Kingsford at 7:30 P. M.. Members Present: Ron Tolsma, Bob Giesler, Max Yerrington, Bob Corrie. MINUTES OF THE PREVIOUS MEETING HELD MARCH 17, 1992: The Motion was made by Tolsma and seconded by Yerrington to approve the minutes of the previous meeting held March 17, 1992 as written: Motion Carried: All Yea: ITEM #1: HAROLD HALL, PRESIDENT OF SENIOR CITIZENS: Harold Hall: Read Statement on Area Three Agency on aging of which we are a part, is in the process of developing their next two year plan of aging for Southwestern Idaho. (See tape for° further statement) Personally invited the Mayor and Council to a speak out meeting at the Senior Center, 133 W. Broadway, Friday April 10th at 1:00 P. M.. We would like to have your input and answer any questions you may have. ITEM #2: FINDINGS OF FACT ON VACATION OF EASEMENT REQUEST BY STRASSER FARMS: The Motion was made by Tolsma and seconded by Giesler to approve the Findings of Fact on Vacation of Easement by Strasser Farms. No Response. ~ , 1 J MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 2 The Motion was made by Giesler and seconded by Corrie that the rules and provisions of 50-902 and all rules and provisions requiring that ordinances be read on three different days be dispensed with and that Ordinance #576 be passed and approved. The Motion was made by Tolsma and seconded by Yerrington to approve of the Final Plat for Chateau Meadows East #7. Motion Carried: All Yea: ITEM #5: COVENANTS CHATEAU MEADOWS EAST SUB. #7; Kingsford: Counselor have you review those? Crookston: Yes I have and I have delivered those changes to Mr. Niemann. The Motion was made by Corrie and seconded by Giesler that the Covenants for Chateau Meadows East Sub.'#7 be approved subject to the Engineer and the Attorney's approval. Motion Carried: All Yea: ITEM #6: FINAL PLAT ON THE LANDING SUBDIVISION #3: Dave Turnbull: We are here to request approval of a somewhat revised version of the Landing #3 Subdivision and I will answer any questions you may have. • w MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 3 Corrie: Have you seen the Engineer's comments? Are they all cleared up? Turnbull: From what I recall from the last meeting, we have agreed to take care of his requirements, The Motion was made by Giesler and seconded by Yerrington to approve the Final Plat on the Landing Subdivision #3: Motion Carried: All Yea: ITEM #7: SANITARY SERVICE: RATE INCREASE IN TRASH SERVICE: Moe Alidjani: We have made a proposal that is in front of you right now and we have been looking at this since January. Mr. Yerrington has been working with me to gather the information for this. I'd be happy to answer any questions you may have. Giesler: What's SSI on your break down? Kingsford: Sanitary Service Inc.. Alidjani: There is one correction I should make on the second line on the same page that Mr. Giesler is looking at for the limited two can there it says Boise Ada, they have just changed that to $6.80. Giesler: Moe, how long has it been since we had the last increase? Alidjani: I believe it was in November, November 15, 1990. Giesler: I guess I'd like to have an explanation of why an increase. Alidjani: We have been mandated by Federal Government or State Government, I'm not sure which one that all of our truck driver's cannot have just a chauffeur's licenses, they have to have a special CDL Class B License. With this qualification they have to go through the truck examine, break system, safety and so on and with that reason we have about a dollar an hour raise for our employees set out aside. With that I need about $24,000 a year budget just for dollar an hour manpower. Just have in mind that 33% of our gross revenue goes to employees salaries and wages. Also our truck insurance has been devastating to us, it's been about $1200 to $1300 a month and now it's about $2300 a month. That's per month for six trucks. • MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 4 Giesler: So your wanting to pay that employee for him to have that license? Alidjani: What's happening is when you ask an employee to go get a certain license, he can either work for me or go on home. I can't keep them fully in tact any more, because they would be qualified to drive long haul trucks and for that we are competing in the market. Giesler: You want to be more competitive on your wages then. Alidjani: we have to be, yes. Giesler: You just can't keep help. Alidjani: No we cannot. We are competing with the big truck companies. Once they obtain that license they can go to work for anybody, a concrete company or trucking and so on. Corrie: Moe have you had a dump fee increase? Alidjani: Have been informed that sometime within the next twelve months the dumping fee will jump 1300 from $9.00 a ton to $24.00 a ton, he could not give me an exact date. Kingsford: I know of nothing about an increase from the County Commissions at this point. Last time we talked about a rate increase we discussed the shape of your yard out there, you were supposed to build a building and put some of that stuff inside. Alidjani: That will be done before this fall. The last time I was here Councilman Giesler had a concern about the shape of the trucks and so on and so forth and that is what we have been working on. Kingsford: Well Moe I think you need to separate those two things out, we need to have that cleaned up. Alidjani: That's fine. Kingsford: Several of those pieces of equipment I asked you to have out of sight - Alidjani: I have sold four of the trucks and there is three still available for sale. Kingsford: Again, those things need to be gone, we can't wait forever on that. MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 5 The Motion was made by Yerrington and seconded by Corrie to approve this proposal with an effective date of May 15, 1992, Giesler: This is the first time I've really had an opportunity to look at these figures and visit with individuals and I think I'd like to research i t a l i t t l e bi t more . I can see where Moe' s coming from about wages with his employees. Yerrington: Well I made the motion and I'm comfortable with it. Motion: 2 - Yea; 2 Nea; Kingsford: Vote to break tie - Nea; Let's look at it after a week or two, it won't hurt us to evaluate this a little. The Motion was made by Tolsma and seconded by Giesler to table this request until the next meeting. Motion Carried: All Yea: ITEM #8: COVENANTS ON KEARNEY PLACE SUBDIVISION: The Motion was made by Tolsma and seconded by Yerrington to approve of the Covenants on Kearney Place. Motion Carried: All Yea: ITEM #9: PRE-TERMINATION HEARING: WATER/SEWER/TRASH DELINQUENCIES: Kingsford: This is to inform you in writing, if you choose to you have a right to a pre-termination hearing at 7:30 P.M,, April 7, 1992, before the Mayor and Council to appear in person to be judged on the facts and defend the claim made by the City that your water/ sewer/trash is delinquent. You may retain Counsel. This service will be discontinued on April 15, 1992 unless payment is received in full. Is there any one from the public who would like to contest their water/sewer/trash delinquency? No response. The Motion was made by Yerrington and seconded by Giesler to approve of the turn vff list. Motion Carried: All Yea: Kingsford: They are hereby informed that they may appeal or have the decision of the City reviewed by Fourth ,judicial Court pursuant to Idaho Code. Even though they appeal their water will be shut off. The amount of the turn off list is $5,873.65. MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 6 ITEM #10: APPROVE THE BILLS: The Motion was made by Tol sma and seconded by Corri e to approve the bills. Motion Carried: All Yea: ITEM #11: RESOLUTION #144: CITY EXCESSIVE FORCE POLICY: The Motion was made by Tol sma and seconded by Yerr i ngton to approve of Resolution #144. Motion Carried: All Yea: ITEM #12: WAYNE FORREY: UPDATE ON DOWNTOWN PROJECT: Forrey: Handed out to Mayor and Council members a Project Status letter. Item #2 is the downtown project and we do have two of four appraisals completed. The other two are being jointly reviewed by both appraisers. We should have that hopefully by the end of this week. At that point then we need to sit down with legal counsel and look at structuring an offer to the parcel's that the City would like to acquire in Phase II. The first item there is the well site south of I-84. The Mayor did submit a letter to the Boy Scouts who own property next to the Coca Cola property and they made a decision to turn down the City's request to donate a well site. Item #3, the tree grant, the City does need to select a landscape firm to maintain the trees and then we need to submit a letter to the State indicating our selection and the final cost of that. Then they will release those funds. Item #4, the 11th Street pipe blockage - Roto Rooter has agreed to clean that pipe out and they are on deck ready to do that work but they wanted to have water in the ditch to make sure their auger worked right and to flush that material out. The first day or first week there is water in the ditch they will go in and do that work. Item #5, it was brought to our attention that Mr. Brent Alger had a difficult situation with costs and so American Paving is remeasuring his footage and making some adjustments. Item #6, Computrol Closeout should be done by next week. • • MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 7 Item #7, the Sewer Rate Analysis, I believe we will have a