Re: The Regency at River Valley
Dear Mayor de Weerd:
This letter is a zespoxise to a recent letter to the City concezning oux application for
annexatio~ and a Conditional Use Permit for the Regency at River Va11ey Apartment
Cornmunity. The comments were made by David Kleiner on April 22, 2008.
In N1r. Kleiner's letter he has made the request (Request #1 } that Bach Homes pay for
50% of tb.e right of way costs at "fair rnarket va.lue". In our previous correspondence
with Mr. Kleiner and Centercal we offered to dedicate 50% of the right of way and
c~nstruction costs if fihe right of way had been on Bach Homes property. In oux
applica.tion process with ACHD and ITD it was determined that the alignment of East
River Va11ey Street was required to be south of our current property Iine. Therefore we
are unable to piovide 50% of the right o£way because of the required roadway alignment.
Please note that Bach Homes is providing 100% of the right of way and 100% of the
cox~struction costs to build Alley's Way through our parcel as required by ACHD. We
staiid by our initial offer to construct 50% of East River Valley Street even though it is
i~ot on our property. In the aimexation approval of the Kleiner property on January 8,
200$ the dedication of the right of way from 1VI~. Kleiner was required to be "immedia~e".
Therefore as soon as tlie City of Meridian grants approval to Bach Homes and ACHD
acquues the proper dedication, Bach Hames is willing to proceed with the construction
process.
We do not believe it is the responsibilitv of Bach Homes to purchase the ri~ht of ~vvav
for East River VaIIey Street from Mr. HIeiner. However we do recognize that if fhe
Kleiner property is not going to be developed iminediately we are willix~g to construct
100% of East River Valley Slreet from the intersection of Eagle Road to our east property
boundary. This offez in.cludes the original requirements of ACHD {curb and gutter and
IO foot xnulti-use path along our south property Iine as well as 35' of asphalt) and now
includes curb and gutter and asphalt along the future Kleiner Properly north boundary for
the entire length of East River Valley Street (approx. 1,2501inear feet).

We believe t.~.is to be a generous offer going above the m;nimwn requiremez~ts of ACHD.
The advazitage to the City of Meridia~l is having a cozaapleted roadway. When the Kleiner
property is eventually developed they will be able to "cut" in their access points through
the curb and gutter c~epeiiding on locations they agree to with ACHD and the City of
Meridian. They are not required to provi.de any funds for ~he consixuction of East River
Valley Sireet, however this offer is only valid if ~ey dedicate the necessary right of way
within the ne~t suc months. ~
In response to Mr. Kleiner's requests #2 and #3 we beiieve our accesses da not preclude
the development of ~their property. Our access locations have been appro~ed by ACHD
and meet ACHD standards. Ftuthermore t31e Kleiner property will have the opportw~ity
to access East River ValIey Stx eet in many locations along their 1,250 feet of fronta.ge.
Bach Homes has been waiting to develop our properiy f~r 2 years and we do not belisve
additional delay is necessaty or fair.
We hope you will considez our offer and our point of view when our application is before
you for review.
