This is a statement to attest to the posting of two City of Meridian Public Hearing Notice
sigas by TouChmark of the Treasure Valley for the Development of Meadow Lake
Village on March 21, 2003. The City of Meridian Public Hearing is to be Apri13, 2003.
One sign is located at 3805 E. Franklin Road, Meridian, Idaho on the south side of
E. Franklin Road between Glovc'rdale Road and Eagle Road. The second sign is located
on north side of I-84 adjacent to the property and east of Eagle Road Exit.

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
1. One and two family dwellings will require afire-flow of 1,000 gallons per minute
available for duration of 2 hours to service the entire project. Fire hydrants shall be
placed an average of 400' apart. 1997 UFC Appendix III-A
2. Commercial, office and multi-family occupancies will require afire-flow consistent
with the Uniform Fire Code to service the proposed project. Fire hydrants shall be
placed an average of 400' apart. 1997 UFC Appendix III-A
3. The fire departmerrt requests that any future signalization installed as the resuh of
the development of this project be equipped with Opticom Sensors to ensure a safe
and efficiem response by fire and emergency medical service vehicles. This cost of
this installation is to be borne by the developer.
4. Acceptance of the water supply for fire protection will be by the Meridian
Water Departmern.
5. Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department thru the City Engineering Departmeirt.
6. All roads shall have a turning radius of 28' inside and 48' outside.
7. All access roads within the project shall have a clear driving surface with a minimum
width of 20' available at all times. Typical street width of 34' will be allowed to
have parking on both sides. The typical collector street with a width of 29' will be
required to have restricted parking to only one side. UFC 902.2.2.1
8. Operational fire hydrams and temporary or permanent street signs are requred before
wmbustible constriction begins. UFC 901.4.2 & 901.3

9. The phasing plan may require that any roadway greater than 150' in length that is
not provided with an outlet shall be required to have a turn around.
10. A minimum of two poirns of access will be required for any portion of the project,
which serves more than 50 homes. This may be a concern during the phasing of the
project. UFC 902.2.1
11. The proposed senior subdivision will be a heavy user of emergency medical
services with an estimated 2.9 residents per household. The office lots and
commercial lots will have an unknown transient population and will have an
unlmown impact on Meridian 1'Sre Department call volume.
12. The proposed project lies outside the five-minute response zone goal.
Achievement of this goal is subject to budgetary constraints and is intended to
enhance the probability of a favorable outcome on a request for Basic Life
Support. The budget constraints are typically defined as capital outlay for
facilities that are located within 1.5 miles from a given location and sufficient
operational funds to staff the facilities.

"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or

Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and. surface water degradation. Manuals that could
be used for guidance are:

Conditional Use Permit Approval for Revisions to a Previously Approved
Conceptual Planned Development (File No.CUP-99-039), Consisting of 318
Residential Units and Approximately 600,000 Square Feet of
CommerciaUOffice Buildings on 138 Acres of Land Located on the South
Side of Franklin, East of the St. Luke's Hospital Campus and North of I-84 in
an L-O Zone, by Hummel Architects, P.A. (Fide No. CUP-03-005).
We have reviewed the above referenced submittals and offer the following comments, as
conditions of approva4 These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicarn, Hummel Architects, has applied for a conditional use permit to revise the
approved conceptual planned development for the Touchmark of Treasure Valley project, now
known as Meadow Lake Village.
The two major revisions to the previously approved concept plan are a shift in the location of the
commerciaUoffice building pads from within the internal portion of the development to the south
adjacent to Franklin Road, (in order to take advantage of the arterial road's visibility), moving
some residential developmern and a request for setback reductions that had not been requested
under the original conceptual approval.
The shifting of the commerciaUoffice buildings to the south is not prohibited by the MCC or the
City's Comprehensive Plan, but the revisions will require the dedication of a new public street to
act as a "frontage" road parallel to Franklin Road. The original street layout was not
irnerconnected with the two Franklin Road accesses and was residential in nature. The new
roadway, proposed by the applicant, would connect both Franklin accesses and will provide
public access to the relocated commerciaUoffice buildings. The MCC requires that the dedication
of a new public roadway be handled through a subdivision application; therefore a new
subdivision may be required as a result of the revision requested by the applicant to the original
planned developmern

Through the planned development ordinance (MCC-12-6), the Commission and Council may
approve the applicants request to allow reduced backs as long as they do not border the periphery
of the project. The following is a comparison of the City's minimum requirements and the
reduced requirements that have been proposed by the applicant:

Because this project is being approved as a conceptual planned development only, additional
detailed conditional use permits shall be required in the future, prior to construction.
CURRENT OWNERS OF RECORD
Touchmark of the Treasure Valley are the current property owners and they have submitted an
affidavit of legal interest to allow the submittal for the planned development.
LOCATION
The property is located on the south side of Franklin Road, east of St. Luke's and north of I-84.
SURROUNDING PROPERTIES
North: Vacant commercial and industrial property, zoned C-G and I-L.
South: I-84, caned L-O.
East: Edgeview Estates Subdivision (single family residential), zoned R-1C (Boise).
West: St. Luke's Regional Medical Center, zoned L-O.

STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms of the following and may approve a conditional use permit if
they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accoromodate the proposed use and all yards, open
spaces, parking landscaping and other features as rosy be required by this
ordinance;
Staff finds that the subject property is large enough to accommodate the requested use
and all other required features as noted above. The submitted landscape plan does not
address the revised layout of the development. A new landscaping plan will be required
with a new preliminary plat or conditional use permit application in the future
B. That the proposed use and development plan will he harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The current Comprehensive Plan Land Use Map designates the property as "Mixed Use
Community". Staff finds that the proposed residential and commercial office uses and
submitted revisions aze harmonious with and in accordance with the Comprehensive
Plan.
The project is being proposed as a conditional use for a planned development in order to
allow reduced setbacks and multiple buildings on a single lot. If the project is approved
as a Planned Development, it will meet the minimum requirements of the MCC.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character
of the general vicinity and that such use will not adversely change the essential
character of the same area;
Staff finds that the proposed residernial subdivision use will be harmonious with the
intended (mixed use) and existing (mixed use) character of the area.
D. That the proposed use, if it coroplies with all conditions of the approval imposed,
will not adversely affect other property in the vicinity;
Staff does not anticipate that the revised project will have an adverse impact on other
properties within the vicinity; however, the Commission and Council should consider any
testimony (written and oral) presented at the public hearings before making this finding.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fu•e protection, drainage structures,
refuse disposal, water, sewer or that the person responsible for the establishroent of
proposed conditional use shall be able to provide adequately any such services;

Staff finds that the revised developmern plans will be adequately served by the essential
public facilities and services listed above. The shift of the commercial property towards
Franklin Road will necessitate the need for the road (parallel to Franklin Road to be
dedicated as apublicright-of--way). This will require a new preliminary and final plat
prior to dedication according to MCC 11-2-2 (subdivision definition).
F. That the proposed use will not create excessive additional requirements at public
cost for public facilities and services and will not be detrimental to the economic
welfare of the community;
Staff finds that the proposed use would not be detrimernal to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for
by the public that would be considered excessive.
G. That the proposed use will not involve activities or processes, materials, equipment,
and conditions of operation that will be detrimental to any persons, property, or
general welfare by reason of excessive production of traffic, noise, smoke, fumes,
glare or odors;
Staff finds that there will be an increase in traffic and noise in the general vicinity of the
revised project, but that approval of the revised project will not lead to a major increase
in smoke, fumes, glare, odors or other disturbances that will be considered detrimental to
the welfare of the City and the subdivision's neighbors.
H. That the proposed use will have vehicular approaches to the property which shall be
so designed as not to create an interference with traffic on surrounding public
streets;
Staff finds that the proposed use and vehiculaz approaches will not create significant
interference with any traffic on the surrounding public streets.
Please review the ACRD report for this project for additional information regazding this
finding.
I. That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff does not find that any natural or scenic feature will be lost, damaged or destroyed
by issuance of this conditional use. Existing trees greater than 4" caliper must be retained
or mitigated for, if removed.
CONDITIONS OF APPROVAL (Conceatual)
1. Applicant shall meet all of the requirements of the previously approved Development
Agreement, Preliminary Plat and Conditional Use Pernut, unless modified below, as a
condition of the revised conceptual approval for this Planned Development.

2. The minimum setbacks within the development shall be as follows:
Front: 20'to garage, 10' for living area
Rear: 20' building to building
Side: 10' 1 story to one story
15' 1 story to 2 story
20' 2 story to Z story
Street side: 10'
(There are no lot lines within the project so all measurements are based on
separation between buildings.)
All development shall comply with the Americans with Disabilities Act and the Fair
Housing Act.
4. The new roadway, paralleling Franklin Road, shall be dedicated as a public road through
the subdivision process. Prior to the issuance of building permits for buildings taking
access off of the proposed roadway, the final plat shall be recorded.
5. All signage within the development shall be subject to a planned sign program per MCC
11-14-9E.
6. This approval is only conceptual, pursuant to MCC12-6-7B, therefore, each future phase
of Meadow Lake Village, excepting exclusively residential phases, will require a detailed
Conditional Use Permit prior to construction.
The landscaping plan is not approved as submitted. A revised landscaping plan will be
required at the time of submittal for a preliminary plat or upon submittal of a detailed
conditional use permit for a fixture phase of the project.
8. The revised concept site development plan (printed in color), submitted with the
application, is approved as submitted.
RECOMMENDATION
Staff recommends approval of the revised conditional use permit with the aforementioned
findings and conditions.

