There was no response: The Motion was made by Tols~~ and seconded by Myers that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance # 542 be passed and approved: Motion Carried: Roll Call Vote: Yerrington, Yea.: Myers, Xea: Tolsma, Yea: Item # 2: Approve the Conditional Use Permits for Pine Bluffs: Mayor Kingsford: New Concepts Developers has requested a Conditional Use Permit along with the annexation & zoning of this property. to allow a Planned Unit Development, Multi-Family housing, Day Care Facility, Nursing Home/Retirement Center & Mini Storages: Are there any questions of the Council Members? The Motion was made by Myers and seconded by Yerrington to approve the Conditional Use Permits for New Concepts Developers on the Pine Bluffs property: Motion Carried: All Yea: Item #3: Public Hearing: 1990-91 Fiscal Year Budget: Mayor Kingsford: At this time I will open the Public Hearing. The expect- ed amounts of revenues and expenses for the City of Meridian for that time period is $4,853,207.00, for the public information I might mention this amount includes the $850,000..00 that the Highway District the State Department of Transportation and the LID has budgeted for. the First Street Project. Is there anyone from the audience who wishes to offer testimony on the 1990-91 Fiscal Year Budget? Item # 4: Ordiance #543: Annual Appropriation Ordinance for 1990-91 Fiscal Year: Mayor Kingsford: An Ordinance entitled the Annual Appropriation Ordinance for Fiscal Year Beginning October 1, 1990, Appropriating the sum of $4,853,207.00 to defray the expense and liabilities of the City of Meridian for said Fiscal Year, Authorizing a levy of a sufficient tax upon the taxable property and specifying the objects and purposes for which appropriation is made, is there anyone in the audience who wishes Ordinance # 543 read in its entirety? There was no response. The Motion was made by Myers and seconded by Tolsma that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 543 as read be passed and approved: Motion Carried: Roll Call Vote: Yerrington,Yea: Myers,Yea: Tolsma, Yea: Item #5: Public Hearing: Request for rezone of portion of Lot 11 & Lot 12 Block 1, Crestwood Estates Subdivision #1: Mayor Kingsford: At this time I will open the Public Hearing, is there anyone from the audience who wishes to testify on this issue? _ Keith Jacobs, 7025 Emerald, Boise: Jacobs was sworn by the Attorney; Jacobs: I am here tonite to answer any questions the Council might have on this particular request. Mayor Kingsford: Any questions of Mr. Jacobs, I think each of the Council Members have been apprised at some great length on this subject. We did receive the letter from the Architectural Control Committee. Tolsma: How about the sewer & water? Jacobs: We will put in a new service for each one of ,the lots and adjust the water to accomodate this. Mayor Kingsford: Anyone else from the Public who wishes to offer test.- imony on this request? There was no response, the Public Hearing was closed. Councilmen you have the Findings as prepared for the Planning & Zoning Commission, there has been no new testimony. The Motion was made by Myers and seconded by Yerrington to approve the Findings of Fact & Conclusions of Law as prepared for the Planning & Zoning Commission. Roll Call Vote: Yerrington, Yea: Myers, Xea: Tolsma, Yea: Item #6: Ordinance #544: Ordinance rezoning portion of Lot 11 & Lot 12, Crestwood Estates #1: Mayor Kingsford: An Ordinance amending and changing. the zoning of certain real property in the City of Meridian which is generally described as Lot 12 and a portion of Lot 11, Block l of Crestwood Estates Subdivision MERIDIAN CITY COUNCIL • • AUGUST 21, 1990 PAGE # 3 No. 1, Meridian, Ada County, Idaho; and providing an effective date. Is there anyone in the audience who wishes Ordinance #544 read in its entirety? There was no response. Roll Call Vote: Yerrington, Yea: Myers, Yea: Tolsma, Yea: Item #7: Ellsworth Loveland: Proposed project at 785 West Franklin: Mr. Loveland: We would like to put in for a zone change at 875 West Franklin, what we intend to do there is put in a fish pond, I think it is zoned residential now and we would like to change that to commercial so we could be allowed~lto put .the fish pond in. I have a drawing of what it would look like. Loveland showed the Mayor & Council the draw- ing. Mayor Kingsford: Your intention then is to stock this and charge for fishing? Loveland: Yes: It is something we do not have around here so I think it would do alright. Mayor Kingsford: Councilman Giesler who was not able. to be here tonight expressed concern about the area being in a residential area and the potentialmosquito problem this could create, have you done any looking into that? Loveland: We could spray it as far as that is concerned.., but there is water now on both sides, I do not think there would be any mosquito problems. Mayor Kingsford: How about security, will it be fenced? Loveland: It will be fenced. Tolsma: How do water get in & out there? Loveland: We have water right and we intend to put in a well