The Regular meeting of the Meridian City Council was called to
order by Mayor Grant P. Kingsford at 7:30 P. M.:
Members Present: Bob Giesler, Max Yerrington, Ron Tolsma, Bob
Corrie.

MINUTES OF THE PREVIOUS MEETING HELD JUNE 2, 1992:
There was a correction in the minutes of the previous minutes, in
the area of Sportsman Pointe Subdivision that only the portion in
the Urban Service Planning Area should be in there.
The Motion was made by Yerrington and seconded by Giesler to
approve of the amended minutes for the meeting held June 2, 1992:

ITEM #1: PETER COVINO: TABLED AT THE JUNE 2, 1992 MEETING:
Kingsford: Council members, any discussion? I think it would be
appropriate for Mr. Crookston to give advice as to what the role
of this body ought to be.
Crookston: The role on the City Council on appeal from the Board
of Appeals from the Uniform Building Code is to assess the record
and review that. If the Council determines that the decision by
the Board of Appeals was clearly erroneous in view of reliable
probative and substantial evidence on the whole record or was
arbitrary or capricious or characterized by abuse of discretion
or clearly unwarranted exercise of discretion then they can grant
the appeal and send it back to the Board.
Giesler: Are we able to use this letter that we received from
that agency?
Crookston: Technically you are supposed to review it on the
record only.
Tolsma: What your saying Wayne is, that if we think the appeals
board acted in accordance with the Uniform Building Code then we
are in agreement with that or if we don't agree with the Appeals
Board.

Crookston: To over-turn the Board of Appeals you have to decide
that what they their decision was arbitrary or capricious, or
that based upon substantial evidence in the record that the
decision that they arrived at was not reliable, was not probative
and was not based on substantial evidence. If you approve of what
they did then you can uphold their decision.
Giesler: On this Board of Appeals we have two builders, and an
architect that use these codes every day and I feel that their
judgement on what their decision was, they have to know more
about this than I do, I feel that I have to back the Board of
Appeals on their decision. My recommendation is that we go along
with the Board of Appeals decision.
The Motion was made by Giesler and seconded by Tolsma to accept
the decision of the Board of Appeals on the request made by Peter
Covino.

ITEM #2: PUBLIC HEARING: PRELIMINARY PLAT DN APPLEGATE
SUBDIVISION:
Kingsford: At this time I will open the Public Hearing. I would
invite the developer or owner to speak first.
Keith Loveless, Loveless Engineering, 4330 Grace Street, Boise,
was sworn by the attorney.
Loveless: I'd like to hand out to the members a revised layout
of this subdivision then I'll discuss the reasons why we have
revised the layout regarding 7th Street and Pine Street
intersection.
Tolsma: I will need to step down, due to a conflict of interest.
Loveless: After the Planning and Zoning Commission Hearing we
had several weeks ago, we heard from some of the neighbors
complaining about the potential of dragging more traffic up into
the Welker Subdivision to the north, because of the straight shot
we had designed for W. 7th Street. In the original design was a
straight shot straight down to Pine Avenue. We went back out to
the site and did some double check and found out that part of our
problem on that design was the existing home shown on the west
before you hit lot 14 has a driveway. That was going to create a

terrible conflict with backing traffic out onto Pine Street with
that intersection there. So in working with the ACHD development
services and their traffic engineers, they came back with more-
less a demand and request for the alignment you see here tonight.
We have not changed the total number of lots in the subdivision,
we have refined the design so that we have the same yield as we
had before of four lots per acre as allowed by the zone. By
putting those two extra 90 turns in 7th Street, we thing we've
solved that problem of the high speed traffic on 7th Street.
This also benefits in the fact that the somewhat misaligned City
18" sewer main that runs through that area will not have to be
relocated in the area of 7th Street. Also at the request of your
Public Works Department and your City Engineer we will be putting
a graveled surface over that so that your maintenance trucks can
get back in there and service some manholes that have to come in
from 8th Street back in there.
Kingsford: At what point do you anticipate changing that then on
this current map?
Loveless: We are doing that design work right now. It will be
presented to your City Engineer for review. We don't have any
problem with any of the conditions or comments made. I'm here to
answer your questions now.
Giesler: Who will maintain that alley?
Loveless: It belongs to ACRD. It will be fenced off so I assume
the maintenance will be ACRD or the City.
Kingsford: We are going to be looking at weed control, the
highway district is not going to do anything with it.
Loveless: It's actually outside our development.
Giesler: There is also some concern about the irrigation for the
neighbors to the south.
Loveless: Yes, we are presently designing because of the amount
of vegetation that's planted by those owners and their fences,
and the least impact on their properties, we are going to put the
irrigation pipe under a low pressure pipe system with orchard
valves to each owner on Pine Street. We are not going to use the
irrigation within our development.
Giesler: Can you explain to me what an orchard valve is?

