RE: Durango Springs Subdivision
Dear Anna,
As required by the Annexation, Conditional Use and Preliminary Plat application I am required to submit
statements of conformance with City Ordinance and provide general statements concerning the
subdivision. Per City of Meridian Planning & Zoning request due to crossing a section line along W. Ustick
Rd. this project is being submitted as two separate Preliminary Plats, Durango Springs North and Durango
Springs South. We have listed the development features for each Preliminary Plat and for the entire
development on both Preliminary Plat drawings. Many of the submitted items are duplicated for both
submitted Preliminary Plats. The following are the statements required along with an explanation of how
we are developing the property and meeting the requirements of City Ordinance:
1. A statement of development features.
The applicant is proposing 597 -single-family dwellings and 64 -commercial lots with 40 -common
lots, located on W. Ustick Rd. between McDermott and Black Cat Road. The site is
approximately 142.19 -acres and will be providing a variety of lot sizes including alley -loaded
neighborhoods. This plan reflects the desire to adapt to the local evolving market creating a
New Urbanist style design scheme. The project allows for 14.22 Acres of Commercial lots to
establish small scale convenience business intended to meet the daily needs of the residents
and immediate neighborhoods as outlined for the proposed C -N zoning district. Durango Springs
Subdivision has landscape and open space amenities including two neighborhood park sites.
The two neighborhood parks and several open space lots will be landscaped to create a park
setting and will have pools with cabanas, totlots, basketball, and picnic amenities for use of
residents within the subdivision. The applicant is providing numerous pathways throughout the
subdivision to create a loop pathway system that will be utilized by residents of the subdivision.
All common areas will have extensive landscaping provided. There are approximately 17.47 -
acres of usable open space, combined with the pathway system; the subject development meets
the requirements of the PUD ordinance.
The streets within this subdivision will be constructed to ACHD standards. The applicant is
proposing a spine collector road with detached sidewalks on either side of the roadway. The
roadway sections within the collector will be 60 -feet back of curb to back of curb. Internal streets
will be constructed as a 36 -foot street section with attached and detached concrete sidewalks.
Interior alleyways will have a 24 -foot street section.
There are four existing single-family dwelling units within the project site. Three of which will be
removed. Removal will be phased with the project. The existing single-family dwelling that is
proposed to remain will hook into City services.

;a A statement describing the characteristics of subject property, which make the zoning amendment
desirable.
The requested R-8-PUD/C-N zoning is harmonious with the adjacent development surrounding
the project site. The applicant is requesting an R -8 -PUD zone and conditional use application
concurrently for reduced lot dimensions (34 -feet), lot size, house sizes. The corner lots have
less than the required 40 -feet of frontage and other lots have less than the required 65 -feet of
frontage required in the R-8 zone. The proposed house sizes range from 1,200 sq.ft. in the alley
loaded neighborhoods to 3,555 sq.ft. in adjacent neighborhoods creating a diverse and unique
community. Portions of the alley -loaded lots are serviced via off-street parking and alleys. This
allows for the creation of greenways with pathways in front. Lots will range from 2,821 -square
feet to 16,139 -square feet. The proposed C -N Neighborhood Business District zone will create
a community commercial area attracting businesses such as accountants, clinics, bakeries, and
convenience stores per City of Meridians permitted land use guidelines.
A statement regarding the pre -application meeting - dates of meeting, and staff present.
On June 1, 2005, Anna Canning, Josh Wilson, Mike C., Matt Schultz, Scott Wonders, and Doug
Brooks met to discuss the Preliminary Plat application.
A statement of traffic impact on existing adiacent roadways and intersections.
Stanley Consultants Inc. has prepared a traffic study for the site which will be available by the
end of August prior to any public hearings. We are anticipating the study to find that the existing
arterials and local streets within Durango Springs subdivision can accommodated the traffic
generated from this site and that the site will not significantly impact existing and proposed
roadway facilities. Meridian Planning & Zoning staff will be provided the report as soon as it is
available.
A statement as to whether or not a variance will be requested with respect to any provision of the
ordinance describing the particular provision, the variance requested, and the reason therefore.
A variance for has not been requested. The conditional use application process allows for
requested waivers of City Ordinance. The applicant is requesting reduced setbacks, reduced
lot frontages and reduced lot sizes in the R-8 zone.
A statement of how the proposed zoninq amendment relates to the City of Meridian
Comprehensive Plan (please cite policy numbers).
