The regular meeting of the Meridian City Council was called to
order by Mayor Grant P. Kingsford at 7:30 P. M.:

ITEM #3: APPROVE THE PRELIMINARY PLAT ON KEARNY SUBDIVISION,
WOODS PROPERTY:
Giesler: What has been worked out for the emergency roadway?
Dan Woods: My parents are going to keep Dixie Lane open at all
times, for snow removal and everything like that. From the
corner of my parents property through lots 11 & 12 we are going
to turn around and it will either be the homeowners association
or my parents be required to keep that open also.
Giesler: If something would happen to them, how would that work?
Kingsford: There would be a deed restriction on the final plat.
Crookston: There is a provision in the Ordinance that provides
that the plat would not be signed by the City Engineer or the
City Clerk until such an agreement is in effect.
Tolsma: That would be just the Dixie Lane side up to the
barricade, up the back side.
Crookston: Well there needs to be some provision of some sort
that pertains to Dixie Lane.

Giesler: Do we have anything back on the traffic study on Locust
Grove?
Gary Lee: The traffic study that JUB is preparing has been
completed and submitted to ACRD for review and comment. Based on
that report they will have a technical review of the preliminary
plat and make recommendations.

Eng. Smith: I sent the minutes out to the committee members and
I'm waiting for a response from them to make sure everything is
the way it was discussed. I had previously contacted the Highway
District requesting studies on Locust Grove with emphasis on
signalization at Locust Grove and Fairview. I specifically
requested a counter be placed on Locust Grove north of Fairview
and also one north of Chateau so we can see what kind of traffic
there is being generated on there right now.
The Motion was made by Tolsma and seconded by Giesler to approve
the preliminary plat on Kearny Subdivision.
Motion Carried: All Yea:
ITEM #4: FINAL PLAT ON ONE SUBDIVISION #2:
Corrie: On item #7 on the comments are they going to put that
turn around over there for the fire department?
Max Boesiger: We do intend to put that in. What we will do is
put in a temporary turn around just beyond the end of this
platted subdivision for service vehicles and so forth to turn
around in.
Tolsma: You didn't have any other problems with any of the other
comments?
Boesiger: I don't believe so.
Tolsma: Did you see the School District's comments about the
buses?
Boesiger: Yes. No problems.
The Motion was made by Tolsma and seconded by Corrie to approve
of the final plat on One Subdivision #2:

ITEM #5: FINAL PLAT ON SUNBURST SUBDIVISIDN #2:
Giesler: Have they received a copy of the City Engineer's
comments?
Roy Johnson: Yes. We have no problems with them.

Cowie: Settlers Irrigation said that the pipe is in place but
not been connected to the open ditch and they haven't received
the plans from Roy Johnson for the concrete inlet box, those two
things are on their January 13th letter.
Johnson: Yes that's correct, but the ditch has been connected
but there is a box that we have to put right at the beginning and
I do not have that to them but will try to get it to them within
the next few days.
The Motion was made by Tolsma and seconded by Giesler to approve
the final plat on Sunburst Subdivision #2 conditioned upon
approval of the irrigation box by the Irrigation District.

ITEM #6: FINAL PLAT ON THE LANDING #3:
Corrie: Have you seen the comments from the Fire Department that
no development be allowed south of the line between lot 13, blk.
5 and Waltman Lane until the roads are tied together? Are you
planning on developing that section behind there?
Roy Johnson: Well yes, in fact we are going to have a
preliminary probably about a month from now on the balance of the
property that goes over to Waltman Lane. What was the comment?
Corrie: That no development be allowed south of the line between
lot 13, blk. 5, that's the one where there is no access.
(Discussion held on future phases - see tape)
Cowie: How about comment #4, the provision needs to be made for
an all weather gravel access road from Ten Mile drain ditch and
maintenance road to West Greenhead Drive, that it is an unsafe
situation? Has this been worked out?
Eng. Smith: I haven't talked to anybody since I submitted this.
Right now we have access to the lift station off of Linder Road
on a gravel road but there wasn't enough room left down there to
turn around and so once the maintenance man gets into the lift
station then the only way to get out is to back all the way out
to Linder. So what I was proposing is that the access road,
which is a canal bank road for the irrigation district, that it
be maintained in an all weather situation so we can go on down to
this phase and come in through the subdivision and go back out on
Linder.

Roy Johnson: What we are going to do maybe we can solve that
problem we really don't want to put the all weather road the full
length of it, the road that we have is adequate for the
irrigation district however we will be proposing to put a second
detention pond just east of this subdivision for future
subdivisions. I think that we could provide a turn around far
you at that point if that would work.
Eng. Smith: I guess my question would be, when is it going to
happen and how far east is it going to be?
Johnson: It's right at the end of this one here so we could put
that in with Sub. #3, it is immediately adjacent to the last lot.
The Motion was made by Tolsma and seconded by Yerrington to
approve the final plat on the Landing #3 conditioned upon the
access road satisfying the Public Works Department.