Loveless: It's a screw valve that fits in the end of the pipe
and let's the water bubble out onto the property.
Giesler: So the ones that flood irrigated before can continue to
do that.
Loveless: It will flood irrigate better than
will be a totally piped system and should
better than what they have been used to.
Giesler: Do any of those homeowners have
property right now that this would need to be

Loveless: Minimum size would be 12, but more than likely a 15.
One other thing I need to point out, over on the NE corner there
at the sharp turn in W. 5th Street there's a landlocked parcel of
ground there. We are designing two sewer services into that
parcel because under your ordinance that piece of ground could
support two separate lots under a variance for your frontage
reduction so we are going to be stubbing out two four inch
services into that parcel to accommodate any future development
on that piece of ground.
Crookston: On the lots that are going to back up to the alley,
the listed square footage on those lots does that not include the
alley?
Loveless: No it does not include the alley.
Crookston: For instance in Block 1, Lot 4, just visually
comparing that lot with say Lot 8 of Block 3, Lot 8 of Block 3 is
approximately 5 1/2 feet wider and it's about seven feet shorter
just visually comparing the drawing those don't compute.
Loveless: Well that is the computer's answer. It's not a scaled
number sir. Further discussion.
Corrie: What are they talking about when they say fencing
issues?

Loveless: It's impossible to design a new subdivision and make
all the rear lot lines match the rear lot lines of the
properties. What we basically agreed to do at Planning and
Zoning is we would write into the covenants that all rear fences
would be of a certain type. In other words that adjoining
parties wouldn't cease two styles of fencing for their rear
yards.
Giesler: I have a question for the Engineer. Is that an area
that we are needing a well?
Eng. Smith: We might be looking at a location a little farther
to the west because of the proximity of well lot #9. (Further)
Kingsford: Is there anyone else from the public that would like
to offer testimony on this issue? No response. I will close the
Public Hearing.
Giesler: All of your questions Gary have been met and everything
so far at this point?
Yerrington: Gary on those lots 1,2,3,4, & 5 that Wayne was
talking about, looking at those does that square footage compute?
Clerk Niemann: It does Max.
Discussion.
Eng. Smith: The only thing that we would need to discuss would
be the alignment of that water line through the lots, the
domestic water line that runs through lot 13 and 14. If we
develop a well on lot #14 then of course we have good control
over the water line going through that lot.
Kingsford: If we don't take that well lot, would you recommend
that it then be realigned into 7th Street?
Eng. Smith: My initial reaction would be to do that, yes.

approve the preliminary plat on Applegate Subdivision.

Kingsford: I will open the Public Hearing at this time and
invite the developer or owner to come forward.
Steve Gregory, 1135 N. Mitchell, Boise, was sworn by the
attorney.
Gregory: I'd be happy to answer any question you might have.
Corrie: The Fire Department had a problem, but probably will not
be a problem, your going to build phase one .before phase two, is
that correct?
Gregory: Yes.
Corrie: Duplex lots?
Gregory: I thought the duplex lots had been eliminated by the
Planning and Zoning. There's been one minor change, we've kind
of pushed everything to the west and widened Adkins Road on the
final plat. It doesn't change the number of lots or anything.
Kingsford: You've seen all the transmittals, the School District
and so forth and are aware of the fact that as that develops
those children may not go to a neighborhood school and so on.
Gregory: Yes.
Tolsma: The Bureau of Reclamation's request, there's no problem
with that, about the storm run-off?
Gregory: That's normal, it's held within the subdivision. No
problem.
Kingsford: Thank you. Anyone else to testify?
Richard Parcells, 1095 N. Locust Grove, was sworn by the
attorney.
Parcells: I own the five acres just to the north of the proposed
subdivision. I would oppose this subdivision on the grounds of
it will adversely impact the traffic in the area and it will
place a strain on an already burdened school system in Meridian.
I would request that an adequate fence be provided at the
developers expense to divide the two properties.
Giesler: You live on which side?

