Kingsford at 7:30 P. M.: Members Present: Ron Tolsma, Bob Giesler, Max Yerrington, Bob Corrie: Other Present: Jeff Miller, John Olsen, Robb Canfield, Larry Bertetto, Don Bryan, Richard & Max Boesiger, Wayne Crookston, Moe Alidjani, Gary Smith, Bill Gordon, Jim Johnson, Members of Boy Scout Troop #30, Frank Thomason: MINUTES OF THE PREVIOUS MEETING HELD APRIL 7, 1992: The Motion was made by Tolsma and seconded by Corrie to approve the minutes of the previous meeting held April 7, 1992 as written: Motion Carried: All Yea: Kingsford: Welcomed Boy Scout Troop #30 to the meeting. Read Proclamation for May 1-7, 1992 as Respect for the Law Week. Mr. Bert Myers is representing the Optimist Club tonight. ITEM #1: SANITARY SERVICE: RATE INCREASE IN TRASH SERVICE: TABLED AT PRIOR MEETING: Giesler: I have had a chance to review and I think the rates are competitive. to see is an improvement in the appearan would like to see Moe staying on top of the place up including the house that is the rate itself I feel it is in line. If would be great. this and talk with Moe The only thing I'd like ce of the employees. I that and also cleaning there also. As far as uniforms will work that Alidjani: After our conversation Mr. Giesler we have asked for bids from five different places on uniforms, but have not had any response yet. Giesler: If uniforms doesn't work out I'd like you to keep, you know watch that. Alidjani: I'm sure without a uniform it's not going to work. If we have a uniform it would be something we can enforce, that basically would be part of the job. Giesler: I definitely don't want to see them without a shirt. Tolsma: I've visited with Moe also and we discussed the same things that Bob has mentioned, and I have no problem with the rate increase. I concur with Bob on the cleanup. MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 2 Alidjani: Certainly I will talk to my tenants and give them some kind of ultimatum, either he's got to clean up or he can leave. The Motion was made by Yerrington to approve this rate increase and also increase the take of the City from 5X to 6X with the agreement of Moe. Kingsford: You agree with that Moe? Alidjani: I didn't know anything about it until right now. Yerrington: We talked about it but it wasn't part of my proposal, but that's fine. There was another item that we discussed and that is the Senior Citizen rate. My feeling is instead of having a Senior Citizen rate for age, have it for hardship cases only. This is just an idea. Kingsford: I'd suggest that maybe we take a look at that for the next time Max, but it's inappropriate for us to deal on that tonight. Tolsma seconded the motion made by Yerrington. Motion Carried: All Yea: ITEM #2: PUBLIC HEARING: PRELIMINARY PLAT W/VARIANCE REQUEST BY BOESIGER, INC. ON THE VINEYARDS SUBDIVISION: Kingsford: I will open the Public Hearing and invite the representative of Boesiger Inc. to come forward. Max Boesiger, 1399 E. Montery Drive, Boise, was sworn by the attorney. Boesiger: This is the same one as was presented to you over a month ago, there's been no changes to it since that time and it has gone through Planning and Zoning and they recommended approval. Just to be brief, this new layout is a lot better than our old layout. It's better according to the standard codes of the Life Safety Standards because number one it has fewer long culdesacs then did the old one. This plan also has better access to the lots. Most of the lots on there have access from both directions which is a much safer layout. Also as you can see the spine road concept that we had in there, we've pretty much done n MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 3 C~ away with and that will eliminate that race track effect that we were so concerned about. Also this new layout is much more marketable and the reason for that is that the lots have a wider frontage. Most of the lots in there are over 80 feet. The housing prices in here will average in the $130,000 price range. We are now ready to proceed, we would like to start construction immediately so we hope that you will approve this preliminary and final plat. I'd be happy to answer any questions. Tolsma: What you've outlined in the dark in the middle, is that the first phase? Boesiger: Yes. Originally phase I was in the northwest quarter there, the reason we had to change that was because of the flood plan. The conduit under Cherry Lane is undersized, it's been there for years of course and in the event of a flood they think that the water will back up. What we will have to do is work out a new detail where we up-size that conduit. This will all take about a year. Giesler: How large of a home are you talking in that price range? Boesiger: 5130,000 would probably buy a 2600 to 2700 sq. foot house. There will probably be some that are less square footage than that, but higher quality that would be in the same price range. I suspect the price range will be from $115,000 low to