(APPROVED) 7: DEPARTMENT REPORTS: • L MERIDIAN CITY COUNCIL FEB. 4 1992 The Regular Meeting of the Meridian City Council was called to order by Mayor Grant Kingsford at 7:30 P. M.: Members Present: Ron Tolsma, Hob Giesler, Bob Corrie, Max Yerrington: Dthers Present: Frank Thomason, Max Boesiger, Larry Sale, Kevin Jones, Wayne S. Forrey, Lee Stucker, Wayne Crookston, Jim Johnson, Gary Smith, Bill Gordon, Holly Houfburg: MINUTES OF THE PREVIOUS MEETING HELD JANUARY 21, 1992: The Motion was made by Tolsma and seconded by Yerrington to approve the minutes of the previous meeting held January 21, 1992. Motion Carried: All Yea: Kingsford: Read a Proclamation Declaring FFA Week to be February 14-21, 1992. ITEM #1: HOLLY HOUFBURG, ARTEC, REGARDING SIDEWALK ALONG FRANKLIN ROAD: Kingsford: Not present at this time so we will come back to this item. ITEM #2: MAX BOESIGER, INC.: REQUEST FOR EXTENSION OF PRELIMINARY PLAT ON THE VINEYARDS SUBDIVISION W/MODIFICATIONS: Boesiger: I'm here tonight representing the developer of this subdivision and we would like to ask tonight that you do two things for us. Number one that you extend the preliminary plat approval for the Vineyards Subdivision that was approved last March 20, 1990. Also that you would approve the modifications that we have made to the preliminary plat since that date and for that I would like to spend a few minutes explaining why these modifications had to be made and why the delays have some about because of those modifications. Explained original plat to Council. We have discovered that people are willing to pay for frontage not depth. We have decided to redesign this project so that it would more accurately fit what we felt the market was buying and we did that. We had your staff start looking at this and just about that time the City adopted a Flood Plain Ordinance and it was at that time we realized that our entire phase I was affected by that Ordinance. The reason for that is not because of low ground but because of a flow restriction there where the Five Mile Canal runs under Cherry Lane. The solution to that • MERIDIAN CITY COUNCIL FEB. 4, 1992 PAGE 2 problem is that we create more flow under Cherry Lane by adding culverts or increasing the size of the one that was there, that's a simple solution. The problem is is to get that flood plain area off of the maps it requires a year to go through the approval process, the modification of the maps, and so forth and by the time you get all those approvals done, it's taken a year to do that. That being the case we can to the realization that we had to once again change our plan of attack and to start our first phase in a different portion of the project that wasn't in this flood plain. As we were ready to submit it again we had another problem. Nampa Meridian Irrigation District called us and said that there is a 40 foot strip of land to the south of the project, along the ditch there that until now has been farmed, and it's a 40' wide part of ground that Nampa Meridian Irrigation District doesn't want to maintain forever. It's actually owned by the Bureau of Reclamation but it's actually maintained by Nampa Meridian. Once we put our subdivision in then we will have a 40 foot strip of ground there that nobody is going to take care. Well the obvious thing to do was to include that 40' foot piece of ground within our subdivision. So then we began the process to purchase the forty acres. Each of these things that have come up have caused us some delay and modifications to our plat. We did go ahead and plat those five commercial lots on the corner there. We hadn't remembered that Meridian had adopted this Ordinance requiring developers to update their preliminary plats every twelve months. We were never notified that our preliminary plat was expiring nor did we remember to have it updated and approved. (Explained further - see tape) Price ranges will be between $130 and 3140 thousand now because of this new design. Can I answer any questions? Tolsma: There is lot li and lot 21 that are a triangle shape off to the left? Boesiger: That's on site retention. Tolsma: I like that layout a lot better than the other one. Kingsford: A agree I think I like that better. I'm not so sure we aren't violating our own Ordinance by saying that we'll accommodate this preliminary plat without going through that platting process. Crookston: I think that the most you could do would be to have them request a variance from the Ordinance. The Ordinance about the time limitation is there and has been there for about 10 years. `/ • • MERIDIAN CITY COUNCIL FEB. 4, 1992 PAGE 3 Kingsford: I don't have any problem with extending your time limit on the preliminary plat but what is at issue to me is that's not the preliminary plat we