draft analysis report to the Mayor and Council, Jack and Gary by April 17th. Item #8, Gary has talked about having a meeting of property owners on Leisure Lane and we anticipate meeting with them April 10th. Item #9, Foreign Trade Zone, a proposal has come to the City regarding the need for a rail spur into the Treasure Valley Business Park with Tom Wright and surface transportation. This is a firm that the City has been working with on the Foreign Trade Zone. Myself and representatives from Tom Wright's office and Service Transportation have met with the Idaho Department of Commerce and they have since followed up with a letter to the Mayor. They see a good potential for a block grant there. I believe the Council should consider this and if you feel the City should attempt to put that project together and ultimately apply for a grant, I think you need to make some decisions regarding that. Yerrington: What's the cost of a spur to go in now? Forrey: For that particular project about $300,000.00. There is also some irrigation and drainage concerns in there and that might bump it up some. Kingsford: What kind of a time frame would you need to put together a grant like that Wayne? Forrey: A decision by the next Council meeting or sooner if that's possible. Giesler: What portion of the $300,000.00 would that grant pick up? Forrey: At this point, I don't know. In terms of the grant regulations the more money the City puts in the better. Tom Wright is willing to put money into it, Service Transportation is willing to invest money, they already have. It will take a little time to put together. We will approach Union Pacific also. The Motion was made by Corrie and seconded by Yerrington that we instruct Mr. Forrey to begin the application process. Motion Carried: All Yea: • MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 8 Forrey: Item #10, is the LID #90-1, at this point the Transportation Department and the Ada County Highway District approved the City's request for supplemental funding, so we now have a firm budget and the costs have been audited. We are ready now to jump forward into this LID process so we need the Council to instruct Gary and myself to proceed and get this LID assessment put together and the notices out and to schedule a public hearing. I would suggest May 19th at your Council meeting to have that public hearing. The Motion was made by Yerr i ngton and seconded by To 1 sma to approve of publishing May 19, 1992 as the LID Hearing. Motion Carried: All Yea: Forrey: Item #11, Glennfield Manor #2 & #3 - I have to tell you I dropped the ball on this sometime ago. i received same instructions to look at an open ditch and in my mind I was thinking a small ditch and it needed to be piped. Then some complaints came i n and Gary advised me and wanted to know what ever happened on that. I went out and meant with some property owners and it's actually bigger than I thought. It's a small canal and property owners out there are pretty upset about the potential of a dog ar cat or a child getting in that and not being able to live. As a condition of Glennfield #6 the developer was required to pipe that Settler's Canal and it is currently piped about 200 feet so at the very end of Monaco Street there is 200 feet of piping, however the developer, even though he was required by Settler's Irrigation District to put in a trash rack or a week rack there isn't one there. I meant with the Settler's Irrigation District today at their board meeting and asked them two things, if they would require a trash rack, I was unaware that that was a stipulation of the developer and secondly if they would participate financially in getting a pipe constructed all the way through that Glennfield Manor Subdivision. My thought to them was that possibly Max Boesiger could pay a portion of that cost, which he has said over the phone to me that he would, that property owners would pay a portion of the cost and I have spoken with some of the property owners. Max thinks it's going to be about $40,000.00 to pipe this portion of open ditch. Without any advance warning I'm springing this on you - in my mind if the property owners put up $10,000.00 and the City put up $10,000.00, the Irrigation District $10,000.00 and Max Boesiger, maybe it could be done. I don't know if that's a solution. I did take it before the Irrigation District today and they took it under advisement. I explained to them that the problem is not going away, there has been correspondence on this ' • • MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 9 dating back to 1987. However,- to put in that trash rack they feel that's the City's role because the City adopted their conditions as part of your plat conditions so they feel