RE: ZOA-07-002, Temporary Use UDC Text Amendment
After further discussion with the City Council, Planning Staff is requesting that the
Council reconsider their March 18`h decision to approve ZOA-07-002. Please schedule
this reconsideration public hearing as soon as possible (hopefully for April 15`h meeting if
you can do back-to-back hearing notices and get the PSA done in time). With the
reconsideration, Staff will be requesting that the Council amend their previous action by
also including community events at education facilities as appropriate accessory uses not
requiring a temporary use permit. Planning Staff would like the Council to consider the
following text amendment (proposed changes from March 18th in bold and underline.
Revisions to the original memo dated March 27, 2008 are shown in bold and double
underline.
11-3E-2: APPLICABILITY: The regulations of this article shall apply to all temporary uses in all
districts with the exception that trailers and other construction related equipment associated with an
active construction site, community events occurring at public narks and at education
facilities, and temporary uses that are conducted as part of the curricular orextra-curricular
programming of an education facility shall be deemed accessory uses. Community events are
meant to include,. but are not limited to events organized by an association of persons for a
social, literary, political, educational or recreational purpose They are not intended for retail
or other services that are customarily carried on as a business See Title 13 for allowed
accessory uses and community events occurring in .public parks.
