I have reviewed the applicant's submittal and offer the following comments and
recommendations:
APPLICATION SUMMARY
The applicant, Doug Campbell, has submitted a request for a variance from the MCC,
(specifically section 12-3-8) to allow a time extension for the recording of the final plat for
Staten Pazk Subdivision.
MCC 12-3-8 states that "Final plat shall be filed with the County Recorder within one year after
written a pproval b y t he council;otherwise, s uch approval s hall b ecome null and v oid, unless
prior to said expiration date an extension of time is applied for by the applicant and granted by
the Council. The Council may authorize an extension of the final plat for a period not to exceed
one year from the end of the original one year period."
The City Council took action to approve the Final Plat for the 8.15 acre Staten Park Subdivision
on February 7, 2002. The owner of the property, Doug Campbell, has not recorded the final plat
or requested a one yeaz time extension within one year of the Council's approval of the Final Plat
as required by City Code.
The applicant is requesting the City Council to allow the Final Plat to remain valid and to allow a
one year time extension to allow the applicant to file and record the final plat. The applicant has
completed the roads, utilities, and landscaping for the Staten Park subdivision.
LOCATION
The property is located on the south side of Ustick Road, r/a mile east of Black Cat Road.
SURROUNDING PROPERTIES
North -Ustick Road and unincorporated agricultural land, zoned RUT.
South -Platted Lakes at Cherry Lane Subdivision, zoned R-4.
East -Platted Wilkins Ranch Subdivision, zoned R-4.
West -Rural Residential parcels, zoned RUT.

REQUIRED FINDINGS
According to Ordinance 12-11-2, Variances, the Council may authorize in specific cases a
variance from the terms of either the Zoning or Subdivision Ordinance. Specifically, the
Ordinance lists the following Findings, all of which must be determined before granting a
variance:
A. That there are such special circumstances or conditions affecting the
property that the strict application of the provisions of this Title would
clearly be impracticable or unreasonable. In such cases, the subdivider shall
first state his reasons in writing as to the specific provision or requirement
involved;
Applicant states that they have not submitted a Time Extension for the Staten
Park Final Plat due to confusion over the acceptance date of the application and
a change in ownership of the subject property during the preliminary and final
plat process.
Staff does not find that the applicant meets the criteria necessary to be granted a
variance. Council should rely on further explanation from the applicant to
determine is there are special circumstances that affect this property in a manner
that would make strict application of MCC 12-3-8 unreasonable.
B. That strict compliance with the requirements of this Title would result in
extraordinary hardship to the owner, subdivider or developer because of
unusual topography, the nature or condition of adjacent development, other
physical conditions or other conditions that make strict compliance with. this
Title unreasonable under the circumstances, or that the conditions and
requirements of this Title will result in inhibiting the achievements or the
objectives of this Title;
Staff Finds that strict compliance with the requirements of this Title would result
in extraordinary hardship for the applicant due to the investment that has been
made in the construction of the subdivision' s infrastructure. Council shall
determine if there are other conditions that make strict compliance with this
Title unreasonable, or that compliance with the Ordinance will inhibit the
achievements or objectives of this Title.
C. That the granting of the specified variance will not be detrimental to the
public's welfare or igjurious to other property in the area in which the
property is situated;

Staff finds that the requested variance will not necessarily be detrimental or
injurious to the public's welfare or to the other properties in the area as long as
current ordinances aze met at the time of issuance of building permits for all lots
within the subdivision.
The City Council should rely upon any public testimony offered concerning
whether or not the surrounding property owners feel that the requested variance
will affect their properties.
D. That such variance will not violate the provisions of the Idaho Code.
Staff is unaware of provisions of Idaho Code that would be violated by the
issuance of the requested vaziance.
E. That such variance will not have the effect of altering the interest and
purpose of this Title and the Meridian Comprehensive Plan.
Staff finds that the issuance of a variance for this project will violate the interest
and purpose of the Meridian City Subdivision Ordinance which is intended to
ensure orderly development occurs within the established timeframe.
STAFF RECOMMENDATION
Staff does not find that there has been any hardship or special circumstance that has prevented
the applicant from applying for a one yeaz time extension for Staten Park's Final Plat.
Therefore, staff recommends denial of this variance request to allow a one year time extension
for the Staten Park Subdivision.
Council needs to determine whether strict compliance with this Title and denial of the variance
would result in an extraordinary hardship for the applicant due to the investment the applicant
has made in the infrastructure of Staten Park subdivision.
Denial of this variance will cause the Staten Park Subdivision to remain null and void as
required by MCC 12-3-8. A new Preliminary Plat or other appropriate application will need to
be submitted to the city for approval prior to the development of this property in the future, if
a variance is not approved for this project.

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
1. That a fire•flow of 1,000 gallons per minute be available to service the entire project.
Fire hydrams shall be placed an average of 500' apart. 1997 UFC Appendix III-A
2. Operational fire hydrarrts and temporary or permanent street signs are required
before combustible construction begins. UFC 901.4.2 & 901.3
3. Acceptance of water supply for fire protection is contingent upon acceptance of the
wales system for water quality.
4. All irrternal roads and entrances shall have a turning radii of 28' inside and 48' outside..
5. Any dead-end exceeding 150' in length as the result of a phasing process will require
as approved tum-around.
6. All access roads within the project shall have a clear driving surface with a minimum
width of 20' available at all times. UFC 902.2.2.1

In response to your request for comment, the Ada County Highway District (ACRD) staff has reviewed the
submitted application and site plan for the item referenced above. It has been determined that the Rioht-of-
due to the
• Roadway improvements currently exist adjacent to the site
If the site plan or use should change in the future, ACRD will review the site plan and may require
improvements to the transportation system at that time.
Prior to the construction or installation of any roadway improvements (curb, gutter, sidewalk, pavement
widening, driveways, culverts, etc), a permit or license agreement must be obtained from ACRD. In addition to
any costs associated with a permit or license agreement, a roadway impact fee will be assessed by ACRD and
will be due prior to the issuance of a building permit.
In accordance with ACHD's standard requirements, the applicant shall:
• Meet District drainage requirements,
• Replace or repair any damaged curb, gutter and sidewalk (as determined by
Construction Services),
• Bear all costs for the relocation of utilities associated with improving street frontages,
• Contact the District's Utility Coordinator or Construction Services Department in
regard to all utility street cuts to determine 'rf the pavement is less than five years old.
These provisions are in accordance with the Ada County Highway District Policy Manual, ISPWC Standards,
Construction Services policies and procedures as well as all applicable ACRD Ordinances. If you should have

The Nampa & Meridian Irrigation District has no comment on the above-mentioned Time
Extension of the Final Plat for Staten Park Sub.
Nampa & Meridian does have an urban contract. However, no pressure test has been
completed on this project. Nor has any pump station update been discussed with Nampa
& Meridian.
The Nampa & Meridian Irrigation District has not accepted this project.
