Regular Meeting of the Meridian City Council was called to order
at 7:30 p. m. by Mayor Grant Kingsford:
Members Present: Ron Tolema, Bert Myers, Bob Giesler, Walt Morrow:
Other Present: Jack Smith, Wilma Blair, Moe Alid~ani, Earl Ward,

Mayor Kingsford: We will vary slightly from the agenda, Mr. Paul
Moroz would like to address the Council.
Moroz: I would 3ust like to thank the Council and the City
Engineer for their help in placing the playground equipment in the
park at the end of NW 8th. The neighborhood really appreciates the
efforts that were put forth to make this happen.

ITEM #3: ORDINANCE 1519: TABLED AT THE LAST MEETING:
Mayor Kingsford: AH ORDINANCE OF THE CITY OF MERIDIAN REPEALING
SECTION 1-704, TIME AND PLACE OF MEETINGS, OF THE REVISED AND
COMPILED ORDINANCES OF THE CITY OF MERIDIAN; AHD READOPTING SAID
SECTION 1-704, TIME AND PLACE OF MEETINGS, TO PROVIDE THAT IN THE
EVENT A CITY COUNCIL MEETING FALLS ON A TUESDAY ON WHICH A CITY
ELECTION IS HELD THE MEETING SHALL NOT BE HELD ON THAT TUESDAY BUT
SHALL BE HELD ON THE FOLLOWING WEDNESDAY; AHD PROVIDING AN
EFFECTIVE DATE.
Is there anyone from the audience who wishes to have Ordlnance #519
read in its entirety. There was no response.
The Motion was made by Giesler and seconded by Morrow that the
rules and provisions of 50-902 and all rules and provisions
requiring that Ordinances be read on three different days be
dispensed wlth and that Ordinance Number 519 as read be passed and
approved.

ITEM #~4: PRE-TERMINATION HEARING: WATER/SEWER/TRASH
DELINQUENCIES:
Mayor Kingsford: This is to inform you in writing, if you choose
to, you have the right to a pre-termination hearing at 7:30 P. M.
11-07-89 before the Mayor and City Council, to appear in person to
be fudged on facts and defend the claim made by the City that your
water, sewer, and trash bill is delinquent. You may retain
Counsel.
Is there anyone present tonight who wishes to come before the
Council about their bil1Y
Wilma Blair: Here is a 520.00 payment on my water bill, that is
all I can do at this time.
Kingsford: Due to their failure to pay their water bill or to
present any valid reason why the bill has not been paid. their
water shall be turned off on Wednesday, November 15, 1989. In
order to have their water turned back on, there will be an
additional fee of 510.00. They are hereby informed that they may
appeal or have the decision of the City reviewed by the Fourth
Judicial District Court, pursuant to Idaho Code. Even though they
appeal the water will be shut off. The .amount of delinquencies is
58,846.65.
The Motion was made by Tolsma and seconded by Giesler to approve
the turn off list with the exception of Wilma Hlair.

ITEM X15: APPROVE THE BILLS:
The Motion was made by Tolama and seconded by Morrow to approve the
bill.

ITEM #6: JACK SMITH: PARKING IN SUBDIVISIONS ON THE STREET:
Smith: I disagree with your Ordinance about parking on the
streets.

Smith: Idaho Code 40-406 f88 Supp) states that the Ada County
Highway District has control over the City streets. I have a boat
that I park on the street in the winter and I received a citation
for parking it there. This Ordinance is to strict.
Giesler: I am not aware of your complaint.
Smith: I received a warning notice for having my boat parked in
front of my house on the street.
Giesler: What about renting a storage unit?
Smith: That won't work for me. When I decide to go hunting or
fishing I need to be able to go so I need my boat there.
Giesler: I did look up a copy of your covenants and you are in
violation of those even though the City can't enforce them.
Smith: Why can't the Council create come kind of a variance?
Giesler: Even if we could create a varlance we can't violate your
subdivision covenants.
Morrow: If we went to a variance procedure we would be creating
the same problem that we've hed all over again. Everyone would
want a variance and then we'd be back to having dunk all over
again. The purpose of this Ordinance is to try to clean up.
Smith: Then what do I do with my boat?
Morrow: You need to make some kind of arrangements.
Smith: That is not acceptable to me.
Hyers: Why don't we hold off on this for awhile.
Attorney Crookston: The Police Officers have the authority to
enforce if in violation. You can't create a variance to a criminal
statute.
Smith: I still disagree:
Crookston: I see no problem with researching your material you've
presented tonight.
Smith: As I said this is only a winter time problem, let's try to
make is so we can live with it, not totally unreasonable.

