The following will be the requireme~s and/or concerns to provide minimum levels of fire
protection for the proposed project:
1. Provide afire-flow per the Uniform Fire Code Appendix III-A to service the
project. Fire hydrants shall be placed an average of 400' apart. 1997 UFC
Appendix III-A
2. Acceptance of the water supply for fire protection will be by the Meridian
Water Departmem.
3. All roads shall have a turning radius of 28' inside and 48' outside.
4. All access roads within the project shall have a clear driving surface with a
minimum width of 20' available at all times. UFC 902.2.2.1

would like to appeal to the City that the new owner be responsible for all drainage
water from the property at 44 NW 10th Street. To date, I have been handling the
run off from this property and my own. I would like to see an appropriate
drainage system be considered in the plans for the proposed used car lot.

In response to your request for comment, the Ada County Highway District (ACRD) staff has reviewed the
submitted application and site plan for the item referenced above. It has been determined that the Right-of-
Way and Development Services Department does not have any site specific requirements for you at this time
due to the fact:
• Roadway improvements currently exist adjacent to the site on Franklin Road.
• The applicant is not requesting access to Franklin Road and none are approved with
this application.
• District policy 7204.9.1 in some existing industrial developments or expansions of
those developments, the District will allow deviations from the street standards by not
requiring the construction of sidewalks. These developments include primary uses of
storage facilities, trucking terminals, contractor shops, utility shops and selective
heavy manufacturing facilities in which significant pedestrian movement is not
anticipated. Deviations from the standards will not be allowed in new industrial or
commercial developments, technological parks or on designated collector or arterial
streets. This policy shall apply to Stewart Avenue.
• District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over
1,000 vehicles to a maximum width of 35-feet. Most commercial driveways will be
constructed as curb-cut type facilities if located on local .streets. Curb return type
driveways with 15-foot radii will be required for driveways accessing collector and
arterial roadways.
• Graveled driveways abutting public streets create maintenance problems due to
gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1,
the applicant should be required to pave the driveway its full width and at least 30-
feet into the site beyond the edge of pavement of the roadway and install pavement
tapers with 15-foot radii abutting the existing roadway edge.
Ada County Highway District
• The applicant is proposing to access Stewart Avehue approximately 70-feet north of
the intersection with Franklin Road, the location meets District policy and shall be
approved with this application.
If the site plan or use should change in the future, ACHD will review the site plan and may require
improvements to the transportation system at that time.
Prior to the construction or installation of any roadway improvements (curb, gutter, sidewalk, pavement
widening, driveways, culverts, etc), a permit or license agreement must be obtained from ACHD. In addition to
any costs associated with a permit or license agreement, a roadway impact fee will be assessed by ACHD and
will be due prior to the issuance of a building permit.
In accordance with ACHD's standard requirements, the applicant shall:
• Meet District drainage requirements,
• Replace or repair any damaged curb, gutter and sidewalk (as determined by
Construction Services),
• Bear all costs for the relocation of utilities associated with improving street frontages,
• Contact the District's Utility Coordinator or Construction Services Department in
regard to all utility street cuts to determine if the pavement is less than five years old.
These provisions are in accordance with the Ada County Highway District Policy Manual, ISPWC Standards,
Construction Services policies and procedures as well as all applicable ACHD Ordinances. If you should have

The Nampa & Meridian Irrigation District's Eightmile Lateral courses through the above-
mentioned proposed project. The easement of the Eightmile Lateral is 60 feet, 30 feet
from the center each way. Any encroachments within the easement of the Eightmile
Lateral without approved plans and a signed license agreement are unacceptable.
The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
application be filed. The developer will need to contact Ms. Donna Moore, Asst.
Secretary/Treasurer at the District's main office at 466-7861 for further information.

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized,. I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.

We have reviewed this submittal and offer the following comments, as conditions of the applicant.
These conditions shall be considered in full, unless expressly modifted or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The applicant is requesting a Conditional Use Pemrit for the establishmern of an automotive sales lot
in order to sell used cars and trucks on the property located at 44 Northwest 10`" Street. The eastern
third of the properly is currently fenced and is being used for storage of construction lllaterials. The
eastern third of the site will continue to be used for construction materials storage regardless of the
approval or denial of this application. The applicant is proposing the addition of an asphalt
parking/vehicle display lot and a temporary office building.
The storage of construction materials on the subject property was previously approved as a
conditional use. The applicant will be required to apply for a separate Conditional Use Permit for
the "Proposed Future Building" shown on the site plan.
LOCATION & SURROUNDING USES
The subject property is located at 44 Northwest 10's Street.
The following uses surround the subject property:
North -Industrial, zoned 1L.
South -Franklin Road borders the subject property to the south. Crestwood Estates Subdivision;
zoned R4 is south of Franklin Road.
East - Commercial, zoned C-G.
West - N.W. Tenth Street is located directly west of the subject property, west of Tenth Street
property is industrial, zoned 1L.

