This leiter will serve to fulfill the Preliminary Plat Application Checklist requirement to
provide a narrative describing the proposed project.
As you are aware, Brighton Corporation, through its subsidiary, Paramount LLC, is the
owner and developer of Paramount, a master -planned community in North Meridian.
BRghtdh Corporation's vision for the overall Paramount development has been to create
a comrunity that includes a diversity of uses including public, residential, educational,
religious, retail, commercial and office. Through this diversity of uses, Paramount has
been successful in providing the immediate and surrounding communities with many of
their most essential services, all within walking distance.

To encourage the diversity of uses envisioned and as part of the Development
Agreement with the city of Meridian, the land on the NE corner of North Linder Rd. and
McMillan Road and the land on the NW corner of Meridian Rd. and McMillan Road was
set aside and zoned C -C to accommodate general commercial and retail services.
Brighton corporation would now like to proceed with the development of one of these
commercial corners by submitting this preliminary plat.
H rewith, Brighton Corporation is submitting a preliminary plat that will subdivide the
t%i o (2) existing parcels on the NE corner of North Linder Road and McMillan Road into
a total of eighteen (18) smaller commercial parcels. In this preliminary plat, Brighton
Corporation has sought to strike a balance between the need for the developer to retain
some flexibility to react to ever-changing market conditions and to provide the City of
Meridian with as much information about the commercial development as possible to
allow them to make a reasonable assessment of the application. Please rest assured
that Brighton Corporation has every intention, in good faith, to provide additional

information as it becomes available and to work together with the city to meet the
conditions of approval which your staff, the Commission or City Council prescribe.
Brighton Corporation desires to develop this commercial area in a manner consistent
with the quality of construction, landscaping and architectural vocabulary present in the
existing Paramount development, thus creating an environment that will be immediately
familiar to Paramount residents and recognizable to the surrounding communities as an
integral part of Paramount. Earth -tone colors, timber, cultured stone, and roof pitches
are examples of some of the architectural elements that will be used and which are
consistent with the existing Paramount buildings and facilities. VVlith this application we
have included several examples of architectural details and existing buildings in
Paramount that we may use in the commercial development. Strict architectural design
guidelines and CC&Rs will govern the development of each parcel to ensure
compatibility with the Paramount design theme.
Vehicular access to the site will be provided from North Linder Road and McMillan
Road, both roads are scheduled for wideningin Zoo? . Access will be provided at four

points two full access and two right-in/right-outs) along North Linder Road and at two
points(one full access and one right-in/right-out)aloe McMillan. While we are not able

to provide extensive details at this time regarding much of the interior layout of the
development, our vision for this area is consistent with the attention we will give to the
perimeter conditions. We have, however, provided a conceptual layout of potential
interior roadways and zones designated for retail, commercial, office and, possibly,
some higher -density residential uses. As part of the internal roadway system, we also
foresee the possibility of connecting to Paramount South 60 to the east and we may be
able to provide for a public roadway extending to North Linder Road and aligning with
either West Deer crest Street or West Apgar Street.
In addition to the design elements already described, the development will be entirely
surrounded by a 25 foot landscape buffer and will include significant berms and
plantings to shield much of the parking areas. This significant landscaping will extend
within the development along the interior roadways and in between the buildings. A
detached, meandering sidewalk will be provided along North Linder Road and McMillan
Road. The network of sidewalks to and within the development will encourage
pedestrian activity by immediate occupants, by residents of the surrounding
communities and by students from Rocky Mountain High School.

Dear Ms. Canning,
This letter will serve to fulfill the Development Agreement'Mbdifcation Checklist
requirement to provide a narrative describing the proposed modification.
As you are aware, Brighton Corporation, through its subsidiary, Paramount LLC, is the
owner and developer of Paramount, a master -planned community in North Meridian.
Brighton Corporation's vision for the overall Paramount development has been to create
a community that includes a diversity of uses including public, residential, educational,
religious, retail, commercial and office. To that end, Paramount LLC, and other Owners
signed a Development Agreement, dated July 15, 2003, which specified the findings of
fact and the conditions of approval for the annexation and rezoning of approximately
392 acres for the construction and development of the Paramount planned community.
A condition of the development agreement in Section 6.A.3 req u i red all future
commercial, townhouse, and multi -family uses to obtain conditional use permit approval
prior to development. At the time of execution, the requirement for a conditional use
permit, even for approved uses in appropriate zones, was seen as the best vehicle to
allow Planning and Zoning staff and the City council to review and evaluate the
proposed projects. Since that time the City of Meridian has adopted a Design Review
process that has allowed for more efficient review and evaluation of proposed projects.
With this application, Paramount LLC, requests that the existing Development
Agreement be modified to remove the Conditional Use Permit requirement for all
commercial development in the C -G zones at Paramount and replace it with a
requirement that all commercial development be subject to Design Review by Planning
and Zoning. The Design Review process will allow a more relevant and efficient
evaluation of each proposed commercial/retail/office building in the development.
Under the current requirement for a CUP, the Owner/Developer would be required to

either, 1) know all the potential users and designs of all buildings and layout in a
development before applying for a CUP (almost impossible in commercial development)
or 2) apply for a CUP for each and every building, one by one (very inefficient and
demanding of City staff and officials). By allowing for Design Review instead of the
CUP requirement the intended objective of both processes would be met but with
greater effectiveness and savings in time and resources for all parties involved.
Another option for the modification would be to allow for Design Review of proposed
buildings if they were smaller than 50,000 square feet and anything over that size would
require a Conditional Use Permit for site plan review only and not for permitted uses.
This exception was allowed in our Development Agreement between the City of
Meridian and Ustick Marketplace LLC for the development of our shopping center at the
NE corner of Ustick and Eagle.

RE: Final 2006 groundwater monitor report — Paramount 60 -acre Site
Groundwater measurements have been completed for the 2006 irrigation season on the 5 test
holes on the above referenced project location. Readings have been collected on a biweekly
y
basis since April 28 . All measurements are displayed in the attached table. I have also
included a map of the site showing the monitor site locations. Two test holes were installed
this spring while three holes are from 2005 and previous years.
Free water has been measured in monitor pipes 1-06, 2-04, 2-06 and 3-05. Levels have risen
since April and peak values are highlighted in red on the table. Peak readi:qg s occurred in
August which is normal for irrigated parcels. A high reading of 128 inches was recorded on
May 25th at 2-04, but the pipe was destroyed in July and no additional readings could be
gathered. I would estimate that a peak no higher than 110 inches below ground level would
have occurred in August. No groundwater was present to the bottom of the pipe in test hole
