Vacation of a portion of the public utility easements platted with Verona No. 2
and 3 Subdivisions, by Primeland Investrnent, LLC.
1. SUMMARY DESCRIPTION OF APPLICANT'S REQiJEST
The applicant, Primeland Investment, LLC requests the vacation of a portion of the public utility
easements platted with Verona Subdivisions No. 2 and No. 3. At this time, the applicant is proposing to
vacate the 10-foot P.U.D.I. easement along the west boundary of Lot 2, Block 12 and the 35-foot blanket
easement on Lot 36, Block 10 and Lot 1, Block 12 recorded with Verona Subdivision No.2. In addition,
the applicant is proposing to vacate all the P.U.D.I easements along the west, north and internal lot
boundaries of Lots 41-46, Block 3. Maps highlighting the aasements that are to be vacated as well as the
easements that are to remain are attached in Exhibit B of this staff report.
The reason for the vacation reqnest is the applicant is proceeding with developing the commercial sites
and has deterrnined some of the existing easements are not necessary and hinder development. The site
has been surveyed and the easements proposed for vacation do not contain any utility infrastructure. It is
the intent of the applicant/developer to market the project for comrnercial development but at this time
tenants are not known. As the property develops, the applicant will proceed with property boundary
adjustments, and if necessary additional easements, to accommodate businesses who desire to locate
within the Verona Development.
The Unified Development Code 11-SA-1, requires the City Council to be the decision making body on
vacations applied for in the City of Meridian. Idaho Code 50-1325 requires that all easements created
with subdivision plats "shall be vacated in the same manner as streets" and must be approved by the local
jurisdictions. State statute further requires an easement vacation be filed when a landscape or irrigation
easement is involved.
The Meridian Public Works Department has no opposition to tfie proposed vacation of the subject
easements. The Applicant has provided proof of relinquishment of the easements by Cable One, Qwest
Communications, Settlers' Irrigation District, Intermountain Gas Company, and Idaho Power Company.
On 1VIay 20, 2008, the City Council approved the final plat for Verona No. 4 which includes the rezoning
and re-platting of those lots associated with the Verona No. 2 vaeation. The proposed vacation is
consistent with the proposed plat layout for Verona No. 4.
The subject site is generally located at the northeast corner of W. McMillan Road and N. Ten Mile Road
in Section 26, Township 4 North, Range 1 West, B.M.
2. RECOMMENDATION
Staff recommends approval of VAC-08-004 to vacate a portion of the public utility easements
platted with Verona No. 2 and 3 Subdivisions, as shown in Exhibit B.

d. History of Previous Actions: In 2003, the City Council approved the final plat for Verona No. 2
(FP-03-O50). A portion of Verona No. 2 was re-platted from 3 office lots to six office lots with
the approval of the final plat (FP-OS-046) for Verona No. 3 in 2005. In 2007/2008, a portion of
Verona No.2 was re-platted and rezoned as part of Verona Commercial Subdivision.