Kingsford: I'd like Crookston to take a look at Ada County who
passed an Ordinance similar to ours. Thank you for coming tonight
Mr. Smith.
ITEM ~7: BURTON BRENNAN, KEYS CONSTRUCTION: BUILDING PERMIT FEE:
Brennan: Thank you for allowing me to appear hear tonight on the
issure of the building permit fee charged by the City of Meridian
on our project which I refer to as Friedman Bag. To more clearly
define the issure your building department has placed a value of
5811,000 on a project that is only a S600,000 fob.
Brennan handed in some papers for the Council to read over.
Brennan also read section 304 part 6 of the UBC. Your prices are
different from the UBC. The difference if S775.00. When a
contractor is charged more than was estimated it must come out of
the profits of the fob. Is there any questions that I can answer?
Morrow: Since Mr. Whitman is not here he has asked the Engineer
to explain.
Engineer Smith: I have made a break down of the figures showing
haw Daunt arrived at his figures I have copies for each of you.
Basically the total size of the building is 38,246 sq. feet that
was taken off of the plane. There were three different charts used
by Daunt to arrive at his figures. One was the Building Valuation
of Standards which comes from the building standards, the regional
modifier, and he also received a building evaluation sheet from the
City of Nampa. In all cases the flgures that Daunt used were less
than any of the three published charts. The sprinkler system for
the building was not included in the sq. foot costs we used for a
means for establishing the value for the building.
Myers: You are saying the sprinkler system, is that the sprinkler
system in the building.
Kingsford: There was an assessment made and Key's Construction did
pay that in full. They asked our consideration in the October
meeting and he asked to be placed on the agenda for further
consideration.
Brennan: UBC states the value to be used will be the replacement
cost value. UBC makes no reference to any other materials. I
think you need to set one established schedule and go by it.
Engineer: I think we are in a different time frame here between
Mr. Brennan is and where the City of Meridian is, when Mr. Brennan
bids a project we don't know about it, he will call and say what

would the building permit be on the basis of 6661,000, we look at
the chart and give a figure according to our charts and that's all
we can do unless we know the specific's of the building.
Morrow: In each case the numbers used are less than the numbers
that are indicated and that should be used by the valuation.
Further explanation was given. Is there an appraisal on this
building? Maybe we should look at the appraisal.
Brennen: I don't know.
Morrow: The market is what determines what the replacement costs
would be, and the building officials are giving us this valuation
table by which to set replacement costs. The appraisal would be
another means of setting replacement cost. Our building inspector
has given you less than the building valuation says we should be
giving you.
Brennan: This project is really an industrial facility with areas
for manufacturing, with areas for warehousing. office, production
support, break rooms and various other things in there.
THERE WAS FURTHER DISCUSSION.
Brennan: We built John Pauls here 1n Meridian.
Kingsford: I'm sure we used no doubt the same formula then as now.
Giesler: I would like to review this a little more.
Tolsma: Also agreed.
Crookston: What your saying is that the valuation used in the UBC
is the replacement value?
Brennan: The UBC Code says that the building permit fee will be
based on current replacement costs.
The Motion was made by Giesler and seconded by Tolsma to table the
issue of Keya Construction Building Permit until the next Council
meeting.

Crookston: The Supreme Court argument on Albert vs. the various
cities of Ada County is scheduled Dec. 5, 1989 at 9:30 in the
Supreme Court Building.
Morrow: We have acquired the Vincent house next door to the Fire
Station the project will be incorporated within our Fire Department
end our 9RU, and we will be bringing the Ada County Paramedics on
line for one shift a day sometime in the near future.
Kingsford: Mr. Alid~ani please take care of the trash problem in
Rose park. Also, we need to set a time to Canvas. the Election.
Myers: Suggested Monday at 5:00 p. m.
The Motion was made by Myers to canvas the election Monday at 5:00
p. m. All in favor.
Being no further business to come before the Council the Motion was
made by Myers and seconded by Tolsma to adjourn at 8:40 p. m.:

WHEREAS,
WHEREAS,
our community has a continuing sense of gratitude to
those disabled veterans who did so much to preserve
the Americsan way of life; and
the Disabled American Veterans has worked exclusively
for the welfare of our disabled veterans; and
WHEREAS, the DAV offers free service to disabled veterans and
their families in filing claims for government benefits
and assists disabled veterans with medical, employment
and other problems; and
WHEREAS, the DAV meets emergency situation which may anise in
the family of a disabled veteran; and
WHEREAS, the DAV has chosen November 9, 10, and 11, 1989, for its
annual FORGET-ME-NOT campaign in our community and has
announced that all funds collected will be used for
disabled veterans in the community.
NOW, THEREFOREr I, Grant P. Kingsfordr Mayor of the City of Meridian, do
hereby proclaim November 9, 10, and 11, 1989 as Disabled
American Veterans FORGET-ME-NOT DAY and urge the support
of all citizens and organizations for that day.

AN ORDINANCE OF THE CITY OF MERIDIAN REPEALING SECTION 1-704,
TIME AND PLACE OF MEETINGS, OF THE REVISED AND COMPILED
ORDINANCES OF THE CITY OF MERIDIAN; AND RE-ADOPTING SAID SECTION
1-704, TIME AND PLACE OF MEETINGS, TO PROVIDE THAT IN THE EVENT
A CITY COUNCIL MEETING FALLS ON A TUESDAY ON WHICH A CITY
ELECTION IS HELD THE MEETING SHALL NOT BE HELD ON THAT TUESDAY
BUT SHALL BE HELD ON THE FOLLOWING WEDNESDAY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Mayor and the City Council of the City of
Meridian, State of Idaho, have concluded that it is in the best
interest of the said City to repeal Section 1-704 of the Revised
and Compiled Ordinances of the City of Meridian and to re-adopt
said section to provide that where a regular City Council
meeting is scheduled on a Tuesday in November that is a City
Council election day the Council meeting shall not be held on
that Tuesday but shall be held on the following Wednesday.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Section 1-704 of the Revised and Compiled
Ordinances of the City of Meridian is hereby repealed.
SECTION 2: That Section 1-704 of the Revised and Compiled
Ordinances of the City of Meridian is hereby re-enacted and
adopted and which shall read as follows:

1-704 TIME AND PLACE OF MEETINGS:
The regular meetings of the City Council
shall be held at the Meridian City Hall at
33 East Idaho Street, by the Mayor and City
Council on the 1st and 3rd Tuesdays of each
month at Seven-Thirty (7:30) o'clock p.m.
of said days. If the said 1st or 3rd
Tuesdays of any month is a holiday, the
meeting shall be held the evening following
at the same hour and place and in the event
the said 1st Tuesday of November is a City
Election Day the meeting shall be held the
following Wednesday at the same hour and
place.
SECT ION 3: EFFECTIVE DATE: WHEREAS, there is an emergency
therefor, which emergency is declared to exist, this Ordinance
shall be in full force and effect from and after its passage,
approval and publication according to law.

WHEREAS: Key Club International, a high school service organization sponsored
by Kiwanis International, is observing the week of November 4-11,
1989, as Key Club Week; and
W[-IEREAS: The members of the Key Club of Meridian are part of an International
organization of over 125,000 students dedicated to serve with
purpose in their school and cormlunityy seeking to give primacy
to the human and spiritual rather than the material value of life;
and
WHEREAS: They promote the adoption of higher standards in scholastics,
sportmanshipy and social contacts and the development of a more _
concerned citizenship; and
Through their purposeful service they have helped to build better
communities making their motto, Caring-Our Way of Life, more than
just words--making it become a goal for living; and
WHEREAS: Each member will perform at least fifty hours of service to his/
her home, school, and community annually; and
WHEREAS: The 1989-90 Theme and Major Emphasis Program ... Develop Within-
Share without calls upon all Key Clobbers to enrich the lives of
individualswho are lonely, isolated, forgotten, or misunderstood
by providing friendship, role models, the teenager to talk to,
the personal contact needed to recognize the great value of each
person; and
WHEREAS: The services by the Key Club will have a positive impact on our
community and its citizens.
THEREFORE: Iy Grant Kingsford, Mayor of the City of Meridian, do hereby proclaim
the week of November 4-11y 1989, as KEY CLUB WEEK, and hereby
do call upon the officials of this municipality and all citizens
thereof, to render all support of the members of this organization
and make themselves aware of Key Club whose members this day are
preparing themselves to be better, more responsible citizens as
they provide meaningful service to our cotmunity.
