Regular Meeting of the Meridian City Council called to order by Mayor
Grant Kingsford at 7:30 p.m.:
Members Present: Ron Tolsma, Bert Myers, Bob Giesler, Max Yerrington:
Others Present: Nick Hallett, Wilma Blair, Don Hubble, Dennis Marshall,

The Motion was ~_ade by Tolsma and seconded by Giesler to approve the
Minutes of the previous Meeting held July 17, 1990 as written:

Item #1: Dr. Nick Hallett, Meridian School District:
Dr. Hallett: Mayor & Council, the reason I asked to be on the agenda for
tonite is to update the City on the upcoming bond proposal the School
District is asking for. Dr. Hallett gave a overview of what the funds
would be used for and the overcrowding in the District at this time.
He also explained the amount the Meridian School District spent per
student as compared to other Districts. We did a review on the Central
Office Expense compared to the other seven largest Districts and again
we are ranked last as far as this expense per student. Dr. Hallett
passed out a sheet showing the bond proposal: (On file with these
minutes):
Giesler: On the Middle School that burned, the cost that you are showing
have they included a auditorium?
Dr. Hallett: We have included the auditorium, it will be smaller than
we orginally planned, it will be cut back to 1200 seating capacity:
This is the only auditori:.lim of any size we will have in the District
and it will serve the whole District not just the Middle School:
Tolsma: Are these buildings engineered and designed by local people?
Are they engineered and designed so that all the materials for. the
buildings-can be purch~s~d~,n the local area?
Dr. Hallett: They are designed and engineered by ,local people and one
of our goals is to purchase materials locally: We cannot guarantee that
local contractors and supplier will get the bids but we are making the
specifications so this is possible.
Mayor Kingsford: You constantly hear.. the we are the highest bonded
indebted District in the State, I have a real question about that
do you have statistics that indicate~the per capita bonded indebtness
and that sort of thing, I know the. whole Districts assessed valuation
has gone up considerable.
Dr... Hallett: If, you look ,at the principal indebtness we would be the
highest in the State, we are not the highest if you look at it on a
per capita basis or on a percent of market value, we are doing some
work on that percent of market value, we are still high, there is no
denying that, when you 'grow as fast as we have you have a fairly high

level of bond indebtness. There are D~.~tricts if you look at from
percent of market value are higher than we are.
Dr. Hallett: We would appreciate the Council's support, again we need
it very much and we enjoy the good working relationship we have with the
City Council, I appreciate the chance to bring you up to date on what we
are doing.
Dennis Marshall: What type of program do you have to educate the voters?
Dr. Hallett: We have a pretty extensive campaign we are starting now,
Ralph Smith is our media person we have worked with the TV, the newspaper
and have had fairly good coverage so far, we have a large committee set
up to work with all the different groups, I think we have a good network
out there to get the word out.
Item #2: Public Hearing; Request for Annexation & Zoning of Limited Office,
w/Conditional Use Permits by New Concept Developers, Inc.:
Mayor Kingsford: I will now open the Public Hearing? Would a representative
of the Developer like to explain the request to the Council?
Gary Lee, JUB Engineers: Lee was sworn by the City Attorney:
Lee: Tonite I would like to give a short overview of the project, this
parcel is about 29 acres, the request is Annexation & Zoningbf LO,
with PUD General w/ Conditional Use Permit for Multi-family housing,
day care facility, nursing home retirement center & mini-storages,
the improvements for the project will include City water & Sewer,Streets
will be private.We are working with the Bureau of Reclamation. to attempt
to make Nine Mile Drain a greenway, park facility open space. We will
provide irrigation for the lots from Rutledge Lateral. There was some
discussion about access off of Linder at the Planning & Zoning Hearing,
I have checked with Nampa Meridian Irrigation and they do not like to
share uses on their easements.
Giesler: There was comment from the Police chief about the additonal
traffic on Pine Street, was this discussed at the P &Z Hearing at all?
Lee: It was discussed at the meeting and briefl I visited with ACRD
about the intersection of Linder & Pine and they have done traffic
counts on that and at this-time the traffic count is much less than
what the collector is designed to carry, those collector streets ..are
designed to carry 4000 vehicle trips per day and their traffic count
is less than 1000. This was done during school time.
There was discussion on the exiting to Linder.
Mayor Kingsford: Anyone else from the Public who wishes. to offer testimony
on this issue? There was no response, the Public Hearing was closed:
Council Members you have the Findings as prepared for the Planning &
Zoning Commission, what is your desire?
The Motion was made by Myers and seconded by Yerrington to approve. the
Findings of Fact & Conclusions of ,Law as prepared for the Planning &
Zoning Commission:

Attorney prepare an Ordinance for the Annexation & Zoning of the
property as requested in the application:

Item #3: Ordinance #541:Ordi~ance rezoning Misty Meadows Subdivision from
R-4 to R-8:
Mayor Kingsford:An O-zdinance amending and changing the zoning of certain
real property in the City of Meridian which is generally described as a
portion of the Northeast 2 of the Southwest i Section 1, Township 3 N.,
Range 1 West, Boise Meridian, Ada County, Idaho and providing an.
effective date, is there anyone in the audience who wishes Ordinance #541
read in its entirety, there was no response:
The Motion was made by Giesler and seconded by Tolsma that the rules and
provisions of 50-902 and all rules and provisions requiring that Ordinances
be read on three different days be dispensed with and that Ordinace #541
as read be passed and approved:

Item # 4: Preliminary Plat on Misty Meadow Subdivision:
Mayor Kingsford, this would be the area the Council would make stipulations
if they have any:
The Motion was made by Tolsma and seconded by Yerrington. to approve the
Preliminary Plat on Misty Meadows Subdivision with the stipulation that
the lots on the South Boundry of the subdivision be a minimum of 7500
square feet and that a access be provided for a stub road to the Hatch
property:.

Item #5: Final Plat on Glenfield Manor #4:
Don Hubble, Hubble Engineering, this is basically the same format as the
Preliminary plat that was filed approximately ten years agdwe have

submitted what we believe. will be the revised layout to the City and as
this progresses on to future phases this is the layout we will hold to,
we hope the Council will be able to approve the phase.
Giesler: This will tie into Sunnybrook Farms, is that correct?
Hubble: Yes.
Giesler: This will make an access that they can come out onto Sandlewood?
Hubble: Yes:
Tolsma: Is there a Glenfield Manor #5 y~twould that be North?
Hubble: Not yet and that would be North:
Tolsma: That would take in the Chateau connection to Sunnybrook?
Hubble: Actually the plan for #5 has not been concieved as yet, so how
far that would go we can not say at this time: I don't think #5 will,
I believe it will take a sixth phase to complete that;

Item # 6: Covenants on Glenfield Manor #4:
Mayor Kingsford;: As I look though these they look substanially the same
as Glenfield #3:
City Attorney: I have not reviewed these:
City Engineer: We wanted to add one sentence to the yard light issue,
which is item C-20, it just has to do with that if some future time the
subdivision owners want street lights installed. that they be aware. that
the City would not absorb that cost. So a sentence needs to be added that
if at some future time the subdivision lot owners desire street lights be
installed the expense of the installation shall be borne by the owners:

Covenants of Glenfield Manor #4 conditioned upon the City Attorney
reviewing them and the requirement on lights being included:

Item.#7: Covenants on Cherry Lane Village #3:
City Attorney: I have reviewed those and everything we discussed has been
changed, I would recommend that. these be approved:

ITEM# 8: Covenants on Chateau Meadows #2:
Mayor Kingsford: Any discussion on these?
City Engineer: On Item #10, they state that fences cannot be built
up against the right-a-way with the exception of North Locust Grove
Road & Chateau Avenue, this phase does not abutt N. Locust Grove Road.
Item #13 A & B, applies to a sanitary sewer easement which was only
involved in Chateau Meadows #1: Item #15, they need to add the same
sentence to that yard light section, that we have requested to be
added to the previous subdivisions: Also they need to add that the lights
will be hooked directly to the power supply:
City Attorney: There is a statement in there about lot owners on several
lots have the duty to maintain and construct and repair a irrigation line
next to them and I think it needs to be added that they make sure they
have the duty to make sure they deliver water to the downstream users.

