FP-00-020 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on October 17, 2000, and the Coundl finding that the Administrative Review is complete which has included certain comments and conditions from Shaft Stiles, Planning and Zoning Administrator, which are herein fotmd fair and reasonable, and that Shaft Stiles, Planning and Zoning Administrator, and Gary Smith, Public Works Director, commented at the heating, and David Tumbull testified on behalf of the Applicant, and the Council having considered the requirements of the preliminary plat the Council takes the following action: IT IS HEREBY ORDERED THAT: 1. (Staff comment nmnber 4.) 1.2 Meridian Fire Chief, Kenny Bowers, requires that the streets and street name signs shall be constructed and installed before building is started. 1.3 Police Chief, Bill Gordon, noted this project would add more traffic. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifying that the plat meets the City's requirements shall be signed only at such time as: a. The Plat dimensions are approved by the City Engineer; and b. The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued guaranteeing the completion of off-site and required on-site improvements. We have reviewed this submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: LOCATION & SURROUNDING USE~'~' The subject property is located w~ Bf Black Cat Road, approximately one-quarter mile north of Cherry Lane. The parcel is currently zoned R4. The Sa.fiord Lateral borders the property on the south. Golf View Estates is south of the Sa:fiord Lateral. Unplatted property zoned R-4 is east of this development, and City of Meridian property utilized for the Golf Course is north of this property. The property is located in an area desi~wnated as single-family residential in the Comprehensive Plan. APPLICATION SUMMARY The application is for 29 single-family building lots on 9.27 acres in an R-4 zone, at a gross density of 3.45 units per acre. The applicant applied for a variance from the requirement to tile the Safford and Eight Mile Laterals in 1995. The variance application was tabled indefinitely because staffwas in the process of rewriting the ordinance regarding piping of ditches to allow ditches to be left open if they were developed in a manner that would create an amenity. Also of concern, with respect to the Eight Mi/e Lateral, was how culverts, etc., would be dealt with in relation to the golf course. Although the ordinance changes were submitted to the planning and Zoning Comrnksion, the Commission never acted on the ordinance change, citing the need for "further study." A variance was granted to the developers of Goif View Subdivision for piping of the Sa.fiord Lateral. SITE SPECIFIC COMMENTS 1. Applicant is to meet all terms of the approved preliminary plat. The common areas within the development will he subject to City of Meridian water assessments for the domestic backup. Payment of water assessment fees is required prior to signature on the final plat map. Mayor and Council October 12, 2000 Page 2 Street signs are to be in place, water system shall be approved and activated, pressurized in'igafion system approved and activated, fencing installed, and road base approved by the Ada County Highway District prior to applying for building permits. Landscaping shall be installed prior to obtaining certificates of occupancy. A letter of credit or cash surety in the amount of 110% will be required for all fencing, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final plat. Applicant shall he responsible to construct permanent perimeter fencing, except where the City has expressly agreed, in writing, that such fencing is not necessary. A fence delineating the property boundary (post and rail, wrought iron, etc.) needs to be installed on the northerly boundary which complements the open space of the golf course. Fencing is to be in place prior to applying for building permits. 5. Revise and/or modify the following notes: 5) 7) 11) 12) ...have a ma-Cig) twelve (12) foot wide permanent public utilities, street light, drainage, sidewalk, and irrigation easement. ...and drainage easement, unless otherwise shown. Delete this note. The sidewalk, although separated, must be a public pedestrian walkway, not an exclusive walkway for homeowners within the subdivision. Add lot and block number for common lot created for Safford Lateral. ...above the highest '~ue:;v, established normal groundwater elevation. ... 1400 square feet of living space, exclusive of garages. This note indicates that the 20-foot-wide planting strip required adjacent to Black Cat Road is unencroachabte by trees. If these lots are utilized for storm sewer mains which prevent planting of trees, how will this area be used as a buffer for the lots along Black Cat Road? This location for the storm sewer is unacceptable if trees are not allowed within it. Applicant needs to relocate the piping and easement to interior lots, or provide additional buffer area along Black Cat Road. Detailed landscape plans, including profiles of any depressed areas, need to be submitted for review and approval prior to signature on the final plat. Provide a ten-foot-wide easement for public utilities, drainage, and irrigation along the southern boundary of all building lots south of W. Dawson Drive, north of the common lot to he created for the Safford Lateral. Detailed landscaping plana for all common areas, including species, size, quantifies, and locations must he submitted for approval to the Planning & Zoning Department prior to City Engineer signing Final Plat. Provide detailed fencing and landscaping plana for review and approval prior to sj~maature on the final plat. Perimeter fencing shall be installed prior to applying for building permits. Landscaping shall be complete prior to obta/ning certificates of occupuncy. 9. Sanitary sewer and water service to this site will be via extensions of the ex/sting mains installed in adjacent phases of this development. Applicant will be responsible to construct FP-O0-020 Mayor and Council October 12, 2000 Page 3 lateral sewer and water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. I0. Applicant's engineer will be required to submit a signed, stamped statement certif3~g that all street finish centerline elevations are set a minimum of three feet above the highest established normal groundwater elevation. This certification will be required prior to approval of the development plans. 11. Provide a copy of the executed encroachment agreemem (if any) with Nampa-Meridian Irrigation District, indicating how the land underlying the Safford Lateral easement may be used, prior to signature on the final plat. The non-eneroachable area of the Safford Lateral easement will need to be removed fi.om the building 10ts and contained within a common lot to be owned and maintained by the Asliford Greens Homeowners Association. The rear lot line may be set at the edge of the eneroachable area if an agreement has been executed. 12. Assuming the variance is granted for tiling, permanent fencing sh~ll be constructed on the northerly easement line of the Sa.fiord Lateral unless an encroachment agreement is entered hato with Nampa-Meridian Irrigation DisUSct. 13. Provide the dimension call that is missing fi.om the southern border of Lot 1, Block 29. 14. If granted, the variance for tiling should only be for the Sa:fiord Lateral at this time. The Eight Mile Lateral will need to be dealt with at a later time when development adjacent to the Eight Mile Lateral is proposed. Brighton Corporation does not have an interest in property adjacent to the Eight Mile Lateral at this t/me, as the option was picked up by Steiner Corporation. 15. Staff's failure to cite specific ordinance provisions or terms of the approved preliminary plat does not relieve Applicant of responsibility for compliance. GENERAL REQUIREMENTS All irrigation ditches, laterals or canal~, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/draln~ge district, or lateral users association, with written confarmation of said approval submitted to the Public Works Department. Any existing domestic wells and/or septic systems within this project will have to be removed fi.om their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. Two-hundred-ill'fy- and 100-wart, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be instal/ed at sulxlivider's expense. Typical locations are at street intersections and/or fire hydrants. Make any corrections necessary to conform. 5. Coordinate fire hydrant placement with the City of Meridiun's Water Works Superintendent. 6. : Provide five-foot-w/de sidewalks in accordance with City Ordinance Section 12-5-2.K.