that it is the City's enforcement position to go out and make sure that's done. The property owners definitely want a trash rack and I got a copy of the minutes for you Jack of the Irrigation District showing that that i s a condition they placed on the deve 1 oper and i t i s not been complied with, yet. Kingsford: I thought that maybe just part of that was a problem, that some of those property owners still don't mind having that open. Is that not true? Forrey: That might be true. Explained which owners want it piped. Kingsford: What would be the cost of just this portion. Forrey: Max estimates $20,000.00. The irrigation district today said that they could pipe and they would do that on their own, the balance on this lot right here, take it to that lot. They had that in their budget last year and didn't get it done. Kingsford: When will the irrigation district make a decision on that or did they just take it under advisement? Forrey: Under advisement. Eng. Smith: One of the other things that's going to be a problem is the ditch will have water in it within a week. I think that, i don't think maybe the property owners realize this, the property owners in Subdivision #2 will be picking up about 20 feet of useful property that they presently don't have. I think they need to be. aware of that. Forrey: We didn't discuss that. Eng. Smith: Because their property line is basically on the west side of that ditch. Mr. Fuller realigned that ditch and pushed it to the west side of that property. Wayne is right when he said that was started out as an amenity to those lots, at least that's what Mr. Fuller's idea was. Not only that but the property owners in Subdivision #3 where there is an existing 18 foot easement that is basically going to be weeds and a distraction for that subdivision, I think those three lots, maybe four lots have fenced that out so there's another 18 feet that the lots in #3 will be able to pick up and use. MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 10 Forrey: Those property owners want something and I'll continue to work in any direction the Council wants. Kingsford: I'd recommend to the Council that we lean on Max Boesiger and have him set that money aside. I don't think we can get i t done thi s year and direct you to continue working and be sure that the screen gets put in before the water's in. We received sometime ago bids from Du-Rite Nursery and Border Landscaping to take care of the trees on First Street for three years which i s part of the tree grant that we got . We have the ability to pick up money from the tree grant in the amount of $5600.00. The low bid is Border Landscaping $2870.00 for the three year period and Du-Rite Nursery was going to wrap the trees in the Fall of the first year making it the difference in expense their bid was for $4500.00, the additional one that we got a bid from did that call for wrapping? Forrey: No it didn't. Kingsford: So they didn't feel it was necessary either. So you have those bids. The one that we don't have the name on is for $3300.00. We need to designate a Nursery to take care of those so we can get the tree grant funds released. Corrie: I have a question on #i the well site, are there any ramifications because of the Boy Scouts denying that request? Kingsford: No. We are pursuing with Mr. Fuller a well site in Meridian Greens and looking at becoming a member of their homeowners association for the maintenance of it. Where are we at with that now Gary? Eng. Smith: I've met with both Norm and Chuck Fuller and Glen Scott and they don't have a problem in donating the well lot to us as long as we engage in some landscape efforts on that lot and part of the landscaping would be some berm work along overland Road and also along E. 5th and then whatever kind of a landscape plan we can work up that would be acceptable to the Homeowners Association. The cost that Norm Fuller was talking about was considerably less than a cost of the lot. Probably i/3 less. I still need to meet with the Irrigation District to see what kind of a setback we are going to be required as far as the i r easement i s concerned on E i ght Mile Lateral. Also I need to talk to the Highway District about any possible improvements to Overland Road that they may require. MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 11 I've met with the Power Company and power is of course right there on Overland Road, it would require setting another pole but we could either go overhead from the pole to the pump house or underground from transformers on the pole. Also, I have some information back on the pressure boost station from Main Water Systems and I need to get that information to Councilman Tolsma so we can discuss it. It's a