Item #1: Public Hearing: Rezone Request W/ Conditional Use Permit for Day Care by
Linda Paddock:
Mayor Kingsford: At the last Hearing, I stepped down frcan participating in this Request,
do to the possible Conflict of Interest ccani.ng frcan the close proximity that I live
where this property is located, I think I had better do this again, at this time I will
turn the meeting over to Ron Tolsma, the Council President, to conduct this Public
Hearing:
Council President Tolsma, at this time I will open the Public Hearing, is there anyone
in the audience who .wishes to offer testimony on this request?
Jerry Browne, 1728 Cresmont, Browne was sworn by the-City Attorney:
Browne: My wife has lived at this location very. close to the proposed day care, she has
lived there for approximately 10 years and I have lived therefor approximately eight
years, we opposed the proposed request, we do not see where this use would increase our
property values, we speculate it would decrease the value, we have concerns about the
increase traffic, there is already a parking probl~n, several homes in the area are
single car garages we think this would add to the parking problem, we feel there would
be increased noise. I am opposed to the Conditional .Use Permit:
Council, President Tolsma: We did have one letter front Mrs.. Caron that is in oppositon to
this request that needs entered into the record: Is there anyone else who wishes to
testify?
Guy Walker, 2555 Misty Drive and I am representing Linda Paddock, she is sick this
evening, Walker was sworn by the City Attorney:.
Walker: I appreciate being able to address the Council. again on this issue and I hope
you have in front of you the revised proposal that we have, we have certainly taken into
account the neighbors desires regarding traffic congestion & noise and as I mentioned
last time we were extremely concerned about this and have a desire to be respective to
the neighborhood and the neighbors because they are going to be part of our. business
and recceYnttendations for the business so it is important to .Linda that we have the

.~ cooperative of the neighbors and we are certainly willing to listen to any of the imput
they have and adhere to it if at all possible. We also took into consideration the
ca:anents fran the last hearing as well as the ccannents fran the Council and. as you can
see by our new proposal we went ahead and were fortunate that Mr. Mortensen had that
property right beside him that was available and we were able to~work sanething out
at an additional expense to Linda to put some additional parking in and to alleviate
we feel the traffic congestion, as you can see on the new proposal the parking for the
clientele will crate in off of Cherry Lane now, this will keep all the traffic off of
Crestmont. We have also increased some of the play area in the new proposal, we are alsc;'
guided by the State Licensing as to how much play area and what it will be like as well
as the structure itself. The structure will dictate how many children she can have,
according to the square footage. On Crestmont as you can see we have only the employee
parking which consists of seven parking spaces. As to the fencing and so forth around
that facility, we would certainly take any recannendation from the Council, our plans are
to put six foot wood fencing between us and the adjacent property owners. There will be
a six foot fence and there could be sane other types of sound barriers, whether it be
types of greenery , types of landscaping that could be put inside the fencing to help
cushion the sound. With the entrance on Cherry Lane, I do not think you will even know
that is a Day Care fran Crestmont with the entrance & signage on Cherry Lane, I feel,
you would think it was almost a hare, I do not think this is going to take anyanes
value away, in fact if sanething doesn't get happening there and the weeds continue to
grow and the structure continues to deteriate we are going to be talking about devaluation
of peoples property. We think this would be an addition to the City, the City is in
need of Day Cares and the children will be well supervised and they will be preparing
them for schooling.
Giesler: According to your new proposal, it looks like the entrance will be changed, is
that correct? 'T'hey will be entering from the parking lot rather than the Crestmont side.
They will not be able to enter fran the Crestmont side.
Walker: That is absolutely correct.
George O'Connor, 1819 Crestmont Drive, O'Connor was sworn by the City Attorney:
O'Connor: Mrs. ..Rath was unable to attend this evening, so I am expressing sane sentiments
for her as well, sane side notes-here we felt that this was unfortunate that this was
on July 3rd and difficult for sane people to get down here, several people in the
neighborhood are still concerned about decreased property. value, myself included,: even
if it is to a minor extent, we are still concerned about traffic even on Cherry Lane,
there may becane a need to restrict East turns out of the parking area, we are concerned
about noise, particularly the neighbors very close, sane of the suggestion that sane of
the neighbors had if this does go through is that along the property lines at least a
solid six foot fence and sane shubbery for sound proofing.
Council President Tolsma: Anyone else fran the audience wish to offer testimony? There
was no response, the Public Hearing was closed.
City Attorney: I think we are going to need new Findings for the new testimony and the
new proposal that has been sutanitted:

Hearing was closed. We have a letter fran Mr. Dave Abo, of Ada County Develogxnent
Service that we will enter into the record.
The Motion was made by Tolsma and seconded by Myers to approve the Findings of Fact &
Conclusions of Law as prepared for the Planning & Zoning Commission:

Mayor Kingsford: We have not passed-the Ordinance changing the Canprehensive Plan, so
I don't think it would be appropriate at this time to deal with this .issue. It would
be my recammnedation that this be tabled until the Ordinance is passed:

Item #4: Amended Final Plat on Weathervane Village:
Mayor Kingsford: Any questions of the Council?

of Weathervane Village conditioned upon meeting the reccannendation of the City Engineer:

Item #5: Final Plat on Dunten Place Subdivision Phase.#I:
Mayor Kingsford: Any questions of the Council?
Tolsma: Has the recommendation & comments of the .City Engineer be taken into consider-
ation?
Roy Johnson, Engineer for the. project: We do not have any problem with. the comments,
there is two thing that we have not ccxnpleted the easement is not recorded as yet,
and Ada County Highway District has not signed off.
The Motion was made by Tolsma and seconded by Myers to approve the Final Plat of Dunten
Place Subdivision Phase #I conditioned upon the Eas~nent being recorded, the Ada County
Highway District specifications and the City Engineers requirFSnents:

Item #6: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies:
Mayor Kingsford: You have been informed in writing, if you choose to, you have the
right to a pre-termination hearing before the Mayor & Council, to appear in person
to be judged on facts and defend the claim made by the. City that your water sewer,
and trash bill is delinquent. You may retain counsel. Is there anyone in the audience
who wishes to have a pre-termination hearing? There was no response. Due to their
failure to pay their water bill or present any valid reason why the bill has not been
paid their water.shall be turned off on July 17, 1990. In order to have their
water turned back on there will be an additional fee of $10.00. They are hereby
informed. that they may appeal or have the decision. of the City reviewed by the Fourth
Judicial District Court, pursuant to Idaho Code. Even though they appeal the water
will be shut off:

Mayor Kingsford: Any questions the Council might have?
Myers: On page 9, section 10, it states something about Boise, Ithink this is just a
misprint but it needs corrected.
The Motion was made by Myers and seconded by Yerrington to approve the Covenants of
Clarinda Fair Subdivision with the incorporation of the-City Attorney and the City
Engineers ccannents & needed corrections:

Mayor Kingsford: This item has been cancelled, they.are still working with the Attorney

Mayor Kingsford: An O~:dnance vacating a portion of Commerce Park Subdivision, of
record in Ada County, Idaho, specifically a lO foot .wide utility and drainage
easement located and centered on the lot lines cce:unon to Lots #~. & 2 of Cce~anerce
Park Subdivision according to the official plat recorded thereof, in Book 45 of

The Motion was made by Myers and seconded by Tolsma that the rules and provisions
of 50-902 and all rules and, provisions requiring that Ordinances be read on three
different days be dispensed with-and that Ordinance Number 536 as read be passed
and approved:

City Engineer: In the process of doing the Ten Mile Sewer Line Project, it is necessary
to cross under the Eight Mile Lateral, in order to do this we have to have a License
Agreement:-: I received the agreement from Nampa Meridian Irrigation and it needs to
have the Mayor's signature. I do not know whether the City Attorney needs to review
this prior to the Mayor's signature or not.
The Motion was made by Tolsma and seconded by Myer's to authorize the Mayor to sign
the License Agreement after the City Attorney has reviewed the agre~nent:

Gieller: Tomorrow is the dedication of the Gazebo, 10 o'clock at the park;
Mayor Kingsford: Mr. Giesler, I would like to personally thank. you for your efforts
in the Centennial Bureau in ramroding that project, it looks very nice and I am
confident it will be here in 100 years.
City Clerk: Need to get the budgets in, we have scheduled a meeting on July 16, 1990
with the Ada County Cca~issioners on the Impact Agreement any of the Council Members
who can make it should attend:
Mayor Kingsford: Council Members as you knew we have been a Member of APA for three years
now at the reduced rate, each year they have asked us to raise our participation as far
as the rate goes, this year they are asking us to go frc[n $1,000.00 to $4,871.00. I
advised them, I mould bring this before the Council and get there imput on the increase
in fees.
The Motion was. made by Myers and seconded by Tolsma that the City of Meridian leave the
dues to the Ada Planning Association at $1,000.00 for the next Fiscal Year:

AN ORDINANCE VACATING A PORTION OF COMMERCE PARK SUBDIVISION, OF
RECORD IN ADA COUNTY, IDAHO, SPECIFICALLY A 10 FOOT WIDE UTILITY
AND DRAINAGE EASEMENT LOCATED AND CENTERED ON THE LOT LINES
COMMON TO LOTS 1 AND 2, BLOCK 2 OF COMMERCE PARK SUBDIVISION,
ACCORDING TO THE OFFICIAL PLAT THEREOF, IN BOOK 45 OF PLATS AT
PAGE 3721 AND 3722, RECORDED AS INSTRUMENT NUMBER 7903627,
RECORDS OF ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Counci 1 and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to vacate a portion of Commerce Park Subdivision,
specifically the ten foot easement located and centered on the
lot lines common to Lots 1 and 2, Block 2 thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
Section 1:: That pursuant to Section 50-1306A,
specifically, and Title 50, Chapter 13, Idaho Code, generally,
the City of Meridian, having held the required hearing and it
appearing that proper notice of said hearing was given, hereby
vacates the 10 foot wide utility and drainage easement located
and centered on the lot lines common to Lots 1 and 2, Block 2 of
Commerce Park Subdivision, according to the official plat
thereof filed in Book 45 of Plats at Page 3721 and 3722, records
of Ada County, Idaho, recorded as Instrument Number 7903627,
records of Ada County, Idaho.
Section 2: WHEREAS, there is an emergency therefor,
which emergency is hereby declared to .exist, this Ordinance
shall take effect and be in full force from and after its
passage, approval and publication as required by law.

Thank you for the opportunity to review the proposed a~menchnents to the
Meridian Comprehensive Plan.
Both Sheri Freemuth and I have reviewed the draft and have found it to be as
we discussed during our recent meetings in Meridian. However, we are
concerned that you consider the possibility of enlarging your Area of City
Impact. As you know we have had several inc~x?ries to that effect .and, if
Meridian is interested in ea~pariding the Impact Area in the near future, now
would be an ideal time to propose that change. Ultimately, we will need a
new map of the Meridian Area of City Impact, Urban Service Planning Area and
city limits.
we look forward to marking with you soon on the necessary ordinance. Please
contact us as soon as possible regarding these negotiations.