and where the back of the pond is we will be able to fill that up. Tolsma: Have you checked with the Irrigation District to see if they wilt allow discharge into that: Loveland: Yea: City Clerk: Where do you plan to discharge=-in cold wea~herx Loveland: We intend to put a filter on the West side and discharge it into the field. Mayor Kingsford: Basically what you are asking for now is our opinions and you are going to have to rezone. MERIDIAN CITY COUNCIL • AUGUST 21, 1990. PAGE # 4 Mayor Kingsford: Certainly before you spend any money on a rezone application I would urge you to check with the .residents of Crestwood Subdivision. Loveland: We intended to check with them, but I do not think there will really be any problem because there is no great amount of noise or any bother as far as that is concerned. Yerrington: How much water would you be pumping i~a pond like this in a 24 hour period? Loveland: I really do not know: Yerrington: How much turnover do you have to have in your water? Loveland: You do not have to have to much turnover as long as you aggitate the water. Department Reports: City Engineer: On the Ten Mile Road sewer project we have a request by the contractor for additional payment above the contract amount and basically the request deals with some. pit run. gravel that was required for backfill. The reason for this pit run gravel was the unaccepability of the material that was excavated to be put back into the trench by the Highway District. They have submitted for. approximately $12,600.00 for the pit run and they are submitting at the rate of $6.25 per yard. Went on to explain what the contractor did. After thinking about it and visiting with another engineer I think it is appropriate that they be compensated for the material, I guess the question is how much do we compensate them for the material. I think the $6.00 is to much but I do not know what the number is that would be reasonable. I visited w/the. Mayor earlier today and the Mayor so stated that this was something the Council needed to approve. In visiting with the Mayor, we thought that maybe if you could leave it up to a negotiable amount that would be satisfactory to us, that we could proceed with it. so it could be finaled out before another Council Meeting in two weeks. The total amount of the change order request is $16,095.79, out of ,that amount $330.00 is for a new manhole base that in my opinion is an allowable cost, there is $583.00 where we changed a meter yoke that is to serve the Church from 1 to 12" and that was for the material, then there was an item of $977.50, we filled the annular space with pea gravel, tha annular space between the inside of the casing going under the road and the canal and the sewer pipe itsself, this was done to stabalize_the pipe. The 1600.00, in my opinion would be to strike. that number because that is excavating the material they put in that did not pass compaction, and they should have not put that much in before they had it tested. The remainder has to do with the pit run. As I recall in discussing it with Hubble Engineering and another engineer probably should be reduced to around $4000.00 maybe. I think they should be compensated for the material and probably the cost to get it down from wherever they purchased it. the haul cost. They did .have another cost of wasteing the material they removed from the trench, it had to be hauled off and disposed of somewhere.The contractor did do a very good job, they do excellent work and are very consientous about it, everything tested very good, there were no problems other than this backfill material. MERIDIAN CITY COUNCIL • • AUGUST 21, 1990. PAGE # 5 Mayor Kingsford: Before a contractor makes a bid do they not run a test hole? City Engineer: Some of them do. These people said that they did not. Tolsma: Do you have any estimated costs on that pit run, what they could acquire it for? City Engineer: I called the Water Department and they called out to G&B and it seem like they told me $2.25 Yard-for, pit run, I do not know whether that was delivered or not. Mayor Kingsford: I think that it requires some more research. There was additional discussion: City Attorney: I think that if it is being treated as a change order, I think it needs to be approved by the Council. Mayor Kingsford: We will do some more research and have it for Council approval at the next meeting. The Motion was made by Myers and seconded by Yerrington to pay for the line items that the City Engineer has approved, manhole, meter yoke and the pea gravle. Motion Carried: All Yea: Mayor Kingsford: Counselor, I have one question for you, what is the status impact area agreement with the County? Counselor: I have had a discussion with Sherie Freeman about whether or not the County had sufficient Ordinances to back up what we have in our Cpmprehensive Plan, she had discussed it with their attorney and he and I have not connected. Mayor Kingsford: I wish you would move on that post haste. Mayor Kingsford: We need to have an indication of those of you who are going to the Legislative