Request by Western Ada Recreation District APPROVED Variance to Construct Metal Building Meridian Council Nov. 21,1983 Item 1 Item 2 Regular meeting of the Meridian City Council was called to order by Mayor Joe Glaisyer at 7:33 p.m. Council Members Present: Grant Kingsford; Ron Tolsma; Bill Brewer; Council Members Absent: Rick Orton Jr.; Others Present: Earl Ward; Vern Schoen; Bruce Stuart; Kenny Bowers; R.C. Spencer; Norman Fuller; Bruce Winchester; Wes Cole; Betsy Dunklin; Harriet Guttertz; Larke Gillett; Terry Smith; Gordon Leishman; Glen Scott; Alan Lance; Gordon Harris; Craig Morrison; Doug Ewing; Curtis Patterson; Don Hubble; Gary Smith; Wayne Crookston; Jack Niemann; Minutes of the previous meeting held November 7, 1983 were approved as written. Request by Fair Share to Canvas & Solicit Membership Betsy Dunklin was present representing Idaho Fair Share. Dunklin explained that Fair Share is a non profit private organization that offers the citizenery to provide a voice on political and economical issues. Dunklin told the Council that the current membership is about 1400 family memberships mostly in the Ada County area. Dunklin said that Fair Share is registered with Boise City, Ada County and with the Better Business Bureau in both areas. "There has been lots of interest in the Meridian area", Dunklin said, which is why Fair Share wishes to continue its canvass of the area. Councilman Bill Brewer said that the organization had been checked out and looked into by the Police Department. City Attorney Wayne Crookston reported to the Council that he had researched material concerning this type of canvassing. Crookston said that the City Ordinances deal more specificaly-.with a commercial nature and felt the Ordinance does not apply to what the Fair Share people are doing. Crookston also told the Council that in researching he felt there was a sufficienct amount of 1st amendment free speech rights that probably our ordinances conflict with those rights. Crookston said that the City should probable allow Fair Share to distribute their information. It was decided that no Council action need be taken, but the Council gave Fair Share a verbal "go ahead". PUBLIC HEARING: Zoning & Development Ordinance The Public Hearing was opened by Mayor Glaisyer. Glaisyer also informed the Public that after the Hearing the Council will be accepting written testimony for the next 10 days. Mr. Norman Fuller, 1103 W. Camellia, Meridian cited several items that he felt need "serious attention." Fuller said that he is most concerned with the lot area requirements as listed on page 52. Fuller said that he feels the costs and demands of housing is alot different than when the Zoning & Development Ordinances were first started. Fuller stated that the minimun frontage requirements defeat the purpose and said he feels "there are other ways to do it." Fuller told the Council that with the minimum lot requirements as they stand now the City is "pricing people right out." Fuller also expressed concern over the PUD area minimum of 10 acres. Fuller said this will cause quite a few parcels around the City to be left because of an odd shape etc. Fuller cited 9-607 F, and 9-607 G7,as special concerns. He said that it will be tough to leave 10~ open space in a PUD. Fuller said this was "not practical'and "serves no purpose." (Material located on Pg. 28 - 32) Referi:ng back to the minimum lot sizes as listed on Pg. 52, Fuller said that he feels a minimum of 320 acres for a TE is "too much land." Fuller expressed to the Council that he would like to see the Chamber have some time to go over the changes and give input on the proposed Ordinance. Meridian City Council 2. Nov. 21, 1983 Item #2 Cont'd . Alan Lance, 1339 Chateau, Meridian came before the Council. Lance said that his purpose was to request that the Council table final approval of the Ordinances as proposed. Lance expressed his concern.by saying:"I think that it is premature at this point in time to approve the Ordinance that are to impliment the Comprehensive Plan that we have yet to finally negotiate with }~da County, and have tentatively approved by Ada County. I appreciate the fact that Ada County will not utilimately and finally approve the Comprehensive Plan until such time as we have Ordinances; however, I believe that a tentative commitment could be received from Ada County." Lance asked the Council that the citizen be give more time to examine and digest all the material. Lance also expressed concern over the map designations as listed on pg. 94. Lance said that he felt the Ada County designations should be incorporated in our Ordinances so that there is no confusion on our maps even though the area may be outside the City limits of the City of Meridian. 2n closing, Lance again asked the Council that final approval and passage of the Ordinances be delayed, and that they table final vote on the Ordinances as presented. Mr. Doug Ewing, 3787 Farlight Place, Meridian echoed Mr. Fuller's comments and concerns. Ealing also requested that action be delayed until more input could be collected. Ewing expressed confusion over wording in 2-411D, Residential Housing Standards, regarding minimun house sizes. (Pg. 13-14 of change sheet) There was discussion. (Tape on File - City Clerk's Office - Meridian City Hall) Ewing told the Council that he would also like to see more input on the Ordinances, and felt that "maybe these should be reviewed a little closer." Curt Patterson, Wright-Patterson Realty, 4082 Rushmore Way, Boise. Patterson told the Council that he felt the Ordinance as written show that the citizens "still have some very hard questions." Patterson said that he is also concerned over the square footage requirements. Patterson said that he is concerned that a 1,000 square foot home will be allowed to go in next to a 3000 square foot home. Councilman Kingsford explained that any development can go over the minimum requirement it is up to the developer to decided what type of development he wishes to go in, and then set those standards. Patterson expressed that the wording of this section was very confusing. Mayor Glaisyer said that the wording may have to be changed as there seems to be a problem in the interpretation of this section. Councilman Brewer explained that it has never been the intent of the Council to restrict a high cost housing development. Brewer reminded all present that the minimums were set when the developers demanded that they be lowered to cut housing costs. This was done,Brewer said "to keep that part of the community alive." Glaisyer quetioned the time frame that the Chamber would like to have to go through the material and to comment. Terry Smith, Future President of the Chamber, told the Council that he would like to set in motion a task force to study the information to help better understand and communicate with the Council. The Motion was made by Kingsford and seconded by Tolsma to table action on the Zoning & Development Ordinances, City of Meridian, that Council will accept written testimony until January 16, 1983, at which time the hearing will be re-published for action. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Item 3 Department Reports Councilmember Ron Tolsma brought fourth a request by Kenneth Crawford, Chairman, Western Ada Recreation District, for a variance to build an aluminum building for storage purposes at Fuller Park. Tolsma explained that this will be for the storage of park equipment, such as mowers, tractor and a golf cart. There will be no water to the building, and there will be 110 volt power only for lights. Tolsma said Crawford would like action on the request as soon as possible, as - he would like to proceed before the weather gets to cold. Building Inspector Vernon Schoen said that this will require a variance from the building code, and that he had no objections. The Motion was made by Kingsford and seconded by Tolsma to approve of the variance by Kenneth Crawford, Chairman, Western Ada Recreation District, to construct an aluminum building for storage purposes at Fuller Park.