X150,000 for high in the first phase. Corrie: I have one problem with the long Street. Do you anticipate any problems with drag racing or anything? Boesiger: One thing about it, that street won't connect all the way through until the project is finished. Kingsford: How many lots in the first phase? Boesiger: 39 lots. Corrie: The Fire Department made some comments, I know what two of them are but that #6 that's a little green area facing Cherry Lane, is that part of that grassy area that would be taken care of by the Homeowners Association? Boesiger: Yes. • • MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 4 Yerrington: Will all the berms be put in for all the sections of the whole subdivision? Boesiger: We will put them in, but not all in phase I. We may curb, gutter and sidewalk all the way from Linder and Cherry Lane out through phase I, we may that's being discussed. So if we do that we will probably go ahead and build the berm but we probably wouldn't landscape it until that phase comes on. Yerrington: When you put the berm in are you going to sod it? Boesiger: Yes. Crookston: Would you address the variance request? Boesiger: The variance request is for the two long culdesacs. They are in the easterly half of the project where those culdesacs are slightly longer than the maximum allowance. I think those are both in the neighborhood of 500 feet and the code is 450 feet. Crookston: Your also asking for a variance on the block length, would you address that? Also which blocks? Boesiger: Explained which blocks. What we are asking for basically is to not have to put in an intersection. Kingsford: So basically we are looking at three variances. Block length on those two blocks and length of culdesacs on the two culdesacs to the east. Boesiger: I believe the only block length that requires a variance is the most southerly one. Then the culdesacs. If they both are then that would be the case. Kingsford: Anyone else from the public to testify? No response. I will close the Public Hearing. Giesler: Has everything been handled with the City Engineer. Engineer Smith: I don't think there's any problems, they have been real good about making corrections. Motion Carried: All Yea: ITEM #3: FINAL PLAT ON PHASE #1 OF THE VINEYARDS SUBDIVISION: The Motion was made by Tolsma and seconded by Giesler to approve the final plat on phase #1 for the Vineyards Subdivision. Motion Carried: All Yea: ITEM #4: COVENANTS ON THE VINEYARD SUBDIVISION: The Motion was made by Corrie and seconded by Giesler to approve the covenants for the Vineyard Subdivision conditioned upon the Attorney and Engineer's review. Motion Carried: All Yea: ITEM #5: RESOLUTION #145: RESOLUTION SETTING DEVELOPER CONTRIBUTION TO WELL FUND IN LIEU OF PRESSURIZED IRRIGATION: Kingsford: A RESOLUTION OF THE CITY THE CITY CDUNCIL OF THE CITY OF MERIDIAN ESTABLISHING AND SETTING THE AMDUNT OF FUNDS THAT MAY BE DEPOSITED WITH THE CITY TO ENABLE A DEVELOPER TO OBTAIN A WAIVER OF THE REGtUIREMENT THAT A SUBDIVIDER PROVIDE, BY UNDERGROUND CONDUIT, PRESSURIZED IRRIGATION WATER TD EACH AND EVERY LOT WITHIN THE SUBDIVISION THAT THE SUBDIVIDER IS SUBDIVIDING; SETTING FORTH THATS THE AMOUNT OF FEES ESTABLISHED HEREUNDER MAY BE INCREASED FROM YEAR TO YEAR TO ADJUST FOR THE CONSTRUCTION COST INDEX, THE CONSUMER PRICE INDEX, THE PREVAILING LAND PRICES FOR A WELL SITE, AND OTHER ADJUSTMENTS THAT ARE NECESSARY; AND ESTABLISHING THE DATE THAT SUCH FUNDS MUST BE PAID TO THE CITY IF THE SUBDIVIDER IS TO TAKE ADVANTAGE OF THE WAIVER; AND PROVIDING AN EFFECTIVE DATE. Motion Carried: All Yea: • • MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 6 ITEM #6: RESOLUTION #146: RESOLUTION SETTING TIME OF HEARING ON ASSESSMENT ROLL FOR LID 90-1: Kingsford: A RESOLUTION OF THE CITY OF MERIDIAN, FIXING THE TIME AND PLACE OF HEARING ON THE LOCAL IMPROVEMENT DISTRICT N0. 9D-1, ASSESSMENT RDLL; PROVIDING THAT OWNERS IN THE LOCAL IMPROVEMENT DISTRICT MAY APPEAR AT SAID HEARING AND OBJECT TO THEIR ASSESSMENT, THE CORRECTNESS OF THE ASSESSMENT, OR TO THE REGULARITY OF THE PROCEEDINGS. The Motion was made by Yerrington and seconded by Tolsma to approve Resolution #146. Motion Carried: All Yea: ITEM #7: REGtUEST BY IDA & JACK SWEET TO CONNECT TO CITY WATER AND SEWER ON NORTH MERIDIAN RD.: Kingsford: This property lays outside the City. Gary do you have any recommendations? Engineer Smith: The sewer and water will be active June 1st or thereabouts and the services have been stubbed into their property in anticipation of their constructing a new home. The water and sewer will be available via the services that have been constructed. The Motion was made by Tolsma and seconded by Corrie to approve the connection to City water and sewer for Ida & Jack Sweet on Meridian Road with the appropriate fees being paid. Motion Carried: All Yea: ITEM #8: DEPARTMENT REPORTS: Eng. Smith: Wayne Crookston gave me a letter that he had received from Andrew Harrington, who is the legal counsel for