approved. Boesiger: You might take into consideration the fact that with that original preliminary plat we did have a variance for culdesac lengths. Kingsford: I recognize that. Boesiger: Would it be fair then to suggest that we would also be asking then for an extension in the variance of the culdesac lengths. Since we had that approved before I guess we would be asking for an extension of that same approval on this project. The difference being that we don't have near the culdesac length condition as we had before. Crookston: The variance that was granted with the prior plat would last the same as the old plat. Boesiger: I recognize that the Ordinance required a developer to renew every twelve months but does that necessarily require that if it is not renewed does it necessarily require that he go back through the process. Wouldn't it still be possible for the City Council to grant an extension even though the old one had expired. Kingsford: Again the issue is this is not the preliminary plat, it's not an extension we are talking about a new preliminary plat. Giesler: I agree with your comments. I do feel real good about this concept and I am in favor of doing anything we can to expedite this thing for you because it looks very nice but I have to agree with the Mayor on this. Boesiger: Would there be a way that we could put this on hold for a couple weeks while your staff researches it deeper to see if there is any resistance on any part of any other public agencies and if there is then we understand your position. But if there isn't any resistance wouldn't it make sense then to be able to go ahead if everyone likes it better I guess I can't see the point in delaying it. • MERIDIAN CITY COUNCIL FEB. 4, 1992 PAGE 4 • The Motion was made by Giesler and seconded by Yerrington to deny this request for extension of preliminary plat. Motion Carried: All Yea: ITEM #1: HOLLY HOUFBURG, ARTEC, REGARDING SIDEWALK ALONG FRANKLIN ROAD: Houfburg: The ACHD is requesting that we produce a sidewalk on Franklin in front of our new site. I really don't have a problem with eventually putting a sidewalk in on this site, however right now it's going to be the only one there and I don't know what use it is going to provide at this point. I'm sure that it would be more cost efficient if we did that all at one time when they decide to widen the rest of Franklin. So what I'm asking is for a waiver for that particular request right now. Kingsford: I have visited with Holly about this and Jack and I went out to this site last week and have a couple of problems each way. (Explained further - see tape) Houfburg: We've had some preliminary landscaping plans drawn up. Yerrington: Are you putting in sidewalk o~n the west side of your building? Houfburg: No. Tolsma: How is that street sighted, I've been down that street. Could we put a restriction on it? Kingsford: I don't have a problem with that. I wasn't aware that you weren't putting it in on 5th Street. On a subdivision we would require a 5 foot sidewalk. Is that not required in Industrial? Eng. Smith: In the Central Valley Corporate Park Development they did build that asphalt walkway and I think that was a deal that was struck with the Highway District and the Developer. The Motion was made by Tolsma and seconded by Yerrington to grant the request regarding the sidewalk along Franklin Road contingent upon a deed restriction if and when Franklin Road is redesigned or widened that sidewalk be installed at that time. Motion Carried: All Yea: • MERIDIAN CITY COUNCIL FEB. 4, 1992 PAGE S ITEM #3: DISCUSS AMENDMENT TO THE IMPACT AREA: Kingsford: Having a conflict I will step down and turn the meeting over to Council President Tolsma. Tolsma: Mr. Giesler can you inform us about the discussion held. on the impact area. Giesler: Right now we are working with the School District and the Commissioners and the City of Hoise to try to get an agreement between them regarding water and sewer. There's already been one on the water and we are trying to get one worked out on the sewer with the City of Boise. If that does not take place for some reason, in visiting with those Commissioner's I feel very confident that the Commissioner's will in fact go along with Hoise in allowing them to come a quarter mile west of Eagle Road. The reason being is because of the request from the School District to do so. They are in fact willing to work hoping that we can resolve this and leave the boundaries as is today. The School does not have a contract with Boise yet, we are in the middle of that right now. There is a meeting Thursday and hopefully we will know a lot more at that time as to maybe what's going to happen at that time. I feel that the Commissioner's will go along with Boise. I'm afraid that the