The proposed use and development plan is harmonious with the existing Meridian
Comprehensive Plan, which calls for medium density single family dwellings within this section of
Meridian (see section 6.1 through 6.10). The proposed development has a medium density of
4.67 dwellings per acre. Durango Springs subdivisions proposed commercial is placed within
the Comprehensive Plan's mixed use -community. (see section 7.2) The pathways within the
proposed development mirror the Comprehensive Plans placement of a multi -use pathway. (see
section 7.2)
t A statement outlining the necessity or desirability of development pertaining to the zoning
amendment and its harmony with adjacent development. Characteristics of property that make
conditional use desirable.
This site is called out for medium density in the current Meridian City Comprehensive Plan. City
services are being provided to this site for the density that is planned and proposed by this
developer. The developer has designed the subdivision in accordance with City Ordinance and
the current Comprehensive Plan. Extensive consideration has been given in regards to the
design of the roadways, park areas, opens space, street buffers, and pathway system. The
pathways and parkways were designed for use of ALL residents of the subdivision and located
in places that will=encourage their use.
The site will be served adequately by existing and future extensions of public facilities. With the
development of this project, the sewer system will be constructed to handle flows from this
project and future tributary projects within the McDermott Trunk service area. A regional lift
station will be constructed adjacent to the project and Ustick Road with a pressure main
extension to the treatment plant. A sewer study will be submitted in the near future
demonstrating the proposed service areas, pipe sizes and alignments. The site will be provided
potable water via extension of mainlines in Ustick Road. Pressure Irrigation will be provided
from a proposed pump station being designed in conjunction with this development request.
The system will be owned and operated by the Nampa Meridian Irrigation District.
The proposed use will not involve activities or processes that produce traffic, noise, smoke,
fumes, glare or odors that will be detrimental to any persons or property. There will only be the
addition of single-family homes and vehicles, and the subdivision was designed so as to not
adversely affect adjoining parcels.
The proposed uses will not result in the destruction of a natural scenic or historic feature
considered being of major importance.
8. A statement that the applicant or user of the property agrees to pay any additional sewer, water or
trash fees or charges, if any, associated with the use, whether that use be residential, commercial
or industrial.
The applicant agrees to pay any additional sewer, water or trash fees or charges, if any, associated
with the use. Development will connect to City services and comply with City Ordinances. The
Street names do not conflict with City grid system.
9. The property will be posted 10 days before the hearing. A signed affidavit stating that this will be
done is attached.
10. The applicant will deliver to the Zoning Administrator a notarized statement that the property was
posted.

This letter is in response to your staff review for completeness of our submittal for the above referenced project
per Kristy Vigil's August 1, 2005 E -Mail. We have addressed your comments as follows:
Preliminary Plat
Complete separate preliminary plat applications for parcels south of Ustick Road and north of Ustick Road are
attached. Please note per City of Meridian Planning & Zoning request due to crossing a section line along W.
Ustick Rd. this project is being submitted as two separate Preliminary Plats, Durango Springs North and
Durango Springs South. We have listed the development features for each Preliminary Plat and for the entire
development on both Preliminary Plat drawings. Many of the submitted items are duplicated for both submitted
Preliminary Plats.
Preliminary Plat requested revisions for plat south of Ustick Road:
• We are working with the Canal Co. to reduce the irrigation easement by piping the ditch. If we are
allowed to pipe the ditch the easement would no longer be within the lot boundaries along Skye Pilot
Drain.
• Public alleys have been resized to the requested 24 ft. minimum.
• Please review the landscape enlargement of the alley loaded blocks. The lot line is at 30 ft. However,
with the building setbacks we have between 56 ft. to 64 ft. We fill this complies with your open space
request.
• The function of the bulb -out on Lot 1, Block 9 is for a picnic shelter located within the open space.
• Lots 12-14, Block 14 has been reconfigured per your request.
Preliminary Plat requested revisions for plat north of Ustick Road:
• We are unable to relocate the commercial lots due to the existing home to remain on Lot 29, Block 1.
We fill our plan still meets the Comprehensive Plan. The bubbles on your Future Land Use Plan are
conceptual and need to allow for existing uses and residences. Flexibility needs to be incorporated
into the plan.
• We have met with ACHD and are complying with their requirements for the collector road. We are
unable to realign North Kennebec Avenue with Durango Way.
• North Rock Point Avenue's access to Ustick Road has been removed per your request.
• West Suttle Street has been stubbed to the east property boundary per meeting with ACHD.
