I have attached a mpy of the entire variance applimtion foryour inspection. I believe it is self-explanatory. This meeting will delay our application by about two weeks. Because only Fcve property owners are involved in this neighborhood meeting, and four haue already expressed their support for this variance, I would propose meeting with you before 2(15/2406 to answer any questions and to hear your comments, should you have any. If a personal meeting >s agreeable to you, or IF you simply do not Intend to attend the neighborhood meeting, I would appreciate your indicating that on the attached form letter and faxing it th me at the number below. This will allow me to file our application earlier and to an unneeded meeting (and avoid a eve hour trip to conduct a phantom meeting), Thank you for your consideration. The Landscaping Cade (12-13-E8-I: pU}tPOSE) "recognizes that the specilc requirements of this landscape ordinance cannot and doles} not anticipate nli possible landscape situations. !n addition, the city recognizes that there may be landscape proposals which conform to dre purpose, intent and objectives ofthe landscape regulations but were not anticipated in the specific regulations. Therefore the department of planning and zoning may allow for a method of alternative compliance in the event of these situations." The Landscaping Code (12-13-8-3: lltliIGATTON' WATEEt) requites use of nonpotable water for irrigation, when it is avai[ahle_ The Landscapiug Code (! 2-13-8-4: 5UBf3lVISION l I2121GATiON SYSTEMS) requires, in essence, that an irrigation pump station be an a common lot and maintained by an irrigation district or association. The Landscaping Cade (12-13-18-2: COI~IDlTIONS, Section F) recognizes that conditions ofather regulatory agencies that conflict with the code may he reason for alternative wmpliance (or a Variance SIC). NMID requires that the pump statien have convenient access to both the water source (the irrigation delivery pipe) AND a discharge path for excess water (a drain ditch ar drain pipe). Because this irrigation pump house is a required component of the landscaping plan (and therefore should reasonably be located within the landscaping area it services), and because the Nampa Meridian Irrigation District expressed to the system's designer that NMID desired the pump house be located at the conjunction of the delivery' box and the drain pipe, the pump house's "common lot" sues located directly astride the line that delineates the limit of the landscape setback Shortly after canstructian ofthe pump house was complete, the developers were informed that the slab and roofofthe pump house are both impervious surfaces, are not allowed within the setback, and that entire structure should be moved +/- 6 feet to the north. Moving the pump house will also require destroying. and rebuilding, the large undcrgraugd cistern on whielt the pump house sits (the cistern has the same area as the pump house, and extends about lS feet underground). Demolishing the existing system, and Ehcn rebuilding it 6 feet north, will create a significant hardship, and is a "waste" ofvaluable resources. This seems especially unproductive, considering the minimal visual improvement that would he achieved with the same structure a mere 6 Ceet fuNter north. Applicant proposes removing the existing 12-foot tall pump house and mplacing it with a short structure (approx. 48" high) concealed by sltrrtbbery. The slab and underground cistern would remain where they are. However, [leis will have six feet by ]2 feet of the cistern's concrete within the landscape setback. Applicant represents that allowing this lotiv profile structure, in the current cistern location, will be sigtriftcantly more attractive for the communiH~ than relocating the existing building 6 feernorih, and having the taller siructurejust beyond the setback line. Applicant believes that this is consistent with the "intent" ofthc landscaping code, whielt is to provide for the beauti&cation of the roadway corridors. Certain impervious surfaces (driveways, signs and walkways) are petxnittcd within the landscaping setback area (]2-13-10-1 l]). The only impervious surfaces expressly prohibited in this code section are vehicle sales pads and related impervious surfaces {apparently "related" to vehicle Sales pads). The code does not specifically address other impervious surfaces that are commonly allowed, like telephone vaults, power vaults or imgation delivery and distnlrution boxes, all located above grade. Granting this varianc¢ should not grant a special right or privilege that does not occur elsewhere in the district. Othor impervious surfaces, not specifically pcrtttittcd by the code, occur in the landscape setback This variance relieves an undue hardship that has been precipitated by applicarrts designer s welt-intemioned attempt to comply with conflicting; requirements ofmultiple jurisdictional entities. As identilxcd about:, granting of this variance should not be detrimental to the public health, welfare and safety ' The replacement structure is planned to be a maximum 4$" high. 1-Towever, the power rncter (which is already in place) will remain at its http://by 112fd.i~ay112.hatmail.msn.corn/cgi-bin/getmsg?msg=C052056A-0615-4656-B406... 2/8/2006 COMMITMENT OF PROPERTY POSTING Per Unified Development Code {UDC) 11-SA-5D, the applicant for all applications zequiring a public hearing (except fox a UDC text amendment, a Comprehensive Plan text amendment and/or vacations) shall past the subject property not less than ten (10) days prior to the hearing. The Landscaping Code (I2-13-$-3: IRRIGATION WATER) requires use of nonpotable water for irrigation, when it is available. The Landscaping Code (12-13-$-4: SUBDIVISION IRRIGATION SYSTEMS) requires, in essence, that an irrigation pump station be on a common lot and maintained by an irrigation district ar association. The Landscaping Code (12-13-1$-2: CONDITIONS, Section F) recognizes that conditions of other regulatory agencies that conflict with the code may be reason for alternative compliance (ar a Variance SIC). NMID requires that the pump station have convenient access to both the water source (the irrigation delivery pipe} AND a discharge path for excess water (a drain ditch ar drain pipe}. Shortly after construction of the pump house was complete, the developers were informed that the slab and roof of the pump house are both impervious surfaces, are not allowed within the setback, and that entire structure should be moved +I- 6 feet to the north. Moving the pump house will also require destroying, anal rebuilding, the large underground cistern on which the pump house sits (the cistern has the same area as the pump house, and extends about ] 5 feet underground). Demolishing the existing system, and then rebuilding it 6 feet north, will create a signif cant hardship, and is a "waste" of valuable resources. This seems especially unproductive, considering the minimal visual improvement that would be achieved with the same structure a mere 6 feet fixrther north. Applicant proposes removing the existing 12-foot tall pump house and replacing it with a short structure (approx. 48" high) concealed by shrubbery. The slab and underground cistern would remain where they are. However, this will leave six feet by 12 feet of the cistern's concrete within the landscape setback. Applicant represents that allowing this low prof le structure, in the current cistern location, will be significantly more attractive for the community than relocating the existing building 6 feet north, and having the taller structure just beyond the setback line. Applicant believes that this is consistent with the "intent" of the landscaping code, which is to provide for the beautification of the roadway corridors. Certain impervious surfaces (driveways, signs and walkways) are permitted within the landscaping setback area (12-13-10-10). Other impervious surfaces, not specifically permitted by the code, occur in the landscape setback. This variance relieves an undue hardship that has been precipitated by applicant's designer's well-intentioned attempt to comply with conflicting requirements of multiple jurisdictional entities. As identified above, granting of this variance should not be detrimental to the public health, welfare and safety. * The replacement structure is planned to be a maximum 48" high. However, the power meter (which is already in place) will remain at its current location, and will be of xed to anew support frame. The meter panel cannot be lowered, because electric code requires the centerline of the meter to be 60" above the ground. Applicant believes this small "bump" should be obscured by the shrubbery, and will be inconsequential when compared to the size of the existing relocated structure were it merely relocated.