school matter is going to persuade the Commissioners to allow Boise to service that area if something isn't worked out by a contract of some kind. Crookston: When an overlap is created - it's just the land use plain act does not speak to when an overlap occurs, or how it occurs, be the position that I've been trying to get the City of Meridian into is to in fact take the position and show to the County Commissioners that they are in fact faced with an overlap situation and unless they recommend a boundary that's acceptable to both parties. The overlap area there has to be an election for the residents in that area to decide whose area of impact they want to be in. tExplained process for agreement - see tape) The issue before the City Council is whether or not they want to approve that motion to extend the boundaries of the area of impact to what is outlined on this map. tExplained further) It is my recommendation to-the City to approve this area of impact with the boundaries being a quarter of a mile west of Cloverdale on the east, Chinden Blvd. on the north from a quarter of a mile west of Cloverdale to McDermott Road following the existing area . . • MERIDIAN CITY COUNCIL FEH. 4, 1992 PAGE 6 of impact until you get down to the southern referral area and include all the southern referral area into the Meridian Area of Impact. Then on that motion I believe it would be appropriate for Mr. Niemann and Mr. Tolsma to send another letter that you have taken that action and there is in fact an overlap. Then the Commissioners have the responsibility to make a recommendation to both City's as to what they deem an appropriate area of impact. If both City's disagree then it is up to them to conduct an election of the residents of the area of impact. tSee tape) Further Discussion. tSee Tape) The Motion was made by Corrie and seconded by Yerrington to amend the area of impact as outlined by the Planning & Zoning Commission to include the northern referral areas to McMillan Road following the line south of the impact area and also include the southern referral area as an added area of impact. Motion Carried: All Yea: The Motion was made by Yerrington and seconded by Corrie to have the attorney to draft a letter to the County Commissioner's. Motion Carried: All Yea: ITEM #4: WAYNE FORREY: UPDATE ON LID FOR DOWNTOWN PROJECT: Wayne Forrey: I am here tonight to give you an update on the East First Project LID and related projects. Last week Gary and I prepared a seventeen page report for Steve Spickelmeyer at the Highway District to give a justification of all the extended quantities and the change orders for the East First Street Project. We went through that report with Steve item by item and I think generally about 80% of all the change orders the Highway District excepted for payment. There are two major items that he would not except at that meeting. He felt that maybe on the front end of the project at the engineering phase there was perhaps some misunderstanding of quantities. tExplained further details with the asphalt) At this point the LID is at X185,000.00, the City has received the tree planting grant in the amount of f5, 600. 00 which the State says we can apply to the East First Street LID so that brings it down by X5600.00 so we are right at $180, 000.00. We are not able to send out the assessments until we know that final figure from the Highway District so that's where we are at. On the Phase II block • MERIDIAN CITY COUNCIL FEB. 4, 1992 PAGE 7 project, the review appraiser has been retained. They are currently reviewing the first appraisals that have been completed. Their work should be complete by next Monday, Feb. 10th. If that's the case, on Tuesday the 11th of February we will submit the contract and will also have the environmental review completed by next Tuesday. Also next week we are going to be walking door to door with Don Hubble along the Phase II project to meet all the property owners and look at all the drainage issues that might come up. For the past two weeks I've been working on housing inventory. Here's a tentative report, I should have a draft report for the Council on the 14th of February. The irrigation pipe at Camellia, I did get a hold of the Highway District and that is scheduled to be cleaned out this week. I asked them to contact Gary and give the City a run down of what they found. Also I got a call from Bob Belveal on the Foreign Trade Zone. He submitted a trade zone application, he got the results back from the Foreign Trade Zone Review Board, I think they had three minor changes. He was going to fax those changes to me for review and then I will pass them on to Wayne Crookston and the Mayor. The- Motion was made by Tolsma and seconded by Giesler to authorize the- Mayor to