feasible solution. Again, if the well lot works out, the pump station can be located either in the well house or in a vault on the well lot. Kingsford: Another condition was to have the siding of the well house and the roof coincide with Meridian Greens. Eng. Smith: I've met with a hydro-geologist from Boise State University concerning our locations of wells and they inform me there really isn't a problem with locating a well anywhere in the Meridian area. Basically the thing that we need to watch is specifications for drilling of the well. (Further explanation - see tape) Discussion (See tape) Yerrington: I have a question for Mr. Forrey. On East First there was supposed to be some crosswalks, where you going to check into that to see when they are going to be done? Forrey: Yes sir. We wrote a letter to the Highway District asking them to get scheduled as soon as possible. Yerrington: How many crosswalks are involved in town? Forrey: I think all the intersections. Kingsford: We still need a motion or something an the tree care. The Motion was made by Giesler and seconded by Tolsma to approve the bid from Border Landscaping for $2,870.00. Motion Carried: All Yea: Giesler: I have one question of Mr. Forrey real quick. The Street is basically complete now, I mean they've been back and done all their repairs and things. ' f MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 12 Forrey: Not all of them. There's a punch list that's been developed and I think there was forty to fifty items on that and there is about half of them done. There's still another twenty items to be completed. ITEM #13: DISCUSSION AND ACTION ON IMPACT AREA: Kingsford: As the Counci 1 may be aware we had a ful 1 gathering two weeks ago. Bob, Wayne and I went up to the County Commission Hearing and offered testimony on that i ssue . We a 1 so had a meeting in their presence at the Commissioner's Office with some of their staff and Dirk Kempthorne and at that time we finally agreed that we couldn't agree, that Boise wanted all of it or nothing. The County Commission then at their last meeting went ahead and passed on allowing that to be in Boise's Area of Impact. We need direction here if we want to pursue the Land Use Planning Act and call for a vote. I think the County Commissioner's are already geared up to that, I gave them a pretty good indication that that's probably the route we would go. Giesler: I'm sure everybody knows that this issue in the eight and a half years I've been on the Council, this issue is probably one of the most important I've dealt with. I have some real strong feelings about this. I feel we've been let down by the County Commissioner's and that I think the testimony that yourself, Wayne and myself gave I think it was more than adequate that we were able to have that in our area of impact. The decision that the Commissioner's have given, there's nothing really stating that Boise City couldn't be between Eagle and us clear to the Canyon County line. I'm very disappointed in this decision that the Commissioner's have made. They told me that the school and the development wouldn't dictate where City limits were going to be, or the area of impact. The school issue was the only thing before we got done with this thing, it looked like big developers and the school did dictate where it went and I think that's very unfortunate that those things have that kind of control over what happens to City's . i don' t think the schoo 1 out there i s an i ssue . I think that there again shows the very poor planning of the school board. (Further explanation - see tape) I would like to see the Counci 1 go ahead, and even though I feel that i f i t goes to the vote of the people that they will vote in favor of Boise because all those owners are thinking about raising, inflating the price of their property, but I would like to have it be a decision of those people and not us. That we have done everything, and used every avenue that the City has available to try to keep this in our area, so I would really like to recommend that we ask for that election. R ' f ' MERIDIAN CITY COUNCIL APR I L 7, 1992 PAGE 13 The Motion was made by Giesler and seconded by Tolsma to pursue the election in the affected area to let the property owners make that decision of which area of impact they feel they should be in. Kingsford: Prior to the- vote I'd just like to say one thing. While I concur with most everything Bob said I think the County Commissioner's are in a precarious situation. If we wouldn't be pushing the vote, Boise would. Motion Carried: All Yea: Giesler: One other thing on that issue, I would like to thank everybody that helped on this issue. ITEM #14: DEPARTMENT REPORTS: Kingsford: I have one comment I'd like to make while Jim is here. I have visited a little bit with City Staff and numerous people in town have indicated a concern, with the speed that we are growing that we need to do something in the way of open space and parks. I'd like to suggest that as we look at Planning, both the Council and Planning and Zoning, as a developer comes in with a proposal we try to look at a big picture area. Require some property from each of them that might be adjoined to others and see if we can't get 10-15 acres in a spot over a period of time in several areas and work toward that. Eng. Smith: To bring you up to date on the slough sewer. The contractor is almost through Simunich property and they are crossing the Creason feeder ditch right now. The sewer in Meridian Road is completed and the contractor has started the water installation. For your information, the drain line at Chateau Meadows Subdivision has been completed. Shortly after they completed that they discovered about eight to ten feet from the inlet structure where the contractor plowing in the cable for telephone and cable T.V. had gone through the pipe and had made a rather inadequate repair of that pipe and it had failed causing a significant amount of gravel to fall through. They are in some kind of a claim situation now between Mr. Blaser and the contractor that installed the cable. Bob, your question about pavers around the trees, the Kiwanis Club is undertaking a service project and that will be the project. MERIDIAN CITY COUNCIL APRIL 7, 1992 PRGE 14 Corrie: I agree with everything that Bob said. One of the things that concerns me is the lack of communication between the Council and the School Board. I don't see that the School Board is even trying to open up a communication channel and I would challenge them to do so and I think it will help us all down the line. Kingsford: On that line I might add, we were asked almost a month ago, a committee was formed two months ago on school siting they asked for a representative from each City. That committee has met three times, Jack went once and I went once. They have a pretty good program put together and we were involved in it and they recognize some of the pit falls they took in several other buildings that they have undertaken. I think it was useful and needs to be pursued in the future. Tol sma : I be 1 i eve we have the Prayer Breakfast i s coming up on April 29th. City Clerk: I've got a request from Dan Sweet, he is getting ready to build a new home out there on the lot he has got on Strasser Farm and he needs approval to hook up to our water and sewer. He needs a letter from us stating we will allow this and he will have to pay the hookup fees and latecomer fees but they won't issue his building permit until he has this letter. The Motion was made by Giesler and seconded by Yerrington to approve of Mr. Sweet's request to hookup to City lines when they are active. Don Bryan: I would like to ask about Mr. Crookston's communication with Nampa Meridian Irrigation on my problem. Crookston: I've had several discussions with their attorney, I've sent him Gary Smith's comments and asked for input from him. I need to get back to him and see what's going on because there is going to be water in it in ten days probably. I will call tomorrow. His initial explanation to me was that he thought a developer had gone in there without a license agreement and constructed that MERIDIAN CITY COUNCIL APRIL 7, 1992 PAGE 15 downstream problem, which is downsized from what's upstream. He led me to believe that because of that fact the irrigation district didn't feel as though they had a responsibility for it. They did at one point offer to do the work if the City would pay for the materials or vis a versa and that's as far as I've gotten with it. Kingsford: What was the length of that smaller pipe? WHEREAS, the Congress of the United States has passed the Armstrong/Walker "Excessive Force" Amendment (P. L. 101-144 section 519) prohibiting the use of excessive force by a local law enforcement agency against any individuals engaged in nonviolent civil rights demonstrations within its jurisdiction; AND WHEREAS, the City of Meridian has received a Community Development Block Grant and is required to comply with the Armstrong/Walker "excessive force" Amendment; AND WHEREAS, the use of excessive force against demonstrators may cause the CITY to lose its grant or eligibility for future federal grants; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MERIDIAN, IDAHO: Section 1. It is the POLICY of the CITY that excessive force by local law enforcement agencies shall not be used against individuals engaged in lawful and non-violent civil rights demonstrations within the City boundaries.