Nampa Meridian Irrigation District. This letter concerns the Jackson Stub Drain, which is the drain that it's upper end is at the northeast corner of Don Bryant's property on Locust Grove Road and it drains to the west eventually discharging near the southwest corner of Settlers Subdivision. • MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 7 Kingsford: How many feet are we talking about there? Eng. Smith: The piece that's under question, the length of that through Meridian Place Subdivision I don't have an exact length but I think it's somewhere around 800 to 1000 feet. In November of 1991 I wrote a letter to John Anderson at Nampa Meridian stating what I felt the problem was as far as the pipe size and the fact that Nampa Meridian had required Gem Park #1 subdivision to install 24" diameter drain pipe and this piece that exists through Meridian Place is 18" diameter. They also installed a 24" diameter pipe under Locust Grove Road as part of Gem Park's project. The legal counsel for Nampa Meridian Irrigation District responded to Wayne. Letter was read stating that Nampa Meridian would offer to replace the 18" pipe with a 24" pipe with all costs, both labor and materials to be borne by the District, it would be the responsibility of the City of Meridian or some other than the district to arrange with the landowners affected by the pipe replacement to concur the work on and along their property. A written agreement will be necessary. The Council should decide if this is something that the City should be involved in as far as contact with the property owners or not. Giesler: They must admit that they are at fault if they are willing to do that. Crookston: Mr. Harrington indicated to me that he was going to ascertain whether or nat prior approval for the 18" and also the 24" had been obtained from Nampa Meridian and was going to let me know about that in this letter, but he did not do that. Giesler: If they are willing to do that they must realize the problem and they are responsible for it. Kingsford: I think we ow consideration to try and get it suggest that we see if we can't people and get it moving. I advised to not do anything with the Fall. Is that running live e those people out there the done as fast as we can. I would get Wayne Forney to contact those suspicion that we would be best it until the water is back out in now? Eng. Smith: Yes. One thing that I might mention, the drain line that was replaced in Chateau Meadows Subdivision this past year was scheduled to be replaced during the winter months when there will be less damage to the ground from the digging operation. Assuming that the irrigation district would be able to get in there during that time period and make that replacement. This one at Chateau didn't work out that way, they still waited until Spring Time basically to replace it. I think that the idea is a good idea. MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 8 Giesler: I would like us though to look into that and see if that isn't something they feel that they could get on right away, there might be a way that it could be done. I think we owe those people to get it done right away. Eng. Smith: I will check with Nampa Meridian and see what they feel would be an appropriate time. Kingsford: Let's get Mr. Forrey involved and get those homeowners contacted. Eng. Smith: On another item, I received a State Health and Welfare approval on our well site near the corner of SE 5th and Meridian Rd. and they don't feel there is any problem as long as we stay 50' from the canal bank. I also have a request for proposal from the hydrogeologist to put the specifications together for the well and also to monitor the drilling of the well so we can be sure that we get out screens placed at the right locations elevation wise to get a maximum flow from the well. I have received a quotation for a pressure boost station and it has exceeded the amount that we can spend without the bidding process so we need to look at that to decide which direction to proceed. Tolsma: If we put the figures together how long is it going to take? Kingsford: Two weeks. The Motion was made by Tolsma and seconded by Giesler to authorize the Engineer advertise for the booster pump. Motion Carried: All Yea: Giesler: The problem that we had last week at Don Bryant's house, how did that come out? Eng. Smith: After I was informed of the problem I went out and looked at it and there was a small lake developing in Don's pasture area and I lifted the manhole lid at the intersection of Oakcrest that goes into Mirage Meadows. There was water running through that manhole from all directions. I ascertained that there was a plug on the pipe coming from the south. There's a length a pipe that parallels Locust Grove Road from the south, actually drains a small drainage ditch that lays along the south side of Don's property and I came back to the office and called the Highway District, talked to Gene Hall and he