sign the Foreign Trade Zone draft upon approval of the Attorney and Wayne Forrey. Motion Carried: All Yea: ITEM #5: PRE-TERMINATION HEARING: WATER/SEWER/TRASH DELINQUENCIES: Kingsford: This is to inform you in writing, if you choose to, you have the right to a pre-determination hearing at 7:30 P. M. 02-04-92 before the Mayor and City Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer, and trash bill is delinquent. You may retain Counsel. This service will be discontinued 02-12-92 unless paid in full. Is there anyone present who wishes to contest their water, sewer and trash delinquency? No response. The Motion was made by Tolsma and seconded by Yerrington to approve the turn off list. Motion Carried: All Yea: ~, • • MERIDIAN CITY COUNCIL FEB. 4, 1992 PAGE 8 Kingsford: The total amount on the turn off list is ~6,682.75.They are hereby informed, that they may appeal or have the decision of the City reviewed by the Fourth Judicial Court pursuant to Idaho Code, even though they appeal their water will be shut off. ITEM #6: APPROVE THE BILLS: The Motion was made by Tolsma and seconded by Giesler to approve the bills. These actions are: 1. Extend the preliminary approval of the Preliminary Plat approved by Council on March 20, 1990. 2. Approve modifications to that approved preliminary plat which improve the circulation pattern but does include two culdesacs longer than your recent code amendment allows and some block lengths which are longer than the standard identified by code. Our basis for these requests have several supporting reasons which we have summarized below for the review of you and the Council. We will discuss these in more detail at the Council meeting. 1. After approval of the preliminary plat by Council, we proceeded with engineering of the first phase and actually completed the design, submitted the plans and the plat to the City for final approval of Phase One. By then, the middle of 1990, the market had changed and it was necessary to redesign the concept to eliminate the long spine road concept which was used in the approved preliminary. Another feature of that concept which we disliked was the depth of the lots, with some being extremely deep. 2. After the project had been replanned, we were again preparing to begin the first phase when the City adopted its Flood Plain Ordinance. When our engineers examined the flood plain maps they found that our entire first phase would be affected by the 100 year flood plain designation by FEMA. This was after we had stubbed an 8" water main across Cherry Lane before ACRD repaved Cherry Lane last Summer. BELMONT ~PA~K L~;AGLE YOINTE ~~IE NTC • • Our engineers have conducted an extensive flood analysis and decided upon the necessary improvements to the Nine Mile Creek crossing of Cherry Lane to eliminate the flood plain problem, but it will take at least a year for the federal agencies involved to complete their review. and approval. So, it became necessary to start our first phase of The Vineyards farther east than we intended. 3. The federal government owns the right-of-way of the Nine Mile Drain. The Bureau of Reclamation and Nampa-Meridian Irrigation District recently decided that they owned surplus width for the drain along the south boundary of The Vineyards and they could relinguish that land to us. The inclusion of this 40' strip of land created the need for another redesign of the preliminary plat. 4. Last year, the Ada County Highway District adopted an ordinance imposing impact fees on new development.. The effect and implementation of this imposition are still being determined and we still do not know how our construction along Cherry Lane frontage will be treated. We don't know what improvements will be required, nor do we know what credit, if any, we will receive for making improvement to Cherry Lane. All these items have combined to cause us considerable, although busy, delay. We have been trying to move forward, even to the extent of having a first phase designed and presented to the City for approval. We have also purchased and begun another project, Crystal Springs, across the street from The Vineyards on property which was not affected by the problems listed above. So you see that our delay was not caused by inactivity or lack of interest in the Meridian area, but instead by concerns over which we have no control. Therefore, we request the City Council to grant our two requests: 1. Extend the preliminary approval previously granted by the Council in March, 1990, and 2. Approve the modifications which we have made to the preliminary plat which we believe make it a better place to live and also improve the traffic circulation. These modifications include culdesacs and block lengths which exceed those listed in your ordinances.