ITEM #7: COVENANTS ON TREASURE VALLEY BUSINESS CENTER:
The Motion was made by Corrie and seconded by Giesler to approve
the Covenants on Treasure Valley Business Center.

ITEM #8: GEORGE WAGNER, JUB ENGINEERS, UPDATE ON FACILITIES PLAN
AND PRESENT SEWER CAPACITY:
George Wagner & Kirby Vickers, JUB Engineers: Explained current
facility and updates needed in the future. Also presented
drawings. (See Tape>
ITEM #9: RESOLUTION #142: RESOLUTION PERTAINING TO FLOOD ZONE:
Kingsford: A RESOLUTION OF THE CITY OF MERIDIAN OF SUPPORTING
FLOOD INSURANCE AND CITY COOPERATION WITH THE FEDERAL INSURANCE
ADMINISTRATION AND THE DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT REGARDING THEIR FLOOD INSURANCE PROGRAMS; AND
PROVIDING AN EFFECTIVE DATE.

approve of Resolution #142.

ITEM #10: ORDINANCE #569: ORDINANCE ADOPTING THE 1991 UNIFORM
FIRE CODE:
Kingsford: AN ORDINANCE OF THE CITY OF MERIDIAN REPEALING
SECTION 2-1001 (A) OF THE REVISED AND COMPILED ORDINANCES OF THE
CITY OF MERIDIAN AND RE-ENACTING SAID SECTION PROVIDING FOR THE
ADOPTION OF THE 1991 UNIFORM FIRE CODE WITH CHANGES TO SECTIONS
4.108, 2.303,. ARTICLE 78 AND ARTICLE 79, AND THE ADOPTION OF THE
FOLLDWING APPENDICES; II-F, III-A, III-B, III-C, V-A-STANDARDS,
VI-A-HAZARDOUS MATERIALS CLASSIFICATION, AND VI-UBC REFERENCES
TABLES; AND PROVIDING AN EFFECTIVE DATE. Is there anyone who
wishes Ordinance #569 read in its entirety? No response.

ITEM #11: FINAL PLAT ON VAL VISTA SUBDIVISION #2:
Giesler: I will be stepping down, due to a conflict of interest.
The Motion was made by Tolsma and seconded by Yerrington to
approve the final plat on Val Vista Subdivision #2 and also
authorize the City Clerk and City Engineer to sign.
Motion Carried: 3 - Yea; 1 - Abstain;
ITEM #12: WAYNE FORREY, UPDATE ON DOWNTOWN PROJECT & LID:
Forrey: This evening it was our intent to come before you and
present the assessment role for LID 90-1 on the East First Street
Improvement Project. Eng. Smith and I met with the Highway
District last Thursday with the intent to finalize some numbers
then prepare that assessment role, bring it to the Council
tonight so that you could set a hearing date and we could mail
the notices to the newspaper and all of the property owners. We
are still wrestling with some numbers and I am confident that by
the next Council Meeting we will have that resolved and be able
to go on with the LID assessment. Explained to Council some of
the costs associated with E. First Street and some change orders.
(Discussion) These calculations are assuming that the Highway

District will agree to pay for cost of extra asphalt and
miscellaneous paving. They are agreeable to look into the
situation and have requested the justification letter to help get
this item resolved. If they do not accept payment for either the
asphalt or miscellaneous paving, someone has to come up with
about 538,000.00. I think they will pay it but we just need to
describe and justify why it happened and how it benefits the
highway district.
Eng. Smith: I think generally speaking a lot of the extra
asphalt cost had to do with the side streets as they framed in E.
First. On the plans typically the engineer had shown a match
back line shortly after the radius into the side streets and
curb. In a lot of cases once they were out there doing the
construction the match line had been cut for match back as shown
on the plans, however, further investigation in the field showed
that the asphalt may have been bad. We did carry the asphalt
back farther on the side streets in most cases than what was
shown on the plans. Gave example of this. Also, in order to
facilitate construction timing on East First Street we moved
those sand and grease traps off of East First Street into the
side streets, that increased the payments cost also. There is
quite a bit of additional expense that was experienced on the
asphalt portion of this patching back. As Wayne mentioned I need
to go back out and do some measuring, particularly on curb &
gutter & sidewalk and verify the quantities the contractor has
requested.
Forrey: If the highway district won't take on that other cost
then we will have to look at some other source. I'd be happy to
answer any questions.
Kingsford: I notice percentage wise the City is at 76-78% over
all for the City, basically we were just looking at lights, what
was the additional on that?
Forrey: Quite a bit of water work during construction. On the
Phase II Block Grant we have prepared a preliminary contract and
it is nearly ready to submit to the State. We have received the
preliminary land appraisals on four properties in the downtown.
The procedure after getting that is to submit that to a review
appraiser, which we are trying to get an appraiser to do that.
Kingsford: If anyone wants to go over the preliminary numbers we
will wait until after department reports to do so.