Reception, it is this week at Nampa. Bert Myers advised he would attend: Mayor Kingsford: I would remind the Council and anyone in the audience that the ribbon cutting for the Eagle Road Interchange is at 11:00 A.M. on August 30th. Norm Brown, 385 S. Locust Grove Road. I was wondering what was going on as far as that Department of Law Enforcement Facility. Mayor Kingsford: What has happened is that,that property is zoned properly for that particular endeavor, so there was not public hearings, it will be built over a three period, and administrative office, a driv- ing range and a firing range. What questions did you have? Brown: Why wasn't it put up for Public Hearing, all of us on Locust Grove Road and I am speaking for four neighbors, I am not for this. MERIDIAN CITY COUNCIL • • AUGUST 21, 1990 PAGE # 6 Outdoor firing range in our back yard. Mayor Kingsford: It is not outdoor, it is enclosed. Mayor Kingsford: Again the reason is just like there would not be a Public Hearing if it was something else that was allowed under the present zoning. Brown: It is not outdoors. Mayor Kingsford: That is a misconception, in fact I saw a range almost identical in Maryland, I had some concerns and happened to be back there and drove out and looked it over. You can barely hear it from outside. Brown: `If it is inside you won't. hear it. Myers: They ran some test on it being patterned after a Secret Service Range, they ran some decimal checks on it and when you are standing right beside it, I can not remember the number but it was less than the freeway would be. When they got a hundred yards away from it it was like normal conversation. Brown: How will they enter the property? Mayor Kingsford: Strafford Lane and through the Corporate Park. I visited with a lady from the State Public Works today and she was concerned about the comments and the editorial in the Statesman and will be writing a reply to that. ASSIGNED PERSONNEL. The City Leaders Institute Inc. will perform the services as requested by Meridian and specifically assign Mr. Wayne S. Forrey, AICP, Executive Director as the primary consultant. The Institute can also provide two additional staff members; a technical analyst and a word processing secretary, to assist with specific project assignments. 2. CONSULTATION SERVICES. In consideration of the promises and covenants set forth in this Agreement, Meridian hereby retains Consultant to perform and Consultant agrees to perform the services set forth in schedule "A" which is attached hereto and by reference incorporated herein, and or special services requested by Meridian. Meridian is under no obligation to the Consultant until Meridian requests the consultant verbally or in writing to perform specified services. Meridian and Consultant must mutually agree on the requested scope and estimated hours of Consultant time to complete requested services. Consultant will only commence work when authorized to do so by the city of Meridian. 3. TERM OF AGREEMENT. The term of this Agreement will begin upon execution by both parties of this Agreement and will end when Consultant has completed the services as requested by Meridian. Consultant will make reasonable efforts to complete such services in an expeditious manner. Either party may cancel, this Agreement on twelve (12) days' notice to the other party in writing, by certified mail or personal delivery. 4. PAYMENT OF CONSULTANT`S FEE. Consultant`s fee for the services to be provided under this Agreement shall be on an hourly basis of $70.00 per hour for direct project work by Mr. Forrey or as specified in a solicited proposal or scope of work/cost estimate. If technical word processing is required beyond routine office secretarial work, the fee for word processing services shall be on an hourly basis of $24.00 per hour for direct project work. If support technical analyst work is required to complete an assignment for the City of Meridian, the fee for technical analyst work shall be on an hourly basis of $47.00 per hour for direct project work. Upon receipt of a statement, Meridian shall pay Consultant's fee in accordance with the payment procedures of the City of Meridian or 30 days of the statement date, whichever occurs first. COSTS AND EXPENSES. All material costs incurred by Consultant in fulfilling its obligations under this Agreement shall be paid by Meridian, and shall not be considered a part of the hourly consulting fee set forth in Section 4. Such costs and expenses shall include by way of example, but are not limited to: travel, lodging, and meals. Meridian must provide consultant with a list of approved expense items and cost allowances. 6. PERCENTAGE OF FEE DUE IN EVENT OF EARLY TERMINATION. Meridian understands and acknowledges that in entering into this Agreement, Consultant has scheduled time to complete the work required and will find it necessary to decline other consulting opportunities in order to give adequate time and attention to its obligations under this Agreement. Accordingly, in the event Meridian terminates this Agreement early, it is agreed that Meridian shall pay Consultant based upon a reasonable estimate as mutually agreed upon between the two parties as to the percentage of work completed. 