Dear Sir or Madam:
Our client, Moonlight Industries, is proposing to build a 2,520 S.F.
Office building which they will occupy, and intend to lease the other half.
Architecture Northwest, P.A. submitted a Certificate of Zoning Compliance
Application on behalf of Moonlight Industries. During the review process the
CofZ, it had been put on hold due to the site plan not having a 20 foot rear
setback. The building was designed to have two entrances, one on the west
and one on the south side of the building. According to the planners, we
could choose which side is our front, however we would then need to provide
the 20 foot rear setback on the opposite side of the building.
During the design phase of the site plan, our office received the civil
drawings from JUB Engineers which indicated the building pad set back lines,
which is what was used in designing the building. These building setback
lines did not indicate the 20 foot rear setback lines designated.
We spoke with the planner at the City of Meridian, Sonya, and trying
to work through the issue of the setback Sonya mentioned she would
research the earlier zoning approvals for the subdivision. After reviewing the
conditional use for the subdivision and the development agreement Sonya
did not see anywhere in the writing that would allow a deviation from the 20
foot rear setback.
Our client, Moonlight Industries, is a landscaping company that does
quite a bit of work in the subdivision where they want to build their new office
building. They brought to our attention that there has been past projects built
in the subdivision that do not have 20 foot setbacks on front and rear sides of
the buildings. Moonlight Industries brought in a set of City of NPeridian
approved plans to our office which did not have the 20 foot setback, but was
approved exactly as we propose to develop this lot.
I then spoke with Caleb Hood, and mentioned to him that there had
been past projects approved without the required 20 foot setbacks. Caleb
researched this subdivision further and found past projects that were
approved by both the planning department and the building department
without the 20 foot front and rear setback.
Caleb did mention that the planning department will be looking at the
current zoning codes and will be amending the codes to allow for reduction of
the 20 foot rear setback with interior lots in a subdivision of the same zone.
Caleb also mentioned that JUB Engineers are now applying for an
amendment to the current conditional use to allow for the reduction of the 20
foot rear setback.
With the City of Wridian looking at changing the zoning code and
JUB Engineers amending the conditional use, both would take quite a long
time for final approval, we would request the City Council to grant us a
variance to the current zoning code. The variance would allow us to reduce
the required 20 foot rear setback to a 10 foot minimum setback, in
consideration that we will be providing 20 foot setbacks on both the front and
side entrances to the building.
We feel that due to the narrow size of the lots, having the required 20
foot front and rear setbacks would make the lot non -usable due to the narrow
width of the building that would be allowed.

Stokesberry Place. The subject property 'is currently zoned L -O. Per the Unified
Development Codep Table 11-213-3, the building setbacks for the L -O zone are as
follows: Rear — 20 feet; Front 20 feet; and Side — 10 feet. The proposed rear
building setback of 10 feet shown on the site plan does not meet the requirement of
20 feet for structures in the L-0 zone. For this reason, Staff is denying your CZC
application as submitted.
At the ti-Tne the Stokesberry Nos. I and 2 applications were sub mcitted., reviewed,, and
approved by the City, a 20 -foot rear setback was the standard. To date, thi's standard
in the L-0tistrict has'hot changed. (See Attachment A)
Staff researched the previous approvals for this developn;ent, Stokesberry
Subdivisions Nos. 1 and 2, to see if a reduced setback had been previously requested
or approved. Staff did not find as such for the property in question, Lot 12, Block 1.
Stokesberry Subdivision No. 2.
Lots 6. 7, and 8 " Blocle, 1, of Stokesberry Subdivision No. I (the lots adjacent to the
school on the:Pest side of N. Stokesberry Place) were approved for a 10 -foot rear
setback through the planned development process I CLTP-00-020. (See Attachment B)
This modification to the standard rear setbaci does not apply to any of the lots 'in
Stokesberry No - 2. Exceptingrthe rear setback on Lots 6, 7, and 8, Block I, no other
dimensional standards were modified witk the approval of Stokesberry No. 1.
In 2003, a preliminary plat apAication was filed with the City to re -subdivide Lots 1
through 4, Block 1, of Stokesberry Subdsion No. 1. This application was
processed as Stokesberry Subdivision No. 2. No development applications were

At the ti-Tne the Stokesberry Nos. I and 2 applications were sub mcitted., reviewed,, and
approved by the City, a 20 -foot rear setback was the standard. To date, thi's standard
in the L-0tistrict has'hot changed. (See Attachment A)
Staff researched the previous approvals for this developn;ent, Stokesberry
Subdivisions Nos. 1 and 2, to see if a reduced setback had been previously requested
or approved. Staff did not find as such for the property in question, Lot 12, Block 1.
Stokesberry Subdivision No. 2.
Lots 6. 7, and 8 " Blocle, 1, of Stokesberry Subdivision No. I (the lots adjacent to the
school on the:Pest side of N. Stokesberry Place) were approved for a 10 -foot rear
setback through the planned development process I CLTP-00-020. (See Attachment B)
This modification to the standard rear setbaci does not apply to any of the lots 'in
Stokesberry No - 2. Exceptingrthe rear setback on Lots 6, 7, and 8, Block I, no other
dimensional standards were modified witk the approval of Stokesberry No. 1.
In 2003, a preliminary plat apAication was filed with the City to re -subdivide Lots 1
through 4, Block 1, of Stokesberry Subdsion No. 1. This application was
processed as Stokesberry Subdivision No. 2. No development applications were

Applicant's Representative, Daren Fluke 'I is quoted as say* "We meet all the

The final plat for Stokesberry No. 2 was recorded in November 2004 (Instrument
No. 104143338). Further, Note 1,.as it appears on the final plat for Stokesberry
