Kingsford at 7:30 P. M.: Members Present: Ron Tolsma, Bob Giesler, Max Yerrington, Bob Corrie: Others Present: Tom Bevan, Don Bryan, Frank Thomason, Walter Casey, Lauri Swanbeck, LaRue Longhurst, Bill Gordon, Gary Smith, Jim Johnson, Walt Morrow, Wayne Crookston: MINUTES OF THE PREVIOUS MEETING HELD MAY 19, 1992: The Motion was made by Tolsma and seconded by Yerrington to approve the minutes of the previous meeting held May 19, 1992 as written: Motion Carried: All Yea: MINUTES OF THE LID PROTEST HEARING HELD MAY 19, 1992: The Motion was made by Tolsma and seconded by Gieller to approve the minutes of the LID Protest Hearing as written: Motion Carried: All Yea: ITEM #1: PROCLAMATION DECLARING JUNE 20, 1992 AS PAINT THE TOWN DAY: Kingsford: Read Proclamation declaring June 20, 1992 as Paint the Town Day. ITEM #2: PETER COVINO: TABLED AT THE MAY 19, 1992 MEETING: Kingsford: Mr. Morrow is here, he is the Chairman of the Appeals Board if you have any questions for him. Tolsma: Did the Chairman of the Appeal Board get the letter from the Post Consultation Services of Idaho? Morrow:' Yes I did. Tolsma: Is that your feeling? Crookston: Well the standard for review before a court, which I think can be safely sent over to the City level is two items. Whether or not the decision of lower entity is clearly erroneous in view of we're liable probative and substantial evidence on the whole record or whether it's arbitrary or capricious or characterized by abuse of discretion or clearly unwarranted exercise and discretion. MERIDIAN CITY COUNCIL JUNE 2, 1992 PAGE 2 Kingsford: I think an issue is whether or not we feel that their decision met either of those two categories. Crookston: That's correct. It would be improper to have an opinion voiced by a member of that committee. Kingsford: As I listen to you read that, it basically says that unless one of those two criteria are met this Council would have no ability to overall that or should not over-rule that. Crookston: Unless you find one or the other then it's appropriate to affirm the decision. If you do find one of those then it's appropriate to remand it back to the Building Appeal's Board. Tolsma: It's Pro Consultation Service's, their interpretation of the Code and what was going to happen in that building, this is what their interpretation of the code? Crookston: You can use that to assist you in determining whether or not either one of those measures have been met but it's still your decision. Kingsford: Counselor given the fact that the applicant is not here, do you think it would be prudent to table this until another meeting or shall we go ahead and render a decision? Crookston: Well he has presented his case at the previous Council Meeting. Kingsford: He did indicate that he would be forth coming with more information but it was supposed to be forth coming before this meeting. Crookston: Just to be fair to him I think it would be appropriate to table it and continue it until the next meeting if he doesn't show up tonight. The Motion was made by Tolsma and seconded by Yerrington to move this to the last item on the agenda then if he does show up we can clear this up. Motion Carried: All Yea: • ~ MERIDIAN CITY COUNCIL JUNE 2, 1992 PAGE 3 ITEM #3: ORDINANCE #577: ANNEXATION & ZONING OF MCBEE PROPERTY, CORNER OF TEN MILE & USTICK ROAD: PRELIMINARY PLAT NEEDS APPROVED IF ORDINANCE PASSED: Kingsford: AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS LOCATED IN GDVERNMENT LOT 4, SECTION 2, TOWNSHIP 3 NORTH, RANGE 1 WEST, ADA COUNTY, IDAHO; AND PROVIDING FDR AN EFFECTIVE DATE. Is there anyone present who wishes Ordinance #577 read in it's entirety? No response. The Motion was made by Giesler and seconded by Corrie that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with that Ordinance #577 be passed and approved. Roll Call Vote: Yerrington - Yea; Giesler - Yea; Corrie - Yea; Tolsma - Yea; Motion Carried: All Yea: The Motion was made by Tolsma and seconded by Yerrington to approve the preliminary plat conditioned upon the meeting the R-4 requirements. Motion Carried: All Yea: ITEM #4: ORDINANCE #578: ANNEXATION & ZONING OF WAITLEY PROPERTY, OVERLAND & SOUTH LOCUST GROVE: PRELIMINARY PLAT NEEDS APPROVED IF ORDINANCE PASSED: Kingsford: AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED A PDRTION OF THE NE 1/4 NE 1/4 OF SECTION 19, TOWNSHIP 3 NORTH, RANGE 1 EAST, B.M., ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE. Is there anyone who wishes Ordinance #578 read in it's entirety? No response. Motion Carried: All Yea: ITEM #5: COVENANTS ON MERIDIAN PLACE #3 SUBDIVISION: The Motion was made by Yerrington and seconded by Tolsma to approve the Covenants for Meridian Place #3 Subdivision. Motion Carried: All Yea: ITEM #6: KELTON NICHOLS, MERIDIAN SENIOR CITIZENS: Kelton Nichols: I'm here to present to you a plan that we have to do some remodeling in the near future. This is not a plan that has been approved by anyone. It uses all of our property that we have. It will be a one time deal and we need the space. There is a house to be moved and office buildings to be moved in order to put this into effect. The plan that we did have just covers about half of it, but when we go to do anything else there is a lot to be torn out and redone. Presented Council with a plan for remodel. We think that you people here and the people of the community should have a say in this building because your the ones that's going to inherit it down the road. We would like to have your input in it and we'd' like to get your help to advertise and maybe help us put on some fund raisers. ITEM #7: PRE-TERMINATION HEARING: WATER/SEWER/TRASH DEL I