Covenants of Chateau Meadows#2 with the additions that the City Attorney
and City Engineer have brought up:

Item #9: Pre-Termination Hearing Water/Sewer/Trash Delinquencies:
Mayor Kingsford: You have been informed in writing,it you choose to, you
have the right to a pre-termination hearing before the Mayor & Council
to appear in person to be judged on facts and defend the claim made by
the City that your water/sewer and trash bill is delinquent. You may
retain Counsel: Is there anyone in the audience who wishes a pre-termin-
ation hearing?
Wilma Blair, 1230 W. 2nd. Account # 03584, I would like. to have until
the first of the month to catch this up:
Mayor Kingsford: I see no problem, we have worked with you before:
Is there anyone else from the public? There was no response: Due to
their failure to pay their water bill or to present any valid reason
why the bill has not been paid,. their water will be turned off on
August 15, 1990. In order to have their water turned back on there
will be an additional fee of $10.00: They are hereby informed that they
may appeal or have the decision of the City reviewed by the Fourth
Judicial District Court, pursuant to Idaho Code. Even. .though. they
appeal the water will be shut off: The amount of the delinquencies
this month is $6,803.20:

Item #11: Resolution #134: Tenative Budget for 1990-91 Fiscal Year:
Mayor. Kingsford: A resolution authorizing publication of an estimate of
d' the expenses for all purposes for the City of Meridian, .Ada Couh~y,Idaho
for the fiscal year beginning the 1st day of October, 1990 and ending
the 30th day of September.,1991, and giving notice of Public Hearing
prior to the passage of the annual appropriation bill: The total amount
of the tenative budget is $4,853,207.00, included in this amount as a
result of the meeting today with ACHD and The State of Idaho is the
amount for the downtown project of $830,000.00:

#134 pertaining to the tenative budget for the 1990-91 Fiscal Year:

Item #12: Request by Rod Trumbull for temporary sales office in
Glenfield Manor #3:
Mayor Kingsford: it has been a practice that we not approve these for
over a period of six months:
The Motion was made by Myers and seconded by Tolsma to approve the
request of Rod Trumbull for temporary sales office in Glenfield Manor
#3 for a period of six months:

Item #13: Department Reports:
City Engineer: We had a bid opening on the 20th of July for the Ten Mile
Sewer Project, Bitterroot Construction Company was .the low bidder at
$ 367,032.OO,I checked through the bid for correctness and everything
is alright, I believe I had $372,000 estimated, I would recommend that
City Council award this bid to Bitterroot Construction.
The Motion was made by Tolsma and seconded by Yerrington'to award the bid
on the Ten Mile Sewer Project to Bitterroot Construction in-the amount
of $367,032.00:

Mayor & City Clerk to sign the necessary papers involved with. the Bid:

City Engineer: The other item I have is the Functional Classification
Map for the City there have been some revisions over. the past months
and we have received an updated map from the State and it requires that
the Council passes a Resolution authorizing the Mayor to-sign for the
City of Meridian:Explained the changes.

Mayor to sign the new Functional Classification Map:

City Attorney: On August lst there was a hearing for oral arguement
in the Tamera Perkins case and we argued that matter before Judge
Bail. As far as the arguement was concerned, I think she was very well
apprised of the issues, she did indicate at the end that she was not
going to issue any preliminary orders, she indicated that there were
some complicated issues, that she had a lot of research left to do,
and took the matter under advisement, I expect it would be a month
to two months before we receive a decision.
Myers: Back in June there were a couple letters written, one to
Treasure Valley Towing and one to Maylon Hvezda concerning that they
were conducting businesses that were not zoned properly, has anything
happened on those?
City Clerk: Hvezda has moved his plumbing business from that location,
supposedly he is operating legal now but I am not sure.
Myers: Al he was supposed to be doing was towing in vehicles and storing
them he was not supposed to do any repairs or salvage, is that correct?
That was the orginal plan.
Myers: Is he still painting cars and repairing them?
Police Chief: As far as we can tell he still is doing this along with
salvage.
Myers: What is the next step then?
Mayor Kingsford: Have the City Attorney write him a letter and advise him
of the consequencies:
Myers: Lets do that, there is no s~~se of messing around with these
people.
The Motion was made by Myers and seconded by Tolsma to have the attorney
write a letter to Treasure Valley Towing:

Tolsma: How is the trailer house out in Crestwood Industrial Park?
City Clerk: Mike Preston called Monday and advised that it would be
moved this week as well as the weeds taken care of:
City Clerk: I have a couple of items: Mr. Ward ,Sewer Plant Superintendent
has sold the irrigation water the sewer plant property is entitled to
and the Council needs to authorize the Mayor & City Clerk to execute the
agreement for the sale of this irrigation water: I beleive we are getting
funds for ~ year this year:

Mayor & City Clerk to sign the agreement on the sale of the irrigation
water for the sewer plant:

City Clerk: We met with ACHD today, the mayor, City Engineer and myself,
and they gave us the go head to proceed on the downtown project,, JUB is
going to do the engineering on the project and the Council need to give
ther approval for the Mayor and City Clerk to sign the engineering
agreement, probably contingent upon the City Attorney reviewing the
agreement.
The Motion was made by Myers and seconded by Yerrington to authorize the
Mayor & City Clerk to sign the engineering agreement with JUB Engineers
for the downtown project contingent upon the City Attorney's review:

City Clerk: The other item, is on this dowtown project we talked about
hiring Wayne Forrey of City Leaders Institute to do some laison work
for the City during the project and they have a contract they would like
signed for this work:
Mayor Kingsford: This is the same thing that was basically approved when
we where looking at the grant:
Giesler: I think we ought to have him on board during this project and
I would certainly recommend that we do this:

Mayor & City Clerk to sign the contract with City Leader's Institute
for service during the downtown project:

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR
FISCAL YEAR BEGINNING OCTOBER 1, 1990, APPROPRIATING .THE SUM OF
$4,853,207.00 TO DEFRAY THE EXPENSE AND LIABILITIES OF THE CITY
OF MERIDIAN FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF A SUFFICIENT
TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES
FOR WHICH APPROPRIATION IS MADE:
BE IT ORDAINED by the Mayor and City Council of the City of

with this Ordinance are hereby repealed:
Section 5: This Ordinance shall take effect and be in full force
upon its passage, approval and publication in one issue of the Valley
News, a newspaper of general publication and circulation in the City
of Meridian, and the official newspaper of said City:

County, Idaho at a convened meeting of the City of Meridian City

AN ORDINANCE AMENDING AND CHANGING THE ZONING OF CERTAIN REAL
PROPERTY IN THE CITY OF MERIDIAN WHICH IS GENERALLY DESCRIBED AS
LOT 12 AND A PORTION OF LOT 11, BLOCK 1 OF CRESTWOOD ESTATES
SUBDIVISION N0. 1, MERIDIAN, ADA COUNTY, IDAHO; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City Counci 1 and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to amend and change the zoning from (R-4)
Residential to (R-8) Residential, for the following parcel
described in Exhibits "A" and "B" incorporated herein as if set
forth in full hereat.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City
Council of the City of Meridian, Ada County, Idaho:
Section 1. That the aforementioned real property which.,,
is described in Exhibits "A" and "B", incorporated herein as if
set forth in full hereat, be, and the same is rezoned from (R-4)
Residential to (R-8) Residential, and Section 11-2-425, Official
Zoning Maps are hereby amended to reflect the same.
Section 2. This Ordinance shall be in full force and
effect from and after its passage and approval as required by

FOR ALL PURPOSES FOR THE CITY OF MERIDIAN, ADA COUNTY, IDAHO FOR THE
FISCAL YEAR BEGINNING THE 1ST DAY OF OCTOBER, 1990 AND ENDING THE
30TH DAY OF SEPTEMBER, 1991, AND GIVING NOTICE OF PUBLIC HEARING
PRIOR TO THE PASSAGE OF THE ANNUAL APPROPRIATION BILL:
BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