ITEM #13: DEPARTMENT REPORTS:
Crookston: The Council asked me to write a letter to Nampa-
Meridian Irrigation District on the flood problems over on
Chateau and Locust Grove. I did not write the letter, but I have
contacted their attorney and discussed this problem with him. He
was going to contact the Superintendent about this and get back
with me.
Kingsford: Let's be sure and follow up.
Giesler: Gary, we sent a letter to Mr. Leon Blaser regarding the
ditch, have we got a response from him yet?
Eng. Smith: I have not heard back from Leon on what their
schedule is, other than their contractor Bitterroot Construction
did call me and they are still on line to do the job and he was
trying to find someone to help him out to get the work done
because of his schedule. I don't know who is going to do it but
he assured me that Leon Blaser told him that it had to be done.
Tolsma: Did we ever find out anything on the ditch behind 11th
Street?
Forrey: ACRD has agreed to open the manhole and clean back to
the edge of the right of way. I apologize but I don't know if
that has been done.
Kingsford: Would you please follow up on that and let us know.

WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to annex to the said City real property which is
hereinbelow described:
A parcel of land being the North 1/2 of the NE 1/4 of the SW

or placed thereon; that there shall be no-single family detached
dwelling units smaller than one thousand three hundred (1,300)
square feet in size constructed or placed thereon and that the
above square footages are determined exclusive of the garage; that
the reason for the R-8 zoning is to allow 79 dwelling units to be
constructed on the parcel which would be an approximate density
of 1 dwelling unit per 4 acres, which would be allowed in the R-
8 Residential zone; that the property shall be subject to site
planning review; that the annexation and zoning is subject to the
conditions refferenced in the Findings of Fact and Conclusions of
Law as adopted by the Meridian Council on the request for
annexation and zoning; and any plat of the property shall not be
signed by the City Clerk or City Engineer until an agreement for
emergency access is entered into by the owner of the property and
the City of Meridian for emergency access.
Section 2. That the property shall be subject to de-
annexation if the owner or his assigns, heirs, or successors shall
not plat the property as required above and designate on the plat
that only single-family dwellings shall be allowed, construct
water and sewer line extensions to serve the property, and
construct streets to and within the property, which conditions
subsequent shall run with land and also be personal to the owner.
Section 3. That the City Clerk shall cause one (1) copy
of the legal description, and map, which shall plainly and clearly
designate the boundaries of said property, to be filed with the

Commission within ten (10) days following the effective date of

Section 4. EFFECTIUE DATE: There being an emergency,

approval as required by law.

AN ORDINANCE OF THE CITY OF MERIDIAN REPEALING SECTION 2-1001 (A)
OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN AND
RE-ENACTING SAID SECTION PROVIDING FOR THE ADOPTION OF THE 1991
UNIFORM FIRE CODE WITH CHANGES TO SECTIONS 4.108, 2.303, ARTICLE
78 AND ARTICLE 79, AND THE ADOPTION OF THE FOLLOWING APPENDICES:
II-F, III-A, III-B, III-C, V-A-STANDARDS, VI-A-HAZARDOUS MATERIALS
CLASSIFICATION, AND VI-UBC REFERENCES TABLES; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Mayor and the City Council of the City of
Meridian, State of Idaho, have concluded that it is in the best
interest of the said City to repeal Section 2-1001 (A) of the
Revised and Compiled Ordinances of the City of Meridian and to re-
enact said section to adopt the 1991 Uniform Fire Code, with
certain changes, and to adopt the following appendices II-F, III-
A, III-B, III-C, V-A-STANDARDS, UI-A-HAZARDOUS MATERIALS
CLASSIFICATION, AND VI-UBC Reference Tables;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Section 2-1001 (A) is hereby repealed.
SECTION 2: That Section 2-1001 (A) is hereby re-enacted
and shall read as follows:
"2-1001: ADOPTION OF FIRE CODES:

(A) Uniform Fire Code. The Uniform Fire Code is adopted for
the purpose of regulating and governing conditions hazardous to
l ife and property form fire. The Uniform Fire Code, 1991 Edition,
including Appendices II-F, III-A, III-6, III-C, U-A-STANDARDS, VI-
A-HAZARDOUS MATERIALS CLASSIFICATION, AND VI-UBC REFERENCES TABLES
is hereby adopted with the following exceptions to the Code:

