The applicant, Red Cliff Development, Inc., has requested approval of a time extension to obtain the City
Engineer's-'signature on the fmal plat for Bienville Square Subdivision. The subject final plat consists of 52
single-family residential building lots, lmulti-family lot, 6 commercial lots and 7 common lots on 27.36 acres
in R-8, R-15 and C-G zoning districts. The Applicant has been unable to meet the time requirements specified in
Unified Development Code (UDC) 11-6B-7 and 11-SB-6. According to the Applicant the delay resulted due to
off-site construction approval from Land Baron and the Alleman Water User's Association. The project is
currently under construction and co~letion date is set for July 1, 2008 (see Applicant's letter dated April 1,
2008). ..
The annexation (AZ-OS-057), rezone (RZ-OS-019), preliminary plat (PP-OS-059) and conditional use permit
(CUP-OS-052) for Bienville Square Subdivision were approved by the Meridian City Council on May 2, 2006.
The final plat for Bienville Square Subdivision (FP-07-012) was approved by City council on June 5, 2007. Per
the conditions of approval, Bienville Square Subdivision would otherwise expire on May 2, 2008."
The City of Meridian's Unified Development Code (LTDC 11-6B-7) allows the Director to authorize one
~E administrative time extension to record the final plat, not to exceed 18-months, when the applicant files a written
request for an extension prior to the expiration of the plat. The Applicant has met the necessary deadline by
filing a written request fora 6-month time extension before the final plat expired. Additional time extensions up „~
zo to 18-months may be granted if determined and approved by the City Council.

With all dktensions, the City may require compliance with the current provisions of the UDC as a condition for
granting a time extension (IJDC 11-6B-7C). Staff believes that there are additional conditions that should
be added to those approved by the City Council for this subdivision. Specifically, staff is recommending full
compliance with the landscape, lighting and pathway standards of the Eagle Road Corridor Study (See Site
Specific Conditions below). Staff recommends approval of Bienville Square Subdivision with the comments and
conditions stated in this report.

I know it is in the code that concurrent CUP and Plat applications expire within )•8 months. However,
neither the findings nor the staff report even mention to the applicant that this is the case. In fact, the
Windings that Joe G. did actually state that there is a 2 year time limit. Because Joe did not provide
accurate information (surprise, surprise), I think we go ahead and give them they TE for both the PP
and CUP. This was a BAD report and Findings that we put out. Hopefully, this is one of the last Joe G.
projects hanging out there.

I actually had a question on the Bienville TE. Their pp expires in May. However, they did have a CUP
and that would have expired a while ago. I read through all the communication that they received
from us and everything said they had two years from the approval of the prelimina~~y plat to get the
final plat signed. From what I can find we never mentioned the18 month expiration for the CUP. I
talked to the building department and they cannot find any record of them pulling a building permit
or starting any kind of construction.
I will look into the lighting and sidewalk issue but I need some guidance on what to do with the TE.

Unfortunately, the projects at Eagle and Ustick were approved prior to the City adopting~the lighting and pathway
standards that your development is being held to. Your~roject has some pretty specific requirements for lighting
and pathway standards. Your right, it is not very likely that we will have a consistent look along the entire length
of Eagle Road anytime soon (unless the state suddenly runs into a bunch of'money or we get a bunch of
redevelopment). However, we do want to start this look and your project will set that standard for what the City
will be requiring as we do see redevelopment along Eagle. Again, we have adopted these lighting and pathway
standards and any development we do see along Eagle will also be held to that standard. For example, the
Meridian Towry Center project at Eagle and Fairview has the same lighting and pathway requirement. With your
project and theirs, wi' can begin to establish this look. I am at a conference for the day, but I wig check my a-mail
regularly if you want to discuss more; I will be back in the ofFce on Monday.

Thanks for the email.
Here is the question. ESI is doing our project and the one on the SE corner of Ustick and Eagle. We
were ready to approve the order for our lighting - a big number at $179,000. They asked why we were
doing the decorative lights at such a premium. We told them it was part of the Eagle road
requirements. Their response, no one else is doing what you are, remember they are the contractor
down the~treet. WH Moore also has no such lighting across the street. Neither development has the 10
foot sidewalk which has been very costly and problematic.

Our understanding has always been that everyone doing new construction on Eagle road will be
required to meet the same Eagle Road corridor study requirements. If not, why are we~required to do

something that will never have a unified look and was the a}~parent reason for the requirement in the
first place. The cost difference is roughly $90,000 so this is not a small issue.
Anyway, if you could please clarify your requirements it would be greatly appreciated. As always we
appreciate working with you and understand that these issues get very complicated sometimes. We
want to do what is best for the City of Meridian, but we also need to be very~cost conscious especially
when the desired purpose for the increased cost may not be standard and required by everyone along
Eagle Road.
If other developments are not required to meet the same standard, we would like to submit for your
approval lighting that will meet the photometric requirements at a substantial savings.

We are requesting a Time Extension for recording of our Final Plat for Bienville Square Subdivision. After delays in ofF-
site construction approval from Land Baron (6 months) and the Alleman Water User's Association, the project is currently
under construction with an anticipated site completion date of July 1, 2008. The Preliminary Plat was approved by
Council on May 2, 2006 and is set to expire on May 2, 2008. As such, we are requesting an extension of 6 months for the
recording the Final Plat.