Parcells: I live just north.

Don Bryon, 2070 N. Locust Grove Rd., was sworn by the attorney.
Bryon: I have to concur with Mr. Parcell's concerns. The
biggest problem I have is the fencing requirement. Livestock and
people do not mix. Voiced additional concerns about traffic
concerns. Does anybody know what's going to happen at the corner
of Locust Grove and Fairview?
Kingsford: It is my understanding that it has been scheduled for
a light.
Eng. Smith: ACRD has informed me that it is scheduled for this
year.
Kingsford: Thank you. Anyone else to testify? No response. I
will close the Public Hearing.
The Motion was made by Tolsma and seconded by Giesler to approve
the Findings of Fact and Conclusions of Law on Maws Addition.

The Motion was made by Tolsma and seconded by Corrie to have the
attorney prepare an Ordinance to also include that the developer
provide fencing that is adequate for livestock that both parties
agree upon on the north boundary.

ITEM #4: PUBLIC HEARING: REQUEST FOR CONDITIONAL USE PERMIT BY
JOINT SCHOOL DISTRICT:
Kingsford: I will open the Public Hearing and invite the School
District representative to speak first. I will be stepping down
due to a conflict of interest.
Tolsma: If there are no comments, I will close the public
hearing. I wanted to ask the school district if there was a way
to run a gravel exit road back up to Franklin from that site for
a secondary access. Did you go out and look at that Gary? Was
there a grade percent coming off that hill?

Eng. Smith: Based on the contour map that they submitted, it
looks like about 10 to 12X grade on the existing contours.
Tolsma: I'd like to have their input on that.
The Motion was made by Giesler and seconded by Yerrington to
approve the Findings of Fact and Conclusions of Law on this
request as prepared.

Tolsma: We need a motion on the Conditional Use Permit.
The Motion was made by Giesler and seconded by Corrie to approve
the Conditional Use Permit by Joint School District with the
condition that a secondary access road be put in from Lanark to
Franklin Road to ACRD Geometric Standards.

Tolsma: I will turn the meeting back to Mayor Kingsford.
ITEM #5: FINAL PLAT ON SUNBURST SUBDIVISION #3:
Kingsford: Council Members do you have any questions of staff or
the representative?
Corrie: On your covenants is it going to be a mandatory
homeowners association?
Russ Hunemiller: Yes.
Kingsford: How are we coming along with the ditch along the west
boundary? Has that all been resolved?
Hunemiller: Yes that is and this will also take care of the
problem when we develop this.
Giesler: What will happen there to resolve that problem?
Hunemiller: On Ten Mile we will use PVC, whatever I brought
across Cherry Lane, which I believe was 12" but I'll put the same
on Ten Mile.

Giesler: Then -what happens to the ditch that runs along the
property, will it all be tiled? The open ditch along the
property to the south.
Hunemiller: I'm open with adjoining neighbors on that. I
believe I signed a deal with the City that whatever it took at
the time if we can get together with adjoining property owners
that we would.
Kingsford: Any other questions for Russ? No response. Any
questions for the staff?
Giesler: Gary you had some questions, have these been resolved?
Eng. Smith: I haven't heard from their engineer yet. One of my
biggest concerns was the easement width of the sanitary sewer
crossing that lot, whether or not there's enough room there to
accommodate the sewer easement plus the house setbacks and so
forth.
Hunemiller: I think the width is 20.
Kingsford: You'll guarantee that you will put that in the middle
of the easement?
Hunemiller: I guess so. It's already there, so I guess what it
is it is.
The Motion was made by Tolsma and seconded by Yerrington to
approve the Final Plat on Sunburst Subdivision #3, with the
consideration of the Engineer's request for the sewer easement on
Lot 18, B1 ock 1.
Giesler: I'd like to have all these comments in that motion.
The motion was withdrawn by Tolsma and the second was withdrawn
by Yerrington.
The new motion was made by Tolsma and seconded by Yerrington to
approve the Final Plat on Sunburst Sub. #3 conditioned upon the
City Engineer's recommendations being meant.

