Key Issues of Discussion by Commission:
• The necessity for Corporate Drive to be extended from the north to Waltman Lane for an
additional access point to/from the site;
• Transition in uses between the future comrnercial uses and the existing residences to the west and
north of the site;
• The relocation of Waltman Lane further to the south and addition of a buffer on the north side of
Waltman adjacent to existing residences;
• The threshold for how much development can occur on the site until Corporate Drive is extended
from the north (5`~ Street) to Waltman; and, ~
• For uses that are non-office on property that abuts residential uses, require conditional use perrnit
(CUP) approval; limit hours of operation; and/or prohibit certain uses
Key Commission Changes to Staff Recommendation:
• Add a Development Agreement (DA) provision requiring CUP approval for all restaurant and
retail uses proposed along the western and northern property boundaries adjacent to residential
uses. Further, drinking establishments and drive-thru uses shall be prohibited within that area;
• Add a DA provision restricting hours of operation for businesses along the western and northern
property boundaries adjacent to residential uses to not exceed 10 pm;
• Modify DA provision to allow up to 150,000 (instead of 75,000) square feet of gross building
area prior to the extension of Corporate Drive from Waltman Lane across the Ten Mile to the
north.

Written Testimony since Staff Report:
. Art Berry endorsed the project and noted that they own 2 adjacent lots.
• Dwayne Cope provided a letter today that opposes the project. Mr. Cope's property was
annexed w/a GG zone back in 1984 by a developer (High Country) who planned to buy
the residential properties on the south side of Waltman and develop them commercially.
Mr. Cope states that the residents agreed to the annexation with a sunset clause that if the
properties did not develop commercially that the land would remain rural residential. He
states further that the properties were never redeveloped and the City did not honor the
sunset clause. Staff has previously researched this matter and was unable to find any
documentation regarding the sunset clause.
• Shawn Nickel provided an update letter today requesting additional DA provisions.
Outstanding Issue(s) for City Council:
• The threshold for how much development can occur on the site before Corporate Drive is
extended from Waltman Lane north, across the Ten Mile Creek and how that restriction is applied
to the subj ect applicant.
• Appropriate transition in uses between the proposed commercial uses and the existing residential
uses to the west and north.
• The applicant has submitted a revised concept plan changing the connection into Landing
Subdivision from a public street to a commercial driveway. The applicant understands that this
will require continuing the item in order to obtain staff comments (if Council chooses to approve
the application), but would like to proceed with the hearing tonight to consider the larger
outstanding issues related to the extension of Corporate Drive. (Staff supports having Council
hear the item tonight.)
