SPECIAL MEETING OF THE MERIDIAN CITY COUNCIL NOVFFl~ER 13, 1989
Special Meeting of the Meridian City Council called to order by Mayor Grant Kingsford
5:05 P.M.: Meeting was noticed and posted as required by law..the purpose of this
Special Meeting was to canvass the votes of the Election held on November 7, 1989:
Members Present: Ron Tolsma, Bert Myers, Bob Giesler, Walt Morrow:
Others Present: Max Yerrington, Paul Stutzman, Wayne Crookston:
Mayor Kingsford: We will begin with the First Precinct:
The Tally Books, Election & Poll Books were examined by the Mayor & Council along with
the City Attorney for Precinct $801: In checking the Tally Books the Vote for Seat #2
Ron Tolsma was 391 ,For Council Seat #4, Stutzmazi 181, Giesler, 266,FOr Council Seat #1
373 Votes for Yerrinqton: There were also several writein's:in this Precinct: The total
number of Ballots cast in this Precinct were 449: Further review discovered that one
of the Tally Books was not filled out on the first page on Giesler and was started on the
second page, there were no marks on the first page the numbers were the same at the end
showing 266 for Giesler: This also was the same for Yerrington, even though the totals
were the same. The City Clerk was instructed to see if he could reach the Judge of this
Precinct to get clarification.
Mayor Kingsford: We will go ahead with the Second Precinct at this time:
The Tally Books, Election & Poll Books were examined by the Mayor & Council along with
the City Attorney for Precinct #802: The review showed that the Tally Books agreed with
Tolsma receiving 217 Votes, Giesler 162 Votes, Stutanan 90 Votes and Yerrington 203 Votes,
there were several write-ins: There were 258 Ballots cast in this Precinct.
The City Clerk was unable to contact the Judge of Precinct # 801:
Mayor Kingsford: What is your advice Counselor?
City Attorney: I think we need to ascertain why they marked the Tally Books the way they
did, not actually the function to recount them.
Mayor Kingsford: We have to canvass within six days, we table and get the Judge in, what
would be the process?
City Attorney: I think in the time frame we could recess for a short period of time
and see if we can reach the Judge.
The Motion was made by Morrow and seconded by Myers to recess for fifteen minutes to
see if the Election Judge froirt Precinct #801 can be reachedc
Motion Carried: All Yea:
Being unable to contact the Election Judge for Precinct 801. after the recess the Meeting
was reconvened:
The City Attorney recan~ended that the Ballots fran Precinct #801 be recounted by the
Mayor & Council, for Councilman Seat #4: The City Attorney read the Ballots and the
Mayor & Council as well as the City Clerk marker the count. This recount resulted in
262 votes for Giesler and 174 for Stutzman. This was four less for Giesler and seven less
for Stutzman than the Tally Books showed. There were several Ballots where the box

opposite the write-in space were marked and no name written iM and these were not included
in the recount. The City Attorney advised there was the possibility the Election Judge
had given these to the candidate whose name was on the bottom as this was the Judges
discrection.
It was the consensus of the Mayor & Council to accept the totals that were shown in the
Tally Books for Precinct 801. after the recount:
The Motion was made by Morrow and seconded by Myers to approve the canvas of the votes:
Motion Carried: All Yea:
Mayor Kingsford: After the canvas of the votes i declare that Ronald Tolsma was the winner
of the Council Seat #2 with 391 votes in Precinct #801 & 217 votes in Precinct #802 for
a total of 608: Robert. Giesler was the winner of Council Seat #4 with 266 votes in
Precinct #801 and 162 votes in Precinct #802 for a total of 428 votes: Stutzman received
90 votes in Precinct # 802 & 181 votes in Precinct 801 for a total of 271: Max Yerrington
was the winner for Council Seat #1 with 373 votes in Precinct #801 and 203 votes in
Precinct #802 for a total of 576:
Being no further business to be conducted the Notion was made by Morrow and seconded by
Myers to adjourn at 6:25 p.m.:

NOTICE OF SPECIAL MEETING
NOTICE IS HEREBY GIVEN that the City Council of the City of
Meridian will hold a special meeting at 5:00 o'clock p.m.,
Monday, November 13, 1989, at the Meridian City Hall, 33 East
Idaho Street, Meridian, Idaho. The purpose of said meeting is to
canvass the ballots of the City election held November 7, 1989.
No public comment will be taken.