ITEM #7: FINAL PLAT ON ONE SUBDIVISION #3:
Kingsford: Any questions?
Corrie: Gary had a comment on Lot 14, Block 4, minimum was 70
ft. and I believe it was 69.34.
Max Boesiger: That catches me by surprise. If that's the case I
would think something that small we can fix.
The Motion was made by Corrie and seconded by Tolsma to approve
the final plat on One Subdivision #3 with the adjustment of lot
line of Lot 14, Block 4.
Motion Carried: All Yea:
ITEM #8: HUNTERS GLEN PROJECT:
Fred Shoemaker: Passed out site plan to the Council. The site
plan for Phase I shows how the 44 units will tie in with what we
call Phases II and III. At your March 17th meeting you approved
the rezone that was requested for the three acres that comprises
Phase I and also approved a conditional use permit for a forty
unit project. We came back to you with a forty four unit
project, which is an increase in the density of the development
on the order of 10% and I submit to you there has been no
reduction in quality of construction or amenities. This project
will earn rents up to X530.00 a month and up by anybody's
definition I think it's fair to describe it as an upscale, first
class apartment project. Gave brief history on owner's history.

agreement saying that the quality of construction will be equal
to or greater than the quality and size of the units in Phase I
and they are prepared also to promise to construct two amenities,
a club house for certain and either a swimming pool or tennis
courts. I will be happy to answer any questions you have.
Kingsford: We've just got this development agreement today, but
a couple of things that jump out at me was, first the issue of
those two amenities, if doesn't stipulate in this agreement what
they might be and you could call an amenity about anything.
Also, item #4 on page 2, we are talking about a prime new
development then it wouldn't be appropriate to give it that R-15
zone. It should be a part of this planned unit development.
Shoemaker: I wasn't sure that you would want a development
agreement and I was just thinking about the basics.
Kingsford: Last meeting Mr. Jones was here and eluded to a
couple of things. One was that phases II and III would have the
size units that you had talked about originally and certainly the
amenities were addressed but they ought to be something certain.
Shoemaker: I think it's fair that you might want the amenities
specified. If you go this direction I hope that you won't
require the developer for later phases, again, all that's really
before us is Phase I and we are prepared to sign some type of
development agreement for Phases II and III.
Kingsford: I don't have a problem with either one but it doesn't
speak to either one in this agreement. Any other questions that
the Council may have?
Giesler: We met with Mr. Leavell and the necessary people to
help out on this project, I had asked for some information on
some different projects in Boise or surrounding area that would
be equal to what their plan is and I just want to ask them if
Phase I will be equal to or better than what you have down on
this proposal. Am I correct?
Leavell: Those will be comparable to what we are building,
right.
Giesler: I would just like to say in looking at the ones I could
find, they were very nice and I was quite impressed with those
projects.
Kingsford: My assumption is that you will have some rental
agreements along the line of covenants that will be pretty tight.

Shoemaker: Initially the primary access for Phase I is to the
south. There will be an emergency access easement for Phase I
over a graveled road to Fairview Ave., it will be gated at the
north border of Phase I just to make sure that it's used for
temporary access only. As soon as there is any development on
what is called on that site plan Phase II and III, there will be
at that time an additional access provided either through
Fairview Avenue on a permanent basis, but probably to the west,
there is an existing right of way that abuts up and runs into
what's called Phase II a fifty foot right of way that would
provide access to 4th.
Kingsford: Any other questions from the Council? No response.
Are you prepared to make any kind of decision? We need a motion.
I would suggest to you if it is your desire to approve of this
that you should condition it upon re-examination and approval
between the Leavell's and the City with regard to the Development
Agreement.
The Motion was made by Giesler and seconded by Yerrington to
approve the Hunter Glen Project changes from 40 to 44 units and
that a Development Agreement be agreed upon between the Leavell's
and the City of Meridian.

