RE: Time extension on final plat acceptance. Item O1: See attached application. Item 02: See attached warranty deed. Item 03: See attached notarized consent of titled property owner. Item 04: See legal description attached to warranty deed. Item O5: The developer is unable to obtain all of the signatures for the plat before the plat expired on February 5, 2003. Item 06: The primary reason for lack of compliance was due to confusion regarding the acceptance date. Staten Park Subdivision plat has had three different owners in the past couple of years through the preliminary and final acceptance and during the construction of the subdivision. Item 07: The minimum reduction of requirement would be an extension of the plat acceptance. The current acceptance expired on February 5, 2003. A one year extension would be requested. Item 08: Plat generation and review were being completed during construction of the subdivision. At the current time the subdivision has been entirely constructed. The roads, utilities, and landscaping have been constructed. If an extension for the plat cannot be obtained the improvements on this piece of property will be lost. Item 09: The greatest motivation for allowing this extension to be granted is that all of the construction within the subdivision has been completed. All items in the subdivision have been built or bonded for. Regulations and standards were followed during construction. Item 10: Not Applicable Item 11: Not Applicable Item 12: The applicant is representing the third party that has been involved in developing this property. Confusion pertaining to the expiration of the plat is the result of changing owners. Item 13: Due to construction times or funding concerns, other developers have been granted time extensions on their plats. This subdivision is constructed and fully funded. An extension is necessary simply to insure that the plat can be properly filed. Some of the agencies on the signature sheet of the plat have already granted acceptance for the plat. Similar subdivisions have been constructed in this area. This variance request is not for any advantage to the applicant other than more time to complete the plat filing process. Item 14: An extension will allow the applicant to file the plat. This subdivision was constructed according to the standazds required for all subdivisions. This extension will not grant the applicant special provision above other developers, financial or otherwise. The extension will simply facilitate completion of the filing process. Item 15: Meridian has already approved the subdivision construction, and granted acceptance for the final plat. This acceptance expired February 5, 2003.