NGlUENC I ES Kingsford: This is to inform you in writing, if you choose to, you have the right to a pre-termination hearing at 7:30 p. m., on June 2, 1992 before the Mayor and City Council, to appear in person to be judged on the facts and the claim made by the City that your water, sewer, trash bill is delinquent. You may retain Counsel. The service will be discontinued on June 10, 1992 unless payment is received in full. Is there anyone from the public who would like to contest their water, sewer, trash delinquency? No response. The Motion was made by Yerrington and seconded by Tolsma to approve of the turn off list. Motion Carried: All Yea: • • MERIDIAN CITY COUNCIL JUNE 2, 1992 PAGE 5 Kingsford: They are hereby informed that they may appeal, or have the decision of the City reviewed by the Fourth Judicial Court pursuant to Idaho Code. Even though they appeal their water will be shut off. The amount of the turn off list is ~6, 864.60. ITEM #8: APPROVE THE BILLS: The Motion was made by Tolsma and seconded by Corrie to approve the bills. Motion Carried: All Yea: ITEM #9: DEPARTMENT REPORTS: Kingsford: Council Members you have Mr. Forrey's progress report, any questions or comments on that? Clerk Niemann: The item listed with the star beside it we need a motion to authorize the City Attorney to prepare documents to make offers to the land owners on First Street as required by the Department of Commerce. The Motion was made by Tolsma and seconded by Corrie to have the City Attorney to prepare the appropriate documents to make offers to the land owners on the First Street Project satisfactory to the Department of Commerce requirements. Motion Carried: All Yea: Clerk Niemann: The other item on the second page that needs to have a motion is to prepare the final assessment rolls, rate percentages, amount of years and so on. The Motion was made by Giesler and seconded by Tolsma to authorize the staff to prepare the final assessment roll, set the term at 10 years and set the interest rate at 6. 4X and advertise. Motion Carried: All Yea: Kingsford: I think Mr. Forrey has discussed the rest of these with the Council members. Clerk Niemann: I've got an application for transfer of beer license and a new liquor license for the New Farmer's Club. I need Council's approval. He has paid his fees and has his State License. i i MERIDIAN CITY COUNCIL JUNE 2, 1992 PAGE 6 The Motion was made by Tolsma and seconded by Yerrington to approve of the Liquor License and Beer transfer at the Farmer's Club. Motion Carried: All Yea: Clerk Niemann: The other item I have is out on Lanark Street, the time limit has come and gone for Beatrice Foods to clean up the weeds on their lot out there. The Motion was made by Yerrington and seconded by Giesler to authorize the clean up and bill to Beatrice Foods. Motion Carried: All Yea: Chief Gordon: We have a yearly contract with the Meridian School District to provide School Resource Officer's. It's that time of the year again to renew this contract, we provide three police officer's for three Elementary School's, one Middle School and the High School. The School District has returned the contract, I've gone over it and there hasn't been any changes since the Mayor and Counselor have looked at it. I would recommend that we approve that for the coming year again. The Motion was made by Giesler and seconded by Corrie to authorize the Mayor and City Clerk to sign the contract for SRO's at the School' s. Motion Carried: All Yea: Chief Gordon: We had our auction to get rid of abandoned property on Saturday. We did make enough money to cover expenses. Corrie: I'd like to invite the Council Members and everybody else present on the ~RU Poker Fun Run Saturday. Kingsford: I would like to remind the Council to get working with their various departments on budget. I have received a letter from eight citizens from Glennfield Manor #2 stating they cannot afford to bear the costs for covering the ditch and asked that the City give thought to funding whatever portion necessary to accomplish this project. Also, I want to remind everybody that this week is Dairy Days and encourage everybody to participate. Motion Carried: All Yea: The Motion was made by Tolsma and seconded by Giesler to go into Executive Session for pending litigation at 7:55 P. M.: Motion Carried: All Yea: The meeting was reconvened at 8:15 P. M. - the Council has directed our Attorney to pursue the pending litigation. CORRIE Chairman Zoning & Planning JIM JOHNSON WHEREAS, on June 20, 1992, "Paint The Town Day", over 4000 volunteers will paint the- homes of approximately 100 seniors and handicapped Treasure Valley residents; and WHEREAS, 175 of these volunteers will .paint the homes of 7 seniors or handicapped Meridian Area residents; and WHEREAS, the labor, paint, and other supplies for the project will be provided, without charge, for the residents; and WHEREAS, "PAINT THE TOWN" is being organized and sponsored by radio stations KBOI, KGtFC, television station KTVB, U. S. West, The Idaho Statesman, West One Bank, The Fred Meyer Corporation, State Farm Insurance and Boise Neighborhood Housing Services, Inc.; and WHEREAS, this outstanding community service project will benefit senior citizens and handicapped who may find it extremely difficult to maintain the beauty and condition of their homes; NOW, THEREFORE, I GRANT P. KINGSFORD, MAYOR OF THE CITY OF MERIDIAN, do hereby proclaim June 20, 1992 as "PAINT THE TOWN DAY" in the City of Meridian, and do commend the participating corporations, firms, service organizations, media and individuals for their generous support and involvement in this worthwhile project.