ITEM #9: ORDINANCE #579: FINAL LID ASSESSMENT, TERM OF LID AND
INTEREST RATE:
Kingsford: AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO,
CONFIRMING THE ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0.
90-1 EAST FIRST STREET RECONSTRUCTION PROJECT, LEVYING
ASSESSMENTS AGAINST THE SEVERAL LOTS AND PARCELS OF LAND AS SHOWN
ON THE ASSESSMENT ROLL, PROVIDING FOR THE PAYMENT OF ASSESSMENTS
IN INSTALLMENTS, FIXING INTEREST AND PENALTIES AND PROVIDING FOR
THE PAYMENT OF SUCH ASSESSMENTS, INTEREST AND PENALTIES INTO
LOCAL IMPROVEMENT DISTRICT ND. 90-1; AND PROVIDING AN EFFECTIVE

rules and provisions of 50-902 and all rules and provisions
requiring that Ordinances be read on three different days be
dispensed with and that Ordinance #579 be passed and approved.

ITEM #10: DEPARTMENT REPORTS:
Kingsford: Let's begin with the house at Chateau Meadows first.
I believe everybody is aware of this. I've asked Wayne to
research and give recommendation at this time.
Crookston: I reviewed the architectural drawings, and the plot
plan. I reviewed and questions our Building Inspector about it,
he explained to me that when he made the foundation inspection
the sidewalk was covered with dirt, not just a couple of inches,
there was mounds of dirt because they had excavated for the sewer
and water connections. The houses next to this property are
landscaped so they put the dirt on the sidewalk. He did not see
the sidewalk, so he measured to determine the setbacks from the
back of the property to get to 15 feet and then he went to the
plot plan and it showed that there was 20 feet from what appeared
to be where the sidewalk was and he approved it on that basis.
He did not measure from the front of the foundation as it faces
the street to the sidewalk because the sidewalk was covered up.
I also discussed also with Daunt what he felt had happened and he
again pointed out on the plot plan that the figures on the plot
plan are not correct. The side lot lines was 86 feet I believe
and the pin is shown there and he told me that the draftsman of
the plans went to, there's a pin drawn on the plan and then the
draftsman added five feet to that. Which in essence took it out
into the roadway. When Daunt used the drawing to continue his
measurements it was not correct but he couldn't tell from that so
he approved the foundation plans. From what I observed from the
plot plan it appears there is just an error. Without the
sidewalk being visible and available for measurement it makes it
difficult for the Building Inspector to perform his duties. Had
that been there so that it was available for use in his measuring
I think we would have determined where that problem was and it
could have been corrected at that time. It definitely appears to
me that at least 75% to 90X of the problem is the drawing that
was prepared by the draftsman.

It's the builders responsibility to conform the plans to our
Ordinances so that the responsibility is theirs and not the
building inspectors. I think if we had to lay blame on this
problem it's the person that made the drawings for that plot
plan. That does not remove the City's complete responsibility
because I suppose he could have said, well you've got to move the
dirt before I can measure, which he could do. He didn't, in
assistance to the builder. Apparently it also came up that when
the distance issue came up, when the garage floor was being laid
and the contractor's for that, and I don't know how Daunt
discovered this, I don't know whether he's out there when they do
that or not, but they claimed that there just wasn't enough
distance here, but Daunt relayed that to me. Apparently the
garage floor was laid prior to the stop work order. He also told
me that when he did put the stop work order on he told them to
continue the work sufficient so they could close the structure in
to help prevent weather damage and so they apparently did
whatever they have to do to close it in. In my assessment of
this, it appears to me that it's the drawings that caused the
problem and the owner or architect or draftsman or whoever drew
up the plans, they have the bulk of the responsibility.

McCutchen: First off you said that Daunt said the sidewalks were
all covered with dirt because we had done out excavating for
sewer and water, that is correct. But there is eves^y building
site. Also the dirt was not so deep that he could not have
measured, it was also not so deep that we could not have got a
shovel and gone after it. Another thing, he says that he did the
measuring, he did not measure until he came out for^ a framing
inspection. That's when he said something was wrong. We did not
make a complaint to him about the sidewalk. We had noticed it
earlier. When Daunt came out to do our footing inspection, he
went out to the back and he said you have fifteen feet, we said
yes. He went over there and talked to the concrete guys and said
hey how is your setbacks on this house, they said fine. They I
think called City Hall and was told that the pavement was the
property. The Architect is here tonight and she was told the
same thing. Further explanation - see tape. You brought up on
here that the applicant is responsible for locations, also it
says here, and this is from my building permit, says that it
would conform to specification and in full compliance with the
Ordinances of the City of Meridian subject to inspection permits

