Thank you for your hard work and continued assistance.in preparing the staff report. We have read the
staff report and agree, with the exception of the Development Agreement provision requiring the
applicant to pay for half the cost of a bridge across the Eight Mile Creek and associated conditions.
Paying a road trust for'/z a bridge doesn't accomplish anything.
• ACHD has agreed not to eliminate Emergency access to this property.
• This small property is already burdened with dedicating and constructing Rackham Way roughly
236 feet east of its current location. The vacated Rackham road is not land this property
owner gains as buildable area due to the existing utilities, such as fiber optics that are too
costly to relocate, therefore, the existing Rackham Road area must remain as a drive isle and
not buildable area.
• This property owner does not own any portion of the Eight Mile Creek. It is cornpletely off of this
property.
• Due to the Floodway around the Eight Mile Creek that must not be encroached with a bridge
structure, it is our understanding that a bridge would have to span roughly 80 feet to cross the
Eight Mile. To put this in perspective that is roughly %z the size of a Boise River crossing. A
bridge in this area would be extremely costly.
• This property consists of 4.77 acres. The entice CG zoned property on this corner equals 80.8
acres. With the addition of this property the total is 85.6 acres. This property is 5.6% of the
total CG developable land on the northeast corner of Eagle and Oveeland. This small of a
property cannot bear the burden of paying %2 of a bridge.
• A potential overall concept plan of 85.6 acres would utilize the existing crossing of Rackham
Way across the confluence area of the Five and Eight Mile Creeks. The other property owners
we've talked to are concerned with getting to the traffic signal at Overland and Silverstone;
they already have access to Rackham. An Eight Mile Creek crossing is not necessary. See
Conceptual Master Plan.
