Monroue drive complies with Meridian's public annexation and LO zoning raquiremcnt, At the Council's hearing oft Apti] l5, 2003, members of the Council expressed concerns about access and there was discussion in connection with the private agreements, that allow connection between Monh+ue Drive and St. Luke's Road (as shown on our clients' site plan). The matter was tabled to sllow the Council the opportunity to review the private agreements. That tabling has allowed the aeighbors to meet several times to continue their process of consolidating practical issues regarding the access thst will flow over and through our clients' property. As you know, many (perhaps most) of the neighbors would appreciate the access between Moatvue and S~. Luke's to be a public way. ACRD has said it will not allow the road to be public. Our client does not oppose the access being public, and will support the rest of the neighbors in any concerted effort they make with ACHD m change the status of the access mad. Of course, whether public or private, the. access road will function the same way - as access between Montvue and St. Luke's. Our client's neighbors have asked that we commit to developing the acecss to ACHD's collector road statuiards. This width can be extended another I I feet (to the western property boundary) at a tune when the neighbors collectively agree. ,The widening of the road would be accomplished by a future developer in s mazmer to meet all:then-existing government regulations. For the iirne being,' the neighbors have asked that the existing trees be left in that 11-foot area along the western boundary to ensure ~ buffer for the neighbors to the west (Thom and Trick Willis). Tn addition, the neighbors have asked that this buffer be mawtainod with trees or other natural vegetation, similaz W what is now in place. Again, as shown on the site plan, out client has committed to maintain the existing trees, and has recommitted to neighbors in meetings that the existing trees or other natural vegetation will be maintained until the Montvue neighbors decide otherwise. The neighbors raised a concern regarding parking on rite access road. As requested by the neighbors, our client has couanitted to provide "no parking" signs on the access road. Tn addition, the site is,desigaed to meet Meridian's pazking statuiards. Finally, the neighbors raised a concern about construction traffic. Our client and the owner of the property immediately east (Pouchmark) have been discussing the possibility that construction traffic, from the site would eater and leave the site from the Touchmark property. We will continue to wank with Touchmazk in this regard. We hope that the Council can clearly see that the neighbors (om client being one of those neighbors) have been actively working together, They have set aside an access mad and they have resolved, and will eontiaue to resolve, practical issues. We ask that the Council acknowledge the hard and diligent work of rite neighbors is their private efforts, sad we ask the Council to grant rho requested annexation and rezone application, which is in wmpliance with rho public's standards.