Under the CONDITIONS OF APPROVAL (Conceptual) for Meadow Lake Village, the Owner
requests the following modifications to those conditions:
1. Under Items number 1, the Owner wishes to modify certain items in the original Development
agreement, designated for phase two construction. The items are identified in the Apri12001
Addendum to the Development Agreement with Touchmark of the Treasure Valley; L:L.C.
.(May 1, 2001). The Items in question are items number 1, 4, 5, 7 & 10 on page ttu~e of the
Addendum under PHASE TWO. It is requested that all reference to completion of Street `H',
Franklin Road Intersection at Street `H', signal and landscaping along Street `H' and Franklin
Road, and utilities along Street `H' and Franklin Road be deleted in this phase. The completion
of these items will be completed with the residential or commercial development adjacent that
roadway.

The following is an April 2001 Addendum to that certain Development Agreement by
and between the City of Meridian and Touchmark of the Treasure Valley, L.L.C., an
Oregon Limited Liability Company, which Development Agreement is dated the

the entering into of the origuzal Develop ent Agreement. This Apri12001 Addendum
specifically pertains to the Phasing Plans One through Five.

This is a summary of the phasing plan drawing for the Touchmark of the
Treasure Valley (TTY Project off Franklin Road east of Eagle Road in the City of
Meridian, Idaho. It is a supplement to the Development Agreement with the
City of Meridian to indicate the extent of the work in Phase One and to address
the pro able areas of impact in the subsequent phases. Mazkckt related forces will
dictate the actual phasing which will be addressed in subsequent CUP
processing for each phase of development. The illustrated first phasing is in
substantial agreement with the original plans in content, although some of the
improvements and houstng locations have been modified to address
construction and marketing issues.
In general the phasing plan presented below indicated the azea of work for each
phase along with those specific items addressed by the City of Meridian as
'requirements [R]' for development. Those items deemed requirements of the
City are designated to be, required to be bonded, prior to receipt of building
permits and completed prior to occupancy Certain items are identified as
'prerequisite items [Pl]' to be completed prior to receipt of building permits (for
life safety issues). Other items of non-priority may not require any special
ireatrnent [NP]. The following items are anticipated to be included in the each
designated phase of TTV.
Items that must be completed before issuance of Building Permits for cottages
and main building are in Red and Pink en the attached Drawing A.
Items that must be completed before issuance of a Certificate of Occupancy for
first cottage are in, Blue, Green, Brown and Orange, on the attached Drawing
B.

1. Construction Road from Franklin Road to the Phase One construction area. This
consists of a 20-foot wide, minimum, all weather oiled access road and turn -
.around-to the Phase One area.- [PI]
2. Domestic water main line installation from near well at St. Luker to Phase one.
This is a 12" water line from the St. Luke's connection point near the well at St.
Luke's over an easement dedicated by St. Luke's to the city of Meridian, entering
the Touchmark property at Street "C", in Street "C", through Roundabout 2
and Street "A" to the west end of "A" Loop, traveling south and east in "A" Loop

3. Domestic water main line installation from the current locations in Franklin Road

thereof, except that any sale or alienation shall be subject to the provisions hereof
and any successor owner or owners shall be both benefitted and bound by the
conditions and restrictions herein-expressed. "City" agrees upon written request of
"Owner", to execute appropriate and recordable evidence of termination of this
Addendum if "City", in its sole and reasonable discretion, had determined that
"Owner" has fully performed its obligations under this Addendum
5. If any provision of this Addendum is held not valid by a court of competent
jurisdiction, such provision shall be deemed to be excised from this Addendum and
the invalidity thereof shall not affect any of the other provisions contained herein.
6. This Addendum sets forth all promises, inducements, agreements, condition and
understandings between "Owner' and "City" relative tot he subject matter hereof,
and there are no promises, agreements, conditions or understanding, either oral or
written, express or implied, between "Owner" and "City", other than as are stated
herein. Except as herein otherwise provided, no subsequent alteration, amendment,
unless reduced to writing and signed by them or their successors'in interest or their
assigns, and pursuant, with respect to "City", to a duly adopted ordinance or
resolution of "City".
6.1 Except as herein provided, no condition governing the uses and/or
conditions governing development of the subject "Property" herein
provided for can be modified or amended without the approval of
the City Council aftez the "City" has conducted public hearing(s) in
accordance with the notice provisions provided for a zoning
designation and/ or amendment in force at the time of the proposed
amendment.