and fees as required. I came in here and I paid $339.00 for a
permit. All my covenants state is that I have got to build a
1300 Sq. foot house valued at X68,000.00. I ask why I was
required to bring in a plot plan if it wasn't going to be
checked? It has been approved and signed off by Daunt. My floor
plan has been, my foundation plan, my heat loss, everything has
been okayed. He never measured the front to my knowledge. I'm
not picking on Daunt but we've got a house right now that we
don't know what to do with. We've got a stop work order. We've
got a lot of water damage. We are going strictly by the book
that's why I brought my plans in to be checked, they were checked
and they were approved. I'm going to have a house sitting there
for two months until we can get this variance.
Kingsford: Again I'd ask Wayne to look into this and advise
Council of our alternatives.
Crookston: The variance is not a realistic procedure because our
ordinance require that the hardship or problem not be self
created. If you take the position that it's an architectural
problem, it would be self created. You can always apply for the
variance, but you have to go through the procedure to do it. I
don't know that it would meet our ordinances to grant the
variance because of that non self created requirement. The other
option is for the City to put this on the record, which it is,
say that we recognize there's a problem, the City can say that
they believe that the bulk of the problem was an architectural
error but also recognize that the City has certainly some
exposure for liability and you let the construction proceed under
the conditions it is right now. We might have to have some
agreements to hold the City harmless from future problems. You
could just acknowledge that this was the error, this was what
happened and acknowledge that there were mistakes made by both
parties. This is a way to approach it.
Kingsford: Is it realistic Wayne that that be a note to be made
on the sales agreement? Somehow it ought to be acknowledged.
Crookston: The way to handle that is not only require that in
the sales document for the initial purchases but a deed
restriction that goes up anytime somebody goes to buy it.
Kingsford: Is that a remedy that you could deal with?
McCutchen: Yes.

Chief Gordan: June 1st of this year we had a promotion in the
Police Department. Norm Williams has been promoted to Lieutenant
and anytime I'm out of town or you need something and you can't
find me, Norm Williams will be available.
Giesler: It was a disappointment at the school to see him go and
all the kids and staff really appreciate him. I appreciate all
the help that you've given to that school Norm.
Kingsford: I've really appreciate the numerous years you've
spent with the Department and I think it's significant that you
have the support of the whole department. I think this is a very
well deserved advancement for you.
Eng. Smith: The bid specification for Well #14 is out and we
will open bids on the 26th. The pump material and piping
material has been ordered for the Meridian Greens booster
station. They will start construction on the piping aspect of
that next Monday. The South Slough Sewer Interceptor is complete
and ready for use. Effective June 29th I will have an
engineering technician employed to help in my department. He
brings twelve years of engineering experience, not only in the
office but also in construction. I'm looking forward to having
him on board.
Wayne Forrey: Wayne Crookston and I have been evaluating the
purchase offers on the phase II land acquisition project. We
think by Friday we will either have them hand delivered or in the
mail to the three parcels that we are wanting to acquire. After
the Department reports, if it's acceptable to the Council, I'd
like to request an executive session we are prepared to discuss
one of those properties and costs and a letter we received ft^om
Department of Commerce.
On the roadway portion of the Phase II Project, Don Hubble met
with the Highway District several weeks ago and they have

promised an expedient review of the design. Don went down and
meant with them and they wanted to increase the asphalt mat from
1 1/2 overlay to 2". Instead of just an overlay, they wanted to
dig up Idaho Street from the Post Office up to Intermountain Arms
and put in a new storm drain line and possibly rebuild Broadway
from E. First to E. 2nd and put in extra base material,
substantially increasing the cost. We will save about X15,000.00
if we omit the overlay and don't disturb the drainage system. In
other works let the highway district deal with their road surface
and maybe take that savings in money and put it into extra
sidewalk. (Further explanation concerning the overlay and the
slurry seal)
Kingsford: When I met with Wayne yesterday we discussed that and
my initial reaction was to let the Highway District come over and
they can beg from us, after thinking about it for a little while,
in having gone through this hat in hand issue and watching them
change the standards numerous times on First Street, you know we
are not in the road business. Those roads are their concern, I'm
for just walking away from the overlay, let's build more
sidewalks and let them take care of the streets.
Discussion.
The Motion was made by Corrie and seconded by Giesler to direct
Don Hubble to construct the sidewalk plans for the West part of
East 2nd and slurry seal for the City rather than the overlay.
Yerrington: How about telling the Highway District that we would
give them the price for the slurry seal if they want to go ahead
and finish the roads?
Kingsford: I wouldn't have a problem with that. My involvement
with the Highway Commissioners has been excellent. All of the
new guidelines that they come up with, that's not our business to
work the streets.