STANDARDS FOR CONDTTIONAL USES
The Commission and Council shall review the particular facts and circumstances of each .
proposed conditional use in terms of the following and may approve a conditional use permit if
they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
The submitted site plan does not meet the required landscaping standards. The southern edge
of the property bordering Franldin Road is required to have a 25' vegetative buffer and the
northern edge of the property is required to have a 5' vegetative buffer north of the existing
asphalt driveway. The landscaping buffers on the western edge of the subject property meet
the required standards.
The applicant must either submit a revised site plan showing the required landscape buffer or
apply for a Variance from the landscaping standards when the application goes to City
Council.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The City of Meridian's zoning map shows the subject property as "Light Industrial." Caz lots
require a CUP in I-L zone according to the Zoning Schedule ofUse Control. Stafffinds the
proposed use and plan to be in Compliance with the Meridian Zoning Ordinance and the
Comprehensive Plan, as long as the conditions of the staff report are met.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the esseutial character
of the same area;
Stafffinds that the proposed development will not adversely change the essential character of
the general vicinity and will be harmonious with the intended character of the same area.
D. That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.

E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development can be adequately served by the essential public
facilities and services listed above. Sanitary sewer and water service lines will need to be
extended into the subject lot at the owners expense.
F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
conununity, nor would it create the need for any new facilities or services to be paid for by the
public.
G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
The proposed use will not substantially increase traffic. Staff does not anticipate that the
proposed use will be detrimental to the general welfare of the community by means of
increased traffic, noise, smoke fumes, glare or odors generated by the use.
H. That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with traffic on the
surrounding public streets. The applicant has not proposed any new curb cuts onto existing
streets.
I. That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Stafffinds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
SPECIAL CONSIDERATIONS
The following items are special issues with the project that warrant discussion with the Commission
and/or Council. They are not conditions of approval, unless so moved by the Commission or Council.

1. Parking: The applicarn has submitted a site plan that shows 7 pazking spaces. MCC's
parking regulations require that one parking space for customers is supplied for every three
parking spaces for car sales. The applicant will be required to provide two spaces for
customer parking if five spaces are used for auto sales.
SITE SPECIFIC REQUIREMENTS
Pazkin~: The applicant has submitted a site plan that shows 7 parking spaces. MCC's
parking regulations require that one parking space for customers is supplied for every three
parking spaces for caz sales. Staffrecommends that the entrance to the proposed parking lot
be reduced to 35' in width to help define the ernrance to the parking lot. The applicant will
be required to provide two spaces for customer parking if five spaces aze used for auto sales.
No pazking will be allowed in the vacant area to the east of the proposed pazking lot; this area
must also be posted "1Vo Parking."
2. Landscanine: 'The south side of the subject property needs to be brought into compliance
with current landscaping standards. The landscaping buffer needs to be 25' in width along
the southern edge of the subject property. Trees should be placed every 35 feet along the
southern perimeter of the subject property. The buffer shown on the landscaping plan for the
eastern edge of the property is in compliance with landscaping requirements. A 5' vegetative
buffer is required north of the existing asphalt driveway. No buffer is required along the
western edge of the subject property. These revisions to the landscaping plan must be
submitted ten days before the application goes to City Council or the applicant must apply for
a Variance from landscaping requiremerns when the application goes to City Council.
Existing Trees: The existing trees shall be protected during construction as noted on the
proposed plan.
4. Handicap parking: All handicapped spaces must be posted as well as marked.
Setbacks: The proposed structure is subject to all required setbacks of the I-L zone. The
submitted site plan appears to meet all of the required setbacks.
6. Water/sewer: The applicant will be required to hook the proposed office building up to city
water and sewer.
7. Irrigation Canal: Applicant will be required to file the irrigation canal running through the
southwest corner of the subject property per section 12-4-13 of MCC.
8. As par[ of a conditional use permit, the City of Meridian may impose additional

restrictions/conditions.
STANDARD REOUIIiEMENTS
1. Off-street pazking shall be provided in accordance with the City of Meridian Zoning and
Development Ordinance and/or as detailed in site-specific requirements. All parking and
areas of circulation shall be improved with a hard surface in accordance with Meridian City
Code 11-13-4.D, and shall be installed and striped in accordance with the approved site plan
and Ordinance 11-13-4.F.
2. All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act.
3. A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street pazking areas. All
drainage water is to be maintained on-site. Storm water treatment and disposal must be
designed in accordance with Department of Environmental Quality 1997 publication Catalog
of Storm Water Best Management Practices for Idaho Cities and Counties and City of
Meridian standazds and policies. Off-site disposal into surface water is prohibited unless the
jurisdiction which has authority over the receiving stream provides written authorization prior
to development plan approval. The applicant is responsible for filing all necessary
applications with the Idaho Department of Water Resources regazding Shallow Injection
Wells.
4. All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties orright-of--way. All pazking lot lighting shall be in accordance with Ordinance 11-
13-4.C.
5. All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance or as specifically approved. All signage is subject to
design review and shall require separate permits.
6. Screen trash areas on at least three (3) sides. Coordinate screened trash enclosure locations
and construction requirements with Sanitary Service Company and provide a letter of
approval from their office when applying for a Certificate of Zoning Compliance (CZC).
7. Per Ordinance 11-17-4.B., a conditional use permit, when granted, shall be valid for a
maximum period of eighteen (18) months unless otherwise approved by the Ciry Council.
During this time, the pemrit holder must acquire building permits and commence the
construction of permanent footings or structures. Time extensions are allowed per the
ordinance.
