SUMMARY DESCRIPTION OF APPLICANT'S REQUEST The applicant, Fairview Lakes, LLC, requests approval to vacate the 10-foot wide public utility easement located along the southern boundary of Lot 3, Block 1, Devon Park Subdivision No. 2. The easement is proposed to be relocated within a drive aisle and platted with Devon Park Subdivision No. 3. A legal description and exhibit map of the easement proposed to be vacated is included in Exhibit C of this staff report. Devon Park Subdivision No. 3 is a re-subdivision of Lot 2, Block 1, Devon Park Subdivision No. 1 and Lot 3, Block 1, Devon park Subdivision No. 2. Devon Park Subdivision No. 3 will provide utility easements. All of the utilities have been installed. The Unified Development Code 11-SA-1, requires the City Council to be the decision making body on vacations applied for in the City of Meridian. Idaho Code 50-1325 requires that all easements created with subdivision plats "shall be vacated in the same manner as streets" and must be approved by the local jurisdictions. State statute further requires an easement vacation be filed when a landscape or irrigation easement is involved. The Meridian Public Works Department has no opposition to the proposed vacation of the subject easement as new easements will be dedicated with the Devon Park Subdivision No. 3 plat. The Applicant has provided proof of relinquishment of the easements by Cable One, Qwest Communications, Nampa Meridian Irrigation District, Intermountain Gas Company, and Idaho Power Company, included as Exhibit D. The subject site is generally located midway between 1V. Meridian Road and N. Locust Grove Road, on the north side of E. Fairview Avenue. 2. RECOMMENDATION Staff recommends approval of VAC-08-005 to vacate the 10-foot wide public utility easement located along the southern boundary of Lot 3, Block 1, Devon Park Subdivision No. 2, as shown in Exhibit B. 3. PROPOSED MOTION Approval I move to approve File Number VAC-08-005, as presented in the staff report for the hearing date of June 24, 2008.
