Beumeler, J.J. Howard, Wilma Blair, Gary Smith, Bill Gordon, Wayne Skiver, Moe Alidjani, Paul Stutzman, John Navarro, Peter Covino, Colleen LeMay, Howard Jenkins, Clint Shuler, Wayne Crookston: The Motion was made by Tolsma and seconded by Giesler to approve the minutes of the previous meeting held November 21, 1989 as written: Motion Carried: All Yea: ITEM#1: PUBLIC HEARING: PRELIMINARY PLAT ON CLEARMONT FAIR SUBDIVISION: Mayor Kingsford opened the Fublic Hearing and asked for public testimony, please come forward and be sworn. John Navarro, 1200 W. Pine, was sworn by the Attorney. Navarro: i have a couple of questions I would like to ask. There comes a possibility of encrochment, the engineer had surveys taken 6 feet over onto my property. Also wanted to know whether the developer is going to put in pressurized irrigation and whether the ditch along Pine Street will be tiled. Jim Howard from J.J. Howard Engineering, was sworn by the Attorney. Howard: I am here representing Mr. Jenkins. Mr. Navarro owns the ground to the west and there is a fence line in there approximately 62 foot, we set the fence based on a section break down, the fence fell 6Z feet west of his fence line, and to the north it would be in the northwest corner of our subdivision about 3. This subdivision plat reflects the adjustment. To answer the second question about tiling the ditch that runs parallel with Pine, do you have a Ordinance stating that all ditches be covered? Kingsford: No, not as this time. Howard: In the past he has tiled them, but I am not going to respond to that question. Kingsford:I have a question for you about the pin placement, when you addressed the pin placements you said that the pin placement was 6 feet west. Howard: Six feet west of the existing pins which falls on the ground of Mr. Navarro. We will pull those pins back to line up with that fence so we don't have a dispute. Tolsma: You said that the irrigation ditch was on the south side of the property. Howard: It is on the south line, our property fronts Pine and there is an open irrigation ditch that will have to be continued, and I image that Howard will elect to the that. Kingsford: The other question that Mr. Navarro had was with regard to pressure irrigation system and of course the Council has adopted a measure now that irrigation systems wil MERIDIAN CITY COUNCIL DECEMBER 5, 1989 PAGE #2 be low head irrigation systems in the subdivisions. Have you made any provision for that. Howard: Mr. Jenkins will respond to that. We are in fact going to take the storm water thats generated in this subdivision, we are going to have a dropin on both sides of the street, the subdivision will drain, all storm water will drain directly .south out to Pine. Tolsma: There is also a irrigation ditch on the north side of the property, will that be tiled also. Howard: Yes. Kingsford: Is it your opinion that tiling that would remedy that situation. I heard some concern that it didn't have the capacity on down the ditch to handle that. Howard: The pipe on Pine is 12" and on the north boundary of our property the ditch that he was speaking to is also 12", but I'll recommend to Howard that we go with 15" and that we use plastic pipe. Howard Jenkins, Pearl Route, Eagle, Idaho, was sworn by the attorney. Jenkins: Will be willing to resolve the conflict of boundaries. Will the ditch along Pine as well as ditch on north boundary. We're not bound to pressurized irrigation? Kingsford: Yes, I don't know how it's timing was in relationship to your filing, but not being a preliminary plat approved I would assume without legal advice that it would be in effect. Jenkins: We have provided this for other areas and it has not been adequate. We will try to drill a well and pressurize it. Howard: There will be a change in the plat, we would like to take this lot 4 and take that with the east line as before and project that straight forward. We create another lot and the purpose behind that is we have the option as possibly using that as a well lot and also to sell it to the gentleman to the south by doing this in the platting procedure. we don't have to go through a re-platting. Morrow: One question on Blk 3 Lot 5 what did you perceive to be buildable on Lot 5. Howard: It would be the existing Lot 4, just extend the line. Kingsford: How are you going to meet any kind of a set back on Lot 5. Howard: I'll take a look at that. Kingsford: Is there any one else that would like to offer testimony. Being no response the Public Hearing was closed. Morrow: It's nice to be doing business with someone that has his neighbors best interests at heart. MERIDIAN CITY COUNCIL DECEMBER 5, 1989 PAGE 113 The Motion was made by Morrow and seconded by Giesler to approve the preliminary plat on Clearmont Fair Subdivision with the quotation that there may be some adjustment in Lot 4 & Lot 5 Blk 3. Motion Carried: All Yea: ITEM 112: RESTRICTIVE COVENANTS ON GEM PARK SUBDIVISION: Kingsford: Councilmen you've had those covenants for review are there any questions or comments. There was some discussion on this. (Tape on file) The Motion was made by Morrow and sears ~, Myers to approve the covenants on Gem Park Subdivision with the exception of striking Page 5 Paragraph 8 Section C. Motion Carried: All Yea: ITEM #3: CONDITIONAL USE PERMIT FOR PETER COVINO, TABLED AT LAST MEETING: Morrow: I have reviewed the letter signed by this real .estate agent and it doesn't appear to me that that letter indicates or takes a position that guarantees the City anything. In terms of our historical problems with Mr. Amyx and the fact that he has taken alot of our time and alot of our money and the court systems time and money to force compliance to things he has agreed to in the past, I don't see that this letter gives us a guarantee to accomplish what we'd hope to accomplish. I am sympathetic with Mr. Covino who is trying to start a business but I don't see where the City should make any exceptions. Giesler: I feel basically the same way. We don't have anything in front of us as far as diagrams or anything to assure us as to what is going to happen. Kingsford: I had some concern in the first paragraph the comment by Mr. Amyx. I'm not sure that that's going to improve the statute of that building. I drove by there after work this evening and it appeared to be about 15 to 20 vehicles outside again. Zn terms of his meeting a compliance, the deal we've got from Mr. Amyx is in violation of that. The Motion was made by Morrow and seconded by Giesler to deny the application for Conditional Use Permit for Peter Covino Motion Carried: All Yea: ITEM #4: PRE-TERMINATION HEARING: SEWER/WATER/TRASH DELINQUENCIES: Kingsford: You have been informed in writing, if you choose to, you have the right to a pre-termination hearing at 7:30 P.M. before the Mayor and City Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer, and trash<bill is delinquent. You may retain Counsel. Is there anyone from the public who would like to contest their water sewer, trash delinquency? Wilma Blair: Will pay as soon as can, maybe the first of the month. The Motion was made by Tolsma and seconded by Morrow to approve of the turn off list with the exception of Wilma Blair. MERIDIAN CITY COUNCIL DECEMBER 5, 1989 PAGE #4 Motion Carried: All Yea: Kingsford: They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the water will be shut off. The amount of the turn off list this month is $7,382.91. ITEM #5: APPROVE THE BILLS: The Motion was made by Tolsma and seconded by Giesler to approve the Bills. Motion Carried: All Yea: ITEM #6: MASONIC HALL AGREEMENT: Tolsma: Maybe we should go to a one or two year time frame. Pointed out that the City would be liable for snow removal and placing a sign up. There was some discussion. The Motion was made by Myers and seconded by Tolsma to approve of the lease agreement with the Masonic Hall for a five year period with a five year option. Motion Carried: All Yea: The Motion was made by Myers and seconded by Giesler to authorize the Mayor and the City Clerk to sign that agreement. Motion Carried: All Yea: ITEM #7: APPROVE RENEWAL OF BEER/WINE/ & LIQUOR LICENSES: Chief Gordon: No problems. The Motion was made rby Myers ahd_seconded by Tolsma to approveof the Beer/wine & Liquor Licenses for those that have paid their fees. Motion Carried: All Yea: ITEM #8: DEPARTMENT REPORTS: Building Inspector: Over the past few days, I have been going over the files on the applications for building permits and there are sane dating back as far as 1986 that have no record of the final inspection being cartpleted. So I have been trying to get these canpleted, I do have two of than where temporary occupancy certificates were given on August 9, 1989 stipulating in the temporary certificate that it was for a period of ninety days, the ninety. days are up and I guess I am asking the Council how we want to proceed with these permits? Morrow: What are our options? Building Inspector: We could give another extension on the temporary occupancy or we are looking at eviction. MERIDIAN CITY COUNCIL • • DFC'F.MRF.R S, 1989 PAGE # 5 Tolsma: what was the temporary occupancy for? Building Inspector: They are homes that are being lived in as the work is being canpleted. They are homes that were moved in on site Tolsma: How far along are they? Building inspector: They are far enough along, it is not a safety hazzard that they are being occupied. The Ordinance says no building should be occupied without a certificate of occupancy. Myaers: Have you talked to the people that are doing the building on it, how many have you got? Building Inspector: Just these two that I have contacted that have this:tanporary occupancy, there are others that I know are being lived in that I have not