said he'd send ~. • MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 9 some people right out. Which he did I believe because that night I went home I checked and the water was gone. I also went up to Dixie Lane and walked up to the entrance of that structure and water was running under Dixie Lane from the fields to the east and it was going on through the pipe with no problems. Don Bryant: The development that has happened out there, I feel is the cause of the problem. Before it was developed I had a culvert going underneath the driveway and coming out on the other side of my property, it always ran clean and if the culvert ever plugged I cleaned it out. I've called Nampa Meridian and they won't return my calls. What I'm saying is I never had the problem before that collection box was put there. I don't know how you unplug a culvert and it's not even my water. I'm flooding out again tonight as we speak. I'm getting real upset with this. I appreciate your concern with getting to this but I can't wait until the Fall and putting up with this flooding every week. If it's not being taken care of and I continue to get flooding, I' 11 just have to get an attorney and we' 11 just have to fight it out I guess. Eng. Smith: There's two different problems. Your problem is the pipe in front of your place this time. The pipe that runs in front of your place was running about a little less than half full when I looked at it, so that pipe is not carrying the water out of there for one reason or another. Kingsford: Gary would you go to work on that. Eng. Smith: I sure will. Yerrington: The Mayor's Prayer Breakfast is April 29th. Giesler: On Sunburst Subdivision, they have the fence up but there's been nothing done with the landscaping and the weeds are growing up. I was wondering if we should find out what's going on. Tolsma: I've been noticing that our trees that were planted in downtown Meridian have grass growing up around them. Clerk Niemann: They are going to put rock around those pretty soon. K I NGSF , Y R ATTEST: MERIDIAN CITY COUNCIL APRIL 21, 1992 PAGE 10 • Kingsford: I guess we've got an elbow in the pipe that is on Norm's property and he is not very anxious to let us dig in there to clean it out. Eng. Smith: There is a 10 foot easement that exists along the west boundary of that subdivision from Clarinda Fair north to Camellia and the easement states in the plat that it's for drainage and utilities, so it does exist. We don't know where the pipe is in relation to the easement but the access to the pipe from Camellia is hindered because when they built the drain line, instead of putting a manhole in Camellia straight away from the drain pipe, they put an elbow in it and ran it over to an existing manhole. Now you can't get up the pipe and around the elbow with this cleaning equipment that Roto Rooter has. The real answer is to go to the elbow, dig it up and replace it with a manhole then you could access the drain line. I haven't talked to Mr. Fuller yet. The City of Meridian, Idaho, will conduct a public hearing on Tuesday, May 5, 1992 at 7:30 p.m. in the Meridian City Hall, Council Chambers. The purpose of the public hearing is to accept public comments on a proposed railroad spur to serve the Meridian Foreign Trade Zone which is proposed to be located within the Treasure Valley Business Center near Eagle Road and Fairview Avenue. The City of Meridian anticipates applying for an Idaho Community Development Block Grant (ICDBG) in the amount of $400,000 to help finance a proposed railroad spur line and related infrastructure improvements. The City of Meridian encourages the public to attend this hearing and offer comments. Written comments may also be submitted to the City Clerk no later than 5:00 p.m. on Tuesday, May 5, 1992. The property in question is in the N 1/2 of the NE 1/4 of Section 11, T. 3N., R. 1[a~., Boise Meridian, Ada County, Idaho. 6. That the property is zoned R-4 Residential. 7. That the property was preliminarily platted previously but the preliminary was allowed to lapse by the Applicant; that the Applicant states in its Application that the prior preliminary plat had eight cul-de-sacs that exceeded the 450 foot limitation and had three blocks that exceeded the 1,000 foot limitation. 8. That present preliminary plat of is significantly different than the one that was initially approved; the lots are larger and provide more street frontage; the developer has sacrificed some lots from the original preliminary plat; that the longer blocks for N. Santa Rosa and W. Sunny Slope do not appear to create problems for emergency access. 9. That the cul-de-sacs for which a variance has been requested are not significantly longer than the maximum required by ordinance of 450 feet; that the turnarounds appear to provide adequate radius for emergency vehicles. 10. That the City, as of the preparation of these preliminary Findings and Conclusions has not received the comments of the Ada County Highway District and if they are received they shall be incorporated herein as if set forth in full. 9. That the specific requirements regarding a variance that must be evidenced and found by the City Council are as follows: 11-9-612 A. 2, FINDINGS No variance shall be favorably unless there is a finding, as a that all of the following exist: a. That there are', such special circumstances or conditions affecting the property that the strict application of the provisions of this', Ordinance would clearly be impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. That the Applicant has requested that it be granted a variance from the above requirements and be allowed to have a block length of greater', than 1,000 feet and a cul-de-sac greater than 450 feet and stated in its Application "The intrusion of a cross street through these blocks will not serve any beneficial use but will instead '.disrupt the neighborhood and create 12 additional lots which are less desireable homesites because of increase traffic exposu~l're, greater wetbacks and less privacy and security. In this design, emergency access to all lots is just as rapid and convenient as if there were a cross street." With regard to the cul-de-sac length the Applicants states in its Application as follows:, "Two Culdesacs, W. Sunny Slope Court and N. Santa Rosa Place are 520 feet and 550 feet respectively in length, measured from the centerline of the intersecting street to the center of the cul-de-sac turnaround. Because of the shape and dimensions of the property boundary, this design presents the best overall arrangement of Lots and streets. The design provides a good mixture of privacy and safety. W. Sunny Slope Court could be turned either north or south at its terminus to avoid its slight overlength, however this would cause two additional corner lots, two very short blocks one of which would be less than the minimum allowed by the~'ordinance, and would increase the number of lots with have solar orientation. That the City has endeavored to have developers increase the size of lots and the value of the homes constructed thereon; that it is concluded that the Applicants change to larger lots should have, that effect; that the length of the two blocks and additional I~length of the cul-de-sacs should not be detrimental to the interests of the Development Ordinance. 9. That regarding Section 11-6-612 A it is specifically concluded as follows: a. That there are special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be unreasonable in that emergency vehicles do not appear to have the necessary access restricted. b. That strict compliance with the requirements of this Ordinance would not result in extraordinary hardship to the owner, subdivider 'or developer as a result of_ factors not self-inflicted but', the Applicant has endeavored to meet the safety requirements and has significantly enlarged the size of the lots which ;meets with the endeavors of the City. c. That the granting of the specified variance would not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated. d. That such variance would not have the effect of altering the interest and purpose of this Ordinance and the Meridian Comprehensive Plan. 10. THE CITY COUNCIL OF THE CITY OF MERIDIAN ESTABLISHING AND SETTING THE AMOUNT OF FUNDS THAT MAY BE DEPOSITED WITH THE CITY TO ENABLE A DEVELOPER TO OBTAIN A WAIVER OF THE REQUIREMENT THAT A SUBDIVIDER PROVIDE, BY UNDERGROUND CONDUIT, PRESSURIZED IRRIGATION 'WATER TO EACH AND EVERY LOT WITHIN THE SUBDIVISION THAT THE SUBDIVIDER IS SUBDIVIDING; SETTING FORTH THAT THE AMOUNT OF FEES ESTABLISHED HEREUNDER MAY BE INCREASED FROM YEAR TO YEAR TO ADJUST FOR THE CONSTRUCTION COST INDEX, THE CONSUMER PRICE INDEX, THE PREVAILING LAND PRICES FOR A WELL SITE, AND OTHER ADJUSTMENTS THAT ARE NECESSARY; AND ESTABLISHING THE DATE THAT SUCH FUNDS MUST BE PAID TO THE CITY IF THE SUBDIVIDER IS TO TAKE ADVANTAGE OF THE WAIVER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 11-9-606 B. 14, of the Revised and Compiled Ordinances of the City of Meridian requires that each subdivider of land provide by underground tile, or other like satisfactory underground conduit, pressurized irrigation water to each and every lot within the subdivision; WHEREAS, Section 11-9-606 6. 14, of the Revised and Compiled AMBROSE, FITZGERALD &CROOKSTON Attorneys and Counaelore P.O. Box 427 Merldlan, Ideho 83842 Telephone 8884481 one gallon of water per ,minute will provide an average daily flow to serve one residential lot and household; the average monthly summer use in Cherry Lane Village in August is 48,390 gallons and the average monthly winter use in December is 6,246, which means that the irrigation summer usage is 87.09% of the summer monthly use and determined to be irrigation use; that the estimated cost of a well site, drilling the well, and providing the .necessary equipment is $225,000.00; that dividing the cost of a well, $225,000.00 by the number of homes that the well will service and then taking the percent',age cost for the irrigation use. provides a figure of $245.00; ($225,000.00 / 800 X 87.09 % = 244.94); that the cost per lot for irrigation supply would be $245.00; WHEREAS, it has been determined that twenty-five percent of the capacity of a well'should be stored; that 25% of 1,152,000 gallons is 288,000 gallons; that the amount of stored water which would be used for irrigation is 87.09% of the total,• that 87.09% of 288,000 gallons i5 250,820 gallons; that the cost of constructing storage of'water is $.40 per gallon; that since the well would provide water for 800 lots the storage would do likewise; that amount of stored water for each lot would be 250,820 / 800 = 314 gallons; that $.40 per lot times 314 gallons per lot equals $126.00 per lot; WHEREAS, the cost of the well and the cost of the storage should be added together ($245.00 + 126 = 371.00 / lot) to determine the actual cost of the appropriate fee to assess RESOLUTION SETTING FEE FOR WAIVER OF PRESSURIZED IRRIGATION Page - 2 subdividers desiring to pay the waiver fee to avoid putting in pressurized irrigation themselves; WHEREAS, the cost of providing land, well and well equipment and necessary storage will increase over time and there is a need to adjust the cost of such facilities to reflect actual current costs when a subdivider desires to pay the waiver fee; and WHEREAS, there is a necessity to have the funds paid in advance so that the City can budget wells. THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, IDAHO: SECTION 1. That the above calculations accurately reflect the basis and formulas for determining the cost of the City to provide well water to be used for pressurized sprinkler irrigation. SECTION 2. That the fee authorized under 11-9-606 B. 14 for a subdivider to obtain a waiver of the requirement of providing underground pressurized irrigation is hereby established at the sum of $371.00 and such fee shall hereafter be referred to as the "Pressurized Irrigation Waiver Fee". SECTION 3. That the Pressurized Irrigation Waiver Fee may be adjusted by the City Council annually to reflect the Construction Cost Index as published by the Engineering News Record, the Consumer Price Index applicable to such costs, the AMBROSE, rate of inflation, and such other appropriate adjusting factors FITZGERALD BCROOKSTON as the City Counci 1 shal 1 deem appropriate. That if a subdivider desires to take advantage of the Pressurized Irrigation Waiver the subdivider shall pay such sum before the final plat of the subdivision is signed by the City Clerk and the City Engineer. THEY MAY FILE WRITTEN OBJECTIONS WITH THE CITY CLERK PRIOR TO THE HEARING OR THEY MAY FII.E WRITTEN OBJECTIONS AND APPEAR AND TESTIFY AT THE HEARING REGARDING THEIR OBJECTIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Local Improvement District No. 90-1 of the City of Meridian ("LID No. 90-1") was formed by Ordinance No. 540 of the City of Meridian adopted, July 17, 1990 and a contract for the improvements therein has been awarded; and WHEREAS, Gary D. Smith, P.E. City Engineer has been appointed by the City as Engineer for LID No. 90-1 and has submitted a cost spreadsheet and pay request form showing in detail the total cost and expenses of the improvements, the dollar amount payable from assessments and from other sources, and a form of assessment roll showing the amount chargeable to each lot or parcel of property. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Meridian, as follows: Section 1. S i n The City Clerk shall give notice of the hearing on the assessment roll by publication in the Valley News, the weekly official newspaper of the City, in two successive issues the first such publication being not less than fifteen days prior to the hearing. The City Clerk shall also mail notice of the hearing to each owner of property, if known, or his agent if know, within the limits of LID No. 90-1 addressed to such person at his post office address, if known; or, if unknown, to the main Meridian post office. The assessment roll is on file in the office of the City Clerk and is available for inspection by the public. At the hearing, the City Council will hear and determine all objections to the regularity of the proceedings in making assessments, the correctness of assessments, and the amount levied on particular lots or parcels in relation to the benefits accurring therein and in relation to the proper proportionate share of the total cost of the improvements in the project. Pursuant to Idaho Code "50-1713 -Notice of Hearing on Assessment Roll", each owner of property within Local Improvement District No. 90-1 is hereby .further notified that in revising the assessment roll, at or after the hearing, the City Council may increase any assessment or assessments up to twenty percent (20°l0) of the original amount thereof without giving further notice and holding a new hearing.
