape plan complies with the intent of the mitigation plan approved with the final plat landscape plan. Woodland Springs Subdivision No. 1 is located on the northeast corner of E. MeMillan Road and N. Locust Grove Road, in the southwest '/a of Section 29, T. 4N., R. lE._ The City Council approved the final plat on April 1, 2008. The final plat consisted of 3 commercial building lots and 3 other/common lots on 4.52 acres of land in the C-N zoning district. 2. SUIVIMARY RECOMMENDATION Staff recommends that the City Council approve the applicant's request to modify the approved landscape plan for Woodland Springs Subdivision No. 1(MFP-08-004) with the conditions noted below, per the revised landscape plan attached as Exhibit A.3 of this staff report. By reason of the provisions of the Meridian City Code Title 11, Chapter 5, the City Council is the decision rnaking body on this matter. Description of Character of Surrounding Area: The area surrounding this site consists mainly of existing and future single-family residential properties. c. Adjacent Land ilse and Zoning 1. North: Rural residential property; zoned RUT (Ada County). 2. East: Rural residential property (future Portico Subdivision - approved for 26 single-family residential building lots); zoned R-8. 3. South: Idaho Power substation; zoned R-8. 4. West: Existing/future residences in Tustin Subdivision, zoned R-4; and existing rural residential property, zoned 'RUT (Ada County). 6. CONDITIONS OF APPROVAL a. Provide one additional tree (for a total of 10 trees) within the street buffer along N. Locust Grove Road, in accordance with the one tree per 35 linear feet standard listed in UDC 11-3B-7C.3. b.