made any contact with, I am still working on that. Myers: What has been your response with the ones you have contacted? Building Inspector: I did not find out about the ninety day stipulation until after I had contacted than. Myers: My feeling would be that we should at least let than go for sane additional time, I would not think you would want to move than out at this time as long as there is no safety hazzard, with the idea that maybe you should talk to than and have than get moving along to get than completed, the weather is not real warm to be working outside, most of it has to be done inside then? Building Inspector: One of than is inside and one is quite a bit on the outside. Myers: Maybe we would have to extend the one on the outside until the weather got wanner. maybe give than sixty or ninety days including the rest of than you find, at least through the winter and check on than then. Building Inspector: Give than a break off date. Myers: Yes, sixty or ninety days or sanething so they would know that and go back and check them at that point and see where they are as canpared to where they are now, if there is no response then we will have to do sanething else. Morrow: Why don't we give than sanething like May 1, 1990? Giesler: Does it look like they are doing anything at all right now or is it just at a standstill? Building Inspector: On one of than it is mostly inside work, it has been progressing, the other one I have not seen anything going on. The Motion was made by Morrow and seconded by Myers to authorize the Building Inspector to give those people who are in violation of their ta~orary occupancy permits as well as others that have not obtained occupancy permits until May 1,.1990 to canplete the necessary itans and obtain their final inspections and occupancy permits. Motion Carried: All Yea: MERIDIAN CITY COUNCIL • • DECEMBER 5, 1989 PAGE # 6 Building Inspector: Just for the record, I wanted to mention that I did a final inspection on a house that Councilman Nbrrow was the contractor on and to el;m;nate any possibility of of conflict of interest I had Perry Payne who is a inspector of P,da County do the inspection on this unit. He is charging me to do this and Mr. Nbrrow and I will split this cost. City Engineer: I mentioned before there is a draft legislation being prepared by Ada County for the developarent of a single county wide drainage district, a draft of this legislation came to me a few days ago, I went through it and put together a small summary of it for you to read, if you want to read in detail I will make you a copy of it. City Attorney: Several of the Cities and their representatives went to the Supreme Court and presented arguments in the Albert Case. One other itan i have is in regards to a conflict of interest and I am going to request that the Council appoint a special City Attorney to handle matters before the Plann;nq & Zoning Commission and the City Council regarding Golf View Estates. Mayor Kingsford: Ixi visiting with you on this we discussed that and I would recannexid that Jack Riddlemoser, I understand you have contacted him and he has agreed. The Notion was made by Morrow and seconded by Myers to approve of Jack Riddlaroser as a special City Attorney for matters pertaining to Golf View Estates: Notion Carried: All Yea: Giesler:If anyone has the opportunity to go into the Police Department and look at the display the Chief has put up i think you will be impressed, he has put together quite a display and I think he has done a good job. Myers: We have had a meeting with Mr. Alidjani and we've decided to leave the rates as they are only we are going to amend the contract of Sanitary Services to review the rates each year prior to the October 1st deadline of the budget.TO review we will use gross revenue, use an inflation factor and that's the way we are going to do that. Mr. Alidjani: I'd like to know for my clarification, what is the clarification for gross revenue? I want to make sure we all understand the same thing. Kingsford: Gross Revenue is the dollars that the City actually takes in. We need to be comparable with other services of the same type also. There was further discussion. (Tape of file) Tolsma: i have heard several people comment on wood burning in town, it would be a good idea to go along with Boise City. Morrow: Commented on burn ban. Kingsford: If it would be the Council's desire we could go along with this. I don't think we want to make it mandatory so we have to try and enforce it. The Motion was made by Morrow and seconded by Giesler to urge voluntary compliance with the Burn Ban . Motion Carried: All Yea: MERIDIAN CITY COUNCIL DECEMBER 5, 1989 PAGE #7 Tolsma: I had two calls today complementing the police department on their policing on the parking, there=has been_alot moved from the streets. Kingsford: There has been both pro and con comments