2.303 BOARD OF APPEALS AND LIMITATIONS OF AUTHORITY
To determine the suitability of alternate materials and
types of construction and to provide for reasonable
~ ~
interpretations of the provisions of this code, there
shall be and hereby is created a board of appeals
consisting of five members who are qualified by
experience and training to pass upon pertinent matters.
The chief shall be an ex officio member and shall act
as secretary of the board. The board of appeals shall
be appointed by the executive body and shall hold office
at their pleasure. The board shall adopt reasonable
rules and regulations for conducting its investigations
and shall render decisions and findings in writing to
the fire chief, with a duplicate copy to the appellant.
The board of appeals shall have no authority relative
to interpretation of the administrative provision of the
code, nor shall the board be empowered to waive
requirements of this code.
2. That the first paragraph of Section 4.108 shall read as
follows:
"4.108 PERMIT REQUIRED
A permit may be obtained from the bureau of fire
prevention prior to engaging in the following
activities, operations, practices or functions."
3. That in Article 78 only Section 78.103 (b) and Section
78.203 through 78.309 are adopted and the rest of the
Article is not adopted.
4. That the first paragraph of Section 79.116 (e) shall
read as follows:
"Underground Tanks Out of Service for One Year.
Underground tanks, except EPA approved tanks, which have
been out of service for a period of one year shall be
removed from the ground in a manner approved by the
chief and the site shall be restored in an approved
manner. When the chief determines that the removal of
the tank is not necessary, abandonment in place is
allowed."
5. That the third paragraph of Section 79.605 (c) shall
read as follows:

"Devices used for final testing of tanks shall be
capable of detecting leaks as small as 0.10 gallons per
hours. Leaking piping and equipment shall not be used
until repaired or replaced. For leaking tanks, see
Section 79.601 (d)."
SECTION 3: EFFECTIVE DATE: WHEREAS, there is an
emergency therefor, which emergency is hereby declared to exist,

AND CITY COOPERATION WITH THE FEDERAL INSURANCE ADMINISTRATION AND
THE DEPARTMENT OF HOUSING AND URBAN DEVE~_OPMENT REGARDING THEIR
FLOOD INSURANCE PROGRAMS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, certain areas of the City of Meridian are subject
to periodic flooding, mudslides (i.e., mudflows), or flood-related
erosion, causing serious damages to properties within these areas;
and
WHEREAS, relief is available in the form of Federally
subsidized flood insurance as authorized by the National Flood
Insurance Act of 1968; and
WHEREAS, it is the intent of this City Council to require the
recognition and evaluation of flood, mudslide (i.e., mudflow), or
flood-related erosion hazards in all official actions relating to
land use in the areas having these hazards; and
WHEREAS, this body has the legal authority to adopt land use
and control measures to reduce future flood losses;
NOW, THEREFORE, BE IT RESOLVED, that this City Council
hereby:
1. Assures the Federal Insurance Administration that it
will enact as necessary, and maintain in force in those areas
having flood, mudslide (i.e., mudflow), or flood-related erosion
hazards, adequate land use and control measures with effective
enforcement provisions consistent with the criteria set forth in
Section 1910 of the National Flood Insurance Program Regulations;
and
2. Vests the Building Inspector with the responsibility,

identify flood plain, mudslide (i.e., mudflow), or
flood-related erosion areas, and cooperate with
neighboring communities with respect to management of
adjoining flood plain, mudslide (i.e., mudflow) and/or
flood-related erosion areas in order to prevent
aggravation of existing hazards.
(d) Submit on the anniversary date of the community's
initial eligibility an annual report to the
Administrator on the progress made during the past year
within the community in the development and
implementation of flood plain management measures.
(e) Upon occurrence, notify the Administrator in writing
whenever the boundaries of the community have been
modified by annexation or the community has otherwise
assumed or no longer has authority to adopt and enforce
floodplain management regulations for a particular area.
In order that all Flood Hazard Boundary Maps and Flood
Insurance Rate Maps accurately represent the community's
boundaries, include within such notification a copy of
a map of the community suitable for reproduction,

for which the community has assumed or relinquished
flood plain management regulatory authority.
3. Appoints the Building Inspector to maintain for public
inspection and to furnish upon request, for the determination of
applicable flood insurance risk premium rates within all areas
having special flood hazards identified on a Flood Hazard Boundary
Map or Flood Insurance Rate Map, any certificates of flood-
proofing, and information on the elevation (in relation to mean
sea level) of the level of the lowest habitable floor (including
basement if habitable) of all new or substantially improved
structures, and include whether or not such structures contain a
basement, and if the structure has been floodproofed the elevation
(in relation to mean sea level) to which the structure .was
floodproofed;
4. Agrees to take such other official action as may be
reasonably necessary to carry out the objectives of the program.
