The property is located at 230 W. Pine Ave., Meridian, Idaho. ~QQ~ 2. The owner(s) of record of the subject property are Merlyn & Brandon Schmeclcpeper, 157 E. Ada Street, Meridian, Idaho 83642. Applicant is same as owner. 4. The subject property is currently zoned R-4 (Low Density Residential). There is, however, an application for rezone to O-T (Old Town) before the City Council The zoning district of O-T is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. The proposed application requests a conditional use permit for a child care facility for approximately 30 children. The O-T zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. 8. The Planning and Zoning Commission recognized the concerns of neighboring property owners in a letter dated March 14, 2003. RECOMMENDATION TO CITY COUNCIL - 1 DENIAL OF CONDITIONAL USE PERMIT REQUEST FOR A CHILD CARE FACILITY BY MERLYN & BRANDON SCHMECHI'EPER -CUP-03-006 RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they deny the conditional use permit as requested by the applicant, finding that: The requested daycare use will adversely affect the surrounding residential uses, as indicated by public testimony offered at the public hearing and per the written objections received by the City concerning the proposed use.