on the parking citations being given. Mr. Clark Clough contacted Jack yesterday about encouraging the City to purchase another cabinet to put in the license department. There are all whole variety of materials placed in those cabinets. I am passing this on to the Council for your views. The charge is $300.00 for the purchase of the cabinet and for him to keep the cabinet full of material. Myers: My suggestion would be to talk to some of the service groups and see if they'd be interested in helping. The Motion was made by Morrow and seconded by Tolsma not to fund the $300.00 annual fee for another stand but to research and try to find someone from the private sector to fund this. Motion Carried: All Yea: Kingsford: The second item that I have is we do not have any type of policy that covers the scope of fees for copies, we certainly want to encourage people who want to know about the City that it's open book, but when copies are made we need to have some sort of policy. There was discussion on this. The Motion was made by Morrow and seconded by Myers to set a policy for SOC a page for copies of City documents. Motion Carried: All Yea: Kingsford: we have one other request, the gentleman couldn't be present and asked if I would bring this to the Council. Hi-Micro Tool would like to have the Council's approval to place temporary office space at their site for a period of ten months. The Motion was made by Myers and seconded by Tolsma to approve of a temporary ten month office space for Hi-Micro Tool. O. til ! ~ d ~~~7 C~ LEASE AGREEMENT This Indenture of Lease, made and entered into this day of _ 1989, by and between Masonic Temple Association of Merid en, Idaho, an Idaho corporation, Party of the First Part, hereinafter called Lessor, and the City of Meridian, Ada County, Idaho, a municipal corporation, Party of the Second Part, hereinafter called Lessee, W I T N E S S E T H:-- That the said Lessor, for and in consideration of the rents, covenants and agreements hereinafter contained Co be kept and performed on the part of the Lessee, does by these presents demise and lease to the Lessee the following-described real property situated in Ada County, Idaho: All that portion North and East of the present Masonic Temple constructed on Lots 1, 2, 3 4 and 9 of Block 7, original Townsite of Meridian, according to the amended plat thereof filed in Book 1 of Plats at Page 30, Records of Ada County, Idaho. Under the following terms and conditions, to-wit: 1. The term of this lease shall commence on the day of 1989, and shall run to the day of , 2. It is agreed that the property herein leased is to be used by the Lessee for public off-street parking of motor vehicles during the hours of 6:00 a.m. to 6:30 p.m. of everyday of the week during the term hereof. 3. For consideration and as payment for the use of the above-described leased premises Lessee agrees to do the following: a. Place a sign on the leased premises at all entrances informing the public that the use of this parking area is a joint effort of the City of Meridian and the Masonic Temple Association and that the parking is public from 6:00 a.m. to 6:30 p.m. and that after said hours, the parking is not public and is only for the use of the Masonic Temple Association and that after 6:30 p.m. any and all vehicles left on the premises may be towed away by the City of Meridian upon request to do so by the Masonic Temple Association. b. That the City of Meridian shall carry and pay for liability insurance on the leased premises and shall hold the Lessor harmless and indemnify the Lessor from any and all claims, causes of action, and lawsuits pertaining to any and all liability that may arise out of the use of the leased premises for all periods in which the lessee has the constructive possession of the leased premises which would be from 6:30 a.m. to 6:30 p.m. each and every day of the week during the term of the lease. c. That the Lessee shall provide all snow removal from the leased premises. 5. That Lessor agrees to maintain the parking lot and keep it in a good state of repair during the entire term of this lease at its own expense. 6. The Lessee agrees to construct suitable barricades at all points adjacent to the Masonic Temple building so as to prevent vehicles from running into said building or in any way damaging the same. 7. It is further and specifically agreed that the Lessee will hold the Lessor harmless against any and all liability whatsoever rising out of the Lessee's operation of said parking lot during the term of this lease and the hours of Lessee's constructive possession of the premises. 8. It is further agreed that the Lessor or the Lessee reserves the right to terminate this lease at any time after giving the other party thirty (30) days written notice of intention thereof to terminate this lease. ~~~~~ LESSEE CITY OF MERIDIAN MAYOR RAN P.