A. Boundaries

AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, CONFIRMING THE
ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 90-l-EAST FIRST
STREET RECONSTRUCTION PROJECT, LEVYING ASSESSMENTS AGAINST THE
SEVERAL LOTS AND PARCELS OF LAND AS SHOWN ON THE ASSESSMENT
ROLL, PROVIDING FOR THE PAYMENT OF ASSESSMENTS IN INSTALLMENTS,
FIXING INTEREST AND PENALTIES, AND PROVIDING FOR THE PAYMENT
OF SUCH ASSESSMENTS, INTEREST AND PENALTIES INTO LOCAL
IMPROVEMENT DISTRICT NO. 90-1; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, in accordance with the provisions of Idaho Code 50-1712, the
appointed Engineer for Local Improvement District No. 90-1 prepared a report showing
in detail the total cost .and expenses of the improvements therein, and the amounts
payable from assessments and from other sources, and containing a form of assessment
roll; and
WHEREAS, the assessment roll as prepared b_y the Engineer was filed with the
City Clerk and a date for a hearing on the assessment roll was fixed; and
WHEREAS, notice of such hearing was published and mailed to the owners of
property in Local Improvement District No. 90-1 at the times and in the manner
required by law; and
WHEREAS, at said hearing the City Council considered all objections to the
assessment roll and all evidence presented;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City
of Meridian, Ada County, Idaho, as follows:
Section 1. The Engineer's report of the total cost and expense of the
improvements in Local Improvement District No. 90-1 is hereby approved and the
aggregate amount of such cost and expenses is hereby confirmed as $191,932.31
$5,600.00 of such amount shall be paid by the Meridian City Tree Grant Contribution
and the balance of such amount, $186,332.31 ,shall be paid by the levy of assessments
on benefited property. Each lot and parcel of land appearing on the final assessment
roll for Local Improvement District No. 90-1 as approved by the ordinance is hereby
found to be specially benefited by the improvements constructed in Local Improvement
District No. 90-1 in at least the amount of the assessment charged against such property.
The assessments against each lot or parcel are further found to be in proper proportion
to the total ~ssesament appearing upon the assessment roll.
ion .Except to the extent reflected in the final assessment roll confirmed
by this ordinance, all protests against the assessment roll in Local Improvement District
No. 90-1 are overruled and disallowed. The final assessment roll for Local Improvement
District No. 90-1 is hereby approved and the certificate attached thereto evidencing such
approval shall be executed by the Meridian City Clerk. The total amount of the final
assessment roll for Local Improvement District No. 90-1 as hereby confirmed is
$186,332.31. There is hereby levied and assessed against each such lot and parcel of
land the amount appearing on the final. assessment roll.
tin .Each assessment or any portion thereof may be paid at an_y time within
30-days from the date of adoption and publication of this ordinance without penalty,
interest or costs. Any property owner whose assessment has not been paid in full within
30-days of the adoption and publication of this ordinance shall be conclusively presumed
to have chosen to pay such assessment in installments. Assessments paid in installments
shall be payable in ten (10) annual installments. On June 1, 1993, and annually
thereafter, one of the ~llments shall become due and sl~ be collected as provided
b_y law. Annual installments may be prepaid in the manner provided b_y law.
Section 4. Assessments paid in installments shall bear interest on the whole unpaid
sum from. the date of adoption and publication of this ordinance. The rate of interest
such installments shall bear is hereby fixed as the rate of 6.4 percent (6.4%) interest for
Local Improvement District No. 90-1
Section 5, Immediately upon the publication of this ordinance, the Treasurer of
the City of Meridian shall file with the County Recorder a notice which shall contain
the adoption and publication of this ordinance and a description of the boundaries of
the District, and the assessment herein confirmed shall thereafter be a lien upon the
property assessed.
Section 6. Immediately upon publication of this ordinance, the Treasurer of the
City of. Meridian shall further mail a postcard or letter to each property owner assessed
at his post office address, if known; or if unknown, to the County post office, in
substantially. the following form:

i n 8 The confirmation of the final assessment roll for Local Improvement
District No. 90-1 as provided in this ordinance is a final determination of the regularity,
validity and correctness of the assessment roll and of each appeal as provided in Section
50-1718 ,Idaho Code. Appeal may be made by filing within 30-days from the date of
adoption and publication of this ordinance written notice of appeal with the Meridian
City Clerk and with the Clerk of the District Court of Ada County, describing the
property and objections of the appellant and otherwise- complying with the provisions of
Section 50-1718, Idaho Code. After said 30-day appeal period has. run, no one shall
have any cause or right of action to contest the legality, formality or regularity of any
assessment.
Section 9 If any provision of this ordinance or any assessment shall be held to
be invalid or unenforceable for any reason, the invalidity or unenforceabilitp of such
provision or assessment shall not affect any remaining portion of this ordinance or other
assessment. The partial invalidity of any assessment shall not prevent such assessment
from being valid and enforceable to the extent permitted by law.
i n 1 . EFFECTIVE DATE. Whereas there is an emergency, therefor, which
emergency is hereby declared to exist, this ordinance shall be in full force and effect
from and after it's passage, approval and publication according to law.

AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN
REAL PROPERTY WHICH ZS DESCRIBED A PORTION OF THE NE 1/4 NE 1/4
OF SECTION 19, TOWNSHIP 3 NORTH, RANGE I EAST, B.M., ADA COUNTY,
IDAHO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to annex to the said City real property which is
hereinbelow described:
A parcel of land being a portion of the NE 1/4 NE 1/4 of
Section 19, T. 3N., R. lE., B.M., Ada County, Idaho, said
parcel being more particularly described as follows:
Commencing at the Brass Cap marking the corner common to
Sections 17, 18, 19 and 20, T. 3N., R. lE., B.M., Ada County,
Idaho; thence S. 89°43'43" W. 615.70 feet along the line
common to said Sections 18 and 19, which is also the
centerline of East Overland Rd. to a point on the centerline
of the Nine Mile Drain, said point also being the REAL POINT
OF BEGINNING; thence along said centerline of the Nine Mile
Drain, S. 3°41'30" E. 28.00 feet;
thence continuing along said centerline of the Nine Mile
Drain and the extension thereof, S. 8°05'42" E. 1311.18 feet
to a point on the south line of the said NE 1/4 NE 1/4 of
Section 19; thence, S. 89°45'39" W. 908.54 feet along said
south line to the Southwest corner of said NE 1/4 NE 1/4 of

is hereby annexed to the City of Meridian, and shall be zoned (R-
4) Residential; that the reason for the (R-4) zoning is to allow
the construction single family building lots, which would be
allowed in the (R-4) Residential zone; that the property shall be
subject to site planning review; that the annexation and zoning
is subject to the conditions referenced in the Findings of Fact
and Conclusions of Lain as adopted by the Meridian Council on the
request for annexation and zoning.
Section 2. That this annexation and zoning is subject to
the following:
1. The roofs on houses constructed on the lots bordering
Meridian Greens Subdivision being constructed with wood
shake shingles.
2. The subdivision developed on the property shall have no

3. The lots bordering Meridian Greens Subdivision shall
have no houses constructed thereon which contain less
than 1,600 square feet. -
4. The house values constructed on alI lots have a value
of no less than $100,000.00.
5. The subdivision developed on the property shall contain
a community park of no less than two acres.
Section 3. That the property shall be subject to .de-
annexation and having the zoning reversed if the owner or its
assigns, heirs, or successors shall not meet the conditions
contained in the Findings of Fact and Conclusions of Law and the
Ordinances of the City of Meridian and the conditions contained
in Section 2. of this Ordinance.
Section 4. That the City Clerk shall cause one (1) copy
of the legal description, and map, which shall plainly and clearly
designate the boundaries of said property, to be filed with the
Ada County Recorder, Ada County Assessor, and the State Tax
Commission within ten (10) days following the effective date of
this Ordinance.
Section 5. EFFECTIVE DATE: There being an emergency,
which emergency is hereby declared to exist, this Ordinance shall
be in full force and effect from and after its passage and
approval as required by law.