7. INTEREST ON DELINQUENT PAYMENTS. Payments which are past due under this Agreement shall accrue interest at the rate of one and one-half (1 1/20) percent per month on the unpaid balance from the date said balance is due. 8. CONFIDENTIAL INFORMATION. Consultant agrees that any information provided by Meridian, will be treated by Consultant in full confidence and will not be revealed to any other persons, firms or organizations. 9. INDEPENDENT CONTRACTOR. Both Meridian and Consultant agree that Consultant will act as an independent contractor in the performance of its duties under this Agreement. Meridian may request Consultant to act as agent or officially represent Meridian as desired. 10. TOTAL AGREEMENT/AMENDMENTS. This is the entire Agreement between the parties, and no representations of promises not set forth herein have been made by either party as an inducement for entering into this Agreement. Amendments to this Agreement must be in writing and signed by both parties. • • Consulting Services Agreement - Pg. 3 11. ADDITIONAL DOCUMENTS. The parties agree to cooperate fully and execute any and all supplementary documents and to take all additional actions which may be necessary or appropriate to give full force and effect to the basic terms and intent of this Agreement. 12. GOVERNING LAW. This Agreement shall be governed by and construed according to the laws of the State of Idaho. 13. DELEGATION OF DUTIES. Neither Meridian or Consultant may delegate, assign, sublet, or transfer his duties or interest in this Agreement without the written consent of the other party. 14. INSURANCE. The City of Meridian has in force and will continue to maintain in force during the term of this Agreement, a general liability insurance policy. Aside from the coverage which is afforded to Consultant under said insurance policy, Consultant shall have no liability to Meridian or its representatives, agents, employees, successors, assigns, or any other persons or entities acting for, by or through Meridian, for any errors, omissions, or other negligence (excluding gross negligence) of Consultant in carrying out its obligations under this Agreement. WHEREAS, the City is the owner of the land described in Exhibit "A", which by this reference is incorporated herein as if set forth in full, which has water rights in the Nampa and Meridian Irrigation District, which water right is known under the Assessment No. 1209A-; WHEREAS, Jensen is the owner or Lessee of the property AMBROSE, FITZGERALD BCROOKSTON Attorneys and Counselors P.O. Box 427 Merldlan, Idaho 83842 Telephone888-4481 described in Exhibit "B", which is attached hereto and by this reference incorporated herein as if set forth in full; WHEREAS, the City of Meridian does not use the water it receives from the Nampa & Meridian Irrigation District and whereas Jensen is desirous of purchasing the water supplied to and available to the land owned by the City; that for the right to the water to the land owned by the City, the City pays an assessment to the Nampa & Meridian Irrigation District; that the assessment for the water for 1990 was the sum of $1,216.84;. that the City also pays in addition to the water assessment, an assessment for operation and maintenance of the Nampa & Meridian Irrigation District, and other annual taxes and assessments to the Nampa & Meridian Irrigation District. NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES u HERETO AS FOLLOWS: 1. That for a term of the irrigation season of 1990, the City of Meridian hereby transfers and assigns to Jensen its right to receive the water which would be applicable to the land that it owns as described in Exhibit "A". 2. That Jensen shall pay to the City the sum of $644.92, AMBROSE, FITZGERALD 6CROOKSTON Attorneys end Counselors P.O. Box 427 Meridlen, Idaho 83842 Telephone 888-4481 which represents 53% of the total amount due for the water, which 53% is arrived at by determining the percentage of irrigation days left in this year, which irrigation days are agreed to be from April 15th through October 15th, which comprise 184 days and of which a 87 days have elapsed on July 11, 1990, which is agreed to be the effective date of this agreement. 3. That in addition to the above amounts paid to the City of Meridian for the use of the water Jensen shall also pay all operation and maintenance assessments and other taxes and assessments of the Nampa & Meridian Irrigation District that are due for the year 1990; that such sum shall be paid to the City of Meridian upon presentation to Jensen of billings for the amounts due. 4. That this Agreement shall be effective for the irrigation season of 1990, and shall terminate on November 1, 1990, if not sooner terminated by the turning off of the water by Nampa & Meridian Irrigation District. 5. That this Agreement is binding upon the heirs and executors, and the administrators of the parties